ADJOURNMENT BACKGROUND MEMO FOR THE CITY COUNCIL MEETING ON JUNE 20, 2016 D.1 June 6, 2016 City Council Meeting Staff recommends Council approve the above minutes as presented. F.1 Washington County Library Strategic Plan — Director Keith Ryskoski and Commissioner Fran Miron Washington County recently completed the library strategic planning process. This 20 -month process involved more than 800 people. Public participation in the form of surveys, questionnaires, forums, retreats, meetings and a public comment period resulted in a final strategic plan released in February 2016. Washington County Library Director Keith Ryskoski and Washington County Commissioner Fran Miron will be in attendance to present the plan and answer questions on it. G. 1 Approval of Claims Staff recommends Council approve the Claims Roster as presented. G.2 Approve Second Amendment to Lease for Bruce and Virginia Bernin at 6540 Greene Ave for an Extension Through June 1, 2022 In 2002, the City of Hugo approved a purchase agreement with Bruce and Virginia Bernin for their 23 acre parcel located at 6540 Greene Avenue North for use as a future City park. The acquisition of their property was partly offset by a $275,000 grant from the MN DNR. At that time, the Bernins entered into a lease agreement with the City to rent the property and remain living in the home and operating their tree farm for ten years. In 2009, the Council approved a five-year extension to the original ten-year lease, until the year 2017. As part of that extension, the lease was amended to remove the tree farm operation. The Bernins are requesting another five-year extension to June, 2022 to continue leasing the property for residential use. The lessee will continue to pay $8,950 annually for the next five-year term, payable in monthly installments. The Parks Commission considered the request at their June 8, 2016 meeting and recommend approval to the Council. Staff recommends Council approve the second amendment to the lease agreement for Bruce and Virginia Bernin for their home at 6450 Greene Avenue North through June 1, 2022. G.3 Approve Temporary On -sale Liquor License for North Star Gay Rodeo on July 30-31, 2016 at Dead Broke Arena The MN North Star Gay Rodeo Association has applied for a temporary on -sale liquor license to serve alcohol at their event on July 30 & 31, 2016 at the Dead Broke Arena. NSGR has secured two deputies for the event and will provide the City a copy of the liquor liability insurance naming the City as additionally insured. Staff recommend Council approve the temporary on - sale liquor license for the North Star Gay Rodeo. GA Approve Variance Request of April Barnhart for Side Yard Setback located at 5368 145th Street North April Barnhart is requesting a variance to allow a three foot side yard setback, where City ordinance requires a ten foot side yard setback, to expand a finished porch on her home. At its June 9, 2016 meeting, the Board of Zoning Appeals and Adjustment considered the request and held a public hearing. Staff provided background on the request and recommended approval. There was no one that spoke during the public hearing. The Board agreed that the request met the criteria necessary to approve the variance and recommends Council approve the resolution approving the variance request. G.5 Approve Final Pay Request to Pember Companies for 129th Street Bridge Project The City of Hugo has received the Final Pay Request No.5 from Pember Companies, Inc for the 129th Street Bridge Improvements. City Engineer Jay Kennedy and Senior Engineering Technician Steve Duff has reviewed the final pay request, and found it to be satisfactory for work completed on this project. Staff recommends Council approve the Final Pay Request No.. to Pember Companies, Inc in the amount of $49,829.34 for work completed to date on the 129th Street Bridge Improvements. G.6 Approve CUP Renewal for Thommes and Thomas Land Clearing Tom and Joanne Benick are requesting approval of a renewal of a conditional use permit (CUP) on property generally located south of 165th Street, west of Forest Boulevard. The CUP allows for the processing and storage of firewood, recycling of tree waste, and wood chipping and, the operation of a mobile air curtain furnace. The permit is to be renewed every two years. On June 15, 2016, staff inspected the property and found it to be in compliance with the approved CUP conditions. It's in staff's opinion that the applicant meets the conditions listed in the CUP. Staff recommends approval of the renewal of the CUP for Thommes and Thomas Land Clearing. K.1 Yellow Ribbon Network Update Council Member Chuck Haas and Phil Klein will report to Council on recent activities of the City of Hugo's Yellow Ribbon Network activities. L.1 CIP Workshop on Monday, June 27, 2016 A workshop has been scheduled for Monday, June 27, 2016 at 7 p.m. to discuss the CIP for City streets. The workshop will be held at Hugo City Hall. L.2 Forest Lake YMCA Ribbon Cutting