HUGO BOARD OF ZONING,APPEALS AND ADJUSTMENTS

Chairperson Schumann called the meeting to order at 6:33 p.m.
PRESENT: Brunotte, Puleo, Schumann
ALSO PRESENT: John Rask, Community Development Director

Minutes of June 13, 2002
Puleo made motion,Schumann seconded,to approve the minutes of June 13,2002 as
presented.
All Ayes. Motion carried.
Niemczyk Property Line Adjustment with Variance
The Board held a public meeting to consider the request approval of a variance from
the minimum lot width requirement to allow a property line adjustment for their
properties located at 17115 Henna Avenue North and 7666 170th Street N. The
Niemczyks would like to subdivide 10 acres from their property at 17115 Henna Ave.
N.consisting of approximately 25.4 acres,and add it to the 10 acres at 7666 170"St.
N., creating a 20-acre parcel.
The property line adjustment would reduce the current road frontage by 664±feet for
the parcel located at 17115 Henna Ave. N., leaving approximately 61±feet of road
frontage. The applicant was requesting a variance from the 300 feet minimum lot
width requirement in the Agricultural Zoning District.
The parcels are under common family ownership but are noncontiguous. The
property is divided by a 50-foot wide utility right-of-way owned by St. Croix Falls
Minnesota Improvement Company. Niemczyks said the home at 17115 Henna would
eventually be removed.
Staff found the hardship was unique to the property because of the location of the 50-
foot wide utility right-of-way owned by the St. Croix Falls Minnesota Improvement
Company. The right-of-way prevented the two parcels from being combined.
All properties are under the ownership of the Niemczyk family. The parcel requiring
the variance from the 300 feet minimum lot width is owned by the father of Joe

Niemczyk. The home would eventually be removed but would remain a separate
parcel because of the utility right-of-way running between the two parcels.
Brunotte made motion,Puleo seconded,to recommend approval of the variance from
the minimum lot width requirement to allow a property line adjustment for 17115
Henna Avenue North and 7666 17e Street N.
All Ayes. Motion carried.
