AN ORDINANCE RELATING TO AND REGULATING
SWIMMING POOLS
NOTICE: THIS PUBLISHED MATERIAL IS ONLY A SUMMARY OF AN ORDINANCE OF THE
CODE OF ORDINANCES FOR THE CITY OF HUGO. THE FULL TEXT OF THE ORDINANCE IS
AVAILABLE FOR PUBLIC INSPECTION AT THE HUGO CITY HALL DURING REGULAR
BUSINESS HOURS.
The City of Hugo City Council passed and adopted Ordinance 2017-484 on the 5"' day of June, 2017.
Ordinance 2016-484 regulates swimming pools in Hugo. The following sections have been added or
amended:
1. Chapter 90, Article I, Sec. 90-1. — Definitions
a. Amending the definitions to include the additions of the following:
i. Swimming Pool, In -Ground Swimming Pool, Above Ground Swimming Pool,
Small Above Ground Swimming Pool, and Large Above Ground Swimming Pool.
2. Chapter 90, Article VI — Requirements for Specific Uses and Performance Standards
a. Adding Section 90-279. - Swimming Pools, to include:
i. General standards for all swimming pools, including;
1. Building permit requirements for all in -ground swimming pools and above
ground swimming pools with a capacity over 5,000 gallons and/or wall
height over 42 inches.
2. Noise -making mechanical equipment screened from view and a minimum
of 30 ft. from nearby dwellings.
ii. In -Ground swimming pools, including:
1. Required submittal information for building permit applications.
2. Property line setbacks: 15 ft. rear yard setback, 10 ft. side yard setback, 6
ft. setback from principle structure or frost footing.
3. Well/Septic setbacks: 20 ft. from well. 10 ft. from septic. 20 ft. from soil
treatment area.
4. Requirement for a fence or wall with a self-closing and self -latching gate.
iii. Above Ground swimming pools, including:
1. Differentiation between "large" and "small" above ground pools.
2. Property line setbacks: 30 ft. rear yard setback, 10 ft. side yard setback, 6
ft. from any principle structure or frost footing.
3. Required submittal information for building permit applications.
4. Large above ground swimming pools require fence or wall with a self-
closing and self -latching gate.
5. Small above ground swimming pools not surrounded be a fence must have
a removable ladder that is removed when the pool is not in use.
Please note this title and summary of this Ordinance clearly informs the public of the intent and effect of
the Ordinance and conforms to Minn. Stat. § 412.191. The ordinance is available from the Hugo City
Clerk for further review.

clause (1) or (2). If the newspaper's known office of issue is located in
a county adjoining the county where the mortgaged premises or some part
of the mortgaged premises described in the notice are located, a substantial
portion of the newspaper's circulation is in the latter county.
