ADJOURNMENT BACKGROUND MEMO FOR THE CITY COUNCIL MEETING ON MONDAY, NOVEMBER 20, 2017 D.1 Approval of the Minutes for the November 6, 2017 Council Meeting Staff recommends Council approve the above minutes as presented. G. 1 Approval of Claims City staff recommends Council approve the Claims Roster as presented. G.2 Approve Annual Performance Review for Building Official Chuck Preisler Chuck Preisler was hired by the City of Hugo as the new Building Inspector on November 29, 2004 and was promoted to Building Official in April 2010. Staff recommends Council approve the annual performance review for Building Official Chuck Preisler. G.3 Approve Resolution Approving Variance for 14469 Geneva Ave. N, - Sierven The applicant is requesting a variance from the size requirements for an accessory building to allow a total size of 540 square feet where 260 square feet is allowed by ordinance. The applicant is proposing to construct a 280 square foot addition onto an already existing 260 square foot accessory structure. Staff feels the request meets the intent of the ordinance and recommends Council approval. The Board of Zoning Adjustments & Appeals considered this request at their meeting on November 9, 2017. There was no one that spoke during the public hearing. The Board agreed that the request met the criteria necessary to approve the variance and recommended approval of the resolution for the variance request to the City Council. G.4 Approve Final Pay Request to T.A Schifsky for North Sunset Lake Improvement Protect The City of Hugo has received Pay Request No. 5 Final Payment from T.A. Schifsky's for the North Sunset Lake Street Reconstruction Project. City Engineer Mark Erichson and Senior Engineering Technician Steve Duff has reviewed the Pay Request No 5 Final Payment, and found it to be satisfactory for work completed on this project. Staff recommends Council approve the final Pay Request No. 5 to T.A. Schifsky in the amount of $74,457.45 for the North Sunset Lake Street Reconstruction Project. G.5 Approve Trail Applications for the Washington County Star Trail Association Hugo Chapter and the Rice Creek Trail Association Each year, the Washington County Star Trail Association and the Rice Creek Trail Association submit their applications to the City for the purpose of providing public recreational snowmobile trails during the winter. Staff recommends Council approve the 2017-2018 trail applications for the Washington County Star Trail Association Hugo Chapter and the Rice Creek Trail Association. H.1 Abatement Hearing for Dennis Schultz at 13101 Henna Ave. N. Staff has been working with the property owner regarding violations of the Municipal Code since August 2016. Although the property owners had been provided ample notice and time to correct the violations, they had failed to do so. An abatement hearing occurred on September 18, 2017, where Council gave the property owner until November 15, 2017 to get the property back into Code compliance. City staff will update the Council on the progress of the property and any code violations occurring on the site. I.1 Concept Plan for Leroux Property CPDC Pratt Oakwood, LLP has submitted an application for a concept plan. The concept plan was completed to get comments from the various commissions and Council prior to moving forward with the formal development approval process. The developer is planning to develop two parcels of land, generally located east of Elmcrest Avenue N. and north of 159th Street N., totaling approximately 120 acres. The properties are currently vacant, relatively flat, and have some site constraints due to approximately 24 acres of wetlands. The applicant would like to receive feedback on the project in regards to general layout, housing types, parks/trails, road circulation and construction, and stormwater management/ water re -use. K. 1 Update on Yellow Ribbon Network Council Member Chuck Haas and Council Member Phil Klein will report to Council on the Yellow Ribbon Network activities held recently. M. Hugo City Council Meeting Minutes for November 6, 2017 Page 2 of 6 Donation to the Yellow Ribbon Network from the Fry Group On Saturday, October 14, 2017, a barbeque rib cook -off was held at Hugo Lions Park. This event was held by the Fry Group as a fundraiser for the Yellow Ribbon Network. Dave and Monica Fry were present and Dave explained the competition between himself and Dave Huynh, a.k.a. BBQ Dave, came about through office banter about who made the better ribs, and they chose the Yellow Ribbon Network to donate to. A check was presented to the YRN in the amount of $957 from donations gathered during the event. Approval of the Consent Agenda Haas made motion, Klein seconded, to approve the following Consent Agenda items. 1. Approval of Claims 2. Approve Resolution Designating Precinct Polling Locations for the 2018 Election All Ayes. Motion carried. Approval of Claims Adoption of the Consent Agenda approved the ter as i tsented. During the 2017 legislative session, changes were made to Minnesota Statutes 204B.16, which discusses polling designations. The new law states that municipalities must designate precinct polling places for all elections for the year by December 31 of the prior year. Adoption of the Consent Agenda approved RESOLUTION 2017-39 A RESOLUTION DESIGNATING PRECINCT POLLING LOCATIONS FOR THE 2018 ELECTIONS IN THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA. Approve' Resolution Approving CUP for Gunsmithing at 5611 152nd Street North, Unit 3 Haas removed this item from the Consent Agenda to hear more about the business. Kevin Muramatsu was requesting approval of a Conditional Use Permit (CUP) for 5611 152nd Street North, Unit #3,that would allow him to utilize 25% of the 2,000 square foot unit for retail space as a supplementary use to the gunsmithing facility. At its October 12, 2017, meeting, the Planning Commission held a public hearing and considered the request. No one in the audience spoke at the public hearing. The Planning Commission agreed that the application met the requirements necessary to approve the CUP and recommended Council adopt the resolution approving the CUP for 5611 152"d Street North. Owner Kevin Muramatsu explained he had been operating out of his home and needed more room. An ideal space opened next to his primary client, JP Enterprises, and part of the building will be used as a small commercial retail space. He explained