Commissioner Kleissler called the meeting to order at 7:00 p.m.
PRESENT: Arcand, Derr, Kleissler, Lessard, Luchsinger, Tjernlund.
ABSENT: None.

Approval of Minutes for the Planning Commission Meeting of January 25, 2018
Commissioner Arcand made a motion, seconded by Commissioner Tjernlund, to approve minutes for the
meeting of January 25, 2018.
All Ayes. Motion carried.
Commissioner Lessard Abstained.
Review of Conditional Use Permit (CUP) for Lametti & Sons, Inc.
Leitz presented on the CUP review for Lametti & Sons, Inc. on property located at 16028 Forest Boulevard.
Leitz described that at its January 2, 2007, meeting the City Council approved a CUP for Lametti & Sons, Inc.
The CUP allows interior and exterior storage of material and equipment, and processing of cured -in-place pipe
that will be completed inside of an existing building. Leitz stated that condition #12 of the permit states that the
CUP shall be review every five years from the date of issuance. The last approved review of the permit took
place on November 19, 2012. Staff visited the property on January 29, 2018, and is not aware of any violations
of the existing conditional use permit. Leitz stated that staff finds Lametti and Sons, Inc. to be in compliance
with the CUP and staff recommended approval of the CUP review.
Chair Kleissler asked the representative from Lametti & Sons, Inc. if they would like to speak.
Mark Jay, project manager at Lametti & Sons, Inc., approached the podium. He stated he was willing to answer
any questions the Planning Commission had for the company in regards to the CUP.
The Planning Commission had no questions and agreed if the business was in compliance with the CUP, the
review should be approved.
Commissioner Derr made a motion, Commissioner Arcand seconded, to approve the Conditional Use Permit
(CUP) review for Lametti & Sons, Inc.
All Ayes. Motion carried.
Update on the White Bear Lake/DNR Lawsuit
City Administrator, Bryan Bear, provided background on the lawsuit and explained that on January 26, 2018,
there was discussion on construction dewatering resulting with an expectation that the prohibition will be
removed. Bear felt the order was vague, and the DNR was not providing much direction to the cities.
Bear talked about other conditions in the order and the DNR's change to Hugo's appropriations permit and
requirement for plans for a partial or total conversion to surface water. Hugo has no viable surface water to
support total conversion. A project was presented for a Metropolitan regional project that would cost
$630,000,000. The City would have to rely on other entities, and it's difficult to rely on such a plan. The City

has already complied with a partial conversion.
He provided options to meet the requirements for contingency plans. The City could use water from several
different sources, which would be prohibitively expensive. Another option would be to appeal the amendment
to the City's permit; there is a 30 day appeal window. The third option would be to prepare a simple plan to
meet the vague minimum requirements. Or, he explained, the City could do nothing and wait for the DNR to
take enforcement action. The City was now appropriated more water than it uses, but it will be needed for future
development.
Other conditions of the order expected to be done by February 281h were the preparation of a residential
irrigation ban, limitations put on total per capita use, and collaboration with other cities. He concluded by
saying the City is doing an excellent job in water conservation and aquifer management. Staff was not
requesting any action, but residents will start to look for remedies and a legislation solution will likely be
necessary.
