HomeMy WebLinkAbout2017.04.17 CC Minutes MINUTES FOR THE CITY COUNCIL MEETING ON MONDAY, APRIL 17, 2017 Call to Order Mayor Weidt called the meeting to order at 7:00 p.m. PRESENT: Haas, Klein, Miron, Petryk, Weidt ABSENT: None ALSO PRESENT: City Administrator Bryan Bear, City Attorney Dave Snyder, City Engineer Mark Erichson, Planner Rachel Juba, and City Clerk Michele Lindau Minutes for the April 3, 2017 City Council Meeting Klein made motion, Miron seconded, to approve the minutes for the April 3, 2017 City Council meeting as presented. All Ayes. Motion carried. Minutes for the April 8, 2017 Good Neighbors Food Shelf Pasta Dinner Klein made motion, Haas seconded, to approve the minutes for the April 8, 2017 Good Neighbors Food Shelf Pasta Dinner as presented. All Ayes. Motion carried. Approval of the Agenda Weidt made motion, Petryk seconded, to approve the agenda as amended by adding a presentation of a Certificate of Appreciation to Sergeant Joe Stoehr and to table action on Adelaide Landing Preliminary Plat and Planned Unit Development. All Ayes. Motion carried. Introduction of New Washington County Sergeant and Investigator At its April 3, 2017 meeting, the Council recognized Sergeant Wayne Johnson's retirement after six years as the sergeant in Hugo. Taking his place is Sergeant Joseph Stoehr who has been with the Washington County Sheriff's Office for the past 12 years, working his first six years as a deputy in Hugo. Also, included in the 2017 budget, Council approved the position of a Washington County investigator in Hugo. Selected to fill this position is Deputy Joe Zerwas. Washington County Patrol Commander Brian Mueller introduced them to the Council. Stoehr and Zerwas provided a brief background on their time with the Sheriff s Office. The Council welcomed them to Hugo. Hugo City Council Meeting Minutes for April 17,2017 Page 2 of 9 Presentation of Certificate of Appreciation to Sergeant Joe Stoehr Councilman Haas spoke about the suicide rate of veterans, and he introduced Captain Troy Davidson of the Minnesota National Guard's resilience, risk reduction and suicide prevention team who talked about the National Guards' suicide prevention efforts. Haas recognized Sergeant Joe Stoehr, who was recently involved in an incident with a suicidal veteran who was committing an unlawful act. Stoehr had pressure from others to take the gentleman to jail, but was he was able to understand and verify the circumstances. Stoehr took a different course of action by sending him to the hospital and not the prison system. A Certificate of Appreciation was presented to Joe for his intervention on behalf of a veteran in crisis. Recognition of Retirement of Sheriff Hutton In January 2007, Sheriff William Hutton had been sworn in as the sheriff of the Washington County Sheriff s Office. Since then, the City of Hugo has had a close working relationship with his department. Sheriff Hutton retired effective April 30, 2017 and the Council presented him a plaque recognizing his over ten years of service to the City of Hugo. The Council thanked Hutton for his innovation and creativity, and for everything he has done for Hugo by creating a proactive policing system. The Council recessed for a short break. Approval of Claims Adoption of the Consent Agenda approved the Claims Roster as presented. Hugo City Council Meeting Minutes for April 17,2017 Page 3 of 9 Approve Temporary Lipuor License for the Hugo Lions Club for Good Neighbor Days Event June 8-11, 2017 The Hugo Lions Club had applied for a Temporary On-Sale Liquor License to serve beer and Bloody Marys at the Hugo Good Neighbors Day event on June 8-11, 2017. Staff had received the application fee and a Certificate of Liability Insurance for liquor naming the City as additionally insured. Adoption of the Consent Agenda approved the Temporary On-Sale Liquor License for the Lions Club for the Hugo Good Neighbors Days event. Approve Resignation of Hugo Firefighter Matt Richardson Hugo Firefighter Matt Richardson had submitted his resignation from the Hugo Fire Department. Adoption of the Consent Agenda approved the resignation of Matt effective April 30, 2017. Approve Renewal of 2 a.m. Lipuor License Sal's Angus Grill Sal's Angus Grill, 12010 Keystone Avenue North, had submitted their renewal of a 2 a.m. Liquor License, which allows them to serve alcohol until 2 a.m. by State Statute. Hugo City Code had adopted state law regarding the hours of sale but still must approve the 2 a.m. closing time. Adoption of the Consent Agenda approved the 2 a.m. Liquor License for Sal's Angus Grill. Approve Hiring of Marty Schwartz, Scott Marschke, James Magill, Hunter Natterstad, Kraig