ADJOURNMENT BACKGROUND MEMO FOR THE CITY COUNCIL MEETING ON APRIL 16. 2016 D.1 Minutes for the April 2, 2018 City Council Meeting Staff recommends Council approve the minutes for the City Council meeting on April 2, 2018 as presented. F.1 Northeast Youth & Family Services Annual Report — President & CEO Jerry Hromatka President and CEO of the Northeast Youth & Family Services will present the annual report to Council G.1 Approval of Claims Staff recommends Council approve the Claims Roster as presented. G.2 Approve Agreement with Northeast Youth and Family Services Northeast Youth and Family Services (NYFS), located in White Bear Lake, has been providing counseling services to youth and families in the City of Hugo for at least the past 20 years. The City has paid NYFS $6,000 annually since the year 2009, and NTFS will continue providing service at that amount. Staff recommends Council approve the agreement with NYFS for counseling services for 2018. G.3 Approve Agreement with Lakes Center for Youth and Families, Inc. The Lakes Center for Youth & Family Services, located in Forest Lake, has been providing counseling services to youth and families in the City of Hugo for at least the past 20 years. The City has paid the Lakes Center $6,000 annually since the year 2009, and the Lakes Center will continue providing service at that amount. Staff recommends Council approve the agreement with Lakes Center for counseling services for 2018. GA Approve Special Event Permit for Color Fun Run on May 12, 2018 The Oneka Elementary School has requested a Special Event Permit for their annual 5K Color Run on Saturday, May 12, 2018. This event requires a Special Event Permit approved by Council because it is expected to draw approximately 800 runners and will include the use of City streets and sidewalks. This run will take place along Oneka Parkway between Oneka Elementary and Frenchman Road. The event has been held for the past three years with no impacts to the health, safety, and welfare of residents or participants. Staff recommends Council approve the Special Event Permit for the Color Fun Run subject to the conditions in the staff memo. G.5 Approve Special Event Permit for Wilson Tool Company Picnic on August 11, 2018 Wilson Tool has applied for a Special Event Permit to hold their annual company picnic on Saturday, August 11, 2018, at the Hanifl Shelter and Fields. This event requires a Special Event Permit approved by Council because there will be amplified sound, alcohol will be served, and approximately 1,000 people are expected to attend. Wilson Tool has held their employee appreciation picnic for several years at Lions Park and the past two years at Hanifl with no impact to the health, safety, and welfare of the residents or attendees. Staff recommends Council approve the Special Event Permit for the Wilson Tool Company Picnic subject to the conditions in the staff memo. G.6 Approve Special Event Permit for New Life Church Summer and Fall Events New Life Church, 6000 148th Street North, has applied for a Special Event Permit to hold outdoor events on Sunday, June 10 and Sunday October 7, 2018. A Special Event Permit approve by Council is required because they will be using an amplified sound system. The June event will be an outdoor service at 9 a.m. followed by a potluck. The October event is an outdoor gathering with potluck, hayrides, and outdoor games. Staff recommends Council approve the Special Event Permit for the New Life Church Spring and Fall events subject to the conditions in the staff memo. G.7 Approve Sale of Fire Department Vehicle #Ul (#4216) The Hugo Fire Department is looking to sell the 2006 Ford Expedition in their fleet that was recently replaced with a new vehicle. The City of Princeton Fire Department would like to purchase the Expedition for $5,000.00. The Hugo Fire Department feels that this is a fair price for the vehicle, as trade in value is estimated at $4,200.00. By selling the Expedition to the Princeton Fire Department, the Hugo Fire Department would also save the costs of having to remove the lights, sirens, and decals from the vehicle because the Princeton Fire Department will continue to use it to respond to emergency situations. Staff recommends Council approve the sale of the 2006 Ford Expedition #U1 (#4216) to the City of Princeton Fire Department in the amount of $5,000.00. G.8 Approve Preliminary Plat and Final Plat for Weston Estates Mike Cressman, on behalf of his mother Janice Cressman, 6085 165th Street North, has applied for a Preliminary Plan and Final Plat to be known as Weston Estates. Cressman owns the strip of land between the existing parcels that appears to have been created at one time for a future road, but the property was tax forfeited in 1987. The applicant is not proposing development of any property, but proposing to modify the property lines and combine parcels within this area to reduce non -conformities and the number of total parcels. Staff recommends approval of the preliminary plat and final plat, subject to the conditions listed in the attached resolutions. G.9 Approve Hiring of Steve Duff as a Seasonal Public Works Engineering Technician City staff recently met with former Senior Engineering Technician Steve Duff to discuss the possibility of seasonal employment to assist with ongoing engineering functions throughout the City. The City has been unsuccessful in filling the vacant Engineering Technician position since Steve's retirement in January. Staff expects to re -advertise and continue the search to fill the vacant position in the early fall. Meanwhile, the City will be relying on a combination of Public Works staff, WSB and Associates staff, and Steve Duff to continue to perform the essential engineering tasks. Staff is requesting Council approve the hiring of Steve Duff as a Seasonal Engineering Technician, with the expectations of working approximately '/2 time (40 hours per 2 week pay period) at a pay rate of $30 per hour as needed throughout the summer and fall of 2018. G.10 Approve Renewal of 2 a.m. License for the Blue Heron Grill Since May 2010, the Blue Heron Grill has had held a license that permits the establishment to stay open until 2 a.m. This license is renewed annually with approval by the City Council. Staff recommends Council approve the renewal of the 2 a.m. license for the Blue Heron Grill. G.11Approve Purchase of a Combination Sewer Cleaning Truck For many years the Public Works Department has been borrowing a combination sewer cleaning truck from White Bear Township to perform necessary sanitary sewer and storm sewer maintenance. The purchase of a USED combination sewer cleaning truck is something that the Public Works Department has been planning for quite some time. Staff has worked with Finance Director, Ron Otkin to budget and plan for this equipment. Staff feels that purchasing a quality used truck is the best option for Hugo. New combination trucks range in price between $450k and $500k. Staff feels confident that a quality used truck valued at half the price of new can be found and secured. City Staff was recently successful in obtaining a Rice Creek Watershed District Urban Stormwater Remediation Cost -Share grant in the amount of $25,000 to use towards the purchase of a pre -owned combination sewer cleaning truck. Although some of these vehicles are located in Minnesota, many of them are not. Public Works Director Scott Anderson is recommending that two Public Works employees travel to the best location to perform the inspections and negotiate the purchase of the combination truck. This process has been discussed with, and supported by, City Administrator Bryan Bear and Finance Director Ron Otkin. Staff is recommending that the City Council authorize staff to travel to a location, yet to be determined, to inspect and purchase a combination sewer cleaning truck priced at approximately $230,000. H.1 Receive Plans and Specs and Authorize Advertisement for Bids for Oneka Lake Blvd and Harrow Avenue Road Proiect At its March 5, 2018, meeting, Council