Ceremony on Thursday, July 14, 2016 The Forest Lake YMCA will hold a Ribbon Cutting Ceremony on Thursday, July 14, 2016 a 9 a.m. 9:30 a.m. follow by tours from 9:30 — 11 a.m. The YMCA is located at 19845 Forest Road North in Forest Lake. L.3 Hugo Good Neighbor Food Shelf Charity Clay Shoot on August 20, 2016 The Hugo Good Neighbor Food Shelf is holding a charity clay shoot on Saturday, August 20, 2016 from 9 a.m. — 3 p.m. at Wild Wings of Oneka. LA Schedule Midyear Budget Review Staff recommends Council select a date at the end of August on which to hold the midyear budget review meeting. M. Approval of Minutes for the May 19, 2016 Micra Manufacturing Open House Petryk made motion, Miron seconded, to approve the minutes for the Micra Manufacturing Open House held on May 19, 2016 as presented. All Ayes. Motion carried. Approval of the Agenda Weidt made motion, Klein seconded, to approve the agenda as amended by adding the Forest Lake YMCA Open House and rescheduling of the Water Summit scheduled for June 23rd, 2016. Hugo City Council Meeting Minutes for June 6, 2016 Page 2 of 6 Lions Club Culpepper Merriweather Circus on July 23 and 24, 2016 at Lions Park -Lions Member Pete Pedersen The Hugo Lions Club will be joined by the Centerville Lions Club in sponsoring the Culpepper Merriweather Circus on Saturday, July 23rd and Sunday, July 24th. The City will be provided a copy of the Certificate of Insurance naming the City of Hugo as additionally insured. Lions Member Pete Pedersen was at this meeting to invite the community to the event and request the City waive the $75 Special Event Permit. Pedersen explained that the circus is based in Hugo, Oklahoma and the City of Hugo is fortunate to have them for two days. The circus has a telesales organization who calls on local business to sell tickets. Businesses are asked to return tickets not used, and the Lions give them to the Northeast Residence. Profits go to the Lion's scholarship fund. Tickets can be purchased at Sagers Liquor, Holiday Station, and at Wiseguys in Centerville. Advanced sales tickets cost $10 for adults, $7 for children. Weidt made motion, Klein seconded, to waive the $75 permit fee for the Culpepper Merriweather Circus on July 23 and 24, 2016. All Ayes. Motion carried. Hugo City Council Meeting Minutes for June 6, 2016 Page 3 of 6 Approve Annual Performance Review for Utility Billing Clerk Jodie Guareschi Since June 17, 2002, Jodie has worked as the City's Utility Billing Clerk in the Finance Department. Jodie also works as a member of the Hugo Fire Department as a firefighter/EMS responder. Adoption of the Consent Agenda approved the annual performance review for Utility Billing Clerk Jodie Guareschi. Approve Annual Performance Review for Public Works Worker Tom Smith Tom Smith was hired by the City of Hugo on June 26, 2000. Tom has worked the past 16 years on the Public Works Department team. Adoption of the Consent Agenda approved the annual performance review for Public Works Worker Tom Smith. Approve Application for Off -Site Gambling by Hugo American Legion for Good Neighbor Days Bingo The Hugo American Legion Post 620 had applied for a permit to conduct off-site gambling during the Hugo Good Neighbor Days event. The Lions will be conducting bingo in Lions Park on June 11 and 12. Adoption of the Consent Agenda approved the application for the Hugo American Legion to conduct off-site gambling during Good Neighbor Days. Approve Pyrotechnics Permit for Good Neighbor Days Firework Display on Saturday, June 11, 2016 Northern Lighter Pyrotechnics had applied for an outdoor public fireworks display permit to provide fireworks on Saturday, June 11, 2016 during the Good Neighbor Days festival in celebration of their 40' year. The Lions had an agreement with St. John's Church to use the cemetery property to discharge the fireworks. Adoption of the Consent Agenda approved the permit for Northern Lighter Pyrotechnics for an outdoor public fireworks display on June 11, 2016. Approve Special Event Permit for Tough Mudder Event on July 16-17, 2016 Tough Mudder had submitted an application for a Special Event Permit to hold a two day event at Wild Wings Game Farm on July 16th and 17th. Tough Mudder is a for profit company located in Brooklyn, New York, who holds approximately 50 events throughout the United States, Canada, United Kingdom, and Australia. This required a Special Event Permit approved by Council because there will be approximately 12,000 attendees over the weekend, impacts to public streets, use of an amplified sound system, and alcohol served. Adoption of the Consent Agenda approved the event subject to the conditions listed as part of the permit. Victor Garden North Village 711 Addition Final Plat. Kettler Construction, Inc. applied for approval of a final plat in order to plat 33 townhome lots on the 8.51 acre parcel located north of Rosemary Way and east of Elmcrest Avenue. The City Hugo City Council Meeting Minutes for June 6, 2016 Page 4 of 6 Council