HomeMy WebLinkAbout2002.06.13 BOZA Minutes MINUTES HUGO BOARD OF ZONING APPEALS AND ADJUSTMENTS JUNE 13,2002 Chairperson Schumann called the meeting to order at 6:30 p.m. PRESENT: Brunotte, Puleo, Schumann ALSO PRESENT: John Rask, Community Development Director Michele Lindau, Secretary Minutes of May 9, 2002 Puleo made motion, Schumann seconded,to approve the minutes of May 9,2002 as presented. All Ayes. Motion carried. Dordinj!-Roth Variance for Deck The Board considered the request of Carrie Dording-Roth for a variance to permit a five-foot side yard setback, where 10 feet is required for construction of a deck on property located at 13921 Fountain Avenue North(Francine's Meadows). The deck would be located on the north side of the home and would provide a means of egress to an existing sliding glass door. Staff found the hardship to be unique to the property because of the location of the existing home and sliding glass door. The home was constructed 17 feet from the north property line, and a sliding glass door was installed. Brunotte made motion, Puleo seconded to recommend approval of the variance to permit a five-foot side yard setback for property located at 13921 Fountain Avenue North. All Ayes. Motion carried. Schumann made motion, Brunotte seconded to request Council review and appoint staff to administratively approve variances of legal nonconforming status for homes built prior to the ordinance change that previously allowed the encroachment of decks to a distance of not less than three feet from any lot line. All Ayes. Motion carried. Board of Zoning Adjustments Meeting June 13, 2002-page 2 Glidden Variance for Pole Building The Board considered the request of Thomas and Rennae Glidden, 7215 137th Street North for a variance to permit a 25520 square foot pole building closer to the road than is the existing home on their property. The City's Comprehensive Land Use Regulations require that the pole building be set back a distance equal to the home. The home on the property is setback 285 feet from the front property line and the applicant was requesting approval to construct the pole building approximately 239 feet from the front property line. Staff found the hardship was unique to the property because the setback of the home far exceeds the 40-foot minimum front yard setback of the ordinance. Thomas and Rennae Glidden were present at the meeting. The applicant had stated they wanted to maintain the alfalfa field that is currently behind the home and that they do not have easy access behind the home because of the location of the drain field. The entire building would be in front of the home but would be approximately 85 feet to the west of the home and behind a stand of trees. Puleo made motion, Brunotte seconded,to recommend approval of the variance for Thomas and Rennae Glidden to construct a pole building closer to the road than the existing home. All Ayes.
