HomeMy WebLinkAbout1975.12.10 PC Minutes MINUTES OF THE PROCEEDINGS OF THE HUGO PLANNING COMMISSION DECEMBER 10, 1975 The meeting was called to order by Chairman Spitzer at 8:04PM. Members present were : Spitzer, Ehret , Peloquin, Rosenquist and Pel- tier. Also attending were Irene Leroux of the City Council and Bill Schwab , Washington County Planner. Motion made by Ehret, deconded by Peloquin, that the minutes of the November 12th meeting be approved as sent out. Motion carried. Motion made by Ehret , seconded by Peltier, that the minutes of the Special Meeting of December 3rd be approved as sent out. Motion carried. Valley View Terrace Mr. Ken Tschida introduced his engineer, Mr. Wayne Tauer, of Suburban Engineering, who presented a proposed plat for Valley View Terrace , second addition. He explained that the present zoning is for single family estates or one acre lots, and they are appearing for plat approval and rezoning of the entire parcel. The adjoining prop- erty is zoned Single Family Estates on the North and South with Rural Residential on the East and West except for one small parcel that is agricultural. He also stated that the land is high along Egg Lake Road and that the land gradually drops away from the road. There is no vegetation to speak of whatsoever; it is basically open lend. Soil borings show fine sand toe depth of about fifteen feet. They propose two zonings ; one acre lots or larger and they would be 1601 lots, which could be subdivided into two 80 foot lots if ut- ilities are extended. There are 33.9 acres involved in the plat and it would contain 59 lots. Five of these lots are one acre parcels and the rest are 10,400 square feet or larger. Mr. Tauer further explained they are asking for variances from 801 frontage to 79.2 feet on a couple lots that front on 138th Street, and also to replat a few 124.4 lots instead of 1301 wide lots in order to reduce the amount of driveways fronting on Egg Lake Road. He stated that with the new layout , the number of driveways would be reduced from 16 to 10. It is the intention of Mr. Tschida to sell both homes and lots: in this project._ He plans on selling at least 1/3 of the lots and plans to build homes on the first ten lots. Mr. Tauer further explained that a fifteen inch sewer line would serve the development but noted that a portion of the development would be served by laterals . Water would have to be extended to the project. He further outlined their storm sewer plans and explained that they have furnished the Rice Creek watershed Board a diagram of their plans and essentially have their approval to begin the first phase of the project . Mr. Tauer said the water table at the present time is 8 to 91 deep and by installing storm sewers , they expect the water table to drop a maximum of another two feet. Bill Meyer, also of Suburban Engineering, stated that provided they get the necessary easements, the storm sewer project would begin at the culvert under Egg Lake Road and continue through the project. He fur- ther explained that their intention is to donate a 9.2 acre park to meet the city 's park requirements. The park would be north of the drain- age ditch. The minimum donation would be 2.7 acres and they hope to contribute the excess to future development. Tschida saidthey would -2- also furnish some playground equipment so as to relieve the city of this expense. Spitzer asked how that land would be disposed of if the city preferred to have a cash donation. Tschida stated that people, in gen- eral, are not accepting homeowner's associations; he would be open to suggestions from the Planning Commission for handling that land. In response to a question, Tschida stated that in '?7 they intended to develop the southerly portion of the plat . Spitzer asked if Foxhill and Geneva would be deadended rather than having a cul de sac or turnaround. Tauer said a temporary easement for a rough turnaround could be installed. Peloquin wanted to know who would be responsible to clean out the drainage ditch if the city doesn't accept the park. Tauer stated that it would be the responsibility of the city and Spitzer rejected that plan. Peloquin stated they could either form a home-owner's association ma k- ing everyone in the project responsible for the maintenance, which could be assessed by the city, or they could preferably forma storm sewer district , which would have normal taxing powers. It was pointed out by Spitzer and Schwab that the city's minimum corner lot requirement is 100' and that there are several 90' corner lots in the development. Mr. Tschida stated there had been a misunder- standing on his part ; it was his opinion that the minimum requirement