approved the PUD amendment and preliminary plat for Victor Gardens North Village 7th Addition at its May 16, 2016, meeting. The final plat will plat all 33 townhome lots from the Victor Gardens North Village 7th Addition preliminary plat. There were no changes to the lots from the preliminary plat. Adoption of the Consent Agenda approved RESOLUTION 2016-14 APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR VICTOR GARDENS NORTH VILLAGE 7TH ADDITION ON PROPERTY LOCATED NORTH OF ROSEMARY WAY AND EAST OF ELMCREST AVENUE NORTH, subject to the City Attorney's review and approval. Approve Separation of Employment for Zaheer Khan from the Hugo Fire Department Fire Chief Kevin Colvard had received an email from Zaheer Khan about his resignation from the Hugo Fire Department for personal reasons. Adoption of the Consent Agenda approved the separation of employment of Zaheer Khan from the Hugo Fire Department. Update on Six Cities Meeting on May 26, 2016 City Administrator Bryan Bear provided an update on the Six Cities meeting that was held on Thursday, May 26, 2016 at 7 p.m. at Lino Lakes City Hall. The purpose of the meeting was to discuss the Met Council's Joint Water Utility Feasibility Study that was completed in December, 2015. This study reviewed the potential to combine the municipal water systems of six cities: Centerville, Circle Pines, Columbus, Hugo, Lexington, and Lino Lakes. At the meeting, the Met Council presented information on the benefits that could be realized by combining the water systems of all six cities. There was discussion among attendees regarding cities not having control over their individual water systems, and there seemed to be little desire to move forward. The Council discussed the merits of the plan and agreed there was a disconnect of all cities. The study provided good information to be considered when the updating of the Comprehensive Plan and planning future development. It was also noted that saving surface water was not considered in the feasibility study, and things had changed since the ideas first came about. It was important to have the study done and unfortunate all cities could not work together. Bryan stated he would like to continue discussions with staff and the City of Lino Lakes, who have the opportunity to combine systems with Hugo through future development. No formal action was taken. Update on Beautification Subcommittee Community Development Assistant Rachel Leitz provided background information on the Beautification Subcommittee that was formed last year with a representative from each commission. The group had been working on a variety of projects with the goal to beautify the City. Projects included improvements to the monument sign in Victor Gardens and banners to replace the ones on CSAH 8, which include a modernized logo. Future discussions will include downtown gateway elements, entry monuments, beautification of the TH61 corridor, and landscape elements in the TH61/170th Street roundabout. Hugo City Council Meeting Minutes for June 6, 2016 Page 5 of 6 Council discussed the new banner design and agreed with Council Member Haas to include a banner showing Hugo as a Yellow Ribbon City. If the Council wanted to move forward on other ideas of the Beautification Subcommittee, it could be discussed at the midyear budget review. Klein made motion, Haas seconded, move forward in purchasing new banners as well as incorporating Yellow Ribbon Network banners into it. All Ayes. Motion carried Yellow Ribbon Network Update Council Member Chuck Haas and Phil Klein reported to council on recent activities of Hugo's Yellow Ribbon Network. District Four Judge Greg Galler, Attorney Pete Orput and others put on a mock veterans court, and Haas thanked Judge Galler for his volunteer time. WSB employees received the Patriot Award. This day was the 72nd anniversary of D -Day, and Haas thanked all veterans. Northland Fence is hosting a movie night fundraiser for YRN. The YRN supported a request from an army widow to help pay for homeowner's insurance. The Hugo Lions have chosen the YRN as beneficiary of their golf fundraiser on August 14th. Xcel Energy was sponsor of the last month's Hamburger Night, and Mark Schowpe, Keller Williams Realty, will be next month's sponsor. A certificate of appreciation was received from the 682 Engineer Battalion. Haas talked about his trip to Kuwait where 150 military members were served steak dinner. Council Photo and City Administrator Performance Review on Tuesday, June 13, 2016 City Administrator Bryan Bear reminded the Council that a meeting has been scheduled for Tuesday, June 13, 2016 at 6:30 p.m. for the Council photo shoot and the annual performance review of the City Administrator. Reschedule July 4, 2016 Meeting to July 5, 2016 Due to Independence Day Holiday City Administrator Bryan Bear recommended Council reschedule their first regular Council meeting in July to Tuesday, July 5, 2016 due to the Independence Day Holiday on Monday, July 4, 2016. Weidt