HUGO BOARD OF ZONING=APPEALS AND'ADJUSTMENTS
Chairperson Schumann called the meeting to order at 6:34 p.m.
PRESENT: Brunotte, Puleo, Schumann
ALSO PRESENT: John Rask, Community Development Director
Michele Lindau, Secretary
Minutes of July 11, 2002
Puleo made motion, Schumann seconded, to approve the minutes of July 11, 2002 as presented.
All Ayes. Motion carried.
Radebaugh Variance for Fence
The Board held a public meeting to consider the request of Craig and Sharon Radebaugh for a
variance to allow a six-foot high privacy fence in a front yard on property located at 4868 1291h
Street North. The property is a corner lot and has two front yards. The home faces 129 'Street
and the fence would be to the rear of the home along Europa Trail. The zoning ordinance
prohibits six-foot high privacy fences in a front yard. A front yard is defined as the yard between
the home and a public street.
Staff found the hardship to be unique to the property because the property was a corner lot. Staff
also found it would be keeping with the spirit and intent of the ordinance because the fence
would be located in the rear yard of the home.
Other than the applicant, there was no one there from the public to comment on the application.
Brunotte made motion, Puleo seconded to recommend approval of the variance with the
condition the applicant enter into an encroachment agreement to allow the fence within the
drainage and utility easement, and the applicant provide a 3 to 4 inch gap between the bottom of
the fence and the ground for that portion of the fence that runs along the north property line.
All Ayes. Motion carried.