that he basically builds and fixes firearms. Hugo City Council Meeting Minutes for November 6, 2017 Page 3 of 6 Haas made motion, Klein seconded, to approve RESOLUTION 2017-40 APPROVING A CONDITIONAL USE PERMIT FOR KEVIN MURAMATSU TO ALLOW RETAIL SPACE FOR THE PROPERTY LOCATED AT 5611 152ND STREET NORTH, UNIT #3. All Ayes. Motion carried. Update on Oneka Lake Blvd/Harrow Avenue Neighborhood Meeting and Approve Resolution Authorizing Preparation of Feasibility Study On October 19, 2017, a neighborhood meeting was held at 7:00 p.m. in the Rice Lake Center. A number of residents were in attendance that evening where Mark Erichson summarized the proposed improvements. City Engineer Mark Erichson explained the project area, which was Oneka Lake Boulevard from Goodview Avenue to Harrow Avenue and Harrow Avenue from Oneka Lake Boulevard to 165th Street. He stated it was the next project identified on the City's CIP. The proposed improvements would consist of reclaiming and paving Oneka Lake Boulevard from Goodview Avenue to Harrow Avenue and Harrow Avenue from Oneka Lake Boulevard to 165th Street. He talked about road widths and a possible future water main and future trails as showed in the comprehensive plan He stated trail are something the neighborhood was not in favor of but the road could be widened to allow a safer road for pedestrians. Project cost is estimated at 1,600,000, not including sewer and water or widening the roadway, and would be paid for through assessments and City funds. He talked about the assessment policy and the general process as it is governed by state statute. He provided a potential schedule which would be to hold a public hearing in January and begin construction in the spring of 2018. Council members who were present at the neighborhood meeting stated the residents who attended generally agreed the road condition was poor and it needed to be brought to a higher standard. There was also overall sentiment that there should be no trail around Oneka Lake but possibly widen the road and add porta potties. Miron made motion, Klein seconded, to approve RESOLUTION 2017-41 ORDERING PREPARATION OF A FEASIBILITY REPORT FOR PUBLIC IMPROVEMENTS TO ALL OR PORTIONS OF ROADWAYS IDENTIFIED AS THE ONEKA LAKE BOULEVARD AND HARROW AVENUE IMPROVEMENT PROJECT. All Ayes. Motion carried. Discussion on Concept Plan for Creekside Heights Planner Rachel Juba presented to Council the Concept Plan for Creekside Heights to be located north of the Peloquin Industrial Park, east of the commercial business along the east side of TH61, and west of Oneka Lake. The Lincoln Group was requesting feedback from the Council on a sketch plan for a subdivision of the 132 -acres, owned about various owners, for development of 251 housing units. Hugo City Council Meeting Minutes for November 6, 2017 Page 4 of 6 Rachel explained the property is within the Metropolitan Urban Service Area, currently vacant and contains some challenges regarding wetlands, drainage ditch, and high ground water. Rachel talked about developments that were proposed for the same properties about ten years ago (Dell Webb and Oneka Shores). During those discussions, there were comment on access improvements, incorporating the commercial property into the plan, and the preservation of natural resources. Those proposed developments were larger and triggered an Environmental Assessment Worksheet, which would not be required with this smaller project, but staff will continue to monitor it. The project would include a combination of single family, villas, and townhomes with the gross density of 1.9 units per acre and the net density of three units per acre. Staff would continue to work with developers on the use of the outlots, including a dock or fishing pier that would be constructed along Oneka Lake. A homeowners association would be established for this development. She explained staff's concerns regarding the buffer between the townhomes and industrial uses and the desire to have the villa products clustered together. Juba stated there are 25 acres of wetland on the site, and the applicant had done a good job meandering the roads around them. There were some floodplains that would be impacted with the development, and staff will continue working with the developer on that. As part of the PUD, the applicant was asking for reduced lot widths and setbacks on the townhomes in exchange for creating trail connections and constructing a dock and fishing pier for public use. She explained the phasing would include homes on the north side, accessed from Highway 61, and homes on the south of the property, which would be accessed from Goodview Avenue and Goodview Trail. Access to sewer and water would be a challenge because the necessary roads will not be built, and they are also working on extending the watermain from 159th Street. She stated it was also unclear how many of the trees will be preserved, but as part of the PUD, it is expected they would preserve a significant number of them. Traffic studies are showing there may need to be traffic intersection improvements at full buildout, and the plan included a roundabout, but the design had not been vetted by either staff or MnDOT. Work will also need to be done with RCWD regarding the ditch crossings, and stormwater management would need to comply with City standards. The applicant had been encouraged to incorporate stormwater reuse, and staff recommended the entire length of Oneka Lake be public parkland. Juba talked about the Parks Commission's comments on the plan saying they liked the amount of trails and sidewalks, fishing pier and dock, but had concerns about tree preservation. They also questioned parking for the public park and wanted to see the park amenities located at the south end of Oneka Lake, closer to Oneka Park off Goodview Avenue. They commented on the lack of trail connections to the townhomes, and they expected the landscaping to go beyond minimum standards. The Planning Commission had expressed concerns about the traffic flow for Phase One, the roundabout design, and the proximity of the homes to the industrial properties. The Commissions also encouraged stormwater reuse. Council asked whether there were any issues in other developments that have reduced lot widths and questioned who would maintain the trails. Juba replied there were reduced lots in other developments with no problems, and the trail would likely fall into