APPROVING PUD GENERAL PLAN FOR EXCELSIOR GROUP, LLC, FOR
"ADELAIDE LANDING" ON PROPERTY LOCATED EAST OF HIGHWAY 61
AND NORTH OF 130TH STREET
WHEREAS, The Excelsior Group, LLC, has requested approval of a PUD general plan to
allow approximately 319 single family residential lots and 10 outlots on the 216 acre
property legally described as follows:

WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly
called Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by The Excelsior Group. LLC, subject to the following conditions:
1. A PUD general plan is approved to allow the creation of approximately 319 single
family residential lots and 10 outlots. The development shall be constructed in
accordance with the application and plans received by the City on February 6, 2017,
March 10, 2017, March 11, 2017, March 13, 2017, and March 16, 2017, except as
amended by this resolution.
2. Approval is contingent upon City Council approval of the requested rezoning of the
216 acre property and preliminary plat.
3. The PUD general plan is approved based on the finding that the proposed project is
consistent with the City's Comprehensive Plan.
4. The developer shall comply with all conditions in the City Engineer's letter dated
March 17, 2017.
5. PUD flexibility is granted to allow:
a. Flexibility to allow various lot sizes with a minimum lot size of 5,850 square feet,
where 10,400 square feet is required.
b. Flexibility to allow various lot width with a minimum lot width of 45 feet, were
80 feet is required by ordinance.
c. Flexibility to allow a minimum front setback of 20 feet, where 30 feet is required.
d. Flexibility to allow a minimum rear setback of 25 feet, where 30 feet is required.
e. Flexibility to allow a minimum side yard setback of 7.5 feet, where 10 feet is
required.
f. Flexibility to allow a maximum impervious coverage of a lot to be 55%, where
50% is required.

g. Flexibility to allow a minimum right-of-way width of 50 feet, where 60 feet is
required.
6. The preliminary phasing plan is generally approved per plans dated November 29,
2016, revised March 10, 2017. Any major revisions to the phasing plan shall require
PUD amendment. Minor modifications shall be reviewed and approved by staff.
a. Phase 1 shall include:
i. The developer and the City shall enter into an agreement on a cost
sharing formula for the reconstruction of 130th Street.
ii. The developer shall provide one-third of the construction cost in
escrow money to the City or other payment method approved by
the City for the improvements to 130th Street per the cost sharing
agreement.
iii. The developer shall work with the City on the final layout of the
Villa homes on the western portion of the plat.
iv. Park improvements:
1. Grading and seeding within the City owned outlot (Oulot
A, County Ponds) and the area south of the powerline
easement. This shall be completed by and paid for by the
developer.
b. Phase 2 shall include:
i. The developer shall provide one-third of the construction cost in
escrow money to the City or other payment method approved by
the City for the improvements to 130th Street per the cost sharing
agreement.
ii. Park improvements:
1. Grading and seeding on Outlot C, within the area north of
the powerline easement. This shall be completed by and
paid for by the developer.
2. An 8' bituminous trail, boardwalk, and landscaping shall be
installed within all of Outlot C. Final location of the trail
and boardwalk shall be reviewed and approved by staff
prior to installation. This shall be constructed by and paid
for by the developer.
c. Phase 3 shall include:
i. The entire length of 130th Street, from T.H. 61 to Goodview
Avenue, shall be constructed as an urban section roadway to City
street standard, with an 8 foot wide bituminous trail on the north
side, and the first layer of bituminous prior to issuance of a
Certificate of Occupancy for the 1 st building.

1. This improvement shall include increase in the forcemain
size that connects the development to the 130th Street lift
station.
ii. The developer shall provide one-third of the construction cost in
escrow money to the City or other payment method approved by
the City for the improvements to 130th Street per the cost sharing
agreement.
d. Prior to the issuance of a building permit for any lot north of Lot 1, Block
15, the entire length of Street 1 to Street 2 shall be constructed with the
first layer of bituminous. No lots shall be issued a building permit until
they are provided access to 130th Street via Street 1 and 2.
7. The building setbacks and impervious surface coverage requirements for the PUD are
as follows:
8. A stormwater re -use system, as shown in the plans, shall be constructed with the
development. The final plans shall be reviewed and approved by staff. The system
will be installed by the applicant, and owned/operated/maintained by the
homeowner's association. A stormwater reuse agreement shall be reviewed an
approved by staff and recoded at Washington County.
9. The developer has indicated that an HOA will be established for the development to
own/operate/maintain community areas, landscaping, and the water re -use system.
The HOA documents shall be reviewed and approved by staff prior to the recording
of the final plat for the Phase 1.

8. A stormwater re -use system, as shown in the plans, shall be constructed with the
development. The final plans shall be reviewed and approved by staff. The system
will be installed by the applicant, and owned/operated/maintained by the

Landscaping and Lighting
a. The landscape plan shall be revised to include the number, size, and type of trees
and shrubs in each proposed location.
b. The final landscape plans must be submitted for review and approval by staff.
c. The developer shall work with the City on providing a buffer from the pond from
the Country Ponds neighborhood to the west. The buffer shall be reviewed and
approved by City staff.
Signage
d. Final design and location of the entrance monument signage for the development
shall be reviewed and approved by staff.
e. The developer shall enter into an easement agreement for access and maintenance
of the landscaping and signage with in Outlots A, C, D, H, I, and J.
Streets/Access
f. The plans shall be revised to show 130th as an urban section road to street
standards, including the 8 foot bituminous trail on the north side. The final plans
must be submitted for review and approval by staff.
Architecture
g. The developer shall develop and implement architectural review and design
guidelines for all residential buildings. These guidelines shall be consistent with
the draft architectural and landscaping guidelines provided by the developer for
the PUD General Plan dated March 13, 2017.
Miscellaneous
h. Architectural design guidelines shall be reviewed approved by City staff.
i. The developer shall work with City staff to provide a trail connection to the
Country Ponds neighborhood to the west.
