RESOLUTION 2016-8
APPROVING A PUD AMENDMENT FOR KETTLER CONSTRUCTION, INC.
FOR "VICTOR GARDENS NORTH VILLAGE 7T" ADDITION" ON PROPERTY
LOCATED NORTH OF ROSEMARY WAY AND EAST OF ELMCREST
AVENUE NORTH
WHEREAS, Kettler Construction, Inc. has requested approval of a PUD Amendment to
allow construction of 33 townhome units on 8.51-acre property legally described as
follows:
Outlot A and Outlot B, Victor Gardens North Village 5th Addition,
according to the recorded plat thereof, Washington County, Minnesota.
WHEREAS, the Planning Commission has reviewed the PUD Amendment at a duly
called Public Meeting and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by Kettler Construction, Inc. for a PUD Amendment, subject to the following
conditions:
1. A PUD Amendment is approved to allow the creation of 33 townhome units in
accordance with the plans received by the City on March 30, 2016, April 15, 2016,
April 21, 2016, and April 22, 2016, except as amended by this resolution.
2. Approval is contingent upon City Council approval of the requested preliminary plat.
3. The development shall be consistent with the Victor Gardens PUD concept plan
approvals (Resolution # 2000-47), and Victor Gardens North PUD approvals (2005-
05 and 2005-06), except as otherwise noted herein.
4. Private driveways in front of the townhome garages shall be a minimum of 22 feet
long to accommodate parking.

5. The developer shall create, or join, a Home Owners Association (HOA) for the
purposes of maintenance of items within the common areas (Outlot A). These items
include, streets, landscaping, exteriors, and stormwater utilities.
6. All platted townhome lots shall comply with the following setbacks:
Minimum front yard setback from private street 20 feet
Minimum setback between buildings 10 feet
Minimum setback around the perimeter of the site 25 feet
Minimum setback around the perimeter of the site 20 feet
(Rosemary Way)
7. Prior to final plat approval, the applicant must comply with the following conditions:
Architecture
a. The elevations for the patio homes and twinhomes shall be revised to provide
architectural elements used on the front elevation (such as brick or stone, shutters,
etc) continued on all elevations. Staff shall review and approve the elevations.
b. All building elevations shall receive nearly equal treatment and visual qualities.
c. The developer shall submit a design palette (including material samples) for the
entire project for City review and approval. The palette shall include colors for
siding, shakes, shutters, shingles, brick, and stone. Building colors and materials
shall be harmonious throughout the development.
d. No adjacent home shall have the same front elevation or colors. Materials shall
be consistent with the architectural plans and design palette to be reviewed and
approved by City staff.
e. The plans must be revised to clearly identify how the mechanical equipment for
the townhomes will be screened.
Signage
f. No development signage is proposed or approved. If signage is proposed at a later
date it shall be reviewed and approved by the City and a sign permit shall be
issued. The sign shall be consistent with the development and the located shall be
reviewed and approved by staff.
Parks and Trails
g. A 10-foot trail easement is provided along Elmcrest Avenue for the future trail.
This easement shall be shown on the plans.

h. The planned future trail along Elmcrest Avenue shall be constructed and paid for
by the developer.
i. Park dedication requirements for this site have been met with previous additions.
No additional park dedication is required for this phase.
Landscaping
j. The applicant shall revise the landscape plan to:
1) Show the proposed 33 units.
2) Indicate what trees on the north side of the property will be preserved.
3) Add additional landscape buffer on north property line.
4) Remove trees from Rosemary Way Boulevard and add trees along
Rosemary Way on development property.
Miscellaneous
k. The applicant shall comply with all conditions from the City Engineer's memo
dated April 21, 2016.
1. The developer must obtain all necessary stormwater management and WCA
permits from the City.
m. The applicant shall complete an as-built survey of the stormwater pond south of
Rosemary way that serves this site.
n. The applicant shall provide copies of the development covenants/HOA documents
for City review. A copy of the covenants/HOA documents shall be filed with the
final plat.
o. The applicant shall provide copies of the cross access and maintenance
agreements for City review. These documents shall be recorded with the final
plat for the shared private drives and parking.
8. Prior to issuance of building permits, the applicant must comply with the following
conditions:
a. The homeowner's association documents shall include language to ensure that
the enclosed garage spaces are maintained for vehicle parking and that parking of
snowmobiles, boats, RVs and other recreational vehicles in the driveway is
discouraged. The covenants should be drafted to prohibit the storage of anything
in the garage or driveway that would prevent the storage and parking of vehicles.
b. The homeowner's association documents and sales information shall note that
the property to the north is zoned Agricultural (AG) and that the intent of this
district is to provide an area for the production of livestock, dairy animals, dairy
products, poultry or poultry products, fur-bearing animals, horticultural or

nursery stock, fruit, vegetables, forages, grains, timber, trees, or bees and apiary
products, and other uses dependent on the inherent productivity of the land.
c. The developer's architectural control committee (ARC) shall review and approve
all building designs for compliance with this resolution, prior to building permit
submittal. A written copy of the ARC approval shall be submitted with the
building permit application for each building. The City shall review the building
architecture for compliance with the approved plans prior to issuance of building
permits.

d. At the time of final plat approval for each phase of the development, the
applicant shall submit PUD Final Plans for the review and approval of the City
staff.
e. The applicant shall obtain all necessary local, state, and federal permits.
8. Prior to issuance of a certificate of occupancy for the first building, the applicant must
comply with the following conditions:
a. The landscape buffer around the perimeter of the site shall be fully installed.
b. The trail along Elmcrest Avenue shall be constructed.
WHEREUPON, said Resolution was declared duly passed and adopted by the City
Council for the City of Hugo this 16th of May, 2016.
