HomeMy WebLinkAbout2017.05.01 CC Minutes MINUTES FOR THE CITY COUNCIL MEETING ON MONDAY, MAY 1, 2017 Call to Order Mayor Weidt called the meeting to order at 7:01 p.m. PRESENT: Haas, Klein, Miron, Petryk, Weidt ABSENT: None ALSO PRESENT: City Administrator Bryan Bear, City Attorney Dave Snyder, City Engineer Mark Erichson, Finance Director Ron Otkin, Planner Rachel Juba, Utility Billing Jodie Guareschi, and Accounting Clerk Anna Wobse Moment of Silence for Sergeant Joe Bergeron Mayor Weidt reminded Council of Hugo resident and Maplewood Sergeant Joe Bergeron who was killed in the line of duty seven years ago while responding to a carjacking. The Mayor called for a moment of silence to remember Sergeant Bergeron. April 13, 2017 Local Board of Appeals and Equalization Miron made motion, Klein seconded, to approve the minutes for the Local Board of Appeals and Equalization meeting on April 13, 2017 as presented. All Ayes. Motion carried. April 17, 2017 City Council Meeting Klein made motion, Petryk seconded, to approve the minutes for the City Council meeting on April 17, 2017 as presented. All Ayes. Motion carried. April 19, 2017 Comprehensive Plan Open House Klein made motion, Miron seconded, to approve the minutes for the Comprehensive Plan Open House on April 19, 2017 as presented. All Ayes. Motion carried. April 22, 2017 Homes for Habitat Dedication Miron made motion, Petryk seconded, to approve the minutes for the Homes for Habitat home dedication on April 22, 2017 as amended to correct attendance. Hugo City Council Meeting Minutes for April 17,2017 Page 2 of 7 Approval of the Agenda Weidt made motion, Klein seconded, to approve the agenda as amended by adding scheduling a meeting to attend the Glamos Open House on May 16, 17, or 18'h. All Ayes. Motion carried. Update from Tim Maurer-WBL Schools Director of Community Services & Recreation Tim Mauer, Director of Community Services & Recreation for the White Bear Lake Area School District was in attendance to provide information on upcoming events and programs available for preschool, youth, adults, and seniors. Tim stated he has been with the White Bear Lake School District for approximately nine months and was excited to be a part of the changes happening. Presentation of GFOA Award for Excellence in Financial Reporting - Finance Director Ron Otkin and Accounting Clerk Anna Wobse City Administrator Bryan Bear announced that Finance Director Ron Otkin had received notification from the Government Finance Officers Association of the United States and Canada that the Hugo Finance Department has received their 23rd Certificate of Achievement for excellence in financial reporting. This certificate is the highest form of recognition in governmental accounting and financial reporting, and its attainment represents a significant accomplishment by a government and its management. Otkin recognized Billing Clerk Jodie Guareschi for her 15 years of dedicated service, and asked the Mayor to present the Certificate of Achievement to Jodie. The Council congratulated the Finance Department on their accomplishment. Approval of the Consent Agenda Haas made motion, Miron seconded, to approve the following Consent Agenda items. 1. Hugo City Council Meeting Minutes for April 17,2017 Page 3 of 7 Approval of Claims Adoption of the Consent Agenda approved the Claims Roster as presented. Approve Annual Performance Review for Parks Planner Shayla DenawaX On May 11, 2009, the City Council approved the hiring of Shayla Denaway as the Economic Development/Parks Intern, and on May 3, 2010, Council approved promoting Shayla as the new Parks Planner. Adoption of the Consent Agenda approved the annual performance review for Parks Planner Shayla Denaway. Approve Special Event Permit for Blue Heron Grill Tent Party on June 23-24, 2017 The Blue Heron, 14725 Victor Hugo Boulevard, had applied for a Special Event Permit for their annual outdoor tent party to be held on Friday, June 23 and Saturday, June 24. A Special Event Permit approved by Council is necessary because alcohol would be sold outdoors, over 200 people were expected to attend, the event will extend past dark, and there will be amplified music. Adoption of the Consent Agenda approved the Special Event Permit for the Blue Heron Grill Tent Party subject to the conditions in the permit. Approve Renewal of 2 a.m. Closing Time for Blue Heron Grill Blue Heron Grill, Inc., 14725 Victor Hugo Boulevard, had applied for renewal of its 2:00 a.m. closing time license. City staff had reviewed the application and found it to be satisfactorily complete. Adoption of the Consent Agenda approved the renewal of the 2:00 a.m. closing time for the Blue Heron Grill Approval of Use Agreement with the Waters Edte Homeowners Association for Use of Stormwater for Irrigation Purposes. City staff had been working with the homeowners' association at Water's Edge to develop a use agreement for stormwater irrigation from a nearby pond. This project includes the portion of the Water's Edge development south of Evergreen Drive and north of Frenchman Road. The Rice Creek Watershed District and the Metropolitan Council have provided grant funds to assist with the cost of this project. The agreement had been approved and signed by the homeowners' association. Adoption