HomeMy WebLinkAbout2017.09.14 PC MinutesMinutes for the Planning Commission Meeting of Thursday, September 14, 2017 Chair, Kleissler called the meeting to order at 7:01 p.m. PRESENT: Arcand, Kleissler, Lessard, Tjernlund. ABSENT: McRoberts. STAFF: Bryan Bear, City Administrator Rachel Juba, Planner Rachel Leitz, Community Development Assistant Approval of Minutes for the Planning Commission Meeting of August 10, 2017 Commissioner Arcand made a motion, seconded by Commissioner Tjernlund, to approve minutes for the meeting of August 10, 2017. All Ayes. Motion carried. Lakeview Family Dental – 14475 Forest Blvd. N. - Variance Leitz presented on a variance application for Carrell Properties, LLC to allow a five foot side yard setback, where City ordinance requires ten foot setbacks from all property lines, to construct a new monument sign on the property. Leitz stated the existing monument sign was approved and permitted in 1993 with a side yard setback of three feet. No variance was required at that time. The landscaping around the base of the existing sign encroaches onto the neighboring south property as well as the MnDOT right-of-way. The applicant is proposing to extend the setback to five feet and is proposing to reduce the non-conformity by accommodating all landscaping on their own property. Leitz explained the standards staff uses to review variance requests including reasonable use, unique circumstances, character of the neighborhood, spirit and intent, prohibited use, hazard consideration, and septic and well compliance. Leitz stated that it was in staff’s opinion that the applicant meets all the criteria necessary to approve the variance request and recommended approval of the variance request for a side yard setback of five feet in order to construct the new monument sign. Commissioner Arcand asked if the setback was being increased from the west property line, along TH 61. Leitz stated that the structure will be further back from TH 61, however, the landscaping and illuminated tooth will be about the same distance from the road as the existing sign. Chair Kleissler asked the applicant if they would like to speak. Drew Carrell, applicant, approached the podium. He stated the current sign is five feet from the right-of-way and they will be moving the new sign to approximately seven feet from the right-of-way. Chair Kleissler opened the public hearing at 7:09 p.m. No one was in the audience. Chair Kleissler closed the public hearing at 7:10 p.m. Commissioner Lessard made a motion, Commissioner Arcand seconded, to recommend approval of the variance, subject to the conditions listed in the attached resolutions. All Ayes. Motion carried. Planning Commission September 14, 2017 Page 2 Appointment of Planning Commissioner to Board of Zoning Commissioner Lessard made a motion, Commissioner Tjernlund seconded, to recommend Commissioner Arcand be appointed to the Board of Zoning. All Ayes. Motion carried. Adjournment Commissioner Arcand made a motion, Commissioner Lessard seconded, to adjourn at 7:21 p.m. All Ayes. Motion carried.