made motion, Klein seconded, to reschedule the July 4 meeting to July 5, 2016. All Ayes. Motion carried. U.S. Bicycle Route 41 Open House on Thursday, June 9, 2016 City Administrator Bryan Bear informed Council that MnDOT is developing a new bicycle route, U.S. Bicycle Route 41, which will connect Hugo to St. Paul and Grand Portage State Park at the Canadian border. An open house will be held on Thursday, June 9 from 4-6 p.m. at the White Bear Lake Police and Fire Building, 4700 Miller Avenue, to learn more about the route and provide input. This was posted as a potential quorum of the Council in case Council wished to attend. Hugo City Council Meeting Minutes for June 6, 2016 Page 6 of 6 Good Neighbor Days June on 9-12, 2016 and Historical Commission Display on June 11-12, 2016 City Administrator Bryan Bear reminded the Council that the Hugo Lions Club will be holding their annual Good Neighbor Days Festival on June 9-12 at Lions Park. The Historical Commission had extended a special invitation to the Council to visit their display on Saturday, June 11 from 1-5 p.m. and Sunday from 9 a.m. — 5 p.m. in the Oneka Room at City Hall. Forest Lake YMCA Open House on Saturday, June 18, 2016 City Administrator Bryan Bear added this to the agenda to inform Council that the Forest Lake YMCA will be holding an open House on Saturday, June 18, 2016 from 4-7 p.m. Haas made motion, Miron seconded, to schedule a meeting to attend the Forest Lake YMCA Open House on Saturday, June 18, 2016. Reschedule the Northeast Metro Water Summit City Administrator Bryan Bear added this to the agenda to request Council reschedule the Northeast Metro Water Summit to be held on Thursday, June 23, 2016 due to conflicts in schedules. Amendment to Section XII — Remedies — No Early Termination Fee if Lessee Default. If an Event of Default occurs, Lessor may terminate this Lease and recover possession of the premises and Lessee shall not be entitled to any early termination fee(s). This remedy shall be Lessor's sole remedy in the event Lessee fails to perform Lessee's obligations under this Lease or fails to observe a restriction set forth in this Lease. i. Amendment to Section XVI — Lessor's Option to Rebuild if Destruction. In the case of the demised premises shall be destroyed, or be so injured by the elements of any cause, as to be untenable and unfit for occupancy and the Lessor, in its sole discretion, decides not to rebuild, then Lessee's right to the possession thereof, shall at once cease and the Lessor shall pay the early termination payment described in paragraph 4 and schedule A, as amended. j. The rent payable herein shall be paid to the Lessor at a place designated by Lessor. I IV. EARLY LEASE TERMINATION PAYMENT In the event the Lessee ceases to use the real property as their homestead or otherwise notifies the Lessor of their intent to terminate the Lease, the Lease will early terminate on the following June 30. In the event of early lease termination the Lessor shall pay to Lessee an early lease termination payment in accordance with the Schedule Exhibit A attached hereto. By way of example, if the Lessee ceases to use the property as their homestead during the twelve-month period from July 1, 2002 to June 30, 2003, the Lease would terminate on June 30, 2003 and Lessor shall pay to Lessee the early lease termination payment of $82,471.00 within ten (10) days of such termination. V. USE AND CARE OF THE PREMISES Lessee shall use the Premises as their homestead and for the operation of a tree farm and all lawful uses reasonably incidental to such use (referred to in this Lease as "Lessee's Intended Use"). VI. SPECIAL ASSESSMENTS So long as the Premises is used for Lessee's Intended Use and Lessee is not in default hereunder, during the term of this Lease, Lessee shall not be required to pay any installments of special assessments against the Real Property, which installments of special assessments shall be waived or paid by the Lessor for each year or part thereof when this Lease is in effect and Lessee is not in default hereunder. VII. SUBLETTING Lessee shall not sublet or assign this lease. VIII. SECURITY DEPOSIT No security deposit shall be required. IX. UTILITIES AND REAL ESTATE TAXES Lessee shall provide snowplowing and lawn maintenance during the term of this Lease. Lessee shall pay for all utilities furnished to the premises, including electricity, gas, refuse removal and telephone during the term of this lease. Lessor shall also pay all real estate taxes on the demised premises during the term of this Lease. X. LESSEE'S COVENANTS Lessee will keep and maintain the premises during the aforesaid term, and quit and deliver up the said premises to the said Lessor peaceably and quietly at the end of the aforesaid term or the earlier termination thereof as provided in Article IV. Lessee will put and keep said premises continually in a neat, clean and respectable condition. All debris, garbage and refuse of any kind shall be removed at said