HUGO BOARD OF ADJUSTMENTS AND APPEALS
OCTOBER 10, 2002
Chairperson Schumann called the meeting to order at 6:30p.m.

Brunotte made motion, Puleo seconded, to approve the minutes of September 26,
2002.
All Ayes. Motion carried.
Satnik Variance for Accessory Building
The Board considered the request of Fancis Satnik, 12310 Janero Avenue North,
for a variance to permit an accessory building with an exterior finish that is
inconsistent with the principal structure on the property.
City Code requires all non-agricultural accessory buildings to resemble, in style,
materials, color, roofline, and siding type, the principal building on the lot. The
home is finished with horizontal aluminum siding and the pole building would be
vertical metal siding.
It was noted in the staff report that the Board considered a variance request on this
property for the construction of a garage 22 feet from the side lot line; however,the
applicant never constructed the building. It was also noted that the proposed
driveway to access the building would cross a wetland as well as a drainage way.
Satnik was present at the meeting and said he would be installing a culvert to
accommodate the driveway. He also provided pictures of his home and what the
accessory building would look like and pictures of three other homes and
buildings in the neighborhood that have accessory building slightly different from
the principal structure. Satnik pointed out the trees on the property that would
screen the building from the road and neighbors.
The Board found the applicant made every effort match the proposed building to the
principal structure. The Board also found the exterior of the proposed building
strongly resembles the exterior of the home and is screened from other properties by
existing trees on the property line.

Brunotte made motion, Schumann seconded to recommend approval of the
variance for Satnik.
All Ayes. Motion carried.
Aschenbrener Variance for Accessory Building
The Board considered the request of Mark and Denise Aschenbrener for a
variance to permit a 25-foot side yard setback for the construction of a 2,000
square foot accessory building on property located 13520 Keystone Avenue
North. City code requires a 40-foot side yard setback in the Agricultural District.
The City had received a letter from Azure Properties, owners of the adjacent
property located north of 13520 Keystone Ave., stating their objection to the
variance.
Puleo pointed out that the letter did not state their reason for objection.
Staff found that the location of the existing well and the required setback from it
prevented the applicant from locating the building closer to the principal structure.
To locate it 40 feet from the property line would not provide access to the rear of
the property in case of an emergency.
Staff also found that at the time the home was constructed, the required setback
was 20 feet. In 1999, the City increased the setback from 20 to 40 feet.
Puleo stated that the Board had considered many variances resulting from this
change in setback requirements and the City would be considering a change to the
ordinance.
Puleo made motion, Brunotte seconded, to recommend approval of the variance
for Mark and Denise Aschenbrener.
All Ayes. Motion carried.
