Set date for 2011 Sledding Party Next Meeting - January 12, 2011 Background Memo Approve Minutes From November 10, 2010 Meeting Staff recommends approval of the minutes from the November 10, 2010 Parks Commission meeting. II. Update on Recommendations to the City Council At the meeting of November 15, 2010, the City Council discussed three items recommended by the Parks Commission. Public Conduct in Parks Ordinance The recommended ordinance revisions were adopted as recommended in a unanimous vote. Three rules are now enforceable with violation result in a petty misdemeanor: motorized vehicle use on active parks, reservation of picnic shelters and fires. Tobacco Use/ Smoking Policy The policy to be effective in all parks was recommended and direction was asked for on whether to have a smoking or tobacco use policy. The Council discussed the policy and asked whether it needed to be addressed at this time and whether government needed to be regulating life style choices. Also discussed was allowing tobacco at events that require a Special Event Permit such as the Hugo Lions Good Neighbor Days. A motion was made and seconded to support the policy prohibiting tobacco use, but the discussion was tabled to allow additional consideration by the Parks Commission. This item will be on the agenda of the January 12, 2011 meeting. Park Dedication Policy Recommendations from the Parks Commission, Planning Commission and EDA were discussed by the Council. Chair Jim Taylor and EDA Commissioner Tom Denaway spoke at the meeting. The Council discussed the line item in the City's tax levy for parks and that businesses are paying a larger portion of the levy than residential property. The Council also expressed that they did not want the lack of commercial/industrial park dedication revenue to hinder the development of parks. The Park Dedication ordinance was adopted as recommended by the EDA with one nay vote. The Council also required review of the ordinance in four years. -2- Parks Commission December 15, 2010 Update on the Health Sub -Committee Commissioner Noel Schmidt will provide an update on the Health Sub -Committee that applied for SHIP funding and is working on a family bike ride. IV. 2011 Goal Setting and Capitol Improvement Planning- The lanningThe Parks Commission sets a budget annually, which is recommended to the City Council. Parks Planner Shayla Syverson will recap the accomplishments of the Parks Commission in 2010. In addition to establishing the CIP/ Parks budget, staff is recommending a discussion on goals which may include items such as marketing, recreation programs, facility operation and park and trail development. The Parks Commission used a Capital Improvement Plan (CIP) in making budget decisions for the years 2005-2009. Staff is recommending that after the Parks Commission establishes goals for 2011, a plan is made for 2010-2015 capital improvements. A CIP worksheet was prepared which includes the Parks Commission's goal of saving money for future development of the Park on Irish Avenue. VI. Set date for 2011 Sledding Party A calendar of upcoming events is attached. Staff is recommending that the Parks Commission set the date of the 3`d annual Sledding Party to be held on February 26, 2010. -3- Parks Commission December 15, 2010 Minutes Parks Commission, City of Hugo November 10, 2010 7:00 P.M. Approval of Minutes of October 13, 2010 Strub made a motion, Birch seconded to approve the minutes of the October 13, 2010 Parks Commission meeting. All Aye. Motion Carried. II. Update on Park Dedication Policy Taylor updated the commission on the October 28, 2010 Public hearing meeting that was held with the Planning Commission. The dedication policy is being placed on the next City Council meeting for final decision. Taylor volunteered to address the commission on this policy. Ill. Update on Public Conduct in Parks Ordinance and SmokinglTobacco Use Policy Taylor informed that the City Council tabled the recommendation for changes on the Public Conduct in Parks ordinance and request for direction with the smoking/tobacco use policy to November 15, 2010 City Council Meeting. -1— Parks Commission November 10, 2010 IV. Discussion on Athletic field Fees Shayla Syverson, Parks Planner presented on the option of adjusting the current rental fees at the Hanifl Fields Athletic Park and as well as implementing permits with a minimal charge for tracking baseball field use. Proposed: Hanifl Fields Athletic Park: City of Hugo - no Fee School Districts - no fee Athletic Organizations affiliated with the School Districts and City -Based non-profit organizations of Hugo for youth - $3,250 per full-sized field $2,750 per U11/U12 field Adult and other- $75 per hour per field Baseball Fields: City of Hugo - no fee School Districts - no fee Athletic Organizations affiliated with the School Districts and City -Based non-profit organizations of Hugo for youth - $10 per day Other - $30 per day Taylor made a motion, Larsen second to approve Hanifl Fields fee schedule with an amendment on $40 daily for other use. All Aye. Motion Carried Larsen made a motion, Birch seconded to approve the baseball field fee schedule with request to re-evaluate in one year. All Aye. Motion Carried. V. Concept Planning for the Future Park Pete Pederson representing the Lions Club informed the interest for long range development of Lions Park. Each year the Lions hold more community events and the need for an additional structure has been discussed. The Lions Cub is interested in