HomeMy WebLinkAbout2017.05.01 RESP 2017-11 Adelaide Landing Pre PlatRESOLUTION 2017-11 APPROVING PRELIMINARY PLAT FOR THE EXCELSIOR GROUP, LLC, FOR "ADELAIDE LANDING" ON PROPERTY LOCATED EAST OF HIGHWAY 61 AND NORTH OF 130TH STREET WHEREAS, Excelsior Group, LLC, has requested approval of a preliminary plat to allow construction of 319 single family lots and 10 outlots on the 216 acre property legally described as follows: (See Attached) WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Excelsior Group, LLC, for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 319 single family home lots and 10 outlots, in accordance with the application and plans received by the City on February 6, 2017, March 10, 2017, March 11, 2017, March 13, 2017, and March 16, 2017, except as amended by this resolution. 2. Approval is contingent upon City Council approval of a rezoning to PUD for the 216 acre site. 3. The developer must comply with Resolution 2017-10, for the PUD. 4. Park Dedication is proposed to be satisfied with a combination of land dedication and fee. The amount of land dedicated is 7.8 acres satisfying 53% of the requirement. The park dedication fee shall be paid for each lot platted at the amount of $1,128 per lot. 5. The entire length of 130a' Street, from T.H. 61 to Goodview Avenue, shall be constructed as an urban section roadway to City street standard, with an 8 foot wide bituminous trail on the north side. 6. The developer shall be responsible for paying 44% of the construction cost of 130th Street. The cost will be divided between the first three phases of the development with one-third of the cost paid to the City prior to the recording of the final plat of each phase. 7. The preliminary phasing plan is generally approved per plans dated November 29, 2016, revised March 10, 2017. Any major revisions to the phasing plan shall require PUD amendment. Minor modifications shall be reviewed and approved by staff. a. Phase 1 shall include: Resolution 2017-11 Page 2 i. The developer and the City shall enter into an agreement on a cost sharing formula for the reconstruction of 130th Street. ii. The developer shall provide one-third of the construction cost in escrow money to the City or other payment method approved by the City for the improvements to 130th Street per the cost sharing agreement. iii. The developer shall work with the City on the final layout of the Villa homes on the western portion of the plat. iv. Park improvements: 1. Grading and seeding within the City owned outlot (Oulot A, County Ponds) and the area south of the powerline easement. This shall be completed by and paid for by the developer. b. Phase 2 shall include: i. The developer shall provide one-third of the construction cost in escrow money to the City or other payment method approved by the City for the improvements to 130th Street per the cost sharing agreement. ii. Park improvements: 1. Grading and seeding on Outlot C, within the area north of the powerline easement. This shall be completed by and paid for by the developer. 2. An 8' bituminous trail, boardwalk, and landscaping shall be installed within all of Outlot C. Final location of the trail and boardwalk shall be reviewed and approved by staff prior to installation. This shall be constructed by and paid for by the developer. c. Phase 3 shall include: i. The entire length of 1301h Street, from T.H. 61 to Goodview Avenue, shall be constructed as an urban section roadway to City street standard, with an 8 foot wide bituminous trail on the north side, and the first layer of bituminous prior to issuance of a Certificate of Occupancy for the 1 st building. 1. This improvement shall include increase in the forcemain size that connects the development to the 130th Street lift station. ii. The developer shall provide one-third of the construction cost in escrow money to the City or other payment method approved by the City for the improvements to 130th Street per the cost sharing agreement. d. Prior to the issuance of a building permit for any lot north of Lot 1, Block 15, the entire length of Street 1 to Street 2 shall be constructed with the Resolution 2017-11 Page 3 first layer of bituminous. No lots shall be issued a building permit until they are provided access to 130'h Street via Street 1 and 2. 8. Outlot Use and Ownership a. Outlots A, D, H, I, and J are proposed for stormwater ponding/wetlands and shall be deeded to the City. b. Outlot C is proposed for a public park and stormwater ponding and shall be deeded to the City. c. Outlots E, F, G, are proposed for openspace and tree preservation and will we owned by the HOA. d. Outlot B is proposed for a future pond/unplanned and the current owner (Stachowiak) will retain ownership. 10. The location and geometrics of the center island located on Street 13 is subject to further review and approval by City staff. 11. The landscaping planned for the development shall be installed all at the same time during each phase. The developers shall take proper precautions to protect the trees as the homes are being built. 12. Prior to the release of the final plat for recording, the developer must comply with the following conditions. a. The developer shall comply with the City standards for street lighting within the public right-of-way. b. The developer must comply with all conditions outlined in the City Engineer's memos dated March 17, 2017. c. The development shall comply with the Fire Chief s requirements regarding fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. Resolution 2017-11 Page 4 d. The developer must obtain all necessary stormwater management and WCA permits from the City. e. The developer shall address all comments in the MnDOT comment letter dated March 9, 2017. a. The plans shall be revised to show 130x'' Street as an urban section road to City street standards, including the 8 foot bituminous trail on the north side. The final plans must be submitted for review and approval by staff. f. A stormwater reuse agreement shall be reviewed and approved by staff and recoded at Washington County. g. The developer shall obtain all necessary local, state, and federal permits. h. The developer shall obtain approval from Xcel Energy on the crossing of the powerline easement. i. The developer shall obtain approval from Koch on the crossing of the gas line easement. j. The Homeowners Association (HOA) documents for review and approval by staff. k. Architectural design guidelines shall be reviewed and approved by staff. 1. Details and specification for the boardwalks shall be reviewed and approved by staff. m. The developer shall provide survey shots of the neighboring properties to ensure all drainage is contained on the developer's property. n. The developer shall work with the City on providing a buffer from the pond from the County Ponds neighborhood to the west. The buffer shall be reviewed and approved by City staff. o. The developer shall work with City staff to provide a trail connection to the Country Ponds neighborhood to the west. p. The City's development fees will apply to this project. The fee amounts will be calculated and included as part of the Development Agreement. A development agreement shall be executed and all fees shall be paid. q. Park Dedication shall be paid for each lot platted in the amount of $1,128 per lot. Resolution 2017-11 Page 5 r. A formula has been developed to determine the amount that the water trunk fee can be reduced based on the water reuse system, which results in a 40% reduction in the trunk fee. This provision will be included in the development agreement for each phase. s. A formula has been developed to determine the amount that the stromwater trunk fee can be reduced based on the drainage provided for the construction of 130' Street, which results in a 5% reduction in the trunk fee. This provision will be included in the development agreement for each phase. 13. Prior to the issuance of building permits, the developer must comply with the following conditions. a. The applicant shall record the final plat, development agreement and all other documentation at Washington County and provide the City with proof of recording. b. A Letter of Map Revision will need to be prepared and submitted for FEMA approval so that the existing floodplain boundaries and elevations can be revised per the plans. c. The Stormwater Trunk fee shall be paid at each building permit.