approved the resolution ordering the improvements to Oneka Lake Boulevard and Harrow Avenue and the preparation of the plans and specs. Plans were prepared and shared with the residents at the open house held on Wednesday, April 11, 2018. Staff will provide an update to Council on that meeting. Staff recommends Council approve the resolution approving the plans and specs and authorizing the advertisement for bids for the Oneka Lake Boulevard/Harrow Avenue road improvement project. H.2 Discussion on Local Assessor At its February 5, 2018 meeting, staff discussed the resignation of Local Assessor Dan Raboin effective following the Board of Appeals meeting on April 12, 2018, and the importance of having a local assessor instead of contracting with the County. City Administrator Bryan Bear and Mayor Tom Weidt had met with Chase Peloquin, who was qualified to meet the City's assessor needs. Council had directed staff to negotiate a contract with Chase; however, Chase has since declined the opportunity. Staff advertised with the Cities of Scandia and Lake Elmo for requests for proposals for local assessors and received a single response from John Keefe, currently the county assessor for Chisago County. Staff will discuss with Council the next steps. K.1 Update on the Yellow Ribbon Network Council Members Chuck Haas and Phil Klein will update the Council on the activities of the Yellow Ribbon Network to date. L.1 Metro Cities Annual Meeting on Thursday, April 19, 2018 Metro Cities Annual Meeting will be held on Thursday, April 19, 2108, at the Como Park Zoo and Conservatory beginning at 5:30 p.m. This has been scheduled as a meeting of the Council. L.2 Spring Cleanup Day on Saturday, April 21, 2018 The City of Hugo will hold its annual Spring Cleanup event on Saturday, April 21, 2018 at the Hugo Public Works Department from 8 a.m. to noon. A list of accepted items and pricing can be found on the City's website. L.3 Kidz `n Biz Saturday, April 28, 2018 The Annual Kidz n'Biz Fest will take place on Saturday, April 28, 2018 at the Oneka Elementary School from 11:00 a.m. to 2:00 p.m. This has been scheduled as a meeting of the Council. LA LMC Annual Conference June 20-22, 2018 The League of Minnesota Cities will hold their Annual Conference on June 20-22, 2018 at the River's Edge Convention Center in St. Cloud. Staff recommends Council schedule as a meeting if they choose to attend and RSVP to City Clerk Michele Lindau for registration. M. PRESENT: Haas (via Skype), Klein, Miron, Petryk, Weidt ABSENT: None ALSO PRESENT: City Administrator Bryan Bear, City Attorney Dave Snyder, City Engineer Mark Erichson, Landform Planner Kendra Lindahl, Planner Rachel Juba, Parks Planner Shayla Denaway, and City Clerk Michele Lindau Minutes for the March 19, 2018 City Council Meeting Klein made motion, Petryk seconded, to approve the minutes for the City Council meeting on March 19, 2018, as presented. All Ayes. Motion carried. Approval of the Agenda Weidt made motion, Haas seconded, to approve the agenda as presented. All Ayes. Motion carried Stillwater School District Update- Superintendent Denise Pontrelli Stillwater School Superintendent Denise Pontrelli provided the Council an update on things happening in the Stillwater School District. She talked about their work on the next strategic plan and things that have been happening since the creation of the Bridge of Excellence Plan five years ago. She provided information about the district's priorities moving forward and things they are doing through partnerships. Miron talked about transition and asked about where the former Withrow School students were going to school. Pontrelli responded that, from looking at demographics, Lake Elmo and Woodbury were growing. The district was interested in selling the Withrow School, but there were no definite plans, and they are not actively pursuing what they will be done with it. They were in the process of selling the school in Marine on St. Croix. She added that many students have opened enrolled in other schools. Weidt recalled the Stillwater School District speaking to the Council a few years ago about supporting their levy, and he felt they were blindsided by the sale of Withrow. He asked for transparency. He talked about the sale of the playground equipment without the City being informed, and he asked her what she would have done differently. Pontrelli replied that for Hugo City Council Meeting Minutes for April 2, 2018 Page 2 of 6 money reasons, she agreed with the decision that were made, and stated she had only been in the superintendent position for two months before that happened (closing of the schools). The school board had a lot of decisions to make, and she did not have a lot of contacts in the district. She stated that 14 groups had contributed for the purchase of the playground equipment, and they had to go up for auction to sell. Weidt asked her to keep the City informed on issues and encouraged her to call when in doubt. Approve Extension for O'Reilly Auto Parts Site Plan and Variances At its February 2, 2015, meeting, the City Council approved the site plan and four variances for a 7,000 square foot auto parts store submitted by O'Reilly Auto Enterprises, LLC. Approval for site plans expire one year after City Council approval if a building permit is not approved and construction has not started on the building. The applicant did not construct the building. The applicant had requested an extension of the site plan and variance approvals. Adoption of the Consent Agenda approved the extension of the site plan and variance, subject to all conditions listed in the approving resolutions. Approve Special Event Permit for Blacksmith Lounge for 2018 Events The Blacksmith Lounge had applied for a Special Event Permit for events to be held during 2018. There would be a total of 14 events hosted on their property between April and October. Events include seven auctions, five car shows, one swap meet, and one corn feed sponsored by the White Bear Lake Hockey Association. These events had been occurring for several years including the largest event, the Northern Lights Car Show, for 30 years. All of the events would be outdoors. City Council approval was required because they will be serving alcohol, over 250 people were expected during some events, and an amplified speaker system would be used. Adoption of the Consent Agenda approved the Special Event Permit for the Blacksmith Lounge for 2018. Approve Renewal of 2 a.m. License for Sal's Angus Grill Since May 2010, Sal's Angus Grill had held a license that permits the establishment to stay open Hugo City Council Meeting Minutes for April 2, 2018 Page 3 of 6 until 2 a.m. This license is renewed annually with approval by the City Council. Adoption of the Consent Agenda approved the renewal of the 2 a.m. license for Sal's Angus Grill. Approve Wetland Replacement Plan for Roy Molitor 211 Addition for Schwieters Properties, LLP To accommodate expansion of its manufacturing division, Schwieters Properties, LLP had submitted an application requesting approval to impact wetlands found on the site. The applicant proposed to impact 1.58 acres of wetland. Impacts would be to two separate wetlands on the property, impacting Wetland No. 2 in its entirety and a portion of Wetland No. 1. The remaining wetland on the property were not proposed to be impacted. Schwieters were proposing to replace the wetlands that are impacted through the purchase of wetland credits from an existing approved wetland bank in Washington County. Based on staff's review of the application and supporting documentation, the requirements under the MN Wetland Conservation Act (WCA) had been met. Adoption of the Consent Agenda approved the Schwieters application for sequencing and wetland replacement. Approve Award of Bid for Fire Hall Roof and Mechanical Equipment Replacement At its February 5, 2018, meeting, Council approved the advertisement for bids for the Hugo Fire Hall roof and mechanical equipment. Bids were opened on March 23, 2018. Eight bids