HomeMy WebLinkAbout2015.01.06 CC PowerPoint Bellamy CUPConditional Use Permit Cindy Bellamy and Shirley Smith 17260 Ingersoll Avenue North City Council Meeting Monday, January 6, 2015 HCity of ugo Description of Request •The applicant is requesting approval of a conditional use permit (CUP) to allow double the amount of animal units allowed on property. •The number of animal units allowed on the property is determined by lots size. •The applicant is requesting to have 14 horses on the property, where 7 is allowed by ordinance. •The ordinance allows double the amount of animal units, with a CUP and an approved facilities and waste management plan. 12-15-14 City Council Meeting • Staff recommended approval of application, subject to the conditions listed in the CUP. • PC recommended approval of application, with a revision to the CUP. •The City Council discussed the application and tabled the request. • There were four items the City Council asked staff to work with the applicant on and to evaluate. Update 1. Work with the applicant on reducing the number of horses • The applicant would like continue to request 14 horses. • The CUP does not let breeding to occur until the number of horses is less than 14. • The applicant stating she plans on reducing the amount, but would like room for breeding. 2. Evaluate the elevations of the paddocks • 12-18-15 site visit to evaluate paddock elevation due to manure pile-up. • All the lots, with exception to Lot E, were close to the same grade as the concrete pad of the pole barn. Update, cont. 3. Work with the applicant on manure application and removal • Conditions #8 and #111 state that manure from Lot E shall be removed from the property. • Condition #51 states that the management plan shall be followed. The plan allows for a portion to be spread on the property. 4. Evaluate culvert location • Conditions #8 and #9 requires Lot E to be graded and the culvert relocated by June 1, 2015. • At that time, it can be determined if the culvert location needs to be revised or needed at all. CUP Application Request • Land Use Application • City Code has standards that need to be met for approval. • The City's discretion in approving or denying a CUP is limited to whether it meets the standards. • If it meets the standards the City must approve the CUP. Options • Approve the CUP application request, with the conditions listed in the CUP. • Approve the CUP application request, with modifications to the conditions listed in the CUP. • Deny the CUP application request, • Shall be based on the standards for approval of a CUP. CUP Criteria *Permissible by Law •The ordinance allows double the amount of animal units, with a CUP and approval of a facilities and waste management plan. *Spirit and Intent •The spirit and intent of the Livestock ordinance is to allow animals on properties in the Agricultural and Rural Residential zoning district based on the number of acres of a property. •The ordinance allows up to double the animal unit density by CUP subJ'ect to an approved facility management and waste -handling plan. •The applicant has applied for CUP and has submitted a facility and waste management plan that is acceptable to the staff. • It is in staff's opinion that that the use meets the spirit and intent of the ordinance. CUP Criteria, cont. • Compatible with Comprehensive Plan and Character of the Area • The Comprehensive Plan guides this property as Agricultural and anticipates agricultural activities to occur in this area. • The character of the area is comprised of large parcels of land, either vacant, occupying single family home and accessory buildings, or occupied with various agricultural uses. • The applicant is requesting 14 horses to be allowed on the property. • The property has a home, accessory buildings, and horses. The proposed use is compatible with the comprehensive plan and is within the character of the area. CUP Criteria, cont • Screening and Buffers • The use is permitted in the Agricultural zoning district. • The use is not required to be screened. • The applicant is requesting additional horses on site.
