Chairperson Schumann called the meeting to order at 6:31 p.m.

Minutes of July 25, 2002
Puleo made motion,Brunotte seconded, to approve the minutes of July 25, 2002 as
presented.
All Ayes. Motion carried.
Grewe Variance for Garaste Addition
The Board considered the request of Brian Grewe,4975 126th Street North, for a
variance to construct an 832 square foot garage addition. The existing garage and
addition would total 1,708 square feet. The zoning ordinance limits the size of an
attached garage to 1,000 feet.
Staff recommended denial of the request because they found the property to have
similar physical characteristics, size, and shape of adjacent lots and a five-stall
garage would be out of character with the surrounding homes. Staff also found
the garage would be 60 feet wide where the home is 26 feet wide. As such, the
garage would visually dominate the appearance of the home.
The City received one phone from the owner of Lot 5, Block 2, Bald Eagle
Estates, who objected to the variance request because she felt the garage would be
too large for the property.
Brian Grewe, the applicant, stated that the ordinance permitted him to have an 870
square foot detached accessory building and that he would be removing the existing
256 square foot detached storage building on the property. Grewe said he felt the
garage would look better attached. He also stated that he was unable to locate it
behind the home because it would block the drainage of neighboring properties.
Puleo said that by granting the variance,they would not be allowing any more storage
space than he was already permitted.
Puleo made motion,Schumann seconded,to approve the variance to construct an 832
square foot garage addition.

Brunotte made motion, Schumann seconded, to amend the motion to require the
existing building be removed.
Vote on amendment: All Ayes. Motion carried.
Vote on original motion: All Ayes. Motion carried.
Variance for Anderson—6551132 nd St. N.
The Board considered the request of Chris Anderson, 6551 132nd Street North, for
a variance to permit a 10-foot side yard setback for the construction of a 2,040
square foot pole building where a 40 foot side yard setback is required by
ordinance in the Rural Residential zoning district
Staff found that the location of the existing home, well, trees, and the size and
topography of the lot prevents the placement of the accessory building at 40 feet from
the property line. The property slopes away from the home toward the rear of the lot
making it unfeasible to move the proposed building back and toward the center of the
lot. Therefore, staff recommended approval of the variance.
Chris Anderson,the applicant,said the 40-foot setback would put the building in the
middle of his back yard.
Ray Frewerda, 6521 132nd Street North, said he shared the property line with
Anderson and had no problem with the variance as long as the building was
constructed to the plans Anderson had submitted to the City.
Cliff Axelson, 12317 Goodview Avenue North, owns the 40-acre parcel next to the
lot next to the Anderson property. Axelson was concerned that the parcel between
his property and the Anderson property would also be granted a variance at some
point, and he said this would be too close to his property line.
The Community Development Director pointed out that the required setback was
only 10 feet at the time the house was built.
Schumann said that since the ordinance change to require 40-foot setbacks, many
variances had been granted. The City will be reviewing the setback requirements.
Brunotte made motion, Puleo seconded, to approve the variance to construct the
building 10 feet from the property line.
All Ayes. Motion carried.
Variance for Ball—8715122nd St. N.
The board considered the request of Mike Ball, 8715 122nd Street North, for a
variance to permit a 32-foot side yard setback and a variance to locate the building
closer to the road than is the existing home. The applicant wanted to construct a

19216 square foot building between the home and the street, and 32 feet from the
side property line, where 40 feet is required by ordinance.
Staff found the location of the existing home, trees, and the size and shape of the
lot prevented the placement of the accessory building in another location. The
garage would be screened by existing trees located along the road and property
line. The adjacent property owner submitted a letter in support of the variance.
The Community Development Assistant had received a phone call prior to the
meeting from Cheryl White, 8775 122°'Street North, who stated she had no
objection to Ball's request.
Brunotte made motion, Schumann seconded, to recommend approval of the
variance to construct a 1,216 square foot building between the home and street,
and 32 feet from the property line.
All Ayes. Motion carried.
Variance for Woolstencroft—5050165th St. N.
The Board considered the request of Steven and Lauri Woolstencroft, 5050 165`h
Street North, for a variance to permit a 15-foot side yard setback where 40 feet is
required by ordinance, and a variance to locate the building closer to the road than
the existing home on property. The applicant wanted to construct a 1,344 square
foot garage 15 feet from the side property line and 13 feet in front of the home.
Staff found that the location of the existing home, septic system, wetland, and trees
prevented the placement of the garage at 40 feet from the property line or behind the
home. Staff also found that the garage would be partially screened by existing trees
located along 165`h Street and that the home is 128 feet from the road and the garage
would be 115 feet from the road, minimizing the extent of the variance.
Puleo make motion, Brunotte seconded, to recommend approval of the variance to
permit the garage to be located 15 feet from the side property line and 13 feet in front
of the home.
All Ayes. Motion carried.