were received with the highest bid being $248,000 and the low bid being $168,185 from Diverse Construction Services, LLC. Staff recommended Council accept the bid by Diverse Construction in the amount of $168,185 for a new fire hall roof and rooftop mechanical equipment. Miron made motion, Klein seconded, to approve the award of bid to Diverse Construction Services, LLC. All Ayes. Motion carried. Approve 2040 Comprehensive Plan for Distribution In 2017, the City initiated the planning process to update the 2030 Comprehensive Plan that was completed in 2008. As part of the 2040 Comprehensive Plan update, Planner Rachel Juba explained, the City had held several meetings with residents, Commissions, and Council to gather feedback and understand the community's priorities. Meetings took place with the Council, Parks Commission, and the Planning Commission, who played a lead role in the review of the plan. The most recent meeting was an open house held on February 26, 2018, where approximately 58 people attended. Juba explained that the 2040 Plan included increased graphic content and layout, interactive links, and guiding principles throughout the document. The 2040 Land Use Map, including the MUSA, remained the same as the 2030 Land Use Plan. The chapter was updated to reflect affordable housing goals and density minimums. Minor changes were made to the Housing Plan and Economic Plan. The Parks, Trails, and Open Space chapter had the most changes, with the reorganization of chapters and changes made after the evaluation of the City's parks and trails. A new Resiliency Chapter had been included to focus on disaster preparedness and managing new technologies. Changes were made to the Transportation Plan to coordinate better with other plans. Hugo City Council Meeting Minutes for April 2, 2018 Page 4 of 6 City Engineer Mark Erichson talked about updates to the Water Supply and Water Distribution Plans that reflected a reduction in gallons used per day, which was mainly influenced by water conservation policies and water reuse projects. The projection of new wells was reduced due to these practices. He explained key updates included adding water conservation goals and strategies and changes made as a result of new Rice Creek Watershed District Rules. Changes were made to the Sanitary Sewer Plan due to less water being used, with average flow projections being significantly less. Juba reviewed comments made at the March 8, 2018 public hearing at the Planning Commission. Five residents spoke on the desire to remove the proposed trail along Everton Avenue, north of Frenchman Road. Comments were related to the activities along the road and trespassing, and residents were worried those activities would increase if there was a trail there. Rachel stated that during the public engagement process, there was a lot of discussion and desire to see trail connections. The Planning Commission voted 4-2 in favor of recommending approval of the plan. The two opposing members were not in favor of the trail connection shown on the map, stating it could be done with development. Juba stated the next step in the process was to get approval from the Council to distribute the plan and make final edits. The plan would then be adopted in November, 2018, and sent to Metropolitan Council for review and approval. Arnie Triemert, 15220 Everton Ave North, said they were misled about the trail, and he asked it to be removed until it is developed. He stated the road is not very wide, and he had safety concerns. He felt it was agreed to at the beginning meetings that there would be no trail there. John Udstuen, 15190 Everton Avenue North, said a great thing about the City was it had a history of not looking for a fight. When the Everton Avenue Study was done, the residents wanted to be left alone on a dead end road, and now people are trespassing. He stated it was not a path or maintained. Udstuen said trees had been cut down, their properties have become a 160 -acre dog park, and there were fire pits. He stated they do not come to the City regarding these things, saying it would be an infringement on the agreement made with the City. He said the neighborhood is 100% unanimous they do not want a path. Laura Syring, 15149 Everton Avenue North, said she has only lived there for 15 year. When she purchased the property, she did not know about the development and found out after the closing. She said the neighbors worked together with the development company on blacktopping the road. Syring stated she had a 20 -plus history in law enforcement, and said activities on the road included people camped out in vehicles, hit and run of mailboxes, poaching and hunting, and building treehouses and fire pits on private property. She said she was disappointed that the calls to the sheriff's department were never talked about at the meetings, and she felt the Council was not properly informed. She stated they just wanted to be left alone, and continuing beyond the dead end would encourage more traffic on the road. Syring said alot has gone on behind the scenes that the Council is not aware of, and she asked for the Council's consideration in removing the trail from the plan. Miron asked if there were any easements or ability to construct a trail. Juba replied that it would be discussed during a street reconstruction project. No evaluation has been done, but the road is narrow and there are steep ditches. Hugo City Council Meeting Minutes for April 2, 2018 Page 5 of 6 Klein said he realized the residents were very uncomfortable with this. The Council tries to make certain they meet the resident's goals, but there was not a cohesive plan in place. Klein made motion, Haas seconded, to abandon the trail with the understanding that it may be a possibility if it is ever developed. Haas stated that it is important to listen to residents, and it is a little premature to draw lines on a map if there is no plan at this time. He added that the City needed to look at the safety issues there. Petryk recalled when these parcels were eliminated for any future development, and they were to remain large lot residential, preserving the area for visual enjoyment. She felt they needed to honor those commitment. Mike talked about the need to address immediate concerns regarding safety in the area. Weidt started that it may be premature to have this dotted line and premature to be upset by it, and he was mainly concerned that there was a safety issue. He said the line can be removed but people will continue to walk down the road whether there is a line there or not. Weidt asked the residents to let the City know if there are activity occurring that are a public safety hazard. Weidt felt it was better to leave the line on the plan, but agreed to take it out. All Ayes. Motion carried. The Council stated their general approval of the plan. Miron made motion, Klein seconded, to approve RESOLUTION 2018 — 4 APPROVING A COMPREHENSIVE PLAN UPDATE FOR THE CITY OF HUGO. All Ayes. Motion carried. Update on Yellow Ribbon Network Council Members Chuck Haas and Phil Klein updated the Council on the activities of the Yellow Ribbon Network. Haas stated the YRN had held their 19ffi Welcome Home Pheasant Hunt the past weekend and the event was filmed by Ron Schara Production. Hamburger night last week was sponsored by the Arcand Family and Oneka Ridge Golf Club and 208 burgers were sold. They have Burger Night sponsors for the rest of the year, and next month's sponsor is Dan Gallatin. The YRN assisted a Gold Star family with car repairs. The Fairview Clinic had a candy book exchange and they donated the collected candy to the YRN for care packages. Girl Scout cookies will also be sent. He asked that if anyone who knew a deployed military member to send a package to, they should provide him an address. Board of Appeals on Thursday, April 12, 2018 City Administrator Bryan Bear reminded the Council the Local Board of Appeals and Equalization was scheduled for Thursday, April 12, 2018, from 5:30 — 7 p.m. in the Oneka Room at Hugo