i <br /> CITY OF HUGO <br /> WASHINGTON COUNTY,MINNESOTA <br /> RESOLUTION 2016-14 <br /> APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR <br /> VICTOR GARDENS NORTH VILLAGE 7TH ADDITION ON PROPERTY <br /> LOCATED NORTH OF ROSEMARY WAY AND EAST OF ELMCREST <br /> AVENUE NORTH. <br /> WHEREAS, Kettler Construction, Inc. has requested approval of a final plat for "Victor <br /> Gardens North Village 7h Addition" to allow the construction of 33 townhome units on <br /> the 8.51-acre property legally described as follows: <br /> E <br /> Outlot A and Outlot B, Victor Gardens North Village P Addition, <br /> according to the recorded plat thereof, Washington County, Minnesota. <br /> I <br /> i <br /> WHEREAS,the Planning Commission has reviewed the preliminary plat and PUD at a <br /> duly called public hearing and recommended approval of the preliminary plat and PUD; <br /> and <br /> WHEREAS,the City Council approved the preliminary plat and PUD at its meeting on <br /> May 16,2016. <br /> WHEREAS, the City has prepared a development agreement covering the improvements t <br /> related to said plat; <br /> NOW,THEREFORE,BE IT HEREBY RESOVLED BY THE CITY COUNCIL OF <br /> THE CITY OF HUGO,MINNESOTA,that it should and hereby does approve the <br /> request by Kettler Construction,for a final plat, subject to the following conditions: <br /> 1. A final plat is approved to allow construction of 33 townhome units, in accordance <br /> with the overall grading and utility plans dated April 18, 2016, and the final plat <br /> graphics dated May 12,2016,except as amended by this resolution. ! <br /> I <br /> 2. The final plat shall be subject to and the development shall substantially comply with j <br /> all plans and conditions of the PUD Amendment and Preliminary Plat approvals <br /> (Resolutions # 2016-8 and #2016-9) granted by the City Council on May 16, 2016, <br /> except as amended by this resolution. <br /> 3. The final plat shall be subject to the Victor Gardens PUD concept approvals <br /> (Resolution #2000-47) and Victor Gardens North PUD approvals (Resolutions <br /> #2005-05 and#2005-06), except as amended. <br /> 4. The developer must comply with all of the conditions outlined in the City Engineer's <br /> memo dated April 21,2016 and June 2,2016. <br />
