All Ayes. Motion carried. Muellner Variance The Board considered the application of Leon Muellner, 14998 Francesca Avenue North, for a variance to permit a garage 20 feet from the rear lot line where 25 feet is required, and a variance to permit a 1,200 square foot accessory building where the ordinance limits the size to 260 square feet. The applicant owns three separate lots of record that total approximately 32,000 square feet. The applicant wishes to construct the garage on the lot south of his home for the storage of a recreational vehicle. Mullner said he would like to be able to sell the lot in the future as a separate home site. Schumann asked Mullner if it was possible to move the home further away from the lot line to meet the required setback and Mullner replied that it would not leave adequate maneuvering space when a home was built on the property. Puleo asked what the height of the building would be and Mullner said 12' sidewalls were necessary to store his motor home in it. Troy Miller, 14969 Foxhill Avenue North, said his home was adjacent to the property line he was requesting the setback variance from. Mr.Miller had concerns regarding the size of the proposed garage and the possible removal of the pine trees located Planning Commission Meeting November 14,2002-page 2 along the lot line. Mullner said four pine trees east of the lot line would be removed and the building would block the view of the future home. Puleo had concerns about the height of the building, and said there should be language stating that there would be no other garage permitted on the property. Puleo made motion, Schumann seconded, to forward the application to the City Council without a recommendation. All Ayes. Motion carried. Orlando Variance The Board considered the request of James Orlando for three variances to allow the construction of a 30' X 60' accessory building on his property at 12718 Irish Avenue North. One variance would be to locate the building 20 feet from the side property line where 40 feet is required by ordinance. Staff indicated in the staff report that at the time the home was constructed, the required setback was 20 feet. In 1999, the setback was increased to 40 feet; therefore, the hardship was due to a change in the ordinance and not caused by the applicant. Orlando was also requesting a variance to permit an accessory building with an exterior finish that is inconsistent with the principal structure. Orlando was present at the meeting and told the Board that he wanted to construct the pole building with maintenance free siding ivory/beige in color. He also stated that he recently purchased the home and intended to reside the home in the near future with the same colors as the accessory building. Also requested was a variance to locate the building in front of the principle structure on the lot. Staff found that the location of the septic system and the replacement septic system area prevented him from constructing the building to the rear of the home. Other than the applicant, there was no one present who wished to speak on the request. Schumann made motion, Puleo seconded, to recommend approval of the variance for Jim Orlando. All Ayes. Motion carried. Planning Comrnission Meeting November 14,2002 -page 3 Al Parent Construction Variance The Board considered the request of Al Parent Construction and Bob and Diane Dufresne, 12844 Greystone Avenue North, for a variance to allow construction of a 40' X 42' attached garage. The attached garage would be 1,455 square feet. The zoning ordinance limits the size of an attached garage to 1,000 feet. The parcel is 3.2 acres in size and located in the Hidden Hills subdivision. Staff found that the applicant designed the garage as a standard three-car garage with an upper level to be used as part of the home. Staff also indicated that dormers and a porch in front of the garage and continuing along the front of the home facing Greystone Avenue would give the garage the appearance of being an extension of the home; therefore, the garage would not dominate the appearance of the home. Puleo made motion, Schumann seconded, to recommend approval of the variance for Al Parent Construction and Bob and Diane Dufresne. All Ayes. Motion carried. Adjournment Puleo made motion, Schumann seconded, to adjourn at 6:58 pm. All Ayes. Motion carried. Michele Lindau, Secretary Board of Zoning Adjustments