of the Consent Agenda approved the Use Agreement with the Waters Edge Homeowners Association for use of stormwater for irrigation purposes. Approve Resolution Calling for Public Hearing on the Issuance of Revenue Bonds— Minnesota Autism Center Proiect The City of Hugo was asked to consider issuing Tax-Exempt Revenue Bonds, in an amount of no more than $5.1 million, on behalf of the Autism Opportunities Foundation (the "Borrower"), a Minnesota nonprofit corporation doing business as the Minnesota Autism Center. The bond proceeds would be used to finance the acquisition, construction, and equipping of an intensive therapy center for children and adults ages 10 to 21 diagnosed with autism spectrum disorder Hugo City Council Meeting Minutes for April 17,2017 Page 4 of 7 ("ASD"). The project would be located at 2010 Silver Bell Road in Eagan, Minnesota. The Borrower also wanted to amend certain terms of the bonds that were issued by the City of Hugo in 2015 which were used to finance the acquisition, construction, and equipping of an approximately 48,000 square foot two-story school building that serves primarily high school students with ASD. The Borrower had agreed to pay the City of Hugo an issuer's administrative fee of 1/4 of 1% of the principal amount of the bonds in consideration for the City of Hugo acting as issuer. A public hearing on the proposal was scheduled for June 5, 2017. Briggs and Morgan, the City's bond counsel, had reviewed this request and found it to be a proper use of the City's bonding authority. Adoption of the Consent Agenda approved RESOLUTION 2017-9 CALLING FOR A PUBLIC HEARING ON THE ISSUANCE OF REVENUE BONDS AND AUTHORIZING THE PUBLICATION OF A NOTICE OF THE HEARING (MINNESOTA AUTISM CENTER PROJECT). Approve Final Payment to Arnt Construction, Inc. for 147th Street/Oneka Lake Boulevard Street Reconstruction Proiect Arnt Construction, Inc. had submitted the final pay request for work done on the 147�h Street/Oneka Lake reconstruction project. WSB Engineer Mark Erichson and Senior Engineering Technician Steve Duff had reviewed the request and found it satisfactory for work done. Adoption of the Consent Agenda approved the final pay request from Arnt Construction in the amount of$123,171.24. Approve Ordinance for Rezoning, Resolution for Preliminary Plat, and Planned Unit Development (PUD) for Adelaide Landing The Hugo City Council tabled this item at its April 3, 2017 meeting at the request of the applicant. Planner Rachel Juba provided background proposed development explaining Excelsior Group, LLC, had applied for a rezoning of the property to a PUD, approval of a Preliminary Plat and approval of a Planned Unit Development (PUD) for a residential development to consist of 319 single family residential lots and ten outlots to be known as Adelaide Landing. The property totals 216.6 acres, is comprised of seven parcels that include wetlands and floodplain, leaving a total buildable acreage of 146.2 acres. The PUD General Plan proposed the property to be rezoned from Single Family Detached Residential (R-3) to Planned Unit Development (PUD). At its March 23, 2017, meeting, the Planning Commission held a public hearing on the request and recommended Council approve the ordinance to rezone to PUD, resolution for the preliminary plat, and resolution for PUD. Juba stated the plan was the same as the one reviewed at their last meeting. The developer was proposing to use the city-owned property for a pond, landscaping, and trail system. The pond would have a 20 foot buffer and require removal of some trees and brush along the Country Ponds Development parcels. She also talked about the stormwater drainage plan stating the floodplain has been studied and the flood elevation would not increase. Juba addressed traffic concerns within the development and on Highway 61 stating the City continues to have discussions with MnDOT, and 130'h Street will be upgraded to a two-lane urban roadway. Rachel stated that the PUD exceeded the standards for residential development and met the intent of the PUD ordinance Hugo City Council Meeting Minutes for April 17,2017 Page 5 of 7 Haas talked about the traffic on TH61 and hoped Hugo could join other cities, or have Metro Cities look at the impacts to TH61 due to improvements on the interstate, stating this could be addressed in our Comprehensive Plan. Bear stated that conversations with legislators and neighboring communities would be beneficial. Haas also said he understood concerns people had regarding 1301h Street, and he recognized improvements would take time. Miron said he felt the Comprehensive Plan would be a good tool to address improvement to TH61, and he also asked for confirmation from City Engineer Mark Erichson that the development would not cause existing homes to purchase flood insurance. Erichson replied that FEMA had reviewed it, and there would be no increase in the flood stage. Klein made motion, Petryk seconded, to approve ORDINANCE 2017-481 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUGO AMENDING CHAPTER 90 (ZONING ORDINANCE) OF THE CITY CODE TO CLASSIFY CERTAIN LAND LOCATED EAST OF HIGHWAY 61 AND NORTH OF 130TH STREET. Ayes: Haas, Klein, Miron, Petryk, Weidt Nays: None Motion carried. Petryk made motion, Klein