APPROVING A VARIANCE FROM THE SIZE REQUIREMENTS FOR AN
ACCESSORY BUILDING LOCATED IN THE SINGLE FAMILY DETACHED
RESIDENTIAL (R-3) FOR BRIAN & EUGENIA SJERVEN ON PROPERTY
LOCATED AT 14496 GENEVA AVENUE NORTH
WHEREAS, Brian & Eugenia Sjerven have requested approval of a variance from the
size requirements for an accessory building to allow a total size of 540 square feet where
260 square feet is allowed by ordinance for the property legally described as follows:
RICE LAKE MEADOWS 4TH ADDITION, LOT 1, BLOCK 2, WASHINGTON
COUNTY, MINNESOTA
WHEREAS, the Board of Zoning has reviewed said variance at a duly called public
hearing on November 9, 2017, and recommends approval with the following findings and
conditions:
1. The requested variance is permissible by law.
2. Because of circumstances unique to the property the applicant is proposing to use
the property in a reasonable manner
3. The 280 additional square feet on the applicant's current accessory building
would not noticeably alter the character of the area.
4. The granting of the variance would be in keeping with the spirit and intent of the
ordinance.
5. Construction of an accessory building is allowed in the R-3 zoning district.
6. The subject property is not within a FEMA designated floodplain.
7. The subject property is proposed to be served by municipal sewer and water.
8. The applicant must apply and receive a building permit prior to construction of
the accessory structure
9. The accessory structure shall meet all building code requirements.
10. The accessory structure shall resemble, in style, materials, color, roofline, and
siding type, the principle building on the lot.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
variance request for Brian & Eugenia Sjerven from the accessory building ordinance to
allow a 280 square foot addition on the existing 260 square foot accessory structure for
one accessory structure totaling 540 square feet, where 260 square feet is allowed by
ordinance.