Lessee's expense. The said Lessee shall not use said premises nor any part thereof for any purpose called extra hazardous by insurance companies. Lessee shall carry contents insurance for all of Lessee's personal property located in the demised premises and hereby agrees to hold Lessor harmless for any damage or loss to said personal property from any cause whatsoever. XII. LESSEE DEFAULT AND LESSOR REMEDIES Events of Default. It shall be deemed an "Event of Default" under this Lease if: (a) Lessee fails to perform any obligation of Lessee under this Lease or to observe any other restrictions set forth in this Lease after Lessor gives Lessee written notice of Lessee's failure to perform Lessee's obligation or observe the restriction within ninety (90) days of Lessee's receipt of Lessor's notice; provided, however, that if Lessee cannot reasonably perform Lessee's obligation or observe the restriction within ninety (90) days, Lessee shall not be deemed to be in default under this Lease so long as Lessee commences the performance of Lessee's obligation or the observant of the restriction within ninety (90) days of Lessee's receipt of Lessor's notice, Lessee diligently pursues the performance of Lessee's obligation or observance of the restriction and Lessee completes the performance of Lessee's obligation or the observance of the restriction within a reasonable time period; or (b) Lessee files a petition in bankruptcy, is adjudicated bankrupt, files any petition or answer seeking any reorganization, liquidation, dissolution or similar relief for itself under any present or future federal, state or other statute, law or regulation or makes an assignment for the benefit of creditors; or (c) Any trustee, receiver or liquidator of Lessee or of all or any substantial part of its properties, or of the Premises shall be appointed in any action, suit proceeding by or against Lessee and such proceeding or action shall not have been dismissed within thirty (30) days after such appointment; (d) Subject to Paragraph XIV hereof, the leasehold estate hereby created is taken on execution or by other process of law; or (e) If, Lessee does not use the Premises or cause the Premises to be used for a use permitted in Section 9, Lessor gives Lessee written notice that Lessor considers Lessee's failure to properly use the Premises as an abandonment of the Premises and Lessee fails to use or cause the Premises to be used for a use permitted under Section 4 within thirty (90) days of the receipt of Lessor's notice. QUIET ENJOYMENT Lessor hereby warrants that if Lessee shall perform all the covenants and agreements herein stipulated to be performed on Lessee's part, Lessee shall at all times during the continuance hereof have the peaceable and quiet enjoyment and possession of 5 the Premises without any manner of hindrance from Lessor or any person or persons lawfully claiming the Premises. Lessor represents that it has the right to enter into this Lease. XVI. DESTRUCTION OF DEMISED PREMISES That in case the home on said demised premises shall be destroyed, or be so injured by the elements of any cause, as to be untenantable and unfit for occupancy and the Lessee, in its sole discretion, decides not to rebuild, provided; however, that if the house on the demised premises is destroyed in an amount greater than fifty (500) percent of its value, it is agreed that the house will not be rebuilt, then, the liability of said Lessee for the rent of said premises thereafter, and all of Lessee's right to the possession thereof, shall at once cease and the Lessor shall pay the Early Termination Payment described in paragraph 4 and Schedule A. If the Lessee decides to have the home rebuilt, the Lessor agrees to do the reconstruction or cause the reconstruction to be done in a timely manner and to provide temporary housing to the Lessee while the reconstruction is being done. XVII. BINDING EFFECT IT IS MUTUALLY AGREED, that this Lease and all the covenants, provisions and conditions herein contained shall inure to the benefit of and be binding upon the heirs, personal representatives, successors and assigns, respectively, of the parties hereto, provided, however, that no assignment by, from, through or under Lessee in violation of the provisions hereof shall vest in the assigns any right, title or interest whatever. XVIII. NO PARTNERSHIP/JOINT VENTURE Lessor does not, in any way or for any purpose, become a partner of Lessee in the conduct of its business, or otherwise, or joint venture or a member of a joint enterprise with Lessee. SEVERABILTIY 3 If any provisions of this Lease, or the application thereof to any person or circumstance shall, to any extent, be invalid or unenforceable, the remainder of this Lease, or the application of such provision or provisions to persons or circumstances other than those as to whom or which it is held invalid or unenforceable, shall not be affected thereby and every provision of this lease shall be valid and enforceable to the fullest extent permitted by law. BOARD OF ZONING UPDATE: At its June 9, 2016 meeting the Board considered the request and held a public hearing. Staff provided background on the request and recommended approval. There was no one that spoke during the public hearing. The Board agreed that the request met the criteria necessary to approve the variance and recommended approval of the resolution for the variance request to the City Council. 