D.1 Approval of the July 6, 2015 City Council Meeting
Staff recommends Council approve the above minutes as presented.
F.1 Presentation of 133rd Air Wing of the Minnesota National Guard — Colonel Dan
Gabrielli
Col. Dan Gabrielli will present on his personal experience Air Guard and his connections with
the City of Hugo. He will also make mention of the upcoming Air Wings Family Day in
association with the Yellow Ribbon Network.
G.1 Approval of Claims
Staff recommends Council approve the Claims Roster as presented.
G.2 Approve Certificate and Resolution Recognizing Wilson Tool 50 Year Anniversary
Wilson Tool began in 1966 in St. Paul, MN, and quickly expanded to Hugo soon after. Their
world headquarters has been located in Hugo since 1978 and has grown to 350,000 square feet.
Today, the company is "the largest independent manufacturer of tooling systems for punch
presses, press brakes and punch and die components for the stamping industry." The business
plays a vital role in Hugo's economic success and stability.
G.3 Approve Extension of Employment for Administrative Intern Taylor Richter
Taylor Richter began her internship on December 21, 2015, as the City's Administrative Intern.
This temporary position is for a six month period of time, after which it may be extended for an
additional six month period. Taylor has assisted the City Administrator on a wide variety of
projects over the past six months. City Administrator Bryan Berar recommends council extend
the internship of Taylor Richter for an additional six month period.
GA Approve Resolution for Authorization to Apply for Metropolitan Council Planning
Assistance Grant
The City of Hugo must review and update its comprehensive plans as required by the
"decennial" review provision of Minnesota Statutes § 473.864, subd.2. On April 27, 2016, the
Metropolitan Council adopted need -based eligibility criteria in order to award local planning
assistance grant funds. Maximum grant amounts for eligible grantees were also established. The
purpose of the grant is to help grantees review and update their comprehensive plans as required
by Statute. City staff recommends the Council approve the resolution to apply for the
Metropolitan Council Planning Assistance Grant.
J.1 Discussion on Temporary Health Care Dwellings
On May 12, 2016, Governor Dayton signed a bill into a law creating a process for landowners to
place a temporary residential dwelling on their property to serve as a family health care dwelling.
The law goes into effect September 1, 2016, and automatically applies to all cities that do not opt
out or do not already allow temporary family health care dwellings as a permitted use under their
local ordinances. Staff recommends that the City Council discuss the temporary family health
care dwelling ordinance and provide staff with comments. Because the new law alters the City's
level of zoning authority and the structures have the potential to change the character of the area,
staff recommends opting out of the temporary family health care dwelling ordinance.
J.2 Discussion on Concept Plan for Terre De L'eau
Excelsior Group, LLC, is requesting review and comments on a sketch plan for 296 residential
lots on 197.5 acres. The gross density of the project is 1.5 units per acre and the net density is
2.5. The Planning Commission and Parks Commission have reviewed and provided informal
comments to the developer at their meetings in June and July. Staff recommends the City
Council provide feedback to the applicant in the proposed Sketch Plan for the development.
L.1 Yellow Ribbon Network Update
Council Members Chuck Haas and Phil Klein will report to Council any updates on the City of
Hugo's Yellow Ribbon Network activities.
M.1 Schedule Grand Opening for McCollar Park
The Parks, Recreation, and Open Space Commission recommends that a Grand Opening of
McCollar Park be scheduled during the first part of September. At the meeting of May 2, 2016,
the City Council approved the purchase of play equipment in the amount of $70,000. This
included $50,000 from the special park fund and a $20,000 donation from the Fable Hill
Homeowners Association. The neighborhood residents and other stakeholders participated in
selecting the play equipment from St. Croix Recreation. The park property was acquired and
improved through park dedication with the Fable Hill Third and Fourth Additions. The park has
been named in honor of the former property owner whose family will be invited to attend the
Grand Opening in addition to area residents and stakeholders.
M.2 HBA Business Showcase and Networking Social Event on July 28, 2016
The Hugo Business Association is hosting an annual networking event on July 28, 2016, at the
Gallivan Insurance Agency in White Bear Lake. The event begins at 4:00pm and will includes
games and food.
M.3 Schedule Neighborhood Meeting for 2017 Street Reconstruction Program
The project ranked by staff as priority one as the street reconstruction project for 2017 included
Homestead Avenue, 132"d Street, Homestead Drive, and 126th Street. The next step of the project
is to schedule a neighborhood meeting.

Presentation of 2015 Audit Report - Jason Miller, Smith Schafer & Associates
Jason Miller from the independent accounting firm of Smith Schafer & Associates presented the
Hugo City Council with a recap of the audit of City's finances for the 2015 fiscal year. Jason
provided a summary of the City's revenues and expenditures stating that the City has good
reserves on hand. He reviewed the different funds and expenditures, and summarized by saying
the City was in good financial shape. An unmodified audit opinion was issued with one
Minnesota legal compliance exception.

Approve Annual Performance Review for Public Works Worker Jeff Maas
Jeff Maas was hired by the City of Hugo on July 24, 2006 as a Public Works Worker and has
worked for nine years in the Public Works Department. Adoption of the Consent Agenda
approved the annual performance review for Public Works Worker Jeff Maas.
Approve Annual Performance Review for Communitv Development Assistant Rachel Leitz
Rachel Leitz was hired as a Community Development intern on January 12, 2015. At the July 6,
2015 meeting, the Council approved the hiring of Rachel as the new full-time Community
Development Assistant with a start date of July 13, 2015. Adoption of the Consent Agenda
approved the annual performance review for Community Development Assistant Rachel Leitz.
Approve Reduction No. 3 in the Letter of Credit for OP3 Prairie Village LLC, Prairie
Village 3' d Addition
OP3 Prairie Village, developer, had requested the City reduce the letter of credit being held for
the Prairie Village 3`d Addition. Senior Engineering Technician Steve Duff had inspected the
work and recommended the reduction of the letter of credit being held for the constructed
improvements in the Prairie Village 3`a Addition be reduced to $139,300.00 of the original letter
of credit $1,393,000.00. Adoption of the Consent Agenda approved the reduction in the letter of
credit to $139,300.00.
Approve Reduction No 2 in the Letter of Credit for OP3 Prairie Village LLC for Waters
Edge 5th Addition
OP3 Prairie Village LLC had requested the City reduce their letter of credit for the Water's Edge
5' Addition Development. Senior Engineering Technician Steve Duff had inspected the work
and recommended the reduction of the letter of credit being held for the constructed
improvements in the Water's Edge 5'h Addition Development be reduced to $30,411.50 of the

