APPROVING FINDINGS OF FACT FOR REZONING FOR TGK AUTOMOTIVE
AND PREMIER BANK PROPERTIES LOCATED SOUTH OF 140TH STREET
AND EAST OF FOREST BLVD (HIGHWAY 61)
WHEREAS, TGK Automotive and Premier Bank, have requested reclassification of the
zoning from Neighborhood Service (NS) to General Business (C-2). The property is
legally described as follows:

WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval, and;
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcels
from NS to C-2;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the request
by TGK Automotive and Premier Bank, have requested reclassification of the zoning
from Neighborhood Service (NS) to General Business (C-2), based on the following
findings:
1. The NS and C-2 zoning districts have different permitted, accessory, and
conditional uses. The C-2 district allows for more intense commercial uses that
may include additional traffic, lighting, and noise. The construction limitations
are the same, except the lot coverage requirements. The applicants have stated
that they would like the property to be zoned C-2 because of the expanded uses,
which allows for the motor vehicle repair business, compared to the NS zoning
district.
The property is close to an important intersection adjacent to Highway 61 and
140th Street (CSAH 8), with high traffic counts. Any use on the property would
likely draw people from several areas of the City, other than the surrounding
neighborhoods. The area is consistent with what would be desired for uses in the
C-2 district to locate. Rezoning the property General Business (C-2) would be in
compliance with the land use guide plan.
2. The proposed zoning classification is appropriate for the properties because there
are no topographic, environmental, or cultural limitations of the site.
3. There is adequate infrastructure to support the proposed rezoning and
development of the properties.

4. While the properties to the east are developed with town homes, they are
separated from these properties by a wooded area. With proper transitions in the
site layout the wooded area could help serve as an acceptable transition to a
proposed commercial development. There are several situations in the City where
properties zoned General Business (C-2) are adjacent to residential uses. Staff has
evaluated site layouts and landscaping as a way to buffer commercial uses from
the residential uses. The properties can accommodate the expanded uses without
having an adverse impact on the surrounding properties.
