RESOLUTION 2016-35 <br /> APPROVING A MINOR SUBDIVISION FOR THE PROPERTIES GENERALLY <br /> LOCATED NORTH OF 140TH STREET NORTH AND WEST OF KEYSTONE <br /> AVENUE <br /> WHEREAS, an application has been filed by Brigg Backer, 9052 1401h Street North, that <br /> requests approval of a minor subdivision for properties generally located north of 140th <br /> Street North and west of Keystone Avenue. <br /> WHEREAS, the subject properties are legally described as follows: <br /> (See Attached) <br /> WHEREAS, the Planning Commission has considered said request on October 13, 2016, <br /> and recommends approval, and; <br /> NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br /> THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the minor <br /> subdivision for Brigg Backer, subject to the following conditions: <br /> 1. A minor subdivision is approved to allow the creation of a 14.48 acre parcel, a 20 <br /> acre parcel, and an 18.20 acre parcel in accordance with the plans and application <br /> received by the City on September 1, 2016, September 12, 2016, September 15, 2016, <br /> and September 19, 2016. <br /> 2. The property is subject to the development standards of the Agricultural (AG) zoning <br /> district. <br /> 3. Prior to recording the minor subdivision: <br /> a. The park dedication shall be cash-in-lieu of dedication for a total of <br /> $2,400. <br /> b. All required drainage and utility easements shall be dedicated to the City <br /> over existing wetlands on all parcels. <br /> c. A 33 foot wide roadway easement shall be dedicated to the City along <br /> 140th Street North. <br /> d. The conditional use permit for the shared driveway shall be recorded at <br /> Washington County. <br /> 4. Prior to issuance of any building permit: <br /> a. A septic permit shall be issued by Washington County. <br /> b. The applicant shall provide a grading plan that reflects the current <br /> topography and proposed grading. <br /> c. The applicant shall demonstrate the building sites will comply with the <br /> City's regulations regarding building elevation related to groundwater and <br /> floodplain. <br /> i <br />