original letter of credit $304,115.00. Adoption of the Consent Agenda approved the reduction in
the letter of credit to $30,411.50.
Approve Reduction No 2 in the Letter of Credit for OP3 Prairie Village LLC for Prairie
Village 4r" Addition
OP3 Prairie Village LLC had requested the City reduce their letter of credit for the Prairie
Village 4`s Addition Development. Senior Engineering Technician Steve Duff had inspected the
work and recommended the reduction of the letter of credit being held for the constructed
improvements in the Prairie Village 0' Development be reduced to $63,672.00 of the original
letter of credit $636,720.00. Adoption of the Consent Agenda approved the reduction in the
letter of credit to $63,672.00.
Approve Temporary On -Sale Liquor License for the Hueo Lions Club for Tough Mudder
Event on July 16-17, 2016
Tough Mudder event organizers requested the Hugo Lions Club members serve beer at their
event at Wild Wings on Saturday and Sunday, July 16 and 17 The Lions Club had submitted an
application for a Temporary On -Sale Liquor License and the appropriate Liquor Liability
Insurance naming the City as additionally insured. In addition, they have secured two
Washington County Deputies to be stationed in the area where alcohol is served. Adoption of
the Consent Agenda approved the Temporary On -Sale Liquor License for the Hugo Lions Club
for the Tough Mudder Event on July 16 and 17, 2016.
Approve Special Event Permit for Wilson Tool Employee Picnic on Saturday, August 13
2016
Wilson Tool had applied for a Special Event Permit for their annual company picnic on
Saturday, August 13, 2016. Wilson Tool had reserved the Hanilf Fields, Hanifl Shelter, and the
Rice Lake Center for their event to celebrate their 50 year anniversary. A special event permit is
required because they expected between 1,200 and 2,000 people to attend, there will be live
music and fireworks, and alcohol will be served. Wilson Tool will be doing a presentation
during the event that the Council will be invited to. Staff will inform Council of the schedule
closer to the date and prepare a form of recognition for the Council to present. Adoption of the
Consent Agenda approved the Special Event Permit for Wilson Tool to hold their annual picnic
at the Hamfl Fields and Shelter on Saturday, August 13, 2016.
Weidt made motion, Miron seconded, to direct staff to prepare a resolution in recognition of
Wilson Tool's 50a' Anniversary for approval by Council at the next meeting.

Approve Application for Pyrotechnic Display, Inc for Fireworks at the Wilson Tool
Company Picnic on Saturday, August 13, 2016
Pyrotechnic Display, Inc. had applied for a permit to display fireworks as part of the Wilson Tool
company picnic. A Certificate of Liability Insurance was provided to the City naming the City

as additionally insured. Adoption of the Consent Agenda approved the permit for Pyrotechnic
Display, Inc for a fireworks display on Saturday, August 13, 2016 at the Hanifl Fields, subject to
approval by the Hugo Fire Chief.
Approve Temporary On -Sale Liquor License to Hugo Lions Club for the Wilson Tool
Company Picnic on Saturday, August 13, 2016
As in past years, the Hugo Lions Club applied for a Temporary On -Sale Liquor License to serve
alcohol at the annual Wilson Tool picnic to be held at the Hanifl Shelter and Fields. The City
had received the appropriate Liquor Liability Insurance naming the City as additionally insured,
and they have secured four Washington County Deputies to be on site. Adoption of the Consent
Agenda approved the Temporary On -Sale Liquor License for the Wilson Tool company picnic.
Approve Brian Esch and John Brockberg as Probationary Employees on the Hugo Fire
Department
Brian Esch and John Brockberg have completed the application procedure to become firefighters
on the Hugo Fire Department. Fire Chief Kevin Colvard and Deputy Chief Jim Compton, Jr.
recommended appointment of Brian and John as probationary firefighters. Adoption of the
Consent Agenda approved the appointment of Brian Esch and John Brockberg as probationary
firefighters on the Hugo Fire Department effective July 5, 2016.
Approve Resolution Appointing Election Judges for 2016 Primary and General Elections
The City has received 39 applications from individuals to serve as election judges for the City of
Hugo's Primary and General Elections in 2016. All election judges will receive two hours of
training, and many of the judges have served in several past elections. City Clerk Michele
Lindau has prepared a resolution listing the election judges who will be staffing the five
precincts. Adoption of the Consent Agenda approved RESOLUTION 2016-16 APPOINTING
ELECTION JUDGES FOR PRIMARY AND GENERAL ELECTIONS IN THE YEAR 2016.
Approve Resolution Approving Joint Powers Agreement and Court Data Services
Amendment for Johnson /Turner
At its July 18, 2011 meeting, Council approved a Masters Joint Powers Agreement with the MN
Department of Public Safety, Bureau of Criminal Apprehension (BCA) to allow the City
attorney's firm of Johnson and Turner to access the BCA's Criminal Justice Data
Communications Network (CJDN). In July 2012, Council approved an amendment to provide
additional tools available to access court data. This was a five-year agreement that will expire
soon, and Johnson/Turner is requesting Council approve the resolution approving the renewal of
the agreements. Adoption of the Consent Agenda approved RESOLUTION 2016-17
APPROVING STATE OF MINNESOTA JOINT POWERS AGREEMENTS WITH THE CITY
OF HUGO ON BEHALF OF ITS CITY ATTORNEY AND ARRESTING AGENCY.