City Hall. Hugo City Council Meeting Minutes for April 2, 2018 Page 6 of 6 Metro Cities Annual Meeting on Thursday, April 19, 2018 City Administrator Bryan Bear informed Council the Metro Cities Annual Meeting will be held on Thursday, April 19, 2108, at the Como Park Zoo and Conservatory beginning at 5:30 p.m. He recommended Council schedule this as a meeting if they wished to attend. Klein made motion, Miron seconded, to schedule a meeting to attend the Metro Cities Annual Meeting on Thursday, April 19, 2018. All Ayes. Motion carried. Schedule Workshop for Gravel Roads Discussion City Administrator Bryan Bear reminded Council of their discussion at the November 20, 2017, meeting regarding the poor condition of the gravel roads. Council had directed staff to send notice to the residents along those roads to let them know the Council was looking for a solution and further schedule a workshop in the spring for discussion. Bear recommended Council schedule a workshop for some time during the week of May 14, 2018. Miron made motion, Weidt seconded to schedule a workshop for Monday, May 14, at 7 p.m. All Ayes. Motion carried. Schedule Open House for Oneka Lake/Harrow Avenue Street Proiect City Administrator Bryan Bear informed Council plans and specification had been prepared for the proposed Oneka Lake Boulevard and Harrow Avenue street improvement project. Staff had scheduled an open house be held on Wednesday, April 11 from 6-7:30 p.m. at the Rice Lake Centre. Bear recommended Council schedule this as a meeting if they wished to attend. Miron made motion, Petryk seconded, to schedule a meeting to attend the open house on the proposed street project. All Ayes. Motion carried. PARTIES This agreement is made and entered into by and between the City of Hugo Minnesota ("City") and Northeast Youth and Family Services ("NYFS"). II. RECITALS A. NYFS is a non-profit social service agency whose mission is to meet the unmet developmental needs of at -risk youth and families within their community environment with emphasis on providing services through collaboration and coordination with existing community resources. These services are available to youth and families residing in the northern suburbs of Ramsey County, including, but not limited to, the municipalities which are signatory to agreements which are identical to this Agreement ("participating municipalities") and students and families from Independent School Districts 621, 622, 623, 624, 282 and 832. B. Through this Agreement the City intends to contract with NYFS to provide such services to its residents and to act as a sponsor of NYFS by providing financial support, a method to establish appropriate services to be provided and policy guidance for its activities. C. This Agreement shall be used as the formal agreement between NYFS and each of the participating municipalies. This Agreement is intended to continue the spirit of cooperation and collaboration in the provision of social services between the City and NYFS. III. TERMS AND CONDITIONS In consideration of the mutual understandings of this Agreement, the parties hereby agree as follows: A. Prior Agreements Cancelled. By execution of this Agreement any prior agreements and amendments thereto between the parties are hereby cancelled. B. Services Provided. NYFS shall provide the City and its residents with youth and family programs set forth in the Addendum attached hereto. C. Principles of Service and Program Establishment and Operations. On a yearly basis and prior to submission of its annual budget, as provided for hereafter, NYFS shall: Report regarding proposed changes in services and programs to the City; and 2. Establish a fair and open bidding/request for proposal (RFP) process to contract, manage or provide such services and programs, which are not directly provided by NYFS staff. D. Funding 1. In addition to the participating municipalities' share of the annual budget, funds for the operation of NYFS will be raised by NYFS endeavoring to secure user fees, grants and appropriations from private organizations, the State of Minnesota, Federal and County agencies, and other legal and appropriate sources. 2. The City shall pay annually to NYFS the base amount listed in Exhibit A. 3. Any new City joining into this agreement will pay a base amount annually to NYFS that is on par with the amount paid by current participating municipalities. 4. Amounts payable by the City shall be paid to NYFS on or before January 30th of each year, or at a date mutually agreed upon by both parties, to cover the City's share for that year. E. Board of Directors. This agreement is contingent upon the City having the right to a seat on the Board of Directors. The Board of Directors shall be limited to not more than 30 Board members. F. Further Obligations of NYFS. In addition to the obligations set forth elsewhere in this Agreement, this Agreement is further contingent upon NYFS doing the following: The Bylaws of NYFS shall be amended to add provisions requiring an open process for contracting services as provided for in paragraph C.2., above, and prohibiting NYFS from supporting or opposing individual candidates for election to public office in any of the participating municipalities; and adding the requirement that IRS 501.C3 status be maintained. 2. On or before June 30, of any year NYFS shall submit the proposed city budgeted amount for the subsequent year. 3. On or before November 30, of any year NYFS shall submit a written report to the City including an Annual Report, the audited financial statement, and a program specific summary of services provided to the municipality; in addition, 30 days from the end of each calendar quarter, NYFS shall submit a written report to the participating municipality. 4. Periodically advising the City of services available through NYFS to the City's residents; 5. Establishing a sliding scale for services available through NYFS tc the City's residents and periodically advising the City of such fees; 6. Providing other reasonable information requested by the City; 7. Purchasing a policy of liability insurance in the amount of at least $1,500,000.00, naming the City as an additional insured and providing a copy of the insurance certificate evidencing such policy to the City; 8. Provide the City with a copy of its Articles of Incorporation, Bylaws, Amendments thereto, and the IRS tax exempt status letter; 9. NYFS shall defend and indemnify the City from any and all claims or causes of actions brought against the City of any matter arising out of this Agreement or the services provided pursuant to this Agreement; and, 10. Without the written approval of the City, NYFS will not enter into any agreement with any other city which differs from the terms and conditions of this Agreement. G. Term. The term of this agreement will be through December 31, 2018. Unless either party gives at least 6 months written notice of its intent to cancel this Agreement effective December 31 of the year in which the notice is made, NYFS will continue to provide services to the City if a successor agreement has not been executed prior to the end of the term. H. (A) Distribution of Assets Upon Dissolution. If NYFS ceases to operate, the Board of Directors will do one of the following: Give the assets to one or more non-profit agencies providing similar social services in the northern suburbs of Ramsey County; or, 2. Form a new Foundation to fund appropriate social service programming in the northern suburbs of Ramsey County. The final Distribution of Assets Plan must be approved by the Ramsey County District Court. (B) Deviation from the Mission. If the City Council determines that NYFS has materially deviated from its mission (See II. Recitals, A.), the City Council may ask the NYFS Board of Directors to consider dissolving the agency and liquidating the assets. The Board will do one of the following: 1. Consider the request and by a majority vote deny it. 2. Consider the request and by a majority vote agree to modify the programs to be consistent with the mission. 