BACKGROUND MEMO FOR THE EDA MEETING OF
MONDAY, NOVEMBER 14, 2011
3. APPROVAL OF MINUTES
Staff recommends approval of the minutes from the October 10, 2011, EDA Meeting as
presented.
4. HEALTHEAST CLINIC EXPANSION
Dr. Joe Moriarity will be present at the meeting to talk about the HealthEast expansion in
Hugo.
5. DISCUSSION ON DEVELOPMENT FEE ANALYSIS
At its October meeting, the EDA directed staff to put together a development scenario for
a restaurant in downtown Hugo. The analysis includes city fees in regards to development
in Hugo and surrounding cities. Staff has included a spreadsheet that outlines the fees for
each city.
6. UPDATE AND DISCUSSION ON CITY IDENTITY WORKSHOP
DECEMBER 15,2011 AT 7 PM
The identity workshop has been set by the Planning Commission for Thursday,
December 15, 2011. Staff recommends that the EDA discuss how they will participate
and contribute to the workshop. Staff will also provide a preview of the ideas for the
workshop.
7. UPDATE ON BOOT CAMP FOR ENTREPRENEURS
Staff will update the EDA on the Boot Camp for Entrepreneurs that was held on October
18, 2011. Commissioner Graff will present the benefits and other topic ideas for the boot
camp.

APPROVAL OF MINUTES FOR THE EDA MEETING OF SEPTEMBER 12,
2011
Arcand made motion, Denaway seconded, to approve minutes for the EDA meeting of
September 12, 2011.
All aye. Motion carried.
UPDATE ON THE MARKETING CAMPAIGN
Staff has started to compile information for the multimedia marketing campaign. The
next steps are to showcase the information in an interesting way on the City's website.
Staff is working with Gov Office, which hosts the website, to make updates to the
website. Staff enclosed the strategic plan for the marketing campaign for the EDA's
review.
Rachel Juba, Planner, gave background on the strategic plan. Miron stated that he would
like to see quality and unique restaurants in downtown Hugo. Bryan Bear, Community
Development Director, asked if the City should target major chains or the private local
restaurateur. Miron stated that the local restaurateurs may be more inclined to locate in
the downtown. Arcand stated that we need something unique in downtown to attract other
businesses. Miron agreed and stated that the downtown needs a project to spark
development which may include significant assistance from the City. Bever talked about
attracting projects that are geared towards kids. Graff stated that the goal for downtown
should be a restaurant to spark development. He stated that it's a matter of effort and
getting prospects to the City. Puleo agreed it's a great spot for a restaurant.
Miron talked about a community center in downtown, it is shown on the downtown
master plan. Miron stated there are several in other cities. Denaway stated that the cities
are lucky to cover operating costs. Mike Ericson, City Administrator, stated that we
thought of that as the new City Hall was built in 2004. The City decided to include a
community room and donate one million dollars to Oneka Elementary School for an extra
large gymnasium. Puleo stated that he does not think the City is ready for the community
center,but maybe there is a way to partner with the development team with the purchase
agreement for the City owned property. Bryan Bear, Community Development Director,
stated that there have been meetings for the planning of Lions Park and there was a visual
preference survey. No one mentioned having a community center, and a covered skating
rink was desired.
Denaway stated that we should also target professional serves, such as lawyers, medical,
offices. Puleo stated that the downtown needs exposure. Graff stated that residents could
be surveyed to see what they would like to see in downtown. Denaway stated it's also a
matter of creating spaces several users can go into. Miron stated that we may have all the
information on the services that people get out of town. Miron, Denaway, and Graff
stated we need to compile of the information in the strategic plan and showcase Hugo.
Denaway made a motion, seconded by Graff, for staff to do an analysis on a hypothetical
development that includes a restaurant. This will show the EDA how much the
development would cost in Hugo and in the surrounding cities.

