BACKGROUND MEMO FOR THE EDA MEETING OF
MONDAY, SEPTEMBER 14, 2009
3. APPROVAL OF MINUTES
Staff recommends approval of the minutes from the August 10, 2009, EDA Meeting as
presented.
4. DISCUSSION ON CARPENTERS RESTAURANT PROJECT
Mike Anderson would like to address the EDA with issues that he has with costs
associated with his redevelopment project.
5. UPDATE ON SAC / WAC FEE STRUCTURE REVISIONS
Over the past year the City has been working on revising the sewer and water connection
fees. The new rates were adopted in August. Staff will update the EDA on the revisions
that were made.
6. UPDATE ON OFFERS TO SELL PROPERTY LOCATED ON 165TH STREET
AND HIGHWAY 61
At the August meeting the EDA discussed the offers to sell for properties located at 165th
Street and Highway 61. The EDA made a recommendation to the City Council to send a
response letter to the listing agent stating that the City was interested, but was not in the
position to purchase the property at this time. The Council considered the
recommendation and directed staff to write and send the letters to the listing agent.
Enclosed are the letters that were sent.
7. UPDATE ON DOWNTOWN REDEVELOPMENT
Staff will update the EDA on downtown redevelopment in the City.
8. UPDATE ON BR&E
Staff will update the EDA on the progress of the BR&E Program.
9. UPDATE ON P.A.W.S. PET HOSPITAL GROUND BREAKING
Staff will update the EDA on the ground breaking for PAWS Pet Hospital that was on
Monday, September 1, 2009 at 8 am.
10. CITY WIDE BUS TOUR
The City of Hugo's annual City wide bus tour is on Monday, September 14, 2009 @ 4:30
pm.
MINUTES FOR THE EDA MEETING OF AUGUST 10, 2009
EDA Vice President Phil Klein called the meeting to order at 8:30 am.

APPROVAL OF MINUTES FOR THE EDA MEETING OF JULY 20, 2009
Denaway made motion, Klein seconded, to approve the minutes for the EDA meeting of July 20,
2009.
All ayes. Motion carried.
DISCUSSION ON OFFERS TO SELL PROPERTY LOCATED ON 165TH STREET
On Thursday, May 14, 2009 staff met with the property owners in the 165th Street and
Highway 61 area. The meeting was to discuss the possibility of another industrial park in that
area. On the 2030 land use plan the area is shown as industrial. At the meeting some of the
property owners in the area were interested in selling. These property owners continue to
market their property for sale. The property owners thought the City may have an interest in
buying the property and followed up with an offer to sell. Staff recommended the EDA
discuss the offers to sell.
Miron talked about the meeting with the property owners and the scenarios that were
presented to them on how the property could be developed. Granger talked about the
proposed land use for the site and that an industrial park will be a good fit once city services
are available to the site. Miron also talked about the reasons the City acquires property and
felt that the property would likely develop on its own.
Miron made a motion, seconded by Granger, to recommend to the City Council that a letter
be sent to the listing agent stating that the City is not in the position to purchase the
properties at this time.
UPDATE ON DOWNTOWN REDEVELOPMENT
The CD Director updated the EDA on downtown redevelopment in the City. He talked about
the Carpenters Restaurant redevelopment project and how the changes to the SAC/WAC fee
structure lowered the cost of the connection to City sewer and water for the proposed
building. He also talked about the improvement plans for Highway 61 being delayed until
spring. Granger stated that the City should work with the property owner to demolish the
antique building.
The CD Director stated that 61 Stop will be reopening with new owners in September. He
also talked about the selling price of the Ricci's property has gone down.
UPDATE ON BR&E PROGRAM
Shayla Syverson updated the EDA on the progress of the Business Retention and Expansion
Program. The leadership team has been set and the task force members will be going though
an orientation of the program on September 22, 2009. The task force training for the site
visits will be on October 7, 2009. The business visits will start in October. Staff continues to
work on the resource list to give to businesses to help them with immediate concerns that
they may have.
MISCELLANEOUS DISCUSSION
At its August 10, 2009 meeting the EDA discussed two items that are related to the City
Budget. First, they discussed whether or not the City would support the project to renovate
the YMCA in White Bear Lake. They discussed the location of the YMCA and the residents
of Hugo that use the YMCA. They generally agreed the location was not close enough to
Hugo to justify the expense to the City and only a small percentage of Hugo residents are
members of the YMCA. The White Bear Lake School district has committed to contributing
to the renovation project and Hugo residents living in the White Bear Lake School District
are supporting the YMCA through their payment of school property taxes.
Granger made a motion, seconded by Klein to recommend the City Council not financially
support the project to renovate the existing YMCA in White Bear Lake since the Hugo
families that are using it are already contributing to the YMCA through the White Bear Lake
School District taxes.
All ayes. Motion Carried.
The EDA also talked about the funding for the Washington County 4-H program. The 4-H
program has funding from Washington County through September 2009, but the County has
eliminated the funding for the coming year. At its July 20, 2009 meeting the City Council
was approached by a Dan Dolan of the Washington County Agricultural Society to have the
Council consider contributing to the 4-H program for the year 2010. The City Council stated
that they would consider it at their Midyear Budget Workshop. The EDA compared the 4-H
program to youth services provided by White Bear Lake and Forest Lake, which the City
provides limited financial support for.
Arcand made a motion, seconded by Granger to recommend to the City Council support the
4-H program on a limited basis for the coming year, with encouragement of the 4-H Program
to eventually become a self supporting organization.