Pettee as Public Works Seasonal Summer Employees At its January 3, 2017 meeting, Council approved the advertisement for seasonal employees in the Hugo Public Works Department. Employees in this positon would assist in maintaining the City's park system, building grounds, road patching, and other work as needed. Adoption of the Consent Agenda approved the hiring of Marty Schwartz, Scott Marschke, James Magill, Hunter Natterstad, and Kraig Pettee as Public Works Seasonal Summer Employees for 2017. Approve Tobacco License for Ksiall Company, dba MGM Wine and Spirits of Hugo Ksiall Company, dba MGM Wine & Spirits of Hugo, had applied for a Tobacco License for their proposed liquor store at 5441 140th Street North. Ksiall Company successfully completed the background check. Adoption of the Consent Agenda approved the Tobacco License for MGM Wine and Spirits subject to payment of the license fee and approval of the On-Sale Liquor License to be considered later this meeting. Approve Special Event Permit for MGM Grand Opening Event Victor Shevchunk, owner of MGM Wine & Spirits of Hugo, had applied for a special event permit to hold a grand opening at his liquor store on Friday, May 12, 2017. This required a Special Event Permit because they expected over 200 people and there would be amplified music in the parking lot. The applicant had submitted the completed application, application fee, and Hold Harmless Agreement. Adoption of the Consent Agenda approved the Special Event Permit Hugo City Council Meeting Minutes for April 17,2017 Page 4 of 9 for MGM for a grand opening celebration subject to approval of the On-Sale Liquor License to be considered later this meeting. Approve Award of Bid for the North Sunset Lake Area Street Proiect At its March 6, 2017 meeting, the Council approve a resolution approving the plans and specification and ordering the advertisement for bids for the north Sunset Lake area street improvement project. Streets included in this project are: Homestead Avenue, 132nd Street, Homestead Drive, and 126th Street. Bids were received and opened on April 6, 2017. City Engineer Mark Erichson explained there were five competitive bids that ranged from $1,273, 990.06 to $1,376,986.03, with the engineer's estimate being at $1,430,849.75. Erichson recommended Council award the bid to the low bidder, TH Schifsky and Son's. Haas made motion, Klein seconded, to approve the award of bid to TH Schifsky and Son's in the amount of$1,273,990.06. Ayes: Haas, Petryk, Klein, Miron, Weidt. Nays: None Motion carried. Public Hearing on Application for On-Sale Wine and Beer Liguor License R & G Services, LTD dba Red's Savoy Pizza A public hearing was scheduled for this evening to consider the application of R&G Services, LTD, dba Red's Savoy Pizza, for a Wine License and a 3.2% Malt Liquor License with a provision for strong beer. According to City Code, the Council can approve strong beer to be served under this license as long as 60% of sales is from food. Savoy Pizza is located at 14755 Victor Hugo Boulevard, and they are currently adding a 2,000 square foot expansion to include a small bar, tables, and booths in the restaurant area. The applicant had paid the $500 application fee and successfully completed the background check for the liquor license. Staff recommended Council approve the application for Red's Savoy Pizza subject to receipt of the prorated license fee and Certificate of Liability Insurance for liquor. Weidt opened the public hearing. After receiving no comments, Weidt closed the hearing. The Mayor invited Jason Ross, co-owner of Savoys Pizza to the podium. Jason stated Savoys had been in business for seven years and would be providing a selection of domestic and craft beers on tap. The expansion was expected to be completed in approximately six weeks, and they would be hiring an additional six to eight employees. All Ayes. Motion carried. Hugo City Council Meeting Minutes for April 17,2017 Page 5 of 9 Public Hearing on Application for Off Sale Liguor License for Ksiall Company, dba MGM Wine and Spirits of Hugo A public hearing had been scheduled for this evening to consider the application of Ksiall Company, dba MGM Wine & Spirits of Hugo, for an Off-Sale Liquor License to operate a liquor store in the former Rick's Liquor building at 5441 140th Street North. The applicant had submitted the appropriate Certificate of Liability Insurance for liquor,paid the $500 application fee, and successfully completed the background check. Included in the Council packet were written comments from Terry Sager, owner of Sager Liquor located at 14849 Forest Boulevard North, stating his opposition