seconded, to approve RESOLUTION 2017-10 APPROVING PUD GENERAL PLAN FOR EXCELSIOR GROUP, LLC, FOR "ADELAIDE LANDING" ON PROPERTY LOCATED EAST OF HIGHWAY 61 AND NORTH OF 130TH STREET. Weidt stated there was not public hearing scheduled; however there was a resident who wished to speak. Carol Crosby, 13445 Fiona Avenue North, stated she had lived in her home for 22 years. She said if you walk the property now you will see standing water. She questioned why the pond needed to be so big, and did not want all the trees being removed. She said she had a fence on the City owned property, and there was a hockey rink there. Members of the Council talked about residential use of City owned outlots, and it was now time for this land to be developed. The pond was needed for stormwater and irrigation, and Council discussed the benefits of it. All Ayes on RESOLUTION 2017-10. Ayes: Haas, Klein, Miron, Petryk, Weidt Motion carried. Miron made motion, Klein seconded, to approve RESOLUTION 2017-11 APPROVING PRELIMINARY PLAT FOR THE EXCELSIOR GROUP, LLC, FOR "ADELAIDE LANDING" ON PROPERTY LOCATED EAST OF HIGHWAY 61 AND NORTH OF 130TH STREET. Approve Plans and Specifications, and Authorize Advertisement of Bids for the Water's Edte Stormwater Reuse Proiect City Engineer Mark Erichson provided an update on the Waters Edge Stormwater Stormwater Reuse Project. He reminded Council City they had recently approved the preparation of plans and specifications, and work had been done with the Homeowners Association on a use agreement. The first phase of the project would include the portion of the Water's Edge development south of Evergreen Drive and north of Frenchman Road. He reviewed items in the use agreement and talked about the design, stating the pipe has been oversized to accommodate the next phase of another potential project to the north. The Rice Creek Watershed District and the Metropolitan Council have provided grant funds to assist with the cost of this project. The City's estimated cost is $303,200, which was expected to be reimbursed through fees charged to the HOA. Erichson requested approval of the plans and specifications and authorization to advertise for bids with construction to begin in the fall. Petryk made motion, Klein seconded, to approve the plans and specifications and authorize the advertisement for bids. All Ayes. Motion carried. Update on April 19, 2017 Comprehensive Plan Open House An open house to begin the visioning process on the 2040 Comprehensive Plan update was held on Wednesday, April 19, 2017. Planner Rachel Juba stated that approximately 130 people attended the open house, and the City received many comments. Staff was still receiving input, and there was a survey available on the City's website. Rachel summarized the comments received so far and informed Council of upcoming meetings. The next workshop was scheduled for May 16 with the Urban Land Institute, which is a non-profit research and educational organization that provides advisory services to the public sector free of cost. The Comprehensive Plan will also be discussed at the Planning Commission meeting on June 8, and a public open house was scheduled for June 13, 2017. Miron made motion, Klein seconded, to schedule a meeting for May 16, 2017 at 5 p.m. to attend the City Council/Planning Commission workshop. All Ayes. Motion carried. Hugo City Council Meeting Minutes for April 17,2017 Page 7 of 7 Glamos Wire Products Open House on May 16, 17, and 18th Petryk added this to the agenda to inform Council she had been made aware that Glamos Wire Products will be holding an open house on May 16, 17, and 18. Petryk made motion, Miron seconded, to schedule a meeting to attend the Glamos Wire Open House on May 18 between 3:30 and 5:30 p.m. All Ayes. Motion carried. Update on the Yellow Ribbon Network Council Members Chuck Haas and Phil Klein updated the Council on the recent activities of the Yellow Ribbon Network. Haas showed photos and shared a thank you note from a veteran they had assisted. The YRN will be sending care packages to Europe. The YRN had worked with Michele Larson to have all the veterans from Keystone Place attend the next Burger Night. The last Hamburger Night was hosted by Dan Gallitan, and Haas shared photos and information on those who attended. The YRN nominated Blattner Energy for the Seven Seals Award. Bald Eagle Sportsman Association has an open house on June 3 and will be accepting free-will donations to the Hugo YRN. A Bayport American Legion member donated $800 from a fundraising event and it will be used it to support youths who will be going to the National Guard Youth Camp. An honor flight will be coming back on Saturday, May 6 if anyone would like to attend. Xcel Energy will be sponsoring the next Burger Night. Schedule Annual Performance Review for City Administrator Bryan Bear Bryan Bear has been employed with the City since May 3, 2004. Bryan served as the Community Development Director until being appointed the City Administrator on November, 7, 2011. Bear requested the Council schedule his annual performance review. Weidt made motion, seconded by Klein, to schedule the annual performance review for City Administrator Bryan Bear for May 15, 2017 following the regularly scheduled City Council meeting. All Ayes.
