RESOLUTION 2016-14
APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR
VICTOR GARDENS NORTH VILLAGE 7TH ADDITION ON PROPERTY
LOCATED NORTH OF ROSEMARY WAY AND EAST OF ELMCREST
AVENUE NORTH.
WHEREAS, Kettler Construction, Inc. has requested approval of a final plat for "Victor
Gardens North Village 7h Addition" to allow the construction of 33 townhome units on
the 8.51-acre property legally described as follows:

Outlot A and Outlot B, Victor Gardens North Village P Addition,
according to the recorded plat thereof, Washington County, Minnesota.

WHEREAS,the Planning Commission has reviewed the preliminary plat and PUD at a
duly called public hearing and recommended approval of the preliminary plat and PUD;
and
WHEREAS,the City Council approved the preliminary plat and PUD at its meeting on
May 16,2016.
WHEREAS, the City has prepared a development agreement covering the improvements t
related to said plat;
NOW,THEREFORE,BE IT HEREBY RESOVLED BY THE CITY COUNCIL OF
THE CITY OF HUGO,MINNESOTA,that it should and hereby does approve the
request by Kettler Construction,for a final plat, subject to the following conditions:
1. A final plat is approved to allow construction of 33 townhome units, in accordance
with the overall grading and utility plans dated April 18, 2016, and the final plat
graphics dated May 12,2016,except as amended by this resolution. !

2. The final plat shall be subject to and the development shall substantially comply with j
all plans and conditions of the PUD Amendment and Preliminary Plat approvals
(Resolutions # 2016-8 and #2016-9) granted by the City Council on May 16, 2016,
except as amended by this resolution.
3. The final plat shall be subject to the Victor Gardens PUD concept approvals
(Resolution #2000-47) and Victor Gardens North PUD approvals (Resolutions
#2005-05 and#2005-06), except as amended.
4. The developer must comply with all of the conditions outlined in the City Engineer's
memo dated April 21,2016 and June 2,2016.

5. Park dedication requirements for this site have been met with previous additions. No
additional park dedication is required for this phase.
6. The proposed future trail along Elmcrest Avenue shall be constructed and paid for by
the developer.
7. Outlot A shall be owned and maintained by the homes owners association.
8. Private driveways in front of the townhome garages shall be a minimum of 22 feet
long to accommodate parking.
9. The developer shall create, or join, a Home Owners Association (HOA) for the
purposes of maintenance of items within the common areas (Outlot A). These items
include, streets,landscaping,exteriors,and stormwater utilities.
10.All platted townhome lots shall comply with the following setbacks:
Minimum front yard setback from private street 20 feet
Minimum setback between buildings 10 feet
Minimum setback around the perimeter of the 25 feet
site
Minimum setback around the perimeter of the 20 feet
site(Rosemary Way)
11.Prior to recording of the final plat,the applicant must comply with the following
conditions:

Architecture
a. The elevations for the patio homes and twinhomes shall be revised to provide
architectural elements used on the front elevation(such as brick or stone, shutters,
etc)continued on all elevations. Staff shall review and approve the elevations.
b. All building elevations shall receive nearly equal treatment and visual qualities.
c. The developer shall submit a design palette (including material samples) for the
entire project for City review and approval. The palette shall include colors for
siding, shakes, shutters, shingles, brick, and stone. Building colors and materials
shall be harmonious throughout the development.
d. No adjacent home shall have the same front elevation or colors. Materials shall
be consistent with the architectural plans and design palette to be reviewed and
approved by City staff.
e. The plans must be revised to clearly identify how the mechanical equipment for
the townhomes will be screened.

f. No development signage is proposed or approved. If signage is proposed at a later
date it shall be reviewed and approved by the City and a sign permit shall be
issued. The sign shall be consistent with the development and the located shall be
reviewed and approved by staff.
Landscaping
g. The developer shall revise the landscape plan to:
1) Show the proposed 33 units.
2) Indicate what trees on the north side of the property will be preserved.
3) Add additional landscape buffer on north property line.
4) Show the foundation planting for all home products.
Miscellaneous
h. The developer must obtain all necessary stormwater management and WCA
permits from the City.
i. The developer shall enter into a development agreement, shall agree to complete
all improvements,and pay all fees required by the development.
j. Staff will continue to work with the developer on the street lighting plan. Exact
locations and light type shall be reviewed and approved by staff prior to
installation.
k. The developer shall provide copies of the development covenants/HOA
documents for City review. A copy of the covenants/HOA documents shall be
filed with the final plat.
11. Prior to issuance of building permits, the applicant must comply with the
following conditions:
a. The developer shall record the final plat, development agreement, and all
associated documents with Washington County. Proof of recording shall be
provided to the City.
b. The developer shall submit three full sets of the final plans to the City.
c. The developer's architectural control committee (ARC) shall review and approve
all building designs for compliance with this resolution, prior to building permit
submittal. A written copy of the ARC approval shall be submitted with the
building permit application for each building. The City shall review the building

architecture for compliance with the approved plans prior to issuance of building
permits.
d. The developer shall obtain all necessary local, state,and federal permits.
8. Prior to issuance of a certificate of occupancy for the first building,the applicant
must comply with the following conditions:
a. The landscape buffer around the perimeter of the site shall be fully installed.
b. The hail along Elmcrest Avenue shall be constructed.