UPDATE ON GREATER MINNEAPOLIS/ST. PAUL ECONOMIC
DEVELOPMENT PARTNERSHIP
Staff attended the Greater MSP meeting on September 29, 2011.
Bryan Bear, Community Development Director, attended the second meeting. He stated
that our City marketing outline is not a lot different from Greater MSP. Their goal is to
get contact information from cities and provide them with prospects. The focus has been
on manufacturing and industrial businesses and they are doing regional marketing to get
leads. Hugo is part of the group that is being responsive to Greater MSP.
UPDATE ON DOWNTOWN REDEVELOPMENT
Staff updated the EDA on the progress of downtown redevelopment.
The LCDA Grant for Pete Sampair's property in downtown has moved to the second step
of evaluation.
The bids for the demolition of the Ricci's building should be in next week.
There will be a sheriff's sale on the Carpenters and Antique Store properties on October
21, 2011. They will have six months to redeem the property. Anyone has an opportunity
to bid on the property. Graff and Denaway stated that the City should not bid on the
property. Bryan Bear, Community Development Director, stated that the one thing the
City may lose if the full access onto and from Highway 61.
UPDATE ON BOOT CAMP FOR ENTREPRENEURS
Staff updated the EDA on the Boot Camp for Entrepreneurs on October 18, 2011.
Miron made a motion, seconded by Graff, to post the boot camp as an EDA meeting.

CITY WIDE BUS TOUR—OCTOBER 15,2011
The 6th Annual City Wide Bus Tour is on Saturday, October 15, 2011, at 10 am. EDA
members were encouraged to attend.
UPDATE ON MEETING DATE CHANGE FOR THE EDA/PLANNING
COMMISSION CITY IDENTITY WORKSHOP—NOVEMBER 17, 2011 AT 7
PM
There is a conflict with the previous meeting date of November 11, 2011. The I-35 W/E
coalition is meeting that night. The Planning Commission rescheduled the date to
November 17, 2011.
Several members of the EDA were not able to make the November 17, 2011, date and
asked for it to be rescheduled to December 81h or 15th. Staff will check with the Planning
Commission and find out what date works best for them.

When calling for inspections, please call during office hours and call one day in advance (24

If you have scheduled an inspection and will not be ready, please call to cancel
before the scheduled inspection time. A reinspection fee will be charged for
noncancellation of inspections or multiple failures of same inspection. Permits
must be pulled and paid for prior to inspections being made.
OBTAINING A BUILDING PERMIT
DOCUMENTS REQUIRED FOR SUBMITTAL:
1. Two sets of complete construction plans. The annexation area must also submit one set reduced to
11X17 (total of 3 sets). One set will be returned with comments/corrections.
2. Two sets of the proposed grading plan/survey. See grading plan handout for requirements. Include
the building setbacks on the grading plan/survey.
3. Annexation area must also submit a copy of the Architectural Review Board approval.
4. Building permit application filled out completely. Any pertinent information that is not filled in
will cause application to be rejected.
5. Copy of current Minnesota contractors license,plumbers license, excavator(sewer and water)
license, or HVAC license. Excavation and HVAC licenses must be obtained with the City of
Stillwater.
6. When the building permit is ready to be picked up, we will contact you.
7. A signature is required on permits, so they must be picked up. We do not mail them out.
8. The building permit and inspection sign off card must be posted on the job site.
9. All construction sites must have the house number clearly marked from the start of construction.
This is an emergency vehicle safety requirement.
SEPARATE PERMITS ARE REQUIRED FOR MECHANICAL AND PLUMBING.

AN ORDINANCE ESTABLISHING PERMIT FEES
TO BE COLLECTED BY THE
CITY OF STILLWATER
The City Council of the City of Stillwater does ordain:
1. A new Section 33.4 is hereby adopted to hereafter read as follows:
PERMIT FEES. The applicant for a permit shall provide an estimated construction
value at the time of application,except for fixed fees. Permit valuations shall include total
value of all construction work, including materials and labor, for which the permit is being
issued, such as gas, mechanical,plumbing equipment, and permanent systems. The building
official shall make the final determination of value.
Valuation is based on the building valuation data, dated May of 2004 or the most
current valuation provided by the ICC via State of Minnesota Building Codes and
Standards Division or contract bid price. The building official shall make the final
determination.
Exceptions: Building permit valuations for the following structures shall be based on the
valuation of on-site work only:
a. Manufactured homes containing a Housing and Urban Development(HUD)
certification label;
b. Prefabricated buildings with a Minnesota Building Codes and Standards
Division prefabrication label; and
c. Industrialized/modular buildings with an Industrialized Building Commission(IBC)
label.
PLAN REVIEW FEES. When submittal documents are required by the building
official,a plan review fee shall be paid. Said plan review fee shall be 65 percent of the
building permit fee. The plan review fees are separate fees from the permit fees and are in
addition to the permit fees. When submittal documents are incomplete or changed so as to
require additional plan review, fees shall be charged at the rate shown in Building Permit Fee
Table. Plan review fees for similar plans falling under 1300.0160, subpart 6, shall be 25
percent of the building permit fee.

