Staff recommends approval of the minutes of the Parks Commission meeting of June 11, 2014.
7:05 pm Oath of Office of Ranell Tennyson
Ranell Tennyson was appointed to the Parks, Recreation, and Open Space Commission by the
City Council on July 14, 2014. We welcome her to the Commission. An oath of office will be
read.
7:20 pm Waters Edge Dog Park
The City of Hugo was approached by the Water Edge Master Association with a request that the
City of Hugo allow the association to use the city -owned property, located east of Oneka
Parkway and adjacent to the neighborhood, for a dog park. The association is proposing to
fence in the area and provide maintenance. A volunteer group will be established to oversee
the maintenance. All of the changes to the property will be upon approval of the Public Works
Director. The dog park will be open to the public. Parking is not available onsite, but there is
nearby on street parking. The dog park will also be accessible by the existing trails.
The property includes approximately 2 acres of upland, surrounded by stormwater ponds. The
majority of the site is delineated as a wetland. To avoid wetland impacts and additional
permitting, wood -chips and other materials are not allowed to be imported from off-site. Grading
or other means of filling the wetland are also not allowed. Posts for fencing and general
vegetation mowing are not regulated in the wetland and are therefore allowed.
A memorandum of understanding (MOU) has been drafted which outlines maintenance
expectations and other agreements between the City and the Waters Edge Master Association.
The site plan, MOU, and other plans will be presented at the meeting for approval.

Call to Order
Present: Joan Benner, Mat Rauschendorfer, Nicole Schmid, Dave Strub, Tom Windisch
Absent: Rachel Berger
Staff Present: Shayla Syverson, Parks Planner

Tom Windisch called the meeting to order at 7:04 p.m.
I. Approval of Minutes from May Meeting
Berger made a motion, Strub seconded to approve the minutes of the May 14, 2014 meeting.
All Aye. Motion carried.
II. Presentation on BearPower by Alli Zomer
Alli Zomer, Project Manager at Health Partners/Children's Hospitals & Clinics MN made a
presentation to the Parks Commission meeting about BearPower. BearPower is a community
wide movement helping familes eat well and be active.
Discussion included current community encouragement on promoting healthy lifestyles. Future
planning can promote better food or snack choices available at our City programs/events for the
community.
III. Recreation Program Policv
Shayla Syverson, Parks Planner provided a draft of the Recreation Program Policy for
discussion.
Rauschendorfer made a motion, Schmid seconded to approve the Program policy as amended
with trail connectivity added and promoting healthy choices/options at programs/events.
All Aye. Motion Carried.
IV. Lacrosse Field Needs
Shayla Syverson, Parks Planner provided a cost estimate of Lacrosse goals of $180.00 plus
shipping per set of goals, to follow up on previous discussions.
Parks Commission members agreed to purchase a set of goals to place in parks.
V. Lions Park Planning
Shayla Syverson, Parks Planner reviewed the Lions Park Planning progress.
Park Commission members discussed the preliminary plan, community park needs,
connectivity, stakeholders meetings and the planning process.
Benner made a motion, Schmid seconded to approve WSB & Associates to complete the
master plan with cost to not exceed $7,800. and approve Dave Strub to representative the Park
Commission at the Stakeholders meeting groups.
All Aye. Motion Carried.
VI. Adiournment
Strub made a motion, Schmid seconded to adjourn the meeting at 8:34 pm.
All ayes.

MEMORANDUM OF UNDERSTANDING
Between
THE CITY OF HUGO
THE WATERS EDGE MASTER ASSOCIATION
August 29, 2014
This Memorandum of Understanding ("MOU") between the CITY OF HUGO, a
Minnesota municipal corporation ("Hugo'), and the WATERS EDGE MASTER
ASSOCIATION ("WDMA") (all parties referred to collectively as "Parties or referred to
individually as "Party" or by their designation as stated in this preamble) is entered into
by the Parties with mutual intent, understanding and agreement of the following terms
and conditions:
WITNESSETH:
WHEREAS, the Waters Edge Master Association wishes to operate a dog park on
city -owned property.
WHEREAS, Hugo wishes to, and agrees that it will, allow use of the city -owned
property for the purposes and on the terms and conditions set forth; and
NOW, THEREFORE, for and in consideration of the mutual undertakings,
covenants and agreements of the parties set forth, the receipt and sufficiency of which are
acknowledged by each of the parties, the parties agree as follows:
1. Anticipated Construction Schedule. The Waters Edge Master Association shall
construct the dog park by July 1, 2015 and make it available to the public thereafter.
2. Improvements. Any and all improvements made to the property are subject to
approval by Hugo Public Works Director. Construction shall be completed as
described in Exhibit A.
3. Ongoing Maintenance. The dog park shall be regularly maintained by the Waters
Edge Master Association according to Exhibit B and subject to inspection by the
Hugo Public Works Director. WEMA shall coordinate volunteer groups or follow
other means necessary to keep the dog park well maintained. Hugo shall provide "no
parking" signage along Oneka Parkway, adjacent to the park. Hugo shall provide
minimal maintenance assistance, upon request of the Waters Edge Master
Association.
4. Operation. The dog park shall be open to the public and shall be free of charge.
Hours of operation shall be posted. The dog park shall not be used between the hours
of 11:00pm and 6:00am.
5. Termination. Hugo reserves the right to terminate this agreement and prohibit use of
the property by the Waters Edge Homeowners Association if the dog park is not
maintained to a satisfactory level, is not operated according to this agreement, or
other.
6. Insurance. Parties agree that City of Hugo will properly insure the property.
Liability. Each Party has had full and fair opportunity to review alternatives to this
agreement. Each Party agrees that it shall be responsible and liable for its own acts,
errors and omissions and the results to the extent authorized by law and shall not be
responsible for the acts, errors or omissions, or results, of any other Party. Each Party
agrees to hold any other Party harmless and free from any and all claims, causes of
action, damages, suits, costs including attorneys' fees with respect to such Party's
respective obligations under this agreement. Hugo's liability shall be governed and
limited to the tort liability provisions found in Minnesota Statutes Chapter 466, as
amended from time to time, notwithstanding the foregoing language. This section
shall survive any termination of this agreement.
8. Notice. Any notice required or permitted shall be in writing and given by personal
delivery upon an authorized representative of a party; or if mailed by United States
registered or certified mail, return receipt requested, postage prepaid; or if deposited
cost paid with a nationally recognized, reputable overnight courier, properly
addressed as follows:

IN WITNESS WHEREOF, the parties have executed this agreement to be effective on
the day and year set forth, with respect to each signing party.

EXHIBIT B
MAINTENANCE REQUIREMENTS
1. Trash receptacles will be provided for animal waste and other trash. Receptacles
will be emptied on a weekly basis. There shall be a sufficient number of trash
receptacles located at the entrance of the park so that users are able to clean up
after themselves.
2. The vegetation will be mowed on a weekly basis.
3. Surface materials sourced from off-site will not be used.
4. Fencing will be maintained and in good working condition.
5. A site inspection will be conducted in the spring and in the fall by the City of
Hugo. Public Works Director Scott Anderson will provide recommendations on
maintenance and improvements.