3. Consider the request and by a majority vote agree with the request and move to dissolve the agency and liquidate the assets. WHEREAS, the intent of City of Hugo is to build safer communities by repairing the harm from, reducing the risk of, and involving the community in the resolution of juvenile crime; WHEREAS, City of Hugo is committed to using community-based approaches to strengthen individuals, families, and community; WHEREAS, City of Hugo approves of the following outcomes for juvenile diversion and early intervention: Juvenile offenders will be held accountable for their actions by engaging in activities that repair the harm done to the victim and community and will participate in programs that promote an increased understanding of the impact of their offense on victims, communities, and themselves; Crime victims will be notified of diversion proceedings; will have opportunities to provide input; and, if willing, will have the opportunity to participate in the process; Community members will have active and direct involvement in programming; WHEREAS, the City of Hugo, pursuant to its goals of providing accountability and the most appropriate diversion and early intervention available to juvenile offenders, wishes to purchase services for youth involved in at -risk behavior from the Contractor to support these outcomes; NOW, THEREFORE, the parties agree as follows: Contractor's Duties — The Contractor agrees to the provision of the following services: a. Recruit and support community work -service sites for youth residents of the City of Hugo who are ordered by the court and/or referred by law enforcement. b. Educational and prevention programs, including Chemical Awareness, Choice & Consequence, fire awareness, theft awareness, violence awareness, or another approved alternative. Eligible juveniles include those who are referred the City's Police Department and other law enforcement personnel. The reason for the referral must be behavior or actions that could result in a police report and a petition for delinquency. c. Evaluation and counseling. Counseling services include crisis intervention, youth, and family and group counseling. Referrals will be made for psychological/ psychiatric evaluation and long-term mental health treatment. d. The City Police Department agrees to provide victims of crimes diverted by local law enforcement the opportunity for direct or indirect involvement into how the juvenile should be held accountable, including consideration of the impact of the crime on the victim and any specific needs for restitution. When necessary, due to the offense, restitution will be determined and collected. e. As appropriate, facilitate restorative justice interventions, such as victim/offender mediation, family group conferencing, and/or community panels, so that juvenile offenders are held direct accountable to the victim and victimized community through some form of reparation. f Provide support to parents of youth offenders, and provide opportunities for youth to access mentoring, enrichment, and leadership activities to keep youth from entering the juvenile justice system. 2. Attachments and References — The Contractor agrees to provide the enumerated services in Exhibit A, which is attached and incorporated herein by reference. 3. Cost and Delivery of Purchased Services — The total amount to be paid to the Contractor for services purchased under this agreement shall be $6,000. For these services, the City of Hugo agrees to make a single annual payment to the Contractor of $6,000 no later than August 1, 2018. 4. Eligibility for Services —A City of Hugo resident between the ages of five and eighteen (or older if still in high school), their family members, and the victims of juvenile crime who are assessed to be appropriate shall be eligible for the services provided under the terms of this agreement. 5. Evaluation . _Reporting and Information Recxuirements — The Contractor agrees to reasonable evaluations of its programs, employees, and volunteers and make them available for review by the City of Hugo if so requested. The Contractor agrees to comply with all reporting requirements as assigned by law, rule, or contract by the State of Minnesota and Washington County. The Contractor further agrees to abide by all laws and rules regarding confidentiality and data practices. The Contractor agrees to provide necessary information allowed by law and deemed necessary by the City of Hugo on referred cases. 6. Indemnification — The Contractor agrees to indemnify, defend, and hold harmless the City, its officers, employees, and agents for all claims arising out of the Contractor's activities related to the services provided under this agreement up to the liability limits set forth in Minn. Stat. 466.04. The City of Hugo will indemnify Lakes Center for Youth & Families, Inc. from and against all liability up to the liability limits set forth in Minn. Stat. 466.04. No other provision of this agreement shall serve to limit in any way the obligations of the Contractor to indemnify and defend the City of Hugo under this clause. 7 Insurance Reluireme_nts — The Contractor agrees that in order to protect it self, as well as the City of Hugo, from claims arising out of the Contractor's activities under this agreement, it will at all times during the term of this agreement keep in force policies of insurance providing the following liabilities: professional liability insurance policy in the minimum amount of Four Hundred Thousand Dollars ($400,000) bodily injury or death of one person; One Million Two Hundred Thousand Dollars ($1,200,000) for bodily injury per occurrence; comprehensive general liability insurance policy in the minimum amount of Four Hundred Thousand Dollars ($400,000) bodily injury or death of one person; One Million Two Hundred Thousand Dollars ($1,200,000) bodily injury per occurrence; One Million Dollars ($1,000,000) property damage; automobile insurance, including non - owned and hired autos, in the minimum of Four Hundred Thousand Dollars ($400,000) bodily injury or death of one person; One Million Two Hundred Thousand Dollars ($1,200,000) bodily injury per occurrence; and One Million Dollars ($1,000,000) property damage. The Contractor further agrees to maintain Workers' Compensation insurance in the statutory amounts. Certificates of Insurance showing the coverage listed herein shall be provided to the City of Hugo prior to the effective date of this contract. 8. Data Privacy — All data collected, created, received, maintained, or disseminated for any purpose by the activities of the Contractor because of this agreement is governed by the Minnesota Government Data Practices Act, Minn. Stat. Chapter 13, as amended, the Minnesota Rule implementing such Act now in force or as adopted, as well as federal regulations on data privacy. 9. Record Disclosures/Monitoring — Pursuant to Minn. Stat. 16C.05, Subd. 5, the Contractor agrees that the City of Hugo, the State Auditor, or any of their duly authorized representatives at any time during normal business hours and as often as they may reasonably deem necessary, shall have access to and the right to examine, audit, excerpt, and transcribe any books, documents, papers, records, etc., which are pertinent to the accounting practices and procedures of the Contractor and involve transactions relating to this agreement. The Contractor agrees to maintain these records for a period of three years from the date of termination of this agreement. 10 Nondiscrimination — During the performance of this agreement, the Contractor agrees to the following: No person shall, on the grounds of race, color, religion, age, sex, disability, marital status, public assistance status, criminal record, creed, or national origin be excluded from full employment rights in, participation in, be denied the benefits of, or be otherwise subjected to discrimination under any and all applicable federal and state laws against discrimination. 