RESOLUTION 2018-10 <br />APPROVING A FINAL PLAT FOR SCHWIETERS PROPERTIES LLP, FOR <br />"ROY MOLITOR 3rd ADDITION" LOCATED SOUTH OF 140TH STREET AND <br />WEST OF FENWAY BOULEVARD NORTH <br />WHEREAS, Schwieters Properties, LLP, has requested approval of a final plat to plat 1 <br />lot and 1 outlots to be known as "Roy Molitor 31 Addition" located south of 140th Street <br />and west of Fenway Boulevard and is legally described as follows: <br />Outlots A, Roy Molitor 2nd Addition <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat to Schwieters Properties, LLP, for "Roy Molitor 3rd Addition" subject to the <br />following conditions: <br />1. A final plat is approved to allow the creation of 1 lot and 1 outlots, in accordance <br />with the plans received by the City on April 24, 2018, except as amended by this <br />resolution. <br />2. The final plat shall be subject to the preliminary plat approval granted by the City <br />Council on December 19, 2011, and as may be amended. (Resolution # 2011-48 <br />and Resolution 2011-49). <br />3. Development is subject to the BP district standards and setbacks. No variances <br />are granted or implied. <br />4. The development shall comply with the comments in the Engineer's memo dated <br />May 3, 2018. <br />5. Although it is not required as part of the plat, Outlot A is proposed to be donated <br />to the City. Outlot A is intended to be owned and maintained by the City. <br />The following conditions shall be met prior to the issuance of building permits: <br />6. A site plan application shall be submitted for review and approval by the City. <br />7. The developer shall pay the sewer and water trunk fees and the City's SAC and <br />WAC fees will be paid at the time building permits issued. All associated <br />development fees shall also be paid in full. <br />8. The applicant shall file the final plat and associated documents with Washington <br />County. Proof of recording shall be provided to the City. <br />9. The applicant shall submit one full set of approved final plans to the City. <br />