Approve Resolution Approving the Master Partnership Contract with MnDOT for 147th
Street/Oneka Lake Boulevard Street Project
The 147`x' Street/Oneka Lake Boulevard project involves the use of the City's state -aid funds, and
as such includes specific requirements related to materials inspections. A number of the required
materials inspections can be completed most efficiently by MnDOT on behalf of the City.
MnDOT will complete the materials inspections on behalf of the City, and bill the City
accordingly for the work. The City needed to enter into a contract with MnDOT to allow for
completion of the work. Adoption of the Consent Agenda approved RESOLUTION 2016 —18
APPROVING THE MASTER PARTNERSHIP CONTRACT WITH THE MINNESOTA
DEPARTMENT OF TRANSPORTATION.
Approve Termination of Escrow Agreement for Property at 16635 and 16673 Forest
Boulevard (ARK)
At its November 4, 2013 meeting, the Council approved the revocation of the Special Use Permit
and Auto Dismantling License for property owned by Norman Horton at 16635 and 16673 Forest
Boulevard. An Order was also approved that defined the steps required to clean up the property.
In November, 2015, the City entered into an Escrow Agreement with the Trustees of the property
who escrowed $25,000 to ensure the conditions in the Special Use Permit, which were required
upon termination of the permit, were completed. Staff had inspected the property and
determined they are in compliance of all the requirements. Adoption of the Consent Agenda
approved the termination of the Escrow Agreement for the property at 16635 and 16673 Forest
Boulevard and release the funds to the Trustees of the property.
Approve Solar Ordinance Subscription Agreement with Geronimo Energy
At the April 4, 2016 meeting, Community Development Assistant Rachel Leitz spoke to the
Council about a solar subscription RFP through the Met Council that the City joined in 2015.
She stated that the City had been paired with Geronimo Energy and have been given the
opportunity to subscribe to a solar garden. In return, the City would receive a bill credit on its
energy bill. The Council had questions regarding the contract and other background information
on the company. At its May 16, 2016 meeting, staff provided the Council with supplemental
information on the solar subscription, including the contract. The City Council directed staff to
move forward with the subscription and begin review and negotiations of the contract. Adoption
of the Consent Agenda approved the final agreement for the City's subscription subject to review
by the City Attorney.
Approve Oneka Parkway Bridge Maintenance Agreement with the Rice Creek Watershed
District
At its August 3, 2015, meeting the City Council approved the Clearwater Cove development.
The approval included the requirement for the construction of Oneka Parkway from Frenchman
Road (CSAH 8) to the development. The construction requires a bridge over Clearwater Creek
and approval from the Rice Creek Watershed District (RCWD). The RCWD Rule G for
crossings of conveyance systems requires the City to enter into an agreement with the district to
maintain the bridge. Staff is comfortable maintaining the bridge per the approved plans and
permit that was issued by the district. Adoption of the Consent Agenda approved the

maintenance agreement for the Oneka Parkway Bridge.
Gary Michalski had requested approval of a preliminary plat and final plat to allow for a 9.42
acre parcel to be split into two 4.71 are parcels. According to the City Code, all subdivisions in
zoning districts that are eligible for municipal sewer and water, which create two or more lots or
parcels shall be platted. At its June 23, 2016, meeting the Planning Commission held a public
hearing and considered the request. The Planning Commission recommended approval of the
preliminary plat and final plat for Bald Eagle Industrial Park 6`h Addition. Adoption of the
Consent Agenda approved RESOLUTION 2016-19 APPROVING A PRELIMINARY PLAT
AND FINAL PLAT FOR GARY MICHALSKI FOR "BALD EAGLE INDUSTRIAL PARK
6TH ADDITION" LOCATED NORTH OF 130TH STREET AND EAST OF FENWAY
BOULEVARD.
Award of Bid for the Oneka Lake Boulevard/147' Street Improvement Project
At its May 16, 2016 meeting, Council approved the resolution approving the plans specifications
for the Oneka Lake Boulevard/147th Street Project and approving the advertisement for bids.
WSB Project Engineer Jim Stremel informed Council that bids were received and opened on
Thursday, June 30, 2016 at 10 a.m. The City received six bids, and Jim explained the lowest bid
was from Ann Construction in the amount of $1,005,867.90.
Haas made motion, Petryk seconded, to award the bid to Arm Construction for the Oneka Lake
Boulevard/147'h Street Project.
All ayes. Motion carried.
Update on June 27, 2016 CIP Worksho
The Council held a workshop on Monday, June 27, 2016 to discuss street capital improvement
projects. City Administrator Bryan Bear provided an update on the meeting stating there was
discussion on future street CIP projects considering budget, timing, and priorities. There was a
general consensus among Council to move forward with the project ranked by staff as priority
one as the street reconstruction project for 2017. Priority one included Homestead Avenue,
132nd Street, Homestead Drive, and 126'h Street. Bryan suggested the first step would be to
schedule a neighborhood meeting on a potential street project.
Miron made motion, Klein seconded, to direct staff to schedule a neighborhood meeting to move
forward with the street project labeled by staff as priority one.

Yellow Ribbon Network Update
Council Members Chuck Haas and Phil Klein reported to Council on the City of Hugo's Yellow
Ribbon Network activities. Mark Schwope, Keller William Realty, was the June sponsor for
Hamburger Night. Wilson Tool will be July's sponsor on July 27, 2016. A packing event is
scheduled for July 30, 2016 and they are in need of toiletry items, which can be dropped off at
City Hall. Four thousand MN National Guard Soldiers of the I" Brigade Combat Team, among
others, have just returned from training in the Mohave dessert. Units are deployed in Croatia,
Norway, Italy, and the 148' Fighter Wing is in South Korea. Also, the 125`x' Infantry Division
Company is leaving for Egypt. The YRN is looking for sponsors for the Welcome Home
Pheasant Hunt to be held on October 15, 2016.
Forest Lake YMCA Ribbon Cutting Ceremony on July 14, 2016
City Administrator Bryan Bear reminded Council that a meeting was scheduled to attend the
Forest Lake Ribbon Cutting Ceremony on Thursday, July 14, 1206 beginning at 9 a.m.
Water Summit and BBO on Thursday, July 14, 2016
City Administrator Bryan Bear reminded Council that a Water Summit to include a BBQ had
been scheduled for Thursday, July 14, 2016; however, staff had been made aware that another
event is scheduled for the same evening.
Weidt made motion, Klein seconded, to reschedule the July 14, 2016 Water Summit.

Hugo Lions Community Golf Scramble on Sunday, August 14, 2016
City Administrator Bryan Bear informed Council that the Hugo Lions Club will hold a Golf
Scramble on Sunday, August 14, 2016 at the Oneka Ridge Golf Course at 9 a.m. All proceeds
will go to the Hugo Yellow Ribbon Network.

A RESOLUTION RECOGNIZING THE WILSON TOOL 50TH ANNIVERSARY
WHEREAS, on June 2"a, 2016, the company Wilson Tool celebrated their 50`x'
Anniversary of business; and
WHEREAS, Wilson Tool's world headquarters has been located in the City of Hugo since
1978; and
WHEREAS, the company provides hundreds of jobs, employs many Hugo citizens, and
contributes significantly to the City's tax base; and

RESOLUTION IDENTIFYING THE NEED FOR
FUNDING TO COMPLETE ITS 2040 COMPREHENSIVE PLAN UPDATE AND
AUTHORIZING AN APPLICATION FOR PLANNING ASSISTANCE GRANT
FUNDS
WHEREAS the City of Hugo must review and update its comprehensive plans as
required by the "decennial" review provision of Minnesota Statutes section 473.864 ,
subdivision 2; and
WHEREAS, on April 27, 2016, the Metropolitan Council adopted need -based eligibility
criteria for awarding available local planning assistance grant funds and established
maximum grant amounts for eligible grantees to help grantees review and update their
comprehensive plans as required by the "decennial" review provisions of Minnesota
Statutes section 473.864, subdivision 2; and
WHEREAS, the Grantee is an eligible city, county or town in the metropolitan area as
defined in Minnesota Statutes section 473.121; AND
WHEREAS, planning assistance grant funds will be made available to eligible applicants
subject to terms and conditions contained in Metropolitan Council grant agreements.
NOW THEREFORE BE IT RESOLVED that, after appropriate examination and due
consideration, the governing body of the City:
Authorizes its Community Development Director or designee to:
1) submit on behalf of the City an application to the Metropolitan Council for Local
Planning Assistance grant funds for the decennial review and update of the City's
local comprehensive plan required under Minnesota Statutes section 473.864; and
2) execute on behalf of the City a grant agreement with the Metropolitan Council for
planning assistance grant funds.