11 Independent Contractor — Nothing contained in this agreement is intended or should be construed as creating the relationship of co-partners or joint ventures with the City of Hugo. No tenure or any rights or benefits, including Workers' Compensation, unemployment insurance, medical care, sick leave, vacation leave, severance pay, PERA, or other benefits available to City of Hugo employees shall accrue to the Contractor or employees of the Contractor performing services under this agreement. 12. Conditions of the Parties' Obli ation — This agreement may be canceled by either party at any time, with or without cause, upon 30 days' notice, in writing, delivered by mail, or in person. Any alterations, variations, modifications, or waivers of the provisions of this agreement shall be valid only when they have been reduced to writing, duly signed by both parties, and attached to the original of this agreement. 13. Compliance With Law — The Contractor shall abide by all federal, state, or local laws, statutes, ordinances, rules, and regulations now in effect or hereinafter adopted insofar as they relate to the Contractor's performance of the provisions of this agreement. 14 Firearms — Unless specifically required by the terms of this contract, no provider of services pursuant to this contract, including, but not limited to, employees, agents, or subcontractors of the Contractor shall carry or possess a firearm on City premises. Violation of this provision shall be considered a substantial breach of the agreement. Violation of this provision is grounds for immediate suspension or termination of this contract, without notice, pursuant to Section 12. 15. Savings Clause — If any section of this agreement is found to be invalid or not enforceable, the remainder of the agreement will remain in force and binding. 16. Governing; Law — The laws of Minnesota shall govern the interpretation and prosecution of this agreement. 17. Notices — If any official correspondence concerning this agreement needs to be communicated to the other party, the following shall be deemed the effective addresses: As to the City of Hugo: As to Lakes Center for Youth & Families, Inc. BACKGROUND: Memorandum Oneka Elementary has submitted a Special Event Permit application for approval of a 5K Color Run on Saturday, May 12, 2018. This event requires a Special Event Permit approved by Council because the event is expected to draw approximately 800 runners and will include the use of City trail/sidewalks/streets. 2. DESCRIPTION OF EVENT: A Color Run is a fund-raising event for the Oneka Elementary and Hugo Elementary school. Students and families will get donations and earn rewards for the amount of money raised for participation in the 5K run/walk. This is their fourth annual event, and will be conducted as follows: • Organizers will set up the event between 7-9 a.m. Registration will be from 8:30- 10:00 a.m., and the run will begin at 10 a.m. • The run will take place along Oneka Parkway from the Oneka Elementary School towards CSAH 8 and back. With the number of runners expected, it will be necessary to close Oneka Parkway for the race. All residential areas have an alternate means of accessing their homes except the homes along Farnham Ave, north of Oneka Parkway. A Washington County Deputy will be stationed at that intersection to allow traffic to go across the Parkway on Farnham, allowing vehicles to enter/exit that neighborhood. Another deputy and car will be stationed at the Oneka Parkway/Frenchman Road intersection to prevent vehicles from entering. All other intersections will have adult crossing guards to block traffic and direct runners. The run is expected to last approximately two hours, and the road will be reopened immediately after all runners/walkers return to the school. • Limited parking will be at the front entrance parking lot at Oneka Elementary Participants are instructed to walk to the school if possible. • Color packets will be sprayed on runners at specified locations along the route. • A post -race party will be held in the busing area where there will be event activities and a DJ playing until approximately 1 p.m. • Water and fruit will be available free of charge. • There will be an inflatable arch at the beginning/end of the race. • Race organizers are working on having a Hugo Fire Department vehicle at the event, and they will have staff trained in first aid. 3. CONDITIONS The applicant has provided the City the completed permit, signed Hold Harmless Agreement, and permit fee. In accordance with this permit, the applicant shall conduct the event as described on their application and herein in addition to the following conditions. Prior to the Event 1. The applicant shall provide the City a copy of the insurance for the event naming the City of Hugo as additionally insured. 2. All tents and inflatables will be anchored per manufacturer's instructions. 3. The applicant shall secure Washington County Sheriff's Deputies to be stationed at specified intersections during the event, as recommended by the Sheriffs Department. 4. One week prior to the event, the applicant will contact the Hugo Public Works Director on the placement of the electronic sign at the Frenchman Road/Oneka Parkway intersection notifying road users that Oneka Parkway will be closed on May 12 from approximately 8:45 a.m. -12:30 p.m. 5. The applicant will contact the Hugo Public Works Director to confirm the drop off cones/barricades along Oneka Parkway at all intersections to be closed. 6. The applicant will notify all HOA's in the area of the road closure so they may get the word out to their residents. 7. The applicant will place signage along the route notifying residents that a race is in progress, as well as directional markers and caution signs. 8. All crossing guards will meet at approximately 8 a.m. with the Washington County deputies working the event to discuss procedures to follow along the route and at all intersections. During the Event 9. The applicant shall conduct the event in accordance with the approved plans submitted with the application. 10. The applicant and all volunteers will comply with all directions from the Washington County Deputies. 11. Adult volunteer crossing guards will block off the intersection with cones and barricades at approximately 8:45 a.m. and remain at the intersection until all run/walkers are done using the Parkway. 12. Adult crossing guards will be at all intersections to direct runners and ensure vehicular traffic does not enter the Parkway. Guards will also have the ability to contact a deputy should a problem arise. 13. Color packets will not be directed towards or sprayed near any vehicle, private property, or individual not participating in the event. 14. No food will be prepared and served on site. 15. There will be two water stops along the route. 16. Staff trained in first aid will be available during the race. 17. Weather conditions will be monitored during the event and delays/cancellations will be determined by the opinions of medical, security and police staff. Participants will be directed to the school gymnasium if necessary. After the Event 18. All garbage shall be removed from the school property and streets and properly disposed of. 19. Barricades will be immediately moved to allow normal traffic flow, and Public Works will pick up the barricades following the event. 20. All signage visible from a public street will be removed immediately after the close of the event. 4. CONCLUSION/RECOMMENDATION: The applicant has held this event for the past three years with no impact to the health, safety, and welfare of the residents of Hugo and participants of this event. Oneka Elementary has agreed to the above conditions, and staff recommends Council approve the Special Event Permit for the Color Run on Saturday, May 12, 2018. Request for a preliminary plat and final plat for "Weston Estates" located south of 165th St. and east of Highway 61 (Forest Blvd.) DATE: April 12, 2018 for the City Council Meeting of April 16, 2018 ZONING: Future Urban Service (FUS) 60 -DAY REVIEW DEADLINE: April 21, 2018 1. PLANNING COMMISSION UPDATE: At its April 12, 2018 meeting, the Planning Commission held a public hearing and considered the preliminary and final plat request for "Weston Estates." Staff will provide the Council with a memo update prior to the City Council meeting. 