2. DESCRIPTION OF REQUEST: April Barnhart is requesting a variance to allow a three foot side yard setback, where City ordinance requires a ten foot side yard setback, to expand a finished porch on her home. The existing size of the porch is 64 sq. ft. and the proposed size of the porch is 180 sq. ft. Ms. Barnhart also has a garage that doesn't meet current ordinance standards. She has stated that this garage will be removed and construction of a new one will occur to meet ordinance standards, therefore the Board is only considering one variance request. 3. LEVEL OF CITY DISCRETION IN DECISION-MAKING: The City's discretion in approving or denying a variance is limited to whether or not the proposed project meets the standards in the Zoning Ordinance for a variance. The City has a higher level of discretion with a variance because the burden of proof is on the applicant to show that they meet the standards in the ordinance. Barnhart Variance Page 2 4. ANALYSIS: A. Surrounding Land Use and Zoning The surrounding properties are zoned Future Central Business (FCB) and classified as Mixed Use (MIX) in the Land Use Plan. The properties are occupied by single family homes on narrow lots. B. Setback Variance The City Code requires a ten foot side yard setback. The applicant is proposing a side yard setback of three feet. 5. VARIANCE STANDARDS: The Board must review the requested variances with the standards outlined in Section 90-38 of the land use regulations. Staff used these standards to review the variance request and finds the following: (1) Law The variance as requested is permissible by law. The proposed variance is permissible by law. (2) Practical Difficulties. The applicantfor a variance shall establish that there are practical difficulties in complying with the provisions of the zoning regulations. The term "Practical Difficulties" as used in the granting of a variance means: a. Reasonable Use. The property owner proposes to use the property in a reasonable manner not permitted by the zoning ordinance and, The applicant is requesting to construct a 180 square foot addition to the northwest corner of the existing house. The applicant is requesting to use the property in a reasonable manner. b. Unique Circumstances. The plight of property owner is due to circumstances unique to the property not created by the landowner and, The setbacks for zoning districts are set for required minimum lot widths. The minimum lot width in this zoning district is 80 feet. The property is unique in that it is a narrow lot (50 feet wide) with an existing home that has been constructed three feet from the west side property line. The home currently has a porch that is connected to the home and is located approximately nine feet from the property line. The applicant is requesting to expand the finished porch and match the home's side yard setback at three feet. c. Character of Neighborhood. The variance, if granted, will not alter the essential character of the neighborhood 2 Barnhart Variance Page 3 Many of the homes located in area do not meet the building setback requirements within the City ordinance. In addition, the applicant's existing home is already located three feet from the west side property line. The variance, if granted, would not alter the character of the area. It is in staff's opinion that there are practical difficulties in complying with the ordinance. (3) Spirit and Intent. The granting of the variance would be in keeping with the spirit and intent of this chapter and with the policies of the City's Comprehensive Plan. The requested variance is keeping with the spirit and intent of the ordinance. The intent of the ordinance is to allow green space between homes. The applicant's home has been located three feet from the west side property line since construction. The neighbor, to the west, has constructed their home very close to their west side property line. This means that there is approximately 80 feet between homes, which meets the intent of the ordinance. It is the staff's opinion that the proposed side yard setback would be keeping with the spirit and intent of the ordinance. (4) Prohibited Use. The variance, if granted, shall not have the effect of allowing any use prohibited in the district. Construction of an addition is permitted within the City. (5) Hazard Consideration. The variance, ifgranted, shall notpermit a lower degree of flood protection than required by this chapter. The variance shall be determined the minimum necessary, considering the flood hazard, to afford relief, and the variance shall not be issued within any designated regulatory floodway if any increase in flood levels during the base flood discharge would result. The property is not located within a floodplain. (6) Septic and Well Compliance. The sewage treatment system and water system of the subject property is in compliance with city and state codes. The property is served by municipal sewer and water. 