SUBJECT: Temporary Family Health Care Dwellings
DATE: July 14, 2016 for the City Council meeting of July 18, 2016
BACKGROUND:
On May 12, 2016, Governor Dayton signed, into law, a bill creating a process for landowners to
place a temporary residential dwelling on their property to serve as a family health care dwelling.
Community desire to provide transitional housing for those with mental or physical impairments and
the increased need for short term care for aging family members served as the catalysts behind the
legislature taking on this initiative. The resulting legislation sets forth a short term care alternative
for a "mentally or physically impaired person", by allowing them to stay in a "temporary dwelling"
on a relative's or caregiver's property. This affects all properties with existing residences in the City.
Per the statute Cities can opt out with adoption of an ordinance or resolution.
2. TEMPORARY HEALTH CARE DWELLING
A. Requirements
Placement of a temporary family health care dwelling can only be on the property where a
"caregiver" or "relative" resides. The statute defines caregiver as "an individual, 18 years of
age or older, who: (1) provides care for a mentally or physically impaired person; and (2) is a
relative, legal guardian, or health care agent of the mentally or physically impaired person for
whom the individual is caring." The definition of "relative" includes "a spouse, parent,
grandparent, child, grandchild, sibling, uncle, aunt, nephew or niece of the mentally or
physically impaired person. Relative also includes half, step and in-law relationships."
The law requires the person residing in the dwelling to qualify as "mentally or physically
impaired," defined as "a person who is a resident of this state and who requires assistance with
two or more instrumental activities of daily living as certified by a physician, a physician
assistant, or an advanced practice registered nurse, licensed to practice in this state." The
legislature did not include an age requirement for the mentally or physically impaired dweller.
A temporary family health care dwelling must:
Primarily be pre -assembled;
Cannot exceed 300 gross square feet;

3. Cannot be attached to a permanent foundation;
4. Must be universally designed and meet state -recognized accessibility standards;
5. Must provide access to water and electric utilities either by connecting to the
utilities that are serving the principal dwelling on the lot or by other comparable
means;
6. Must have exterior materials that are compatible to the exterior materials used in
standard residential construction;
7. Must have a minimum insulation rating of R-15;
8. Must be portable (defined by statute);
9. Must comply with Minnesota Rules, chapter 1360 or 1361, and contain an
Industrialized Buildings Commission seal and data plate or to American National
Standards Institute Code 119.2; and
10. Must contain a backflow check valve.
B. Application Process
Unless otherwise provided by ordinance, the municipality may charge a fee of up to $100 for
the initial permit and up to $50 for a renewal of the permit.
The mandatory application requests very specific information including, but not limited to
proof of care from a provider network, written certification signed by a Minnesota licensed
physician, physician assistant or advanced practice registered nurse that the individual with
the mental or physical impairment needs assistance performing two or more "instrumental
activities of daily life," an affidavit that the applicant provided notice to adjacent property
owners and residents, and a general site map showing the location of the temporary dwelling
and the other structures on the lot.
C. Approval/Denial Process
Due to the time -sensitive nature of issuing a temporary dwelling permit for a temporary
family health care dwelling, the municipality does not have to hold a public hearing on the
application.
The municipality has 15 days to issue a permit requested under this section or to deny it. If
the municipality receives a written request that does not contain all required information, the
applicable 15 day limit starts over only if the municipality sends written notice within five
business days of receipt of the request telling the requester what information is missing. The
municipality cannot extend the period of time to decide. This is a very tight timeline for staff
working on a request such as this. The normal review period under State Statute is 60 days.
All of this would mean that the permit process for a temporary health care dwelling would
most likely be staff reviewed and approved and would not go through a process with the
Planning Commission or City Council.
A temporary family health care dwelling that meets the requirements of this section cannot be
prohibited by a local ordinance that regulates accessory uses or recreational vehicle parking
or storage. The primary types of dwellings proposed fall within the classification of

recreational vehicles, to which the State Building Code does not apply. Two other options
exist, however, for these types of dwellings. If these structures represent a pre -fabricated
home, the federal building code requirements for manufactured homes apply (as stated in
Minnesota Rules, Chapter 1360). If these structures are modular homes, on the other hand,
they must be constructed consistent with the State Building Code (as stated in Minnesota
Rules, Chapter 1361).
The law specifically limits the time frame for these temporary dwellings permits to 6 months,
with a one-time 6 month renewal option. Further, there can be only one dwelling per lot and only
one dweller who resides within the temporary dwelling
D. Revocation
The statute allows for the city to require the permit holder to provide evidence of compliance
and also authorizes the city to inspect the temporary dwelling at times convenient to the
caregiver to determine compliance. The permit holder then has sixty (60) days from the date
of revocation to remove the temporary family health care dwelling. The law does not address
appeals of a revocation.
3. IMPLICATIONS FOR THE CITY
The law requires cities to follow and implement the new temporary family health care dwelling
law beginning September 1, 2016. Cities will need to be prepared to accept applications, must
have determined a permit fee amount (if the city wants to have an amount different than the law's
default amount), and must be ready to process the permits in accordance with the short timeline
required by the law.
Cities may opt out of the new law. The new law alters a City's level of zoning authority for these
types of structures, especially with provisions where accessory structure or recreational vehicle
ordinances do not apply. City's ordinances are made to preserve a neighborhood's character. This
new law would allow this type of structure in all zoning districts, even those that would not allow
them. The City does allow similar structures within the City Code, which are accessory dwelling
units and accessory apartments. These uses have their own performance standards and are accessory
uses in the rural areas of the City. The City has also made special provisions for these types of uses
if a special situation arises and is open to working with residents if they have a request for a similar
use.
Other considerations should be the permitting process and enforcement after the permit period has
expired. As stated before, a new permitting process will have to be considered, as these
requirements differ from standard application review requirements. This will take a considerable
amount of staff time, which all needs to be completed before September 1, 2016. If the City were to
move forward with this process, there would need to be staff time devoted to tracking approved
permits and approving renewals at the six month mark. Once a one year period has expired, staff
would then need to begin a monitoring process to ensure the temporary health care dwelling was
removed from the property. Staff believes this process may be difficult because even though a
permit may expire, a healthcare issue generally does not and there may be an unfavorable response
from permit holders.

