HomeMy WebLinkAbout2000.06.28 BOZA Minutes MINUTES FOR THE HUGO BOARD OF ZONING ADJUSTMENTS MEETING OF " JUNE 28, 2000 r Stoltzman called the meeting to order at 6:30 p.m. PRESENT:Brunotte, Stoltman Deputy Clerk, Michele Lindau Dan Cornejo, City Planner John Benson, Building Official ABSENT: Puleo Minutes of January 26, 2000 Stoltzman made motion, Brunotte seconded, to approve the Board of Zoning Adjustment minutes for January 26, 2000. All Ayes. Motion carried. Variance (Hengtgen) The Board of Zoning Adjustments considered the variance request of Jason Hengtgen, 5540 159th St. N., for a 28'3"wide driveway when a 16' wide driveway is allowed by ordinance. The property is legally described as Lot 10, Block 3, Creekview Preserve 2nd Addition. The Board of Zoning Adjustments considered the report prepared by the City Planner, which recommend denial of the variance. He felt that enforcement of the ordinance would not cause undue hardship because the circumstances were caused by the land owner and were not unique to the property. Prior to the passing of the new zoning ordinance on July 27, 1999, the maximum driveway width at the street was 22 feet. Hengtgen provided the Board of Zoning Adjustments a list of neighboring driveway widths, which showed 48 other driveways to be greater than the required 16 feet, and 15 of those driveways to be greater than 22 feet. Hengtgen felt a 16' driveway was not compatible with a 3- car garage, which was a requirement in the development. He also referred to a driveway variance approved, after the fact, on September 2, 1997, to Thomas Gamboni, 5727 Egg Lake Road, for a 46' wide driveway. Members of the Planning Commission requested the Building Official investigate the surrounding communities to determine if the zoning ordinance should be amended to allow wider driveways. Stoltzman made motion, Brunotte seconded, to table until the Planning Commission meeting on August 23, 2000. All Ayes. Motion carried. Variance (Marcu) The Board of Zoning Adjustments considered the request of Al and Linda Marcu, 15350 Everton Ave. N., for a variance to build a deck on the south side of their home, two feet from the property line, where a 40' setback is required. The property is legally described as the N 1/2 of the S 1/2 of the NEI/4 of the SWI/4 of Sec. 18, T3IN. R21 W. Prior to the passing of the new zoning ordinance on July 27, 2000, the required sideyard setback was 40'. The Marcus proposed a 16' deck, which would provide a 6' setback from the property line. Stotlzman made motion, Brunotte seconded, to recommend approval of a 2-tier deck, with the lower portion of the deck to be a minimum of 4' wide, and a 6' setback from the south property line, providing the property line is established by a registered land surveyor.