2. DESCRIPTION OF REQUEST: The applicant is seeking approval of a preliminary plat and final plat to allow for the alteration of ten parcels to become four parcels. The applicant is proposing the modification to move property lines and combine parcels within this area to reduce non - conformities and the number of total parcels. The applicant is not proposing development of the property. They are simply requesting to clean up the miscellaneous parcels with lot combinations and property line adjustments. 3. BACKGROUND: The applicant has lived within this neighborhood for a long period of time and is now selling the properties. A new buyer and neighbors have contracts to purchase some of the land, which would result in many property line adjustments, lot combinations, and extensive legal descriptions. The applicant has proposed a preliminary plat and final plat to alter ten existing parcels to become four parcels. Weston Estates Preliminary Plat & Final Plat Page 2 Most of the parcels within the proposed plat were single family properties, except one unique parcel that is strewn about the properties. City staff does not know a full history of this specific parcel, however does believe it was proposed streets at one point in time. In 1987 this property was sold as a tax forfeited property and has remained as a separate parcel. 4. CONTEXT: A. Surrounding Land Use and Zoning The subject properties are zoned Future Urban Service (FUS) and have a Mixed Use (MIX) land use according to the 2030 Comprehensive Plan. There are three parcels excluded from the plat, but within the neighborhood, that share the same zoning and land use designations. The property to the south is zoned General Business (C-2) and Single Family Detached Residential (R-3) and has both a MIX and Low Density Residential (LD) land use designation. The property to the east is a four acre single family residence also zoned FUS with a MIX land use designation. Properties to the north are single family homes, zoned FUS with a MIX land use designation. The property to the west, across TH 61, is zoned Restricted Industrial (RI -1) and has an Industrial (IND) land use. This property is currently being operated as an industrial business. B. Natural Site Characteristics Currently the area has three parcels that have single family homes on them and seven vacant parcels. The properties are relatively flat and heavily wooded. A large portion of the site is within the floodplain. 5. ANALYSIS: A. Level of City Discretion in Decision -Making The City's discretion in approving or denying a preliminary plat is limited to whether or not the proposed plat meets the standards outlined in the Comprehensive Land Use Regulations. If it meets these standards, the City must approve the preliminary plat. B. Consistency with Ordinance Standards PRELIMINARY PLAT Lot Requirements The FUS zoning district requires a minimum lot size of 20 acres, lot width of 300 ft. and lot depth of 480 ft. None of the existing parcels within the proposed plat conform to the requirements of the FUS zoning district. Weston Estates Preliminary Plat & Final Plat Page 3 Parcel 1: This single family home currently sits on approximately 0.51 acres. The plat indicates the east property line extending approximately 40 ft. further east, therefore, creating an approximately 0.64 acre parcel. Although this property will still not meet FUS lot size standards, this change will reduce the non -conformities by increasing the lot size as well as the lot width. Parcel 2: This single family home currently sits on approximately 0.5 acres. The plat indicates a change in property lines that will result in a parcel that is approximately 2.80 acres. This property will meet the FUS lot size standards for lot depth, however will not meet other lot size standards. Nonetheless, the proposed change will further reduce the non -conformities by increasing the lot size. In addition, this parcel is currently a land- locked parcel and does not have access onto 165th St. Although the proposed parcel will not meet the lot width standards, it further reduces the non -conformity by giving the parcel access to 165th St. Parcel 3: This parcel is comprised of many vacant parcels. These parcels will be combined and some of the unique "old roadway" property will be added to it. The resulting parcel will be approximately 4.08 acres. The property will meet the minimum lot width and lot depth requirements for the FUS zoning district. The parcel will continue to not meet the minimum lot size requirements, however, the non -conformity will decrease as the lot size will be larger than the many existing smaller parcels that it now consists of. Parcel 4: This single family home currently sits on approximately 0.35 acres. The plat indicates the property will be combined with another existing parcel to the east as well as a piece of the unique "old roadway" property. The resulting parcel will be approximately 0.59 acres. This property will meet the FUS lot size standards for lot width, however will not meet other lot size standards. Nevertheless, the proposed changes will reduce the non -conformities by increasing the lot size. The existing parcels do not meet the lot requirements of the FUS zoning district. The proposed plat reduces the non -conformities of each property. It is in staff's opinion that the proposed plat is more in conformity with the FUS zoning district standards for lot size than the existing conditions. Setbacks The FUS zoning district requires a 40 foot front yard setback, a 20 foot side yard setback, and a 50 foot rear yard setback. Parcel 1: There are three structures on this site. The existing house meets all setbacks for the FUS zoning district. The existing garage meets the front and rear yard setbacks, however is approximately 11 feet from the west property line. The shed meets the front and side yard setbacks, however is approximately three feet from the south property line. Although the proposed plat does not assist in reducing the setback non -conformities for this lot, they do not increase the existing the non -conformities. Parcel 2: There are two structures on this site. Both the existing house and garage meet the front and side yard setbacks, however do not meet the rear yard setback for the FUS Weston Estates Preliminary Plat & Final Plat Page 4 zoning district. With the proposed plat, both the existing house and garage will meet the 50 foot rear yard setback and be in conformity with the FUS zoning district. Parcel 3: There are no structures on this property. Parcel 4: There are two structures on this site. The existing house meets the front and rear yard setbacks, however is approximately 17 feet from the east property line. The existing garage meets the front and side yard setbacks, however is approximately six feet from the south property line. Since this property is proposed to be combined with other parcels, it results in the parcel having three "front yards" and two "side yards." The existing house would still not meet the side yard setback, however the proposed changes would not increase the existing non -conformity. The existing garage would not meet the 20 foot side yard setback, however, the non -conformity would be reduced as it no longer is required to meet a 50 foot rear yard setback. All but parcel three have multiple structures on site. The proposed plat would put all structures on parcel two in conformity with the FUS zoning district setbacks. Structures on parcels one and three would still not meet the setback standards in the FUS zoning district, however the proposed plat does not increase the existing non -conformities. It is in staff's opinion that the proposed plat is more in conformity with the FUS zoning district standards for