Cities that wish to opt out of this law must pass an ordinance or resolution to do so, which requires a
public hearing through the Planning Commission and an approval of a resolution by the City
Council.
4. CONCLUSION/RECOMMENDATION:
The law goes into effect September 1, 2016 and automatically applies to all cities that do not opt out
or don't already allow temporary family health care dwellings as a permitted use under their local
ordinances.
Staff recommends that the City Council discuss the temporary family health care dwelling
ordinance and provide staff with comments. Because the new law alters the City's level of
zoning authority and the structures have the potential to change the character of the area, staff
recommends opting out of the temporary family health care dwelling ordinance.

Subdivision 1. Definitions. (a) For purposes of this section. the following terms
have the meaningsig ven.
(b) "Caregiver" means an individual 18 years of age or older who:
(1) provides care for a mentally or physically impaired person• and
(2) is a relative, legal guardian, or health care agent of the mentally or Physically
impaired person for whom the individual is caring.

1. PLANNING COMMISSION UPDATE:
At its June 23, 2016, meeting the Planning Commission reviewed the sketch plan and provided
informal comments. The applicant provided the Planning Commission with their background and
that they are completing the Prairie Village and Waters Edge developments.
The Planning Commission stated they were generally comfortable with the proposed lot sizes and
lot widths, but did have come concerns on the 45 foot wide lots. They wanted to learn more
about the housing product type that would be built on the lots. The developer stated it would
likely be a slab on grade single level product, but will provide additional detail during the
approval process.
The Planning Commission felt that the use of the City owned outlot for stormwater ponding, a
passive area of the park, and trails, was a positive amenity for the development and surrounding
area. They were comfortable with the use of the outlot. In addition, they suggested a full size
playground, since there are so many homes that are proposed to be built within the development.
The developer agreed.

The Planning Commission stated they would recommend updates to 130"' Street to an Urban
Collector roadway per the Comprehensive Plan with the proposed development. They encourages
the trail to be constructed at that time.
The Planning Commission had concerns on the long road connecting the north and south ends of
the development. The developer stated that they realize this has also been a concern of staff and
will be working with a traffic engineer on the alignment. They did mention that they made some
changes at the entrance from 130"' Street and that there are some site constraint due to wetlands,
but will continue to work with staff on the issue.
The Planning Commission agreed with staff that significant buffers along Highway 61 and 130t"
Street should be provided.
There were five residents that spoke during the meeting. One stated the sketch plan showed
exactly the project needed for this lot and that it is better than past proposals for this lot. The
other residents voiced concerns on the following:
• The proposed density of the project.
• The proposed lot size and lot width in relation to the allowance in the R-3 zoning district.
• Traffic
o Potential for cut -through traffic on 137t" Street
o Additional traffic along 130th Street
• The location of stormwater ponds in relation to the existing homes in regards to flooding,
bugs, and odors.
They wanted to ensure that the Commissions and City Council kept the neighboring
properties in mind during the approval process.
2. PARKS COMMISSION UPDATE:
At its July 13, 2016, meeting the Parks Commission reviewed the sketch plan and provided
informal comments in regards to trails, park improvements, and park dedication. In general the
Parks Commission liked the proposal, but realizes there are several details to work out. They
liked the trails within the development and encouraged additional connections from the adjacent
neighborhoods to the attire park area. They encouraged the trail along the north side of 130t" to
be constructed with the development. They stated they were comfortable with the active park
location but, encouraged a more contiguous park area. The also stated they were comfortable
with the use of the City owned outlot for the passive park area, stormwater pond, and trails. They
thought the developer was on track with the park 'dedication proposal. They stated that more
analysis and discussion will need to occur in regards to phasing of the trail and park
improvements within the development.
I DESCRIPTION OF REQUEST:
The applicant is requesting review and comments on a sketch plan for 296 residential lots on
197.5 acres. The gross density of the project is 1.5 units per acre and the net density is 2.5.

4. CONTEXT:
A. Level of City Discretion in Decision -Making
The City's comments on a sketch plan are advisory only and non-binding.
B. Land Use and Zoning
The subject property is zoned R-3. The properties to the north, south and east are zoned R-3 and
are occupied by townhomes to the north and single family homes. The property to the west,
across Highway 61, is zoned I-3 (general industrial) and occupied by industrial uses.
C. Natural Characteristics of Site
The subject property has some significant stands of trees and has 35 acres of wetlands. A small
portion of the wetlands in the northeast corner are classified as DNR wetlands. A private ditch
runs through the site and a portion of the site is designated as floodplain.
5. ANALYSIS: Consistency with Ordinance Standards

The applicant is requesting sketch plan comments prior to a formal submittal.
The next steps for the applicant would be to submit a request for approval of the following
applications:
a. Rezoning from R-3 to PUD,
b. PUD general plan and
c. Preliminary plat.
Following the preliminary approvals would be applications for final plat of the first phase.
Environmental Review
The applicant is proposing 296 new homes on this property. The minimum threshold for a
mandatory Environmental Assessment Worksheet (EAW) is 250 units, because the request is for
more than 250 units, an EAW is required. The applicant has indicated they will continue to work
with City staff on this process if the project moves forward.

home sites. The R-3 zoning district requires a minimum lot width of 80 feet. The applicant is

The applicant has done a good job providing a mix of housing products and providing
connections between the adjacent neighborhoods as encouraged by the neighborhood pattern and
housing goals section of the Comprehensive Plan. The transitions between product types has
been thought through and generally works well. The applicant has also provided natural buffers
between the proposed development and the existing neighborhoods as to not have lots directly
back up to the existing lots. In general staff is comfortable with the mix of hosing products and
where they are located on the site.
The City has approved smaller lot size and lot widths for detached townhomes and villa housing
products. There are several natural resources on the site that the applicant is trying to preserve by
the development layout. There is also development difficulty with the powerline and pipeline
easements. Therefore, reduced setbacks and smaller lots sizes would allow the developer to
maintain the natural topography, trees, and wetland features of the site. Since the product types
have not been submitted for review by staff, it's difficult to determine whether all of the
proposed lot widths would work with the proposed setbacks. As the project moves forward, the
applicant will need to provide the elevations of the product types and show how they will fit on
the proposed lots. The City Council and Commissions should comment on the proposed lot size
and lot widths.
Zoning Change
The applicant will be requesting a rezoning from R-3 to PUD. The developer is requesting a
PUD to allow development flexibility for lot width, lot size, and setbacks. In exchange for this
flexibility, the city expects a higher level of design and amenities within a project. The applicant
has indicated that they will provide landscaped streets, decorative lighting, trails, a public park
and stormwater reuse system to irrigate the park and home sites.