the City's park system. There was also discussion on the fishing pier and the DNR's PUD standards. It was stated that buyers would need to know hunting was allowed on Oneka Lake. The Council had questions Hugo City Council Meeting Minutes for November 6, 2017 Page 5 of 6 regarding the roundabout, and Juba stated it first needed to be determined if it was warranted through MnDOT. City Engineer Mark Erichson added that it would be a City led project. Council talked about the importance of the connection to TH61, stormwater reuse, and synergy with the properties to the south. Project Engineer Rich Wilburn, from Kaskaskai Engineering, explained that the roundabout as shown is conceptual, and its design is complicated by the Industrial Utilities property. The Lincoln Group has been trying to negotiate with the property owner. He stated they are looking at reusing stormwater and agreed it made sense to put the fishing dock on the south ridge. He stated there was not a lot of usable ground, and they are asking for the PUD for flexibility to make the numbers work. They are still working through some road issues, and the location of lots are dictated by the lay of the land. He indicated they were open to all comments received. Discussion on Revisions to City Code Regarding Small Cell Technology in ROW City Administrator Bryan Bear explained there was an amendment to the Minnesota's Right -of - Way statute effective May 31, 2017, which gives telecommunications (small cell) providers permitted use of the right-of-way in all zoning districts except historic and residential. As a result, updates should be made to the City's ROW ordinance per the new amendment, and the City is also responsible for providing a draft colocation agreement and new permit for small cells by November 30, 2017. Intern Sarah Rumppe explained how the new technology complements macro -cell towers with the use of smaller antennas to boost and enhance the technology. Cities can manage the use of the right-of-way and charge a fee for using poles in the right-of-way, though the City does not own most poles. Weidt made motion, Klein seconded, to direct staff to prepare revisions to the City's right -of way ordinance. All ayes. Motion carried. Yellow Ribbon Network Report Council Members Haas and Klein reported on the recent activities of the Yellow Ribbon Network. Haas showed photos of the Fry group and talked about the VFW Auxiliary in White Bear Lake who helped collect money to aid in the cancer treatment for a two year old, whose grand uncle is an YRN volunteer. They received "thank -you" cards from the 210 EIS for an event they sponsored, the 133 Air Wing for a Children's Halloween party the YRN help helped with, and from KC 10 pilots in Afghanistan for the care packages. The YRN received an invitation to attend Veteran's Day Remembrance at the Forest Lake High School. General Nash recognized the Serve Our Troops volunteers and presented the highest civilian award to Haas. The general's reception on Saturday included Senator Klobachar. Bob Dettemer, who is the chair of the House Committee of Veteran Affairs, presented a resolution to General Nash for 45 years in the military and General John Jensen was sworn in as new adjutant general. The YRN received an anonymous donation for $500. The YRN helped a couple of families with childcare Hugo City Council Meeting Minutes for November 6, 2017 Page 6 of 6 and household items. They received an email from a sergeant in the 133 Air Wing thanking the YRN for care packages. Ryan Companies is doing a community outreach and will be putting together packages. They received another donation from Mark Schwope. The 133rd Air Wing will recognize the YRN in December. Network volunteers host the meat raffles on Saturday from noon to 2 at Sals's. December 2 will be the 18d' pheasant hunt. The YRN is gearing up for the Secret Santa program. On November 23, Mueller Mortuary will sponsor Hamburger Night. Hass stated he had received notice that the American Legion received a grant from the sale of Serve Our Troops license plates that will help them update their facility Legislative Reception Thursday, November 16, 2017 , City Administrator Bryan Bear reminded Council they had scheduled a meeting to attend the Legislative Reception to be held on Thursday, November 16, 2017 at the Tria Restaurant in North Oaks from 5-7 p.m. Reschedule Comprehensive Plan Workshop to Monday, February 26, 2018 City Administrator Bryan Bear informed Council the meeting scheduled for the Comprehensive Plan Workshop on Wednesday, December 6, 2017 at 7 p.m. was changed to a different date. DATE: November 13, 2017 for the City Council Meeting on November 20, 2017 ZONING: Single Family Detached Residential (R-3) REVIEW DEADLINE: December 3, 2017 1. BOARD OF ZONING UPDATE: At its November 9, 2017 meeting the Board considered the request and held a public hearing. Staff provided background on the request and recommended approval. There was no one that spoke during the public hearing. The Board agreed that the request met the criteria necessary to approve the variance and recommended approval of the resolution for the variance request to the City Council. 2. DESCRIPTION OF REQUEST: The applicant is requesting a variance from the size requirements for an accessory building to allow a total size of 540 square feet where 260 square feet is allowed by ordinance. The applicant is proposing to construct a 280 square foot addition onto an already existing 260 square foot accessory structure. The property is approximately 1.2 acres, located within the Single Family Detached Residential (R-3) zoning district, and is allowed one accessory structure for a total combined size of 260 square feet. For properties with a size of 1.5 acres, the Code allows up to a maximum of two accessory structures with a maximum combined size of 1,500 square feet. 3. LEVEL OF CITY DISCRETION IN DECISION-MAKING: The City's discretion in approving or denying a variance is limited to whether or not the proposed project meets the standards in the Zoning Ordinance for a variance. The City has a higher level of discretion with a variance because the burden of proof is on the applicant to show that they meet the standards in the ordinance. Sjerven Variance Page 2 4. ANALYSIS: A. Surrounding Land Use and Zoning The surrounding properties are zoned Single Family Detached Residential (R-3) and classified as Low Density Residential (LD) in the 2030 Land Use Plan. The properties are occupied by single family homes. B. Accessory Structure Size Variance The City Code allows properties under 1.5 acres one accessory structure with a maximum size of 260 square feet. The applicant is requesting a variance to allow an addition on an existing accessory structure to form one accessory structure with a size of 540 square feet. 5. VARIANCE STANDARDS: The Board must review the requested variances with the standards outlined in Section 90-38 of the land use regulations. Staff used these standards to review the variance request and finds the following: (1) Law. The variance as requested is permissible by law. The proposed variance is permissible by law. (2) Practical Difficulties. The applicant for a variance shall establish that there are practical difficulties in complying with the provisions of the zoning regulations. The term "Practical Difficulties" as used in the granting of a variance means: a. Reasonable Use. The property owner proposes to use the property in a reasonable manner not permitted by the zoning ordinance and; Accessory buildings are allowed in the Single Family Detached Residential (R-3) zoning district. The applicant is proposing to use the property in a reasonable manner. b. Unique Circumstances. The plight of property owner is due to circumstances unique to the property not created by the landowner and; The property is unique in that it is a large lot (1.2 acres) in a development generally comprising of .25 acre properties. It is also unique that the property is not surrounded by homes, as it is located adjacent to Egg Lake and has wetlands providing a buffer from surrounding properties. The applicant has a large wetland complex separating its neighbor to the west, which sets the neighbor's home approximately 600 feet from the current accessory structure. There are no neighbors to the south, as that area is a large wetland complex. The proposed building addition will occur on the west side of the 2 Sjerven Variance Page 3 existing accessory structure, which will be out of view from the adjacent properties to the east. c. Character ofNei,-hborhood. The variance, ifgranted, will not alter the essential character of the neighborhood. Accessory buildings are common within this neighborhood and are allowed in the R-3 zoning district. Generally, the development has .25 acre properties, however, there are a variety of lot sizes adjacent to Egg Lake, which allows a mixture of accessory structure sizes within the area. The applicant is proposing to locate the addition on the west side of the existing structure, which will not be noticeable to the closest adjacent properties to the east. The 280 additional square feet on the applicant's current accessory building would not noticeably alter the character of the area. (3) Spirit and Intent. The granting of the variance would be in keeping with the spirit and intent of this chapter and with the policies of the City's Comprehensive Plan. Accessory structures are common in the R-3 zoning district. The intent of the ordinance is to allow a property owner to have a reasonably sized accessory building on the property and to regulate the square footage of accessory buildings based on the size of the property. This prevents accessory structures from dominating the appearance of the property. The property is 1.2 acres and is allowed, by Code, one accessory structure at 260 square feet. A property of 1.5 acres is allowed two accessory structures with a maximum combined size of 1,500 square feet. The proposed accessory building addition is relatively small and because of the applicant's large lot, the development layout, and the natural landscape, the accessory building would not dominate the appearance of the property. It is the staff's opinion that the proposed accessory building would be keeping with the spirit and intent of the ordinance. (4) Prohibited Use. The variance, if granted, shall not have the effect of allowing any use prohibited in the district. Accessory structures are a permitted use in the R-3 zoning district. (S) Hazard Consideration. The variance, if granted, shall not permit a lower degree of flood protection than required by this chapter. The variance shall be determined the minimum necessary, considering the flood hazard, to afford relief, and the variance shall not be issued within any designated regulatory floodway if any increase in flood levels during the base flood discharge would result. The property is not located within a FEMA designated floodplain. (6) Septic and Well Compliance. The sewage treatment system and water system of the subject property is in compliance with city and state codes. The property is served by municipal sewer and water. Sjerven Variance Page 4 6. CONCLUSION: It's in staff's opinion that the applicant meets all the criteria necessary to approve the variance request. 7. STAFF RECOMMENDATION: Staff recommends approval of the variance request from the size regulations for an accessory building for Brian & Eugenia Sjerven on property located at 14496 Geneva Ave. N. The size of our existing shed is at the max square footage allowed by the current zoning ordinance. It is needed to help keep clutter and other things out of the yard and safe in a building. The location of the property is unique since we do not have neighbors to the south or west of our property and the front is the street (see attached map for a reference). We are backed up to Egg Lake and on a corner. The addition to the existing building is in the back yard and on the opposite side from the neighbors to the east of us. The addition will be set back far enough from the property line, enough that it will not impact any water table lines and will not block passage to the rest of the property if needed. BACKGROUND: The City received a complaint regarding trash, debris, and junk vehicles lying about the property located at 13101 Henna Avenue. City staff inspected the property and confirmed that there were nuisance violations, which included the accumulation of 40-50 junk vehicles, small machinery, boats, tires, and other miscellaneous junk and debris. Consistent with the City's approach of attempting to work with the property owner directly before seeking any formal intervention, City staff repeatedly contacted and met with the property owner to encourage and assist with formulating a plan and action to eliminate junk, wrecked