6. CONCLUSION: It's in staff's opinion that the applicant meets all the criteria necessary to approve the variance request. 7. DESCRPTION OF REQUEST: The applicant is requesting approval of a renewal of a conditional use permit (CUP). 2. BACKGROUND: In 1993, the City Council approved a CUP for the applicant to allow for the processing and storage of firewood, recycling of tree waste, and wood chipping. The permit was issued for a two-year period. In 1996, the City Council approved a renewal of the CUP. The permit was issued for a two-year period. In 1999, the City Council approved a renewal of the CUP and an amendment to allow the operation of a mobile air curtain furnace. The permit was issued for a two-year period. In 2001, the City Council approved a renewal of the CUP with the same general conditions. However, there was a condition revised to delete the termination date for the permit and revise it to be renewed every two years. At that time the City Attorney opined that the City cannot set time limits on conditional use permits and that MN State Statute states that " A conditional use permit shall remain in effect as long as the conditions agreed upon are observed..." In addition, staff noted that the conditional use permit runs with the property, not a particular owner or operator. Page 2 3. ANALISIS OF REVIEW: Although, formal approval of renewal of the CUP has not been completed since 2001, the applicant has been conducting the same operation on the property. The intensity of the use over the last several years has declined. On June 15, 2016, staff inspected the property and found it to be in compliance with the approved CUP conditions. 4. CONCLUSION/RECOMMENDATION: It's in staff's opinion that the applicant meets the conditions listed in the CUP. Staff recommends approval of the renewal of the CUP for Thommes and Thomas Land Clearing. All burning activities, unless specifically permitted by the City Fire Marshall, shall be conducted within a Mobile Air Curtain Burner approved for such use by the Minnesota Department of Natural Resources and the Minnesota Pollution Control Agency. The burner shall be operated in accordance with the manufacturers standards and recommendations, as well as the rules and regulations of the Minnesota Pollution Control Agency. 4. No open burning is pennitted on the site unless specifically permitted by the City Fire Marshall, the Minnesota Department of Natural Resources, and the Minnesota Pollution Control Agency. 5. Hours of operation for the site shall be from 7:00 a.m. to 7:00 p.m., Monday through Friday, except legal holidays. Hours of operation on Saturday shall be from 7:00 f1m. to 6:00 p.m., except legal holidays. The Mobile Air Curtain Bumer shall be allowed to operate 24 hours per day Monday through Saturday, except legal holidays. 6. No machinery, equipment, or vehicles shall be stored on the site, except processing equipment necessary for the conduct of permitted activities. 7. The permitee shall maintain access for fire fighting equipment to all storage areas and processing facilities at all times, as determined adequate by the City Fire Marshall. Resolution 2001- 75 Page 2 8. Access to the site shall be controlled by a gate, which shall be closed and locked at all times an employee of the permitee is not on the site. "No Trespassing" signs shall be posted at the entrance gate. 9. Exterior storage of tree waste on bare ground, and in accordance with the approved site plan, is recognized as a lawful non -conforming use of the property. Pavement of the tree waste storage areas is not required. 10. The permitee shall maintain the vegetative screening along the south property line to screen on-site activities from view from adjacent properties and public road right-of- way. 11. The permitee shall reimburse the City for any and all costs the City incurs in responding to fires that occur, on or off the site, due to the pennitee's activities on this site. 12. The permitee shall hold the City of Hugo, its employees and agents harmless for all activities undertaken by the permitee under the terms of this pennit. The permitee shall maintain liability insurance, naming the City of Hugo as an additional insured, in an amount not less than $1,000,000 for operations undertaken on this site during the duration of this permit. 13. No advertising signs are permitted on the site. 14. Vehicle weight restrictions on public roads shall be observed at all times. 15. All brush, wood, refuse, and other materials brought on to the site shall be removed from the site prior to expiration of this permit. 16.