Density
The proposed development would have a gross density of 1.5 units per acre and a net density of
2.5 units per acre, but the final calculation must be provided by the applicant with the preliminary
plat. The City's Comprehensive Plan allows up to 4 units per acre with a PUD in the R-3 zoning
district.
Building Materials/Design
The applicant did not provide building elevations or material samples at this time. Although the
applicant stated that the Villas and Detached Townhomes would be maintenance provided, they
did not submit details about association maintenance with this application. These items would
need to be reviewed as part of the preliminary plat application.
Wetlands
The site contains approximately 35 acres of wetlands of Various qualities. The majority of the
wetlands are jurisdictional to the State Wetland Conservation Act (WCA), but a small portion in
the northeast corner of the site is identified as a public waters and regulated by the Minnesota
Department of Natural Resources (DNR). The wetlands have been delineated within the site and
Technical Evaluation Panel (TEP) has approved the delineation. The applicant will need to work
with the TEP and the City Water Resources Engineer as the project moves forward to obtain any
necessary permit(s) related to the wetland delineation, if impact or mitigation is proposed with
the development.
Floodplain
A portion of the property is located within the floodplain district. The FEMA Floodplain map
designates the area around the private ditch on the site as a "Zone A" area A ith the regulatory
floodplain elevation of approximately 930 - 931. It is likely that the proposed site grading will
impact the floodplain and the applicant will need to work with the City Water Resources
Engineer during the permit process to mitigate any proposed impacts.
Grading/Drainage
There is a private ditch that runs through the site. The groundwater within the site has the
potential to be relatively high which will require that additional analysis to be completed before
finalizing the grading plan and low -floor elevations.
Ponding for water quality and rate control will be required on site in compliance with City
standards. In addition, the applicant has indicated that the stormwater ponds will be used for
irrigation through a water reuse system.

Sanitary Sewer
The site is divided into two separate sewer districts in the City's Comprehensive Sanitary- Sewer
Plan. Sanitary sewer service is available for the southerly portion of the site by direct connection
to the existing systems within 130th Street and the Beaver Ponds development. The northerly
portion of the site can be served by the existing systems west, north and cast of the site.
The existing 130th Street lift station will serve a portion of the site. The lift station was
constructed and financed by the developer of the Beaver Ponds Development. All fees for the
list station have been satisfied.
Water
Municipal water service is available by connecting to the existing systems along the north, south,
and west sides of the site. The development of this site will provide an opportunity to complete
an additional north -south trunk loop as outlined in the City's Comprehensive Water Supply Plan.
Streets/Access
The applicant is proposing two access Iocations onto 130th Street on the south and connections to
135th Street to the east, Flay Avenue to the north, and 1371h Street on the west. There will be a
need for a traffic analysis so that the intersections and roadways can be evaluated in light of the
anticipated increase in traffic. The applicant should show how access could be made to the
property to the east, south of 135th Street (Atkinson Property).
The property is located within the northeast quadrant of the Highway 61 and 130th Street
intersection. The intersection is signalized, and the signal/intersection was designed assuming the
development of this property. Staff does not expect improvements to the intersection itself as a
result of the proposed development.
A long-range plan was developed in 2008 for Highway 61 that includes the following for
Highway 61:
• Four -lane divided roadway
• An additional 40 feet of right-of-way required within the development property.
• Full access at 137th Street
• Right-in/right-out access at 134th Street
As the development proceeds, improvements to Highway 61 may be required based on the
anticipated traffic. Potential improvements may include the addition of turn lanes on Highway 61
or improvements to existing intersections, and would be based on the information in the traffic
study and input from MnDOT.
If the proposed development moves forward, nearly all of the roadway segment between
Highway 61 and Goodview Avenue will be developed on the north and south sides. 130th Street
is currently a two-lane, rural section roadway. Staff recommends that the City Council and
Commissions discuss the possible upgrade of 130th Street to an urban -section collector between

Highway 61 and Goodview Avenue as outlined in the City's long-range plans. This developer
may be responsible for these improvements.
The applicant is showing a long road connecting the north and south portions of the
development. It's in staff opinion that traffic calming measures should be taken into
consideration on the proposed long roadway. The goal of traffic calming is to reduce speeds,
reduce cut through traffic, and improve safety including non -motorized traffic. Although, the
applicant has designed the road with slight curves, the roadway will need to be further analyzed
in regards to creating turns within the roadway and the access to home sites directly off the
roadway.
Park and Trails
The Master Park Plan indicates a public park in this area. The City owns 18 -acres of land,
consisting of some wetlands, on the west side of the site, which is adjacent to the parkland
proposed by the applicant. The outlot is not included in the parkland dedication calculation.
The applicant is showing a large public park area on the plan central to the development with
trail connections to provide access to the park. The park area is 10.2 acres excluding the wetlands
and easement areas. The proposed park includes passive areas, as well as, a playground, shelter,
soccer field, and potential playfield. It's unclear what would be included in the playfield and it
seems disconnected from the rest of the active park area. The applicant may consider relocating
the playfield area to be accessible from the active park area in order to be considered for parkland
dedication. The applicant has done a good job in locating the park in a central area for access not
only for this proposed development, but existing adjacent neighborhoods.
Trails and sidewalks are strongly encouraged throughout the development to provide access to
parks and other recreation. Sidewalks along City streets are required in developments with lot
widths less than 80 feet. The applicant is showing a trail system that connects the residential
areas to the park, as well as, to the adjacent neighborhoods and other nearby parks. The trail
system is shown to provide a recreational experience that takes advantage of the view sheds of
the natural areas.
There is a trail shown along the north side of 130' Street in the City's Trails Plan. With the
reconstruction of 130th Street, this should be included in the plans. This would make connections
to future trails including the Hardwood Creek Regional Trail and trail along Goodview Avenue.
The applicant would like the City Council and Commissions to consider allowing the developer
to use and make improvements to a portion of the existing 18 -acre outlot for a passive park area,
additional trails, and for a stromwater pond. The outlot was deeded to the City for public
purpose/use. In discussions with the City Attorney, the proposed use would be allowed and can
be considered. Staff is generally comfortable with the proposed use of the outlot. The City
Council and Commissions should discuss the proposed use and provide feedback to the
developer.
Park dedication is proposed to be a combination of land dedication and fee. The park dedication
section of the City Code requires the applicant is dedicate 10% of the developable acres for park