and old vehicles and materials littering the property. The property owner has not corrected the situation despite requests for voluntary compliance and offers of assistance. The first ordinance violation letter was sent on August 8, 2016 which gave the property owner until October 1, 2016 to come into compliance with the City's ordinance. Prior to the first due date, City staff spoke with the resident who stated he was working on cleaning up the property. Staff re -inspected the property on October 1, 2016 and found the property to still be in violation. Staff spoke to the resident whom requested more time to contact resources to clean up the property. Staff provided information on the fall cleanup event held at the Public Works facility and provided a resource for the removal of the junk vehicles. Staff conducted a follow up inspection on October 27, 2016 and found very little progress had been made towards compliance. Staff sent another violation letter on October 31, 2016 stating the property owner had until November 14, 2016 to meet compliance of the City Code. Staff inspected the property and found little progress had been made towards compliance. On December 14, 2016 City staff met with the property owners regarding the nuisance violations on the property. Staff and the property owners discussed the winter weather conditions and that they have created a difficulty in working towards compliance. At this meeting, the property owners agreed to the following: Page 2 1. Postpone further cleanup efforts until May 1, 2017 at which time cleanup of the property would resume towards ordinance compliance. 2. Continue to work on the sale of the vehicles remaining on the property. 3. Create a cleanup plan to be submitted to City staff by March 1, 2017. This plan was to include a date where the property would be in compliance. On March 8, 2017 City staff had a meeting with the property owners regarding the cleanup plan and time line to bring their property into compliance. The property owners stated that they would work on cleaning up the property and would bring it into compliance with ordinance standards by August 1, 2017. City staff conducted a site re -inspection on August 7, 2017. Staff noted that very little progress had been made at bringing the property into compliance with the City's code. On August 23, 2017 a letter was sent to the property owners notifying them that an abatement hearing was scheduled for the September 5, 2017 Council meeting and the violations noted on the property, which include: • Municipal Code Chapter 46, article I., Section 46-2 and 46-3: o Section 46.2 — Public nuisances affecting health, safety, comfort or repose. ■ (3) The accumulation of garbage and rubbish not in containers, as required by ordinance of the city; ■ (5) An accumulation of tin cans, bottles, glass, trash or debris of any nature or description; o Section 46.3 — Public nuisances affecting peace and safety. ■ (1) The piling, storing or keeping of wrecked or junked machines or vehicles and other junk or debris other than by persons involved in commercial business where the city council deems certain accumulations are necessary in the course of transacting business. The property owner spoke to staff on August 30, 2017 stating they would not be able to attend the Council meeting on September 5, 2017 due to personal reasons. Staff removed the abatement hearing from the Agenda at the September 5, 2017 meeting. On September 11, 2017 a letter was sent to the property owners notifying them that their abatement hearing was to be scheduled for the September 18, 2017 City Council meeting. On September 18, 2017 Council held the abatement hearing and directed the property owner to remove the following items by November 15, 2017: 1. All miscellaneous junk, debris, and rubbish. a. This includes all materials that are miscellaneous equipment, machinery, bicycles, lawn chairs, signs, tires, etc. 2 now being stored outside, such as sinks, barrels, containers, storage tanks, Page 3 2. All vehicles that are not considered to have substantial value. a. A case shall be made for any vehicle the property owner believes has substantial value. A case may be made through providing the City with comparable vehicle listings, assessed values of vehicles, or any other evidence which demonstrates a vehicle is of substantial value. On September 22, 2017, City staff met with the property owner on site and discussed the outcome of the hearing and the Council's direction. On September 26, 2017, City staff sent the property owner a letter stating the Council's expectations, the re -inspection date (November 25, 2017), and the date (November 20, 2017) in which the item would return to the Council for an update. City staff conducted a site inspection on November 15, 2017 and noted that progress had been made towards compliance, however, multiple violations are still seen on site and the property is not compliant with the City Code. At this meeting, the Council is to consider an order for the property owner to clean up the property within 30 days of serving the order. If the property is not cleaned up and brought into compliance, the City shall begin the process to abate the property. 2. CONCLUSION/RECOMMENDATION: City staff has been working with the property owners for more than a year on bringing the property into compliance by cleaning up the trash, debris, and junk vehicles. Although some progress has been made by the property owners, it has been slow progress and the site still has multiple violations. City staff is recommending the City Council open the abatement hearing and take comment and testimony from the property owner and/or their representatives. Following the hearing, staff is recommending the Council approve the order to abate the property located at 13101 Henna Ave. N. to bring the property into compliance with City Code. ATTACHMENTS: 1. PLANNING COMMISSION UPDATE: At its October 26, 2017, meeting the Planning Commission reviewed and provided comments on the concept plan. The Commission asked for a better understanding of the items the developer would be proposing to give back to the City in return for PUD flexibility. The developer stated that the preliminary plat stage will further show those requests, however did discuss some of the proposed trail connections, exceeding the City's landscape requirements, and potential park improvements. The Commission expressed some general