to the issuance of the license due to the number of off-sale liquor stores already in Hugo. Staff recommended Council approve the application for MGM Wine & Spirits of Hugo subject to receipt of the prorated license fee. Victor Shevchuk, 5141 Fairpoint Drive North, said he also has owned the MGM if Forest Lake for the past seven years and has lived in Hugo since 2014. Victor said he plans to open the Hugo store by May 1, 2017. Weidt opened the public hearing. John Arcand, a Forest Lake resident, said his nephew was employed by him, and he supported the liquor store. There were no other comments, and Weidt closed the public hearing. Klein made motion, Miron seconded, to recommend approval of the Liquor License MGM Wine & Spirits in Hugo. Chuck addressed the comments of Terry Sager. He talked about disasters in economy caused by government meddling in private businesses. Haas stated he felt it is the marketplace's role to deciding who the public wants to patronize, and the City has worked to make Hugo a business friendly city. Ayes: Petryk, Haas, Miron, Klein Weidt. Approve Resolution for Issuance of Negative Declaration for an Environmental Impact Statement for Adelaide Landing and Approve Wetland Replacement Plan for Adelaide Landing and Approve Resolution for Preliminary Plat and Planned Unit Development (PUD) for Adelaide Landing Planner Rachel Juba began by informing the Council and audience that she had been contacted by the applicant who requested to remove approval of the preliminary plat and planned unit development from the agenda. The applicant was still looking for approval of the negative declaration for an Environmental Impact Statement and Wetland Replacement Plan. Hugo City Council Meeting Minutes for April 17,2017 Page 6 of 9 Planner Rachel Juba explained the Excelsior Group, LLC, was proposing to develop 216.6 acres of property, consisting of seven parcels, into 319 single family residential lots and ten outlots to be known as "Adelaide Landing". The Planned Unit Development general plan proposed to rezone the property from Single Family Detached Residential(R-3) to Planned Unit Development (PUD), which would allow flexibility on lot sizes and setbacks. The property included wetlands and floodplain for a total buildable acreage of 146.2 acres. Juba explained that the minimum threshold for a mandatory Environmental Assessment Worksheet (EAW)per MN State Statute is 250 units, therefore, an EAW was required. The developer had worked with City staff to prepare an EAW, which is a document that analyzes, at a preliminary level, the effects a development has on the environment in regards to land use, geology, water resources, wildlife, air, noise, and transportation. The EAW had been sent out for public comment with a 30-day comment period, which ended on March 29, 2017. The Planning Commission held a public hearing on the EAW at its March 23, 2017, meeting, and staff drafted responses to all comments on the EAW, which was sent to all the agencies and others who had commented. The EAW identified areas where potential environmental effects exist and appropriate mitigation measure had been incorporated into the project plan. Staff had analyzed the EAW and plan as it relates to State Rules and found the project did not have the potential for significant environmental impacts; therefore, recommended the City Council approve the findings of fact and conclusions and the resolution approving the issuance of a negative declaration for the need of an Environmental Impact Statement (EIS). In addition, the proposed project included a proposal to fill 1.32 acres of wetlands associated with the construction of a single family development. The applicant proposed to purchase wetland bank credits at a 2:1 mitigation ratio in-advance of the proposed wetland impacts. The wetland delineation was approved by City staff in 2014 and 2016. The wetland replacement plan application was deemed complete on March 8, 2017, and public notice was sent on March 25, 2017, with an April 10, 2017, deadline to receive comments. Rachel explained the applicant's response to the public comment received was compared to the proposed plans/application and found satisfactory by City staff in fulfilling the replacement standards under MN Rules 8420. Ben Schmidt, representing the Excelsior Group, was in attendance and he provided price ranges of the homes and spoke about the positive economic impact to local builders. Council asked questions about the ponds, water reuse, street lighting, road easements, and the buffer on the west side of the pond. Juba clarified the buffer was City owned property and could be used for a future trail