PRESENT: Brunotte, Goiffon, Rubenzer City Administrator, Robert Museus Brunotte made motion, Rubenzer seconded, to approve the minutes for the meeting of June 255 1997, as submitted. All aye. Motion Carried. GAMBONI Thomas and Mary Gamboni, 5927 Egg Lake Road, requested a variance to driveway width separation at their home at the above address. The Gambonis constructed a driveway 24 feet in excess of 22 foot maximum allowed in the SFU district. Mrs. Gamboni stated that the additional driveway width was necessary to park cars. The location of the fire hydrant on her lot, as well as neighbors parking along 8A, adjacent to her lot, limit the on-street parking available to her property. In addition, she has a number of children who own automobiles, and as a foster-care facility, she often has visitors coming to her home. At the time the driveway was framed for construction, the City's building official had warned Mrs. Gamboni that the width was in excess of that allowed by ordinance, and recommended she apply for a variance if she wanted the extra width. The Gambonis poured the concrete driveway about a week after receiving this warning. Brunotte made motion, Rubenzer seconded, to deny the variance request by the Gambonis, since the hardship Mrs. Gamboni described was not due to the unique characteristics of the property. In addition, granting of the variance would not be in keeping with the spirit and intent of the City's ordinance, and would allow a substantial amount of additional paved surface in a residential neighborhood. The Gambonis still had reasonable use of their property without granting the variance. All aye. Motion Carried. Rubenzer indicated that he would favor granting a variance to allow a 24' wide driveway at the residence to match the garage on the property. SULLIVAN John and Susan Sullivan, 15325 Irish Avenue, requested a variance to the size of the garage they are building at the above address. City ordinance allows 1,000 sq ft of garage space in the agriculture zoning district, and the Sullivans propose to construct a garage 1,196 sq ft. The Sullivans explained that the need for the variance was due to the angle of Board of Zoning Adjustments - August 27, 1997 Page 2 the garage, which is necessary due to the location of wetlands located on the site, and the area approved for construction of the septic system. The angle of connection between the garage and the house creates an enclosed space of approximately 196 sq ft. The Sullivans stated that approximately 96 sq ft of this was being used by the living room; the other 100 sq ft they desire to keep for open storage space in the garage. Staff recommends approval of the variance subject to the condition that the allowable square footage of accessory structure on the property be reduced by the amount of variance granted for the garage. Rubenzer made motion, Brunotte seconded, to approve the variance subject to the condition that any future accessory structures on the property be limited to the extent allowed by law minus 100 sq ft. All aye. Motion Carried. ONEKA CHILDCARE CENTER Mr. Tom Houk, representing the Center, 5525 141st Street, requested a variance from the City's sign setback. The City's sign ordinance allows a sign to be constructed 32 feet from the street easement. Mr. Houk proposes to construct his sign 22 feet from TH 61 and 10 feet from 141 st Street. Mr. Houk explained that the variance was necessary due to the large amount of wetland easement on the property which limits options for locating the sign. This wetland cuts across his property at an angle, and takes up a large amount of his frontage with Th 61. The location he has identified would place the sign along the edge of the parking being construct for the facility, and since the road right-of-way in this area in quite wide would still place it a substantial distance from TH 61. The City Engineer reviewed the proposed sign location and found no adverse consequences to the proposed site, and staff recommends approval of the variance subject to the stipulation that the sign be placed in as low a profile as possible. Goiffon made motion, Rubenzer seconded, to approve the variance allowing Mr. Houk to construct a pylon sign 10 feet from the right-of-way of 141 st Street and 22 feet from the right-of-way of TH 61. All aye. Motion Carried. Goiffon made motion, Brunotte seconded, to adjourn at 7:1OPM. All aye. Motion Carried. Robert A. Museus City Administrator