concerns for the park and trails. There was a concern for connections to the park for the residents living in the western quadrant of the development, a request for an addition of a trail loop within the northern portion of the park property, a concern for the wetlands within the area shown for ballfields, and a concern for the amount of parking spaces and parking layout. The Commission had concerns about the small amount of villa homes in the southeast corner of the development since they are far removed from the western portion of the development, however did discuss the land use of the adjacent parcel and how those units may make sense as development occurs. The Commission wanted to ensure a proper buffer from the villa products and the park if the layout of the development remains. The Commission strongly encouraged stormwater re -use for irrigation be incorporated into the development. The developer stated they would evaluate using stormwater reuse throughout the entire development. The Commission recognized the difficulties with developing the property and was generally comfortable with a PUD request for the development, but requested the developer to continue to work with staff regarding meeting density requirements for the project and what the City would receive in return for PUD flexibility. The Commission agreed that having a variety of lot sizes and product types is attractive for the City because it will offer more options and price points for smaller families and empty nesters. They also believed the developer has generally done a good job preserving area within the Greenway Corridor for natural resources. 2. PARKS COMMISSION UPDATE: At its November 15, 2017, meeting the Parks Commission reviewed and provided comments on the concept plan. The Commission asked for a better understanding of the park dedication request and if the developer would be proposing any park improvements with their PUD request. The developer stated that the park dedication request is just for the land, with no improvements. The developer will have their PUD request ready for their formal preliminary plat submittal. The Commission encouraged the developer to work with staff on the PUD request and how the proposal would exceed City standards. It was unclear to the Commission what portions of the open space on the eastern side of the development would be provided as part of the park dedication proposal and if not solely owned by the City, who would be owning and maintaining these areas. The Commission expressed concerns for connections to the park for the residents living in the western quadrant of the development. They encouraged sidewalk and trail connections to existing infrastructure in adjacent developments as well as further off-road trails. Although the developer indicated there would be no improvements to the park, the Commission had comments regarding more looping trails, specifically within the northern portion of the park, the wetlands within some of the planned ballfield areas, and the number of parking spaces and layout of the parking/loading areas. The Commission was generally very supportive of the preserved open space within the Greenway Corridor for park land. They are interested in understanding the developer's full park dedication and PUD proposal as the project moves forward. 3. BACKGROUND: The properties are generally located east of Elmcrest Avenue N. and north of 1591h Street N. and total approximately 120 acres. The properties are currently vacant, relatively flat, and have some site constraints due to approximately 24 acres of wetlands. The applicant would like to receive feedback on the project in regards to general layout, housing types, parks/trails, road circulation and construction, and stormwater management/ water re -use. 4. CONCEPT PLAN: CPDC Pratt Oakwood, LLP is planning to develop two parcels of land, both of which are owned by the developer. The plan shows 177 proposed residential lots with a variety of product types and lot sizes, stormwater ponding areas, a large park and open space, sidewalk and trail connections, and road connections. The developer is proposing to construct this development in three phases. The developer has indicated that an HOA will be established for the villa homes. The concept plan was completed to get comments from the various commissions and Council prior to moving forward with the formal development approval process. Current Zoning The two proposed parcels are located in the Future Urban Service (FUS) zoning district. The applicant intends to abide by single-family detached residential requirements for lots on the west side of Oneka Parkway, while requesting flexibility on lot sizes and setbacks for lots on the east side of Oneka Parkway. 2030 Comprehensive Plan The western parcel (40 acres) and western 40 acres of the adjacent 80 acre parcel is guided as Low Density Residential (LD). The eastern 40 acres of the 80 acre parcel is guided as Medium Density Residential (MD) according to the 2030 Land Use Plan. The density standards for the Low Density residential designation is a minimum of two units per acre while the Medium Density residential designation is a minimum of three units per acre. The developer is proposing a residential gross density of 1.5 units per acre and an adjusted net density of 2.6 units per acre. The development is currently not meeting the density requirements for these two land uses. In order for the developer to meet the density requirements for these land uses, a minimum of three units per acre would be required. This may mean that the entire development would be zoned as Planned Unit Development in order to combine the minimum density requirements for those land uses. Alternatively, the applicant could request a Comprehensive Plan Amendment proposing a change to the medium density residential land use designation to Low Density residential. Planned Unit Development The developer has proposed requesting approval of a PUD for a portion of the development. PUD's offer enhanced flexibility to develop a site through the relaxation of zoning district standards. The use of the PUD zoning also allows for a greater variety of uses, internal transfers of density, construction phasing and a potential for lower development costs. In exchange for this enhanced flexibility, the City has the expectation that the development plan will result in a significantly higher quality and more