was 90 ' and they would make the necessary changes. The engineer stPted that several of the lot sizes could be remedied simply by extending Jeffrey Court another 10 feet . It was further explained by Schwab t ha t the size of the lots are exclusive of the road right of way, and that the city eingineer might require additional road right of way along Egg L ke Road. Motion made by Ehret, seconded by Peltier, that the request for q rezoning be tabled until the January 14th meeting. Motion carried. pald Eagle Industrial park, Mr. Tauer presented a sketch plan of the Bald Eagle Industrial Park showing the drainage pattern, for the park, upon the request of the City Council for such a plan. Mr. Meyer explained street patterns and the drainage plan, pointing out that there were several ponds se rv- ing the area. Jerry, Moe. Mr. Moe presented a new plat for approval, showing eight lots varying in size from ten acres to 19.1. The plat shows an easement for a future road to the east of the property, and Spitzer and Schwab argued whether it would be better to simply give an easement or to ded- icate it and bring it up to grade. Peltier asked for the attorney to clarily the matter. Spitzer requested Moe to show on the new plat where the perc tests were taken and also where the soil borings were taken. Moe stated that the park consisting of four acres, more or less, would be attached to the individual land owners and is not intended to comprise a park dedication. Motion made by Rosenquist , seconded by Ehret , that the Planning Commission recommend to the City Council that the proposed plat of J & J Rolling acres as submitted, be approved with the following conditions : 1 ) The City Engineer's report, which is not available to the Plan- ning Commission at this time, shall be duly considered by the Council in it 's decision. 2) That the City Attorney clarify the matter of the road marked _3_ "dedicated future road" as to the desireability of dedication as opposed to an easement. 3) Monitary requirement of 3800 be assessed to the developer in lieu of park land dedication. 4) That the road development for the proposed Julie Road North be of sufficient capacity to meet the needs of the area as stipulated by the City Engineer. Members voting for: Spitzer, Ehret , Peloquin, Rosenquist and Peltier. Motion carried. Richard Schuh Richard Hinaker of White Bear Lake , represented Mr. Schuh in mak- ing application for a special use permit for excavation, processing and removal of aggregate for gravel base and bituminous mixture. Ownee - Lavina Duraine also applied for a mining permit. Motion made by Peloquin, seconded by Peltier, that a public hearing for the mining permit and special use permit for the Schuh and Duraine mining operation be scheduled for 7:30PM on January 14; 1976 at the Hugo City Hall. The City Engineer and the City Attorney will be not- ified to attend the hearing. Motion carried. Neil Peltier Mr. Peltier, who presently operates the Recreational Vehicles and Interiors and Supplies appeared for site plan approval for a new build- ing. He has a 2Lx80 building on a one acre parcel on 140th Street just west of the RR tracks and has a platform already in for an additional 24140 building which he wants to use for storage purposes. He wants site plan approval for that second building. Motion made by Rosenquist , seconded by Ehret , that the request be tabled until the next meeting and that the applicant be required to furnish information showing traffic flow, proposed structure with park- ing and description of the use of the building and that he make a formal request for site plan approval. Motion carried. Shepherd of the Fields Lutheran Church Lester Winter was the spokesman for the group, which included the pastor, who appeared for discussion of a six acre site , presently owned by Vern Peloquin, which they would like to build a church on. Meting Cancelled Motion made by Peltier, seconded by Rosenquist, that the regular meeting scheduled for December 24th be cancelled. Motion carried. Reatpoint ments Motion made by Peloquin, seconded b y Peltier, that the Planning Commission recommend to the City Council that Robert Rosenquist and Larry Ehret be reappointed to the PlAnning Commission for a second term. Motion made by Spitzer, seconded by Peltier, that the Planning Commission recommend to the 'City Council that Harley Johnson be re- moved as a member of the Planning Commission as he has not attended meetings and a more active member is needed. Motion carried. Motion made by Ehret, seconded by Rosenquist, that the Planning Commission recommends to the City Council that Dan Spitzer be re- appointed Chairman of the planning Commission.
