HUGO BOARD OF ADJUSTMENTS AND APPEALS
DECEMBER 12,2002
Chairperson Schumann called the meeting to order at 6:35p.m.
PRESENT: Brunotte, Puleo, Schumann
ALSO PRESENT: John Rask, Community Development Director

Minutes of November 14, 2002
Puleo made motion, Schumann seconded, to approve the minutes for November 14, 2002, as
submitted.
All Ayes. Motion carried.
Heimerl Variance for Porch
The Board considered the request of Steve & Sheri Heimerl, 5478 157th Way Court North, for a
variance for a 25.5 foot rear yard setback where 30 feet is required for construction a 12' X 16'
addition to their single family home located in the Creekview Preserve Subdivision. The
applicant would like to construct a 12-foot x 16-foot two-story addition. The upper portion of
the addition would be off the existing kitchen and would be constructed as a four-seasons porch
and the lower portion would be a future bedroom.
Other than the applicant, there was no one present who wished to speak on the request.
Brunotte made motion, Puleo seconded, to recommend approval of a variance for 5478 157th
Way Court North.
All Ayes. Motion carried.
Wilsey Variance for Property Line Adiustment
The Board considered the request of Andre Wilsey and Kristi Rose, 7793 132"d Street North, for
a variance from the minimum lot size requirement and a variance from the minimum front lot
width requirement to allow a property line adjustment between two properties, both owned by the
applicant. The lot line adjustment would allow the applicant to reshape the lots to provide more
contiguous usable area on each parcel.
The applicant's home is located on the five-acre parcel at 7793 132'd Street North. The parcel
located to the west is vacant and is approximately nine acres. After the adjustment of the
property line, the acreage of both parcels would remain the same. To permit the lot line
adjustment, the applicant is requesting a variance to allow a lot size less than 10 acres for each
parcel, and a variance to allow less than 300 feet front lot width for one of the parcels.

Puleo questioned why the lot with the home would be 326 feet and not 300 feet, which would
give the other lot greater frontage. Wilsey pointed out that 326 feet would permit the access to
the rear of his property to be on one parcel without having to cross wetlands.
Schumann recalled the previous owner of these parcels wanted to subdivide the lots into three
parcels but the City only permitted the creation of the two existing parcels.
Bill Kujala, 12930 Homestead Ave. N., said he did not favor the request because he recalled the
Planning Commission wanting the lots to be as close as possible to the 300 feet front lot width
requirement when the previous application was before them.
Alan Schmit, 7701 132nd St. N., said he recalled the application in 1998 when they were trying to
subdivide into three lots. Schmit said that because of the wetlands, there would only be 37 feet
between the wetland and the property line in which to put in a driveway.
Dennis Schultz, 13101 Henna Ave. N., suggested the public notices include a better description
of the location because he would have not known the subject properties were adjacent to his had
he not talked to his neighbor. Schultz said he bought his lot because of the nice view of the pond
and didn't want a home obstructing it.
Schumann told him that this property line adjustment would not change the use of the property
and the lot could be built on as it existed today.
Puleo informed the audience that the applicant was only asking to change lot lines, not where the
building site is or obtain a driveway permit. He said the acreage of the parcels was not changing
and the lot line adjustment has no bearing on what the applicant can do as far as building on the
property.
Puleo said that is had been common practice that if a variance was reasonable and had no effect
on the health, safety, and welfare of the citizens of the community, it was approved.
Puleo made motion, Schumann seconded, to recommend approval of the variance for Andre
Wilsey and Kristi Rose.
All Ayes. Motion carried.