setbacks than the existing conditions. Streets/Access The applicant has proposed to dedicate right-of-way (ROW) to the City on both TH 61 and 165th St. The applicant has proposed to dedicate 30 feet of ROW to the City on 165th St. and 150 feet on TH 61. At the time of development, the City will request an additional 39 feet of ROW as part of the TH 61 corridor plan, which requires a 150 foot wide corridor for future expansion. Additionally, City staff will further evaluate street access into the site upon development of any of the proposed parcels. Parcels one, two, and the parcel to the west of parcel one currently have one shared access onto 165th St. The applicant and these property owners have recorded a shared driveway agreement at the County. Drainage/Grading The applicant is not proposing any grading to the properties within the plat, therefore, drainage will not change within the site. 165th St. is classified as a rural road and has ditches on both sides that accommodates drainage from the road. At the time of development, installation of storm sewer will be further evaluated. Weston Estates Preliminary Plat & Final Plat Page 5 Wetlands/Floodplain The applicant has not completed a wetland delineation of the site. City staff will required a wetland delineation to be completed at the time of development of any of the proposed parcels. Much of the property within the plat is within the floodplain. Floodplain, including the floodplain elevation, will need to be further evaluated upon development of any of the proposed parcels. Utilities The occupied properties are all served by private well and septic systems and currently, do not have access to City utilities. The properties are within the Metropolitan Urban Service Area (MUSA), which means the properties are eligible to receive City utilities in the future. According to our municipal sewer and water service plan, the proposed plat is planned to be served by a 33 inch trunk sanitary sewer pipe and 12 inch watermain that is planned to be located along 165th St. The City's Comprehensive Plan also indicates that the proposed plat is within a search area for a future well location. Upon development of the site, City staff will further evaluate adequately supplying the area with City utilities. Park Dedication Park dedication is required of all land subdivided for residential purposes. The applicant has not created any new lots, therefore, it not required to dedicate parkland or pay any park dedication fees for the plat. 6. CONCLUSION: The applicant is proposing a plat to clean up miscellaneous parcels with lot combinations and property line adjustments. Many of the existing parcels do not meet FUS zoning district standards for lot requirements or setbacks. It is in staff's opinion that the proposed plat is reducing existing non -conformities and is a good way to attain greater compliance of the FUS zoning district standards. The applicant is not proposing to develop the property. At the time this area develops, further evaluation will need to occur regarding streets/access, drainage/grading, wetlands/floodplain, and utilities. Staff expects to re -advertise and continue the search to fill the vacant position in the early fall. This work includes routine cleaning of sanitary sewer mainlines and sanitary lift stations. It also includes the cleaning of stormwater infrastructure such as sump catch basins and other devices designed to reduce stormwater pollution. The combination sewer cleaning truck is critical in the response to sanitary sewer back up emergencies. This type of equipment allows you to clean sewers and vacuum debris and water at the same time. The Current sewer cleaning equipment operated by the Public Works Department is a 1985 Ford 8000 with "Jetter" sewer cleaning equipment installed on it. Essentially, it is a truck mounted water tank with a high pressure hose system. It does not have the capability to vacuum debris. Among the disadvantages of borrowing a combination sewer cleaning truck is the limited availability. Borrowing from a neighboring community becomes difficult to schedule as it can only be done when they are not using their equipment. Ownership of this type of equipment would increase the availability to routinely perform stormwater and sanitary sewer infrastructure maintenance. The purchase of a USED combination sewer cleaning truck is something that the Public Works Department has been planning for quite some time. Staff has worked with Finance Director, Ron Otkin to budget and plan for this equipment. Staff feels that purchasing a quality used truck is the best option for Hugo. New combination trucks range in price between $450k and $500k. Staff feels confident that a quality used truck valued at half the price of new can be found and secured. City Staff was recently successful in obtaining a Rice Creek Watershed District Urban Stormwater Remediation Cost -Share grant in the amount of $25,000 to use towards the purchase of a pre -owned combination sewer cleaning truck. Once the purchase of a truck is complete, RCWD will issue the City of Hugo a check to fulfill the grant obligations. PROPOSED PURCHASE PROCESS In the past, the City of Hugo has purchased new equipment through the State of Minnesota's Cooperative Purchasing Venture (CPV). However, staff is recommending that the City purchase a used combination truck. Used equipment is not available through the State's CPV, therefore staff has been searching the used equipment market elsewhere. Staff has contacted many used equipment vendors in the United States and have identified several pieces of equipment that are within the budgeted amount and would fit the needs of the department. The vendors selling these trucks are not located in Minnesota, so staff is recommending Council pre -approve Public Works staff to travel to a location where the trucks can be inspected. If a truck is inspected and deemed desirable, staff requests the authorization to negotiate a purchase at that time. Public Works Director, Scott Anderson, is recommending that two Public Works employees travel to the best location to perform the inspections and negotiate the purchase of the combination truck. This process has been discussed with, and supported by, City Administrator, Bryan Bear and Finance Director, Ron Otkin. DESIRED ACTION Staff is recommending that the City Council authorize staff to travel to a location, yet to be determined, to inspect and purchase a combination sewer cleaning truck priced at approximately $230,000. Request for a preliminary plat and final plat for "Weston Estates" located south of 165''' St. and east of Highway 61 (Forest Blvd.) DATE: April 13, 2018 for the City Council meeting of April 16, 2018 1. PLANNING COMMISSION UPDATE: At its meeting on April 12, 2018, the Planning Commission held a public hearing and considered the request of a preliminary plat and final plat to allow for the alteration of ten parcels to become four parcels located south of 165th St. N. and east of Highway 61. Two people spoke during the public hearing regarding the right-of-way requirements, a timeframe of when utilities would be extended down 165th Street, and further interest in the City's Land Use Plan. The Planning Commission considered the request while evaluating the City's Comprehensive Land Use Regulations. The Commission agreed that although the properties still do not meet the lot regulations in the FUS zoning district, the proposed changes would more align the properties with the FUS zoning requirements. The Planning Commission recommended approval of the request for a preliminary plat and final plat for "Weston Estates" with the conditions listed in the resolution. 2. CONCLUSION/RECOMMENDATION: It is in staff s opinion that the proposed plat is reducing existing non -conformities and is a good way to attain greater compliance of the FUS zoning district standards. Staff recommends approval of the preliminary plat and final plat for "Weston Estates", subject to the conditions listed in the attached resolution. O C� Co 0 CN