land. The applicant has indicated that there are 121 acres of developable land, therefore, would
be required to dedicate 12.1 acres of park land. The applicant is showing (per a revised park land
calculation) 10.2 acres of park land, excluding wetlands and easements. In this case the applicant
would have 1.9 acres remaining to meet the required land dedication, which is 15.7% of the
requirement. In this case a fee could considered by the Park Commission for the remaining
15.7% and is calculated at $111,533 {296 units * (15.7% * $2,400).
The Parks Commission re,6ewed this item at their July 13th meeting.
Landscaping
The applicant is showing a general landscape plan for the development. More detail will be
required with the preliminary plat. The applicant is showing landscaped main entrances into the
development and landscaped streets. The site includes a few significant stands of mature trees
that the applicant is proposing to preserve with the development. The applicant is also providing
landscape and tree -lined buffers between the proposed lots and the existing neighborhoods.
The plan shows a landscape and pond buffer along Highway 61 from the Villa Homes. The plan
also shows a landscape buffer along 130' Street. Both of these areas should include dense
landscaping, possibly a berm, and the buffer areas may need to be increased.
6. CONCLUSION/RECOMMENDATION:
The applicant is proposing a creative and efficient use of the property, while reducing impacts to
the natural features of the site. The applicant has done a good job with the development layout
and proposed added amenities. The plan meets the intent of the comprehensive plan in regards to
land use, parks, and transportation.
Staff recommends the City Council provide feedback to the applicant on the following:
1. Proposed lot size and lot width
2. Proposed use of City 18 -acre outlot
3. 130"' Street improvements to an urban section road
4. Proposed long roadway connecting the north and south portions of the site
5. Proposed landscape buffers along Highway 61 and 13011' Street

PROJECT NARRATIVE
June 13, 2016
Nestled among wetlands, Terre De L'Eau demonstrates an appreciation for the natural environment.
Preservation of the wetland system enhances connections with nature. The extensive trail system
meanders organically throughout the site allowing one to appreciate the open views and wildlife.
Both street and trail connections are created to neighbors, to nature and to the surrounding community.
Trails lead to the centrally located park which is a gathering space for families to picnic, kids to play or
individuals to simply enjoy nature. Curved streets follow the edges of wetlands and ponds to create a
design where a majority of the homes back to open space.
A variety of lot sizes craft a community for those at different life stages and income levels. Home styles
will attract first time homebuyers, families with children as well as empty nesters.
LOCATION
The site is located at the northeast intersection of CSAH 61 and 130`h Street North.
GENERAL DESCRIPTION OF REQUEST
Prior to preparing the Preliminary Plat, a Sketch Plan review is requested for this 200 -acre Planned Unit
Development of nearly 300 housing units with a mix of lot sizes. 45', 50', 65', 70' and go' widths.
The PUD is a tool that will allow flexibility from the R-3 District standards to create a better overall
design that introduces a mix of product styles for first time homebuyers, families and empty nesters.
Further, it will create much needed connections to open and play spaces for the surrounding community.
HOUSING
The variety of lot sizes allow for a variety of home styles to meet the needs of many different buyers.
The 45' wide lots are planned for Villas which offer main level living with association maintained
grounds mostly geared toward empty nesters. The 5o' wide lots could be similar one level living with
grounds maintenance or smaller lots ideally geared toward first time homebuyers. The remaining lot
sizes would offer different home styles to meet the needs of buyers at different price points. In all, there
will be about five different home series.
STREETS. SIDEWALKS & LANDSCAPING
There are number of access points to the site, which also creates connections to the surrounding
community. The curved tree -lined streets will help to calm traffic is this pedestrian friendly
neighborhood. The street design allows for many of the homes to not directly back another home
creating many premium lots with wetland, open space or park views.
While the site is generally open, there are a few stands of trees intended to be preserved. Most notably,
the easterly entrance along 130`x' where the road is split around the trees to create a more dramatic
entry. in the Villa (45' lot) area, the trees create a neighborhood green which becomes the focal point of
this sub -neighborhood. Other existing treed areas will be reviewed for preservation where possible.
TDL Concept - Narrative
Landscaping will be reviewed in more detail during the platting process. However, extensive landscaping
is planned along 130`" Street and Highway 61. A large monument at the main intersection will create
identity for the neighborhood as will other features throughout, including an overlook area and pocket
green spaces.
WETLANDS
A wetland delineation has been completed and approved in 2015. Generally, the site layout protects the
approximately 70 acres of wetlands. There are a couple smaller incidental wetlands that may be
impacted, but the larger ones are amenities creating vista views and spaces for trails to meander
through.
The existing ditch through the site is intended to be enhanced to become a site amenity, similar to a
small creek or brook.
PONDING
Due to the groundwater levels, the site needs to be raised. As a result, ponds will be created to not only
generate material to raise the building sites, but to also manage storm water. Additionally, the ponds
will be used for irrigation to meet water reuse and infiltration requirements.
PARKS
We are requesting the adjacent city outlot be incorporated into the site design. The outlot will be used
for ponding and passive open space. This will allow for a more contiguous useable public park,
anticipated to be nearly 15 acres with a soccer field, shelter/picnic area and playground. Trails provide
connections for the adjacent neighborhoods to access the park. We will work with the City in calculating
parkland vs cash dedication. in all, the site proposes nearly 65 acres of park, open space, ponding,
wetland buffer and wooded area.
CONSTRUCTION SCHEDULE
Following Sketch Plan review, the preliminary plat will be advanced along with the Environmental
Assessment Worksheet (EAW). The goal is to begin grading the south portion of the site as early as Fall
2o16. Utility and street construction for the 15t phase of development would follow in Spring 2017.

Arcand Property—Terre de Lreau

Dear Ms. Juba:
We have reviewed the concept plan for the proposed Terre de L'eau Development located on the Arcand
property at the intersection of Highway 61 and 130th Street. Our review is based on Sketch Plan #4 submitted
by the Excelsior Group and received by the City on May 25, 2016. We will provide a more in-depth review of
this project once detailed plans are provided by the applicant.
Based on our review, we offer the following comments regarding the concept plan:
Grading and_Drainaee
Wetlands: A wetland delineation was performed on October 14, 2014. The site contains approximately
35 acres of Type 1/3/6 wetlands as well as DNR Public Water 82-260W. The site was reviewed on
Thursday, May 14, 2015, by the Technical Evaluation Panel (TEP), and there were modifications made to
the wetland boundaries. The applicant will need to continue to work with the TEP and the City Water
Resources Engineer as the project moves forward to obtain the necessary permit(s) related to the
wetland delineation, sequencing, and mitigation within the site.
2. Site Grading;/Low-floor Elevations: The site is relatively flat, and is bordered by 137th Street on the north,
130th Street on the south, Country Ponds Development and TH 61 on the west, and Birch Tree Ponds
Development and other private large -tract parcels on the east. A private lateral ditch discharges through
the center of the site from south to north and ultimately discharges under TH 61 and into the Branch 2 of
JD 3. The groundwater within the site has the potential to be relatively shallow which will require that
additional analysis be completed before finalizing the grading plan and low -floor elevations.
3. Floodplain Impacts: The FEMA Flood Insurance Study designates the area around the private ditch on-
site as a "Zone A" area with the regulatory floodplain elevation of approximately 930-931. The site
grading within the property will likely have an impact on the FEMA regulatory floodplain. In addition,
Rice Creek Watershed District rules require that floodplain impacts be mitigated through compensatory
storage. The applicant will need to work with the City Water Resources Engineer during the permit
process to determine if there is a need to modify the FEMA floodplain and/or provide compensatory
storage for floodplain filling.