ORDINANCE NO. 2009 -431
AN ORDINANCE OF THE CITY OF HUGO,WASHINGTON COUNTY,MINNESOTA,
AMENDING CITY CODE CHAPTER 82, ESTABLISHING WATER AND SEWER
TRUNK FEES AND AVAILABILITY CHARGES AND TO APPORTION COSTS FOR
THE CREATION,ACQUISITION,CONSTRUCTION,IMPROVEMENT,EXTENSION,
AND MAINTENANCE OF WATER AND SEWER LINES AND RELATED
IMPROVEMENTS
The City Council of the City of Hugo, Washington County, Minnesota, does hereby ordain
as follows:
WHEREAS, the City authorized the preparation of a justification report to consider the
City's current utility fee structure; and
WHEREAS,the City is desirous of adopting a revised fee structure wherein, in addition to
connection and other fees required by the ordinance,the fees for water and sewer are segregated
into two categories: 1. Trunk water and sewer fees due at the time of platting, subdivision, or
development; and 2. Water access (WAC)and sewer access (SAC)charges due at the time of
connection to the system or upon expansion of an existing use; and
WHEREAS, Section 82 of the Hugo City Code provides for payment of connection charges
for water and sewer systems however,the City desires to make modifications previously stated to
provide for the allocation of costs associated with the creation,acquisition, construction,
improvement, extension, and maintenance of water and sewer lines and related improvements.
NOW THEREFORE,the City Council of the City of Hugo, Washington County,
Minnesota,does hereby ordain as follows:
Section 1. Existing City Code Section 82-21 is deleted in its entirety and replaced with
the following:
Sec. 82-21. Connection charges.
Any party desiring to connect any premises with the municipal water system shall file an
application for service accompanied by a fee established by the city council. The fee amounts
will be evaluated by the City Council and designated in the City's fee schedule by resolution of
the city council. The connection charges shall be split into two categories as follows:
Trunk Fee: The trunk water system fee is based on the cost to develop and expand the water
system to accommodate growth as outlined within the 2030 Comprehensive Water System Plan,
or subsequent updates. The charge will be uniformly applied based on the anticipated growth
and new connections to the system, and will be calculated using Metropolitan Council
Environmental Services (MCES) Sewer Availability Charge (SAC) units. High water users will
be evaluated on a case-by-case basis at the time of plat to determine the impact and ability of the
water system to serve the user. Additional fees and/or improvements may be required based on
the evaluation.
Trunk Fee Collection: All trunk fees shall be paid collected at the time of plat or subdivision for
newly developed areas, or at the time of a building permit in the case of connection of properties
formerly served by private wells.
Water Availability Charge ((WAC): The WAC charge is based on the value received by the
customer from the water system. The WAC charge will be calculated using the MCES SAC unit
calculation.
WAC Charge Collection: All WAC charges shall be paid and collected at the time of connection
or expansion when a building permit is requested.

Section 2. Section 82-101 is amended to delete existing Section (f), (g), and (h) and
to add new and amended (f), (g) and (h) as follows:
(f) MCES Sewer availability charge (SAC). No permit shall be issued for any connection,
enlargement or alteration to the sewer system until a determination has been made by the city of
the service availability charge to be imposed by the Metropolitan Council Environmental
Services (MCES), and the applicant has paid to the city the full amount of any such sewer
availability charge that may be applicable.

City SAC Charge Collection: All City SAC charges are to be collected at the time of connection
or expansion when a building permit is requested.
(h) Fees. All fees and charges referenced in this section shall be as established by the city
council and designated in the City's fee schedule.

Section 3. Severability. In the event a Court of competent jurisdiction judges any
part of this ordinance to be invalid, such judgment shall not affect or impair any other provision
of this ordinance not specifically included in that judgment.
Section 4. Applicability. This Ordinance shall apply to all property where a party
makes a connection to or an expansion of the municipal sewer or water system. Property that
has been platted or subdivided prior to the effective date of this ordinance, has not been
connected to the municipal sewer or water system, and where a trunk fee has not been paid, will
be subject to the SAC and WAC fees outlined in the 2009 Fee Schedule adopted December 15,
2008. After January 1, 2010, the above referenced properties will be subject to both the trunk fee
and SAC/WAC fees as required by this ordinance and as described in the justification report.
Section 5. Effective Date. This Ordinance shall be effective after its passage and
publication according to law and severability.

AN ORDINANCE OF THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA,
AMENDING CHAPTER 30, SECTION 2, OF THE MUNICIPAL CODE RELATED TO
FEES
WHEREAS, the City Council is desirous of establishing a uniform system of fees for
requests relating to official controls, information, permits, applications or other matters handled
by the City, and;
WHEREAS, the City conducted a thorough study of its fees in relation to sewer and water
connection fees, and wishes to amend said fees.
NOW, THERFORE, it is ordained by the City Council of the City of Hugo, Washington
County, Minnesota, that Chapter 30, Section 2 of the City Code of the City of Hugo is hereby
amended as follows:
Section 1. Amendment of the City Code. Existing City Code Section 30-2 is deleted in its
entirety and replaced with the following:
Sec 30-2. Fee Schedule.
Fees shall be as established below. The fee shall be doubled for after-the-fact permit applications,
and the Uniform Building Code establishes a fee schedule for grading permits.

Economic Development Authority (EDA) reviewed and discussed the offers at their August 10, 2009,
meeting. The EDA believes that the offer is reasonable, but the City does not have it in its budget to
purchase land at this time. The EDA made a recommendation to the City Council to decline the offer
to sell and asked the City Staff to continue to monitor the land and assist when needed. At their
August 17, 2009, meeting the City Council decided to decline the offer as well.
We will continue to reference the property as people contact the City for industrial land. The property
is currently advertised on the City's website. You expressed some concern regarding development
approvals and environmental reviews. Please be assured that the City's intention is to make the