donating/investing $35,000. to build a park shelter if the City will help match funds. Taylor made a motion; Berger seconded directing staff to develop a master plan of Lions Park. All Aye. Motion Carried. Commission Members included discussion on MORC. Commissioners agreed that a master plan needs to be determined for the Park at Irish Avenue before direction can be given to MORC. -2- Parks Commission November 10, 2010 VI. Homework: 2011 Goal Setting.at December Meeting Taylor reminded the Parks Commission that goals need to be determined for 2011. Each member is to determine a list of priorities for the next meeting. Larsen directed City Staff to verify that the Property Tax Levy is invested in a money market fund. VII. Adjournment Berger made a motion; Larsen seconded to adjourn the meeting at 9:11 pm. -3— Parks Commission November 10,- 2010 Hugo City Council Meeting Minutes for November 15, 2010 Page 5 of 10 Discussion on Prop.osed Parks Ordinance Re ulatin Public Conduct This item was tabled at the last Council meeting due to lack of time. At their October l0, 2010 meeting, the Parks, Recreation and Open Space Commission made a recommendation to change the Public Conduct in Parks Ordinance. The Parks Commission has had discussion on park rules at multiple meetings. The Parks Commission identified three rules to make into an ordinance, enforceable by law: motorized vehicle use on park property, reservation of picnic shelters, and fires. Also in the recommendation are revisions to the definitions and special permit section of the existing ordinance. Parks Planner Shayla Syverson presented the recommendation for changes to the Public Conduct in Parks Ordinance, and the Council discussed the definitions of active and passive parks, leashing of dogs in active parks, enforceability to include the violation of the ordinance to be a petty misdemeanor, and signage at the parks. Haas made motion, Weidt seconded, to adopt ORDINANCE 2010-448 AMENDING CHAPTER 54, ARTICLE I1, PUBLIC CONDUCT WITHIN PARKS and directing the Planning Commission to hold a public hearing on updates to the Parks, Trails, and Open Space section of the 2030 Comprehensive Plan. All Ayes. Motion carried. Discussion on Proposed Tobacco Use/Smoking Policy This item was tabled at the last Council meeting due to lack of time. At their October 10, 2010 meeting, the Parks, Recreation and Open Space Commission heard a presentation from the program director for Tobacco Free Youth Recreation. The Commission made a recommendation to the City Council to ask direction on a possible smoke-free or tobacco -free policy which would include the entire property of all active and passive parks in the Hugo park system. Parks Planner Shayla Syverson explained the Parks Commission generally agreed there should be a policy and it should be effective in all Hugo parks; however, there was no consensus on whether it should be just smoking or if it should include all tobacco products. (Mayor Fran Miron arrived at 8:20 p.m.) Parks and RecreationCommission Chair Jim Taylor was present and stated his opinion that all parks should be tobacco free, and the Council discussed whether it needed to be addressed at this time and whether government needed to be regulating life style choices by ordinance. Hugo City Council Meeting Minutes for November 15, 2010 Page 6 of 10 Discussion on Park Dedication Fee Ordinance At its September 20, 2010 meeting, the Council discussed proposed changes to the Park Dedication Fee Ordinance, which include adding an appeal process and a table to assign dedication based on the density of residential development. The Council also considered whether to require park dedication on commercial and industrial development and voted four to one to include FDA's recommendation to not require a parkland dedication fee on commercial and industrial land, and to review it again in four years. Council had directed staff to hold a public hearing at the Planning Commission on the draft Park Dedication Fee Ordinance. A public hearing was held at the Planning Commission meeting on October 28, 2010, and the Planning Commission unanimously recommended including a requirement to charge commercial and industrial property development a park dedication fee. Parks Planner Shayla Syverson presented to Council these recommendations from the Parks Commission, EDA, and Planning Commission. Jim Taylor, Chair of the Parks and Recreation Commission spoke in favor of park dedication on commercial/industrial property saying that parks make money and the City could lose 1.1 million dollars over time. Jim stated that the value of property near parks increases resulting in more tax revenue. He also said parks attract businesses and bring money into our economy. Tom Denaway Economic Development Authority Commissioner, defended the EDA's decision stating they were not anti -parks and not changing the Parks Capital Improvement Plan, just the best way to allocate the cost, and the development of commercial/industrial property did not create a need for parks. He explained that, as reported by the National Commercial Real Estate Association, there was no direct benefit from parks, and parks dedication fees affect the businesses' bottom line. Councilmember Haas supported a park dedication fee for commercial/industrial development, and said he sees the need for parks as a necessary part of city planning. As a businessman, he said he did not feel a parks dedication fee requirement would deter commercial/industrial development.