connection. Mayor Weidt invited the audience to comment. Bob Creager, 5214 141" Street North, said he was concerned about the lot sizes, water overflowing in the ditches, and an increase in taxes. Lisa Berger 5485 134th Street North, stated she was directly affected by the proposed pond, and asked to keep a large buffer because of standing water on their property when it rains. She was also concerned that water would flow into their property when they build the lots up. She talked Hugo City Council Meeting Minutes for April 17,2017 Page 7 of 9 about the wildlife that was not mentioned in the EAW, and she also had concerns about the traffic. Grace LaValle Schostag, 5361 145�h Street North, asked about whether there was enough room for the highway easement. She stated she was sick of paying for parks being maintained by Public Works and wanted police protection and fire protection. She questioned where the stormwater was going and said there would be major problems with traffic and water. Chris Dufresne, 15764 Fenway Avenue North, spoke in favor of the development. He said he has lived in Hugo since 2005, and building homes will bring more people,jobs, and commercial development to Hugo. John Arcand stated he was the former owner of the property. He talked about his background that eventually resulted in the home he grew up in being demolished and property becoming the ownership of the bank and/or his cousin, who had issued a restraining order against him. City Attorney Dave Snyder informed Arcand he should only talk about things germane to the development. Arcand asked for an Environmental Impact Statement (EIS)to be completed. Klein made motion, Haas seconded, to approve RESOLUTION 2017-8 ISSUING A NEGATIVE DECLARATION OF NEED FOR AN ENVIRONMENTAL IMPACT STATEMENT FOR ADELAIDE LANDING. All Ayes. Motion carried. Petryk made motion, Klein seconded, to approve the Wetland Replacement Plan for Adelaide Landing. All Ayes. Motion carried. Miron made motion, Petryk seconded, to postpone action on the Preliminary Plat and PUD until the May 1, 2017, meeting. All Ayes. Motion carried. Update on the Yellow Ribbon Network Council Members Chuck Haas and Phil Klein updated the Council on the activities of the Yellow Ribbon Network to date. Over the past few months, the YRN had been sending packages to troops overseas and have received "thank you"notes. Haas provided some pictures, and he thanked the Hugo Lions Club for the Girl Scout Cookie donations. He talked about the Youth Hunt at Wild Wings on April 9 and thanked Dan Arcand for his donation to the YRN. Next week is Hamburger Night sponsored by Dan Gallatin. Hugo City Council Meeting Minutes for April 17,2017 Page 8 of 9 Severe Weather Awareness Week April 17-21 and Tornado Drill on April 20, 2017 City Administrator Bryan Bear informed Council that Severe Weather Awareness Week is April 17-21. Tornado Drills had been scheduled for Thursday, April 20 2017 at 1:45 p.m. and 6:45 p.m. Comprehensive Plan Open House Workshop on Wednesday, April 19, 2017 City Administrator Bryan Bear reminded Council an open house/workshop had been scheduled for Wednesday, April 19, 2017 at 7 p.m. in the Oneka Room at Hugo City Hall to talk about visioning for the 2040 Comprehensive Plan update. Spring Cleanup Day on Saturday, April 22, 2017 City Administrator Bryan Bear reminded Council the City of Hugo will hold its annual Spring Cleanup event on Saturday, April 22, 2017 at the Hugo Public Works buiding from 8 a.m. to noon. A list of accepted items and pricing could be found on the City's website. Habitat for Humanity Home Dedication Saturday, April 22, 2017 City Administrator Bryan Bear reminded Council a meeting had been scheduled to attend the Twin Cities Habitat for Humanity dedication for four new homes on Saturday, April 22, 2017 at 10 a.m. at 14932 Generation Avenue North. Community Blood Drive Tuesday, April 25, 2017 City Administrator Bryan Bear informed Council the American Red Cross will hold a Community Blood Drive at the Hugo Fire Station on Tuesday, April 25, 2017 from 2:30-7:30 p.m. Kidz `n Biz Saturday, April 29, 2017 City Administrator Bryan Bear reminded Council a meeting had been scheduled to attend the Annual Kidz n'Biz Fest will take place on Saturday, April 29, 2017 at the Oneka Elementary School from 11:00 a.m. to 2:00 p.m. NYFS Leadership Lunch on Wednesday,May 3, 2017 City Administrator Bryan Bear informed Council they were invited to attend the Northeast Youth & Family Services 2017 Leadership Luncheon on Wednesday, May 3 at the Midland Hills Country Club, 2001 Fulham Street in Roseville, from 11:30 — 1 p.m. The Council indicated they were unable to attend.