Miscellaneous work such as duct work, new gas line, etc, has the minimum fee applied
WORK COMMENCING BEFORE PERMIT ISSUANCE. If work for which a permit is
required by the code has been commenced without first obtaining a permit, a special
investigation shall be made before a permit may be issued for the work. An investigation fee
shall be collected and is in addition to the required permit fee, and equal to the permit fee.
FEE REFUNDS. The building official may authorize refunding of any fees paid here under
which was erroneously paid or collected.
The building official may authorize refunding of not more than 80 percent of the permit fee
or plan review fee paid when no work has been done under a permit issued. The building
official shall not authorize refunding of any fee paid except on written application filed by the
original permittee not later than 180 days after the date of fee payment.
REINSPECTIONS. A reinspection fee may be assessed for each inspection or re-
inspection when such portion of work for which inspection is called for is not
complete or when corrections called for are not made.
To obtain a reinspection, the permit applicant shall pay the reinspection fee in
accordance with Building Permit Fee Table in the fee schedule adopted by this
Municipality.
In instances where reinspection fees have been assessed,no additional inspections of the
work will be performed until the required fees have been paid.
EXPIRATION. Every permit issued by the building official shall expire by limitation and
become null and void if the building or work authorized by such permit is not commenced
within 180 days from the date of such permit,or if the building or work authorized by such
permit is suspended or abandoned at any time after the work is commenced for a period of
180 days. Before such work can be recommenced, a new permit shall be first obtained to do
so,and the fee therefore shall be one half the amount required for a new permit for such
work, excluding plan review fee,provided no changes have been made or will be made in the
original plans and specifications for such work.
The building official may grant, in writing, one or more extensions of time, for periods not
more than 180 days each. The extension shall be requested in writing and justifiable cause
demonstrated.
EXPIRATION OF PLAN REVIEW. Applications for which no permit is issued within 180
days following the date of application shall expire by limitation, and plans and other data
submitted for review may thereafter be returned to the applicant or destroyed by the building
official. In order to renew action on an application after expiration,the applicant shall
resubmit plans and pay a new plan review fee. In the event of a hardship and at the discretion
of the building official a new plan review fee may be waived.

not charge not-for-profit groups and educational institutions to use City Parks, unless otherwise noted.
The City does require a refundable damage deposit from ALL groups and persons renting parks
facilities.

PARKING RAMP FEES
1. Contract Parking.
a. Business Hours Permit. This permit is for the use of one parking space on weekdays
from 6:00 AM to 6:00 PM. Parking before or after the permitted hours is subject to the flat
fee for transient parking, or the event parking fee if that applies. Note that all rates are
given in monthly equivalents, however permits must be purchased in quarterly increments.
The minimum purchase is one quarter. The prices listed are for each permit.
i. Uncovered space (fourth level) $10/month [$30/quarter]
ii. Covered space $15/month [$45/quarter]
iii. Covered space, bulk rate (5 permit minimum) $12/month [$36/quarter]

2. Event Parking. Parking during events does not include overnight parking. Any vehicle parked at
the event rate after 2:30 AM will be subject to towing.
a. Summer weekends. For the purposes of the municipal parking ramp, "summer
weekends" are defined as occurring between May 15t and October 31st. A summer
weekend begins at 5:00 PM on Friday evening and runs through Sunday evening at 8:00
PM.

b. Special Events. Currently Lumberjack Days, 4th of July Fireworks and the Stillwater
Criterium annual bike race are considered Special Events. The list of Special Events can