4. Storm Water Management: The applicant will need to obtain a permit from the City for their Storm
Water Management Plan within the site, including the appropriate storage, rate control, treatment, and
volume reduction. The prevailing soil and groundwater conditions, along with the fact that the site is
within a High -Vulnerability Drinking Water Supply Management Area (DWSMA), will discourage the use
of standard infiltration as a volume -reduction strategy. There is a high likelihood that the site can
support water reuse, and this should be explored in greater detail moving forward.
Transportation/Traffic
1. Highway 61/1301h Street Intersection: The property is located within the northeast quadrant of the
Highway 61/13 01h Street intersection. The intersection is signalized, and the signal/intersection was
designed assuming the development of this property. We do not expect any need for further
improvements to the intersection itself as a result of the proposed development; however, there will be
a need for a traffic analysis so that the intersection and other intersections/roadways can be evaluated in
light of the anticipated increase in traffic.
2. 130th Street: 1301h Street is currently a two-lane, rural -section roadway beyond the intersection with
Highway 61. If the proposed development moves forward, nearly all of the roadway segment between
Highway 61 and Goodview Avenue will be developed on the north and south sides. With this in mind,
there should be a discussion about the upgrade of 130th Street to an urban -section collector between
Highway 61 and Goodview Avenue as outlined in the City's Comprehensive Plan, including right-of-way
needs. Improvements to 130h Street are included in the City s Capital Improvement Plan, and 1301h
Street is part of the City's State -aid roadway network.
3. Roadway Connections: As we review the roadway connections within the area, there are a number of
current roadways that will be connected to the proposed development that were anticipated when
previous development occurred. This will result in changes to traffic volumes on roadways within the
adjacent neighborhoods, which will be reviewed as part of the traffic study.
4. Highway 61: The long-range plan for Highway 61, completed in 2005, includes the following for Highway
61 adjacent to the proposed development:
o Four -lane divided roadway
• 150 feet of total right-of-way width, with an additional 40 feet required within the development
property
• Full access at 137th Street
• Right-in/right-out access at 134th Street
As the development proceeds, improvements on Highway 61 may be required based on anticipated
traffic. Potential improvements would include the addition of turn lanes on Highway 61 or
improvements to existing intersections, and would be based on the anticipated traffic and input from
MnDOT.
Sanitary Sewer Service
City Sewer Districts: The site is divided into two separate sewer districts in the City's Comprehensive
Sanitary Sewer Plan. Sanitary sewer service is available for the southerly portion of the site by direct
connection to the existing systems within 130th Street and the Beaver Ponds Development. The
northerly portion of the site can be served by the existing systems west, north, and east of the site. We

have attached a copy of a letter from March 9, 2011, that contains additional information regarding
sanitary sewer service to the property.
Water Service
1. Trunk Watermain Improvements: Water service is available by connecting to the existing systems along
the north, south, and west sides of the site. The development as proposed will provide an opportunity to
complete additional trunk loops as outlined in the City's Comprehensive Water Supply Plan.

As you requested, we have reviewed the Arcand Property with respect to sanitary sewer service
in accordance with the City's Comprehensive Sanitary Sewer Plan. It is estimated that
approximately one third of the Arcand Property can be served by the gravity sewer, if the sewer
was extended from the 130th StreetrM 61 intersection. The sewer flows from the remaining two
thirds of the parcel and will need to be directed to a lift station prior to entering the gravity sewer
within Subdistrict E3.
Please find the attached figure that details the portion of the Anand Property as it relates to the
City's Comprehensive Sanitary Sewer Plan. The above referenced property is located at the
northeast corner of the 130'' Street North and Trunk Highway 61 mtersection and is within the
City's Sewer Subdistrict E4. As shown, a portion of the property is in Sanitary Sewer Subdistrict
E4, which was planned to be served via Subdistrict E3, and eventually outletting to the MC:ES
Interceptor sewer.
We preliminarily evaluated the existing elevations within the Arcand Property and the existing
elevations of the sanitary sewer within Subdnstrict E3. Sewer flows from Subdistrict E4 can
either be direc--ted to the gravity sewer within Subdistrict E3 or to Lift Station No. 4 located
within the eastern portion of Subdistrict F,3, depending on the final grading plan of the Arcand
Property. The attached figure also details the approximate areas to be served by gravity sewer
versus a lift station. However. during site phasing, it is recommended that as site elevations are
finalized and the feasibility of gravity sewer be evaluated in greater detail.

In the June 9, 2016 publication of The Citizen, the article "Bullish on Hugo" discussed a concept plan to
develop 296 units of housing on Highway fit and 130th. As a resident of both Hugo and the Fable Hill
neighborhood, I am very concerned about any development east of Fable Hill that will contribute to
increased motor vehicle traffic through this neighborhood as commuters and, in some cases trucks and
other service vehicles, find their way to and from 1-36 E and surrounding neighborhoods.
In my opinion, the roads through Fable Hill were designed to meet the Met Council's definition al "Local
Streets", as found in Appendix D of the Met Council's Regional 2030 Transportation Policy Plan.

Current utilization clearly shows that is not the case. Fable Hill Parkway North and Fable Hill Way North
are being used as "Collector Streets'. The additional traffic from any commercial, industrial, or residential
development that will flow through Fable Hill will result in very significant safety concerns for drivers and
local residents, deterioration of the roadways, and congestion.
In Chapter 8 'Transportation" of Hugo's Comprehensive Plan, it is clear that the city recognises this
problem. I Urge you take this situation into consideration not only for this development plan but any plan
that would involve new property development to the east of Fable Hill. A well designed east - west
collector street between Otter Lake Road and Fenway Ave. No, needs to be in place or traffic must be
routed to Frenchman Road in order to maintain or Improve our Hugo neighborhoods in this area. Hugo is a
wonderful place to live and we need to carefully consider how to support new development that will not
negatively Impact existing residential and commercial properties.