sensitive proposal than would have been the case with the use of other, more standard zoning districts. The developer will be asking for flexibility on the following: • Lot Widths o The developer is proposing a variety of lot widths for the different product types being offered in the development, east of Oneka Parkway. Product Lot Width Number of Lots Villas (Capstone Homes) 55 feet 80 Single Family (Capstone Homes) 65 feet 41 Setbacks east Oneka Parkway o The developer is proposing a front yard setback of 25 feet where 30 feet is required by ordinance, a side yard setback of 7.5 feet where 10 feet is required by ordinance, and a 30 foot rear yard setback, which matches the required rear yard setback. In exchange for the proposed PUD, the developer is expected to have a higher quality development with valued amenities. The developer has not indicated what they would be giving back to the City in exchange of PUD flexibility, however, the developer has indicated the development will offer trail and sidewalk connections within the development and a public park. The Low Density Residential designation identifies areas for single-family detached homes and some two family homes directly related to other complementary uses. The Medium Density Residential designation's primary intent is to respond to a need for smaller homes on smaller lots. This designation offers the opportunity for housing that may expand opportunities for more affordable single family home living and changes in demographics, including smaller homes for empty nesters and smaller families. The medium density designation also describes the importance of preserving natural resources and amenities. The proposed concept plan is requesting flexibility to accommodate a higher density, smaller lot sizes, a variety of housing products, and preservation of natural resources. This is in line with the intent of the land uses present in the development. Staff will continue to work with the developer on their proposal to request a change in the zoning to Planned Unit Development as the project moves forward. Housing Types The developer has proposed all single family homes within the development, however a variety of products will be offered on three different lot sizes. Currently, Capstone Homes are proposing to construct the homes on the east side of Oneka Parkway. These homes consist of 80 villa homes on 55 foot lots and 41 single family homes on 65 foot lots. The 56 single family homes on the west side of Oneka Parkway are still open to builders, but are proposed to meet single family zoning district standards with 80-85 foot lots. Oneka Parkway provides a significant break in product type, however, staff is concerned about the layout proposed for the mix of products on the east side of Oneka Parkway. Staff recommends the layout is evaluated to ensure there is an appropriate transition between homes and product types. The first phase is proposed to have approximately 52 homes built, while there will be 177 lots in total when the development is fully complete. The first phase is proposed to have a mix of the three product types. Parks / Trails The developer is proposing a park to the east of the residential development. This park is within the City's greenway corridor, which is an area that has been identified for having significant natural resources. The desire with greenway corridors is to preserve large intact blocks of natural resources as open space and link them together so that it can be used by both humans and animals. Because the site is located within the greenway corridor and proposed to be deeded to the City as a public park, staff will be working more with the developer on the amenities planned to be offered in the park. The developer is required to dedicate land, or pay a fee, or a combination of land and a fee. For the 117.5 acre site, parkland dedication of 9.36 acres of upland is required. The developer may also pay the fee, which is currently $2,400 per unit. The parkland dedication fee for the proposed 177 lots would be $424,800. The developer is proposing land dedication in lieu of fees with 11.20 acres of land. The developer's proposal will be evaluated by the Parks Commission. The developer has prepared a plan of what the park could look like. Currently, the developer has not indicated what would be constructed or paid for with their park dedication or request for PUD flexibility. The park currently has a layout that shows parking and loading areas, a pavilion, playground space, two sport courts, ballfields, and trail connections. Staff has reviewed the park and believes the developer has generally done a good job planning what the future of the park could like look while understanding its location within the greenway corridor. Staff has some general comments regarding trail connections, parking, and ensuring proper use of the park with the wetland constraints on site. Staff will continue to work with the developer on the park as the project moves forward. Although not shown on the concept plan, the developer has indicated that trail and sidewalk connections will be made to existing connections to the south. The developer will also be expected to plan for sidewalks on any street that is planned to have housing products with a lot width under 80 feet. Landscaping The developer has not submitted a landscape plan. In exchange for PUD flexibility, the City could expect a landscape plan that goes beyond the minimum requirements to provide street trees, entrance streetscaping, plantings around a monument sign, plantings in openspace, etc. Road Construction & Access The concept plan shows the proposed development to extend main road connections. Oneka Parkway is proposed to be extended to the north with other main connections to adjacent parcels. Staff is working with the developer on the transition from the median in Oneka Parkway, south of the development, and narrowing Oneka Parkway as it continues north. Ethan Trail is proposed to extend from Prairie Village, to the south, and connect to the main north/south connection of Oneka Parkway. The developer has proposed extending Falcon Avenue for use of the entrance to the proposed park. The developer has also included an extension of Farnham Avenue with a connection to a vacant parcel to the east. It's in staff's opinion that the road connections and access are generally good and connect existing residential developments while