APPROVING AN ORDER REGARDING ACCUMULATION OF RUBBISH,
GARBAGE, AND JUNK VEHICLES FOR THE PROPERTY LOCATED AT 13101
HENNA AVE. N.
WHEREAS, this Order is made in connection with the property located at 13101 Henna Avenue
North in the City of Hugo, County of Washington, State of Minnesota, legally described as:
SEE ATTACHED EXHIBIT A
(hereinafter the "Property"). The Property is owned by, without limitation, Dennis and Karen
Schultz ("Owners");
WHEREAS, the Property contains numerous abandoned, wrecked, unlicensed and other
inoperable vehicles, junk and debris;
WHEREAS, the City Council held a hearing on September 18, 2017, at which Mr. Schultz
attended and spoke to the Council. The Council recommended the property to be brought into
compliance by November 15, 2017 and the item to return to the Council for an update on
November 20, 2017;
WHEREAS, the City Council held a hearing on November 20, 2017, at which the Owners did
not attend. The Council recommended approval of the order;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUGO, MINNESOTA, that it should and hereby does approve the order to bring the
Property into code compliance, subject to the following violations of the Municipal Code
Chapter 46, article I., Section 46-2 and 46-3:
• Section 46.2 — Public nuisances affecting health, safety, comfort or repose.
o (3) The accumulation of garbage and rubbish not in containers, as required by
ordinance of the city;
o (5) An accumulation of tin cans, bottles, glass, trash or debris of any nature or
description;
• Section 46.3 — Public nuisances affecting peace and safety.
o (1) The piling, storing or keeping of wrecked or junked machines or vehicles and
other junk or debris other than by persons involved in commercial business where
the city council deems certain accumulations are necessary in the course of
transacting business.

follows: Beginning at the Southeast corner of said Southwest Quarter of

degrees 59 minutes 53 seconds West, assumed bearing, 1326.55 feet, along the
North line of said Northwest Quarter of Section 34; thence South 0 degrees 16
minutes 07 seconds West 126 feet, said line being the center line of Henna
Avenue North; thence North 89 degrees 59 minutes 53 seconds East 1056.18 feet
to a point on the West line of Lot 2, Block 1, Royalhaven Estates 2nd,
Washington County, Minnesota distant 78.28 feet South of the Northwest corner
of said Lot 2; thence North 0 degrees 06 minutes 00 seconds East 78.28 feet,
along the West line of said Lot 2; thence North 80 degrees 00 minutes 00
seconds East 275.00 feet, along the Northerly line of said Lot 2, to the point
of beginning.