Investigation Fee: Work Without A Permit
Whenever any work for which a permit is required from the city has been commenced without first
obtaining said permit,a special investigation shall be made before a permit may be issued for such
work. An investigation fee,in addition to the permit fee,shall be collected whether or not a permit is
then or subsequently issued. The investigation fee shall be equal to the amount of the permit fee
required by this code. The payment of such investigation fee shall not exempt any person from
compliance with all other provisions of this code nor from any penalty prescribed by law.
Plan Review Fee
• When a building permit is required and a plan is required to be submitted,a plan review fee shall
be paid. Plan review fees for all buildings shall be sixty-five percent(65%)of the building permit
fee.The fee for similar plans shall be twenty-five percent(25%)of the normal building permit fee
as defined in M.S.B.C. Section 1300.
• The plan review fees specified are separate fees from the building permit fees specified and are in
addition to the permit fees and are to be charged when a plan review is done even if the permit is
not issued.
• When submittal documents are incomplete or changed so as to require additional plan review,or
when the project involves deferred submittal items,an additional plan review fee shall be charged
at the above rate.
• Expiration of plan review. Applications for which no permit is issued within 180 days following
the date of application shall expire by limitation,and plans and other data submitted for review
may thereafter be returned to the applicant or destroyed by the building official. The building
official may extend the time for action by the applicant for a period not exceeding 180 days on
request by the applicant showing that circum-stances beyond the control of the applicant have
prevented action from being taken. No application shall be extended more than once. In order to
renew action on an application after expiration,the applicant shall resubmit plans and pay a new
plan review fee.
Refund Fee
• The building official may authorize refunding of any fee paid hereunder that was erroneously paid
or collected.
• The building official may authorize refunding of not more than eighty percent(80%)of the permit
fee paid when no work has been done under a permit issued in accordance with this code.

• The building official shall not authorize refunding of the plan review fee when an application for a
permit is withdrawn or canceled after a plan review has been done.
• The building official shall not authorize refunding of any fee paid except on written application

$25.00.

ESCROW DEPOSITS
In order to obtain a Certificate of Occupancy, escrow deposits shall be collected if exterior work
cannot be completed due to inclement weather, as determined by City Staff,whereupon a Temporary
Certificate of Occupancy would be issued subject to the execution of an escrow agreement and
payment thereof. Any unfinished work must be completed within six months(weather permitting)
from the date of issuance. The following escrow amounts are hereby established:

This formula covers degradation for depreciation caused by intrusion into the right-of-way. The
depreciation applies to the original surface of the right-of-way and to the overlays and seal-coats applied to
the surface. The formula includes life expectancy schedules for each and has an estimated cost per square
yard based on the quality of the right-of-way surface required for different levels of traffic. This formula
creates a degradation fee which is determined by the cost per square yard for street, overlay, and seal-coat,
multiplied by the depreciation schedule, multiplied by the area of the street patch.

STAFF TIME

ESCROWS,FEES AND CHARGES
a) Escrow for City Costs and Fees. Developer shall deposit sufficient
escrow with the City as outlined in Section A. 1. The required beginning balance in the account is
calculated at $8,546.76. This sum is calculated to be four percent (4%) of the estimate of the
required improvements to be installed to serve the development.
b) Cash Escrow or Letter of Credit. Developer shall provide a financial
guarantee to the City, in the form of a cash escrow or letter of credit, in the amount equal to one
hundred twenty-five percent (125%) of the estimated amount of the required improvements to be
installed to serve the development. This amount has been calculated by the City's Engineer to be
two hundred sixty seven thousand and eighty six dollars$267,086). This amount may be reduced
upon request of the Developer and approved by the City. At no point shall the Letter of Credit be
reduced below 10% of the original amount. The City shall have the right to retain the financial
guarantee until the improvements have been completed to the satisfaction of the City and the
warranty period has expired.
c) Storm Water Trunk Fee. The Developer shall pay the City a Storm
Water Trunk Fee in the amount of$9,568.51. This sum is calculated to be$0.07 per square foot for
the 136,693 square feet of Net Developable Area within the Plat. This fee shall be paid before the
Final Plat is signed by the City.
d) Storm Water Ponding Fee.The storm water ponding requirement has
been met by the Developer within the plat. No storm water ponding fee will be applied.
e) Snow Plowing. Developer agrees to pay a cash escrow to the City to
cover the cost of snowplowing the roads within the plat, during the first snow season, before the
roads are formally accepted by the City of$.50 per lineal foot. The Developer shall post a cash
escrow with the City in the amount of$157.50(i.e.,$0.50 x 315=$157.50).
f) Sealcoatin . The Developer shall post a cash escrow with the City in
the amount of$1,260.00 to cover the cost of the first sealcoating of the streets in the Plat. This sum
is calculated to be$4.00 per foot for the 315 feet of streets within the Plat.
g) Park Dedication. Developer agrees to pay a park dedication fee of$1,956
per lot for residential development payable before the final plat is signed by the City. Said fee shall
be due for each of the 6 lots within the plat(i.e.total due$11,736).

h) Cul-de-sac Escrow. N/A
i) >acrow for Street Signage. Developer shall deposit$250.00 into an
escrow account with the City. This amount represents an estimated cost to install signage within