also planning connections to other parcels for future development. Wetlands The developer has applied for approval of a wetland delineation through the City. They are currently going through the City's Technical Evaluation Panel (TEP) for approval of their wetland delineation on the site. A wetland replacement plan would need to be applied and approved by the TEP if the developer plans to impact any wetlands on the site. This will be evaluated as the project moves forward. Stormwater Management/Water Re -Use The developer is proposing to have a stormwater management plan through the construction of ponds within the site. Staff will be working with the developer, as this projects moves forward, as it relates to stormwater management, floodplain, and infiltration. The developer has also indicated that they will be evaluating the potential of using stormwater, for irrigation purposes, within the development. If the system is feasible, from a water availability and design standpoint, it will require additional review and analysis as the project moves forward. 5. CONCLUSION/ RECOMMENDATIONS: The developer has been working with staff to develop a basic concept plan for informal comments. The applicant intends to abide by single-family detached residential requirements for lots on the west side of Oneka Parkway, while requesting flexibility on lot sizes and setbacks for lots on the east side of Oneka Parkway. Staff believes that the layout of the proposed development is generally good. The applicant has done a good job providing a mix of housing products, openspace, and trail connections. The developer is also planning to evaluate a stormwater re -use system that uses water from the stormwater ponds to irrigate the development, which is a system that is fitting with the City's "Reduce, Reuse, Replenish" initiative. Staff recommends that the City Council provide feedback on the concept plan to the developer on the following: 1. General Layout 2. PUD Request a. Proposed flexibility on lot widths and setbacks. b. The applicant should continue to work with staff on the PUD request and how the proposal would exceed City standards. 3. Housing Types a. Clustering of the Villa Home product and/or providing adequate transitions between product types. 4. Parks/Trail and Sidewalk Connections a. The applicant should continue to work with staff on connecting trails and sidewalks to existing infrastructure in adjacent developments. b. The applicant should evaluate the further off-road trails. c. The applicant should provide another trail connection to the development, specifically in the northern portion. d. The applicant should further evaluate trail loops within the park, specifically in the northeast area of the park. e. Provide a tree inventory and plan for what trees will be preserved and removed. f. The applicant should evaluate the planned areas within the park and if they can be fully utilized with the wetland constraints on site. g. The applicant should evaluate the number of parking spaces needed for proposed uses and the layout of the parking and loading areas. h. Full description of the park land dedication request and how the remaining open space is owned and maintained. 5. Road Circulation and Construction a. The applicant should continue to work with staff on the transition from Oneka Parkway, south of the development, to a narrower Oneka Parkway, without the center median, within this development. 6. Our review is based on the Sketch Plan submitted by Pratt Development. We will provide a more in-depth review of this project once detailed plans are provided by the applicant. Based on our review, we offer the following comments regarding the concept plan: Grading and Drainage Wetlands: The site contains extensive wetlands. A wetland delineation was performed on July of 2017, identifying 23.9 of the total 117.5 acres as being wetland. A notice of decision for the wetland delineation boundary is expected to be issued in the near future. The applicant will need to continue to work with the TEP and the City Water Resources Engineer and Environmental Scientist as the project moves forward to obtain the necessary permit(s) related to the wetland delineation, sequencing, and mitigation within the site. Site Grading/Low-floor Elevations: The groundwater within the site has the potential to be relatively shallow which will require that additional analysis be completed before finalizing the grading plan and low -floor elevations. Storm Water Management: The applicant will need to obtain a permit from the City for their Storm Water Management Plan within the site, including the appropriate storage, rate control, treatment, and volume reduction. There is a high likelihood that the site can support water reuse, and this should be explored in greater detail moving forward. Credit to the trunk area water fees is determined based on the amount of water reuse utilized within the project area. This will result in changes to traffic volumes on roadways within the adjacent neighborhoods as previously expected. Oneka Parkway and associated network of roadways to the south can accommodate the proposed development without extending Oneka Parkway north to 1651h Street. The developer is proposing to narrow the Oneka Parkway right of way from 110 -ft to 80 -ft and eliminate the center median. From an engineering standpoint, Oneka Parkway would not require having the center median, however staff would work with the applicant to review traffic flow and identify any need for turn lanes. Sanitary Sewer Service City Sewer Districts: Sanitary sewer service is available from the southerly portion of the site by direct connection to the existing systems within Oneka Parkway, Ethan Trail, Farnham Avenue and Falcon Avenue. A trunk sanitary sewer lift station is identified in the Comprehensive Sewer System Plan for this property and further evaluation with the applicant's engineer will be required to determine this developments cost participation. Water Service Trunk Watermain Improvements: Water service is available by connecting to the existing systems within Oneka Parkway, Ethan Trail, Farnham Avenue and Falcon Avenue. 12" Trunk watermain will need to be extended to the north within Oneka Parkway as outlined in the City's Comprehensive Water Supply Plan. Also, a 24 -inch trunk watermain is identified in the City's Comprehensive Water Supply Plan along the Leroux eastern property line.
