Chairman Senkler called the meeting to order at 6: 15PVI

Present: Bob Ellman , Bob Olson , Senkler
Motion made by Senkler, seconded by Olson to approve the minutes of June
28, 1989 as amended .
All aye, motion passed .
Chairman Senkler reviewed the application with members of the board . He
stated that Mr. Keith Johnson of 12450 Ingersoll Ave. No. , has made
application to the City of Hugo for a variance to construct a 24' X 36'
pole building , 50' from the east shoreline of Sunset Lake. The property
in question is zoned RR2 and approximately one acre in size. The City
stic)reland regulation requires a minimum 100' setback from the shoreline of
the lake for structures of this nature on recreational lakes. The drawing
as shown appears to meet the 40' setback requirement from the front
property line, however, it is 50' short of the requirement from the lake.
We have requested that Mr. Johnson stake the building site in question to
afford you an opportunity to view the site and get a perspective as to the
buildings location from the road , lakeshore, and other buildings in the
area. On Mr. Johnson ' s site plan he indicates that the mound septic
system and several trees limit the placement of this building on site.
Accessory buildings under 1800 sq . ft. in size are permitted in RR2 zoning
district subject to site plan approval by the city council . It should be
noted that the site plan is not drawn to scale and if the lot dimensions
are correct, the size of the building and it' s placement on site is not
proportionate to the size of the site, making the building size look
smaller than it actually is. It should also be noted that the Department
of Natural Resources has been in contact with the city indicating their
concern regarding this variance request. The DNR has been notified of
this evenings meeting of the Board of Zoning Adjustments. It would appear
that they do not like the variance from the lake and would rather see the
city approve a variance from the road setback and the principal residence
on site.
The city still has not received approval from the Rice Creek Watershed
District, nor copies of the information requested in the watershed
districts letter dated December 19, l989. Notices of this variance
request have been sent to the property owners within 300' of the property
in question , as well as, the Sunset Lake Homeowners Association .
Mr., Keith Johnson informed the commission and the audience that the
proposed structure would have metal siding and roof , the same color or
similar to the existing home. Mr. Johnson plans to hire a contractor for
the construction .

Chairman Senkler asked for public comments. Area residents felt that
considering the size of the lots in the area and location of the
construction site in relation to the lake, this was an inappropriate area
for a pole building . Residents felt the esthetic value of the Sunset Lake
area would diminish with the construction of a pole building and it would
set a precedent. Several residents stated they had no objection to
additional sotorage on Mr . Johnson ' s lot but felt it should be further from
the lakeshore and the exterior should be similar to the residence.
Chairman Senkler informed the audience that he and Bob Olson visited the
site and measured the setback from the ordinary high water mark from the
lake. The proposed structure would be 22' from that mark . Commissioners
concurred that a variance to the required setback of 78% was too great to
allow. Members were also concerned that if the structure would be allowed
there would be no space to relocate the septic system should the need
arise.
Motion made by Senkler, seconded by Ellman to recommend denial of the
variance request of Keith Johnson , 12450 Ingersoll Ave. No, to construct a
pole structure to within 22' of the ordinary high water mark of Sunset
Lake for the following reasons;
1 . Variance request of 80% of the required setback is too great.
2. The septic system would be only 20' from the structure.
3. Allowing the structure would set a precedent for future pole
structures in the area.
