F.1 Swearing in of Brian Esch as Firefighter and Brian Kindelberger as Lieutenant
At its March 5, 2018, meeting, Council approved the promotion of Brian Kindelberger to
Lieutenant on the Hugo Fire Department, and at its July 2, 2018, meeting, Council approved
Brian Esch as a regular firefighter. Fire Chief Kevin Colvard will perform the swearing in of
Brian and Brian.
F.2 Forest Lake School District Update — Superintendent Steve Massey
Superintendent Steve Massey will provide the Council an update on the Forest Lake School
District.
G.1 Approval of Claims
Staff recommends Council approve the Claims Roster as presented.
G.2 Approve Annual Performance Review for Public Works Mechanic Dave Greeder
Dave Greeder was hired by the City of Hugo as the mechanic in the Public Works Department
on August 8, 2005. Public Works Director Scott Anderson recommends Council approve the
annual performance review for Public Works Mechanic Dave Greeder.
G.3 Approve Annual Performance Review for Public Works Director Scott Anderson
Scott Anderson was hired by the City of Hugo on August 11, 2003 as a Senior Engineering
Technician, and on August 5, 2008, Scott was promoted as the City's Public Works Director.
City Administrator Bryan Bear recommends Council approve the annual performance review for
Public Works Director Scott Anderson.
GA Approve Annual Performance Review for Public Works Lead Worker Mike Loeffler
Mike Loeffler was hired as a maintenance worker for the City of Hugo's Public Works
Department on August 5, 2002. On October 17, 2011, Mike was promoted to be the Public
Works Lead Worker. Public Works Director Scott Anderson recommends Council approve the
annual performance review for Public Works Lead Worker Mike Loeffler.
G.5 Approve Final Pay Request for Waters Edge Stormwater Reuse Proiect
In August of 2016, the City of Hugo entered in to a grant agreement with the Rice Creek
Watershed District and the Metropolitan Council for the Water's Edge Stormwater Reuse
Project. The City of Hugo received $30,000 from the Rice Creek Watershed District and
$200,000 from the Metropolitan Council towards this project. The project consisted of the
construction of a stormwater irrigation system at the 30-acre Water's Edge townhome area,
conserving an estimated 16.9 million gallons of groundwater annually. In the fall of 2017, the
construction of the Water's Edge Stormwater Reuse system was completed and the only
remaining work to be completed was the installation of the electrical transformer and connection
to power. On July 3, 2018, Peterson Companies completed the startup of the Water's Edge
Reuse system with Birch, the HOA's irrigation contractor. Peterson Companies worked with
Birch to get the pump system specifically programmed for the HOA's irrigation system.
Following this, on July 11, 2018, Peterson Companies conducted a successful startup of the reuse
system with representatives from the City, WSB, and RCWD in attendance. The City is now in
the process of completing the educational signage for the reuse project and plan to have this
installed as soon as possible. Staff has received the necessary contract closeout documentation
from Peterson Companies and staff is therefore recommending the acceptance of the
improvements and payment of the final voucher for the Water's Edge Water Reuse Project.
G.6 Approve Pay Request No. I for Oneka Lake Boulevard/Harrow Avenue Improvement
Project
Pay Request No. 1 is for work performed through July 31, 2018. The contractor has the first
layer of bituminous place on the entire project and is expected to be completed with the project
mid to late August. Staff is recommending approval of Payment Voucher No. 1.
G.7 Approve Resolution Approving Final Plat and Development Agreement for Oneka
Place
CPDC- Pratt -Oakwood, LLP, is requesting approval of a final plat on a 117 acre parcel located
north of Oneka Parkway and 159th Street. The site is currently vacant. The City Council
approved the preliminary plat and PUD for Oneka Place at its May 21, 2018, meeting. The final
plat will plat 54 lots from the Oneka Place preliminary plat. The lots meet the minimum lot
standards and requirements outlined in the regulations for the Oneka Place PUD. Staff
recommends approval the resolution approving the Final Plat and Development Agreement for
Oneka Place.
G.8 Approve Purchasing Agreement with HGAC for Cooperative Purchasing
Minnesota Statutes allow municipalities to purchase supplies, materials, or equipment without
regard to the competitive bidding requirements if the purchase is through a national purchasing
alliance or cooperative. The Houston -Galveston Area Council (HGAC) is a nationwide
procurement service that primarily deals with capital equipment for use by Public Safety and
Public Works departments across the United States. There are over six thousand local
governments, including 199 Minnesota public entities, that utilize their services. HGAC offers
an expedited procurement process that can eliminate the need for preparing detailed
specifications while satisfying all other requirements for competitive bidding. The City of Hugo
can use their services by entering into a contract which can be terminated upon 30 days written
notice. Staff recommends Council approve the execution of a membership contract with HGAC,
subject to review and approval by the City Attorney.
G.9 Approve Hiring of Hugo Residents Jacob Jorgenson and Timothy Olson as
Probationary Firefighters
Jacob Jorgenson and Timothy Olson have completed all the necessary requirements to be hired
as probationary firefighters. In addition to being available evenings and weekends, both have
daytime availability within their work schedule. Staff recommends Council approve the hiring
of Jacob Jorgenson and Timothy Olson as probationary firefighters on the Hugo Fire
Department.
G.10 Approve Hiring of Lino Lakes Resident William Lusk as Probationary Firefighter
William Lusk has completed all the necessary requirements to be hired as a probationary
firefighter. William lives eight minutes away beyond the west edge of Hugo in Lino Lakes,
however he is employed with Schwieters and works behind the fire station. Schwieters will
permit William leave work for daytime calls. Staff recommends Council make an exception to
the City Code, which requires firefighters to reside within a six -minute radius of the Fire Hall,
and approve the hiring of William Lusk as a probationary firefighter on the Hugo Fire
Department.
G.11 Approve Lawful Gambling Exempt Permit for North St. Paul, Maplewood, Oakdale
Rotary Club for Event at Wild Wings on September 14, 2018
The North St. Paul, Maplewood, Oakdale Rotary have applied for a Lawful Gambling Exempt
Permit to conduct raffles at their event at Wild Wings on September 14, 2018. Staff
recommends Council approve the Lawful Gambling Exempt Permit for the Rotary Club.

G.14 Approve Appointment of Maria Mulvihill to the Hugo Board of Zoning Appeals and
Adjustments
On July 17, 2018, Council conducted interviews of six individuals to fill vacancies on Hugo's
commissions. Staff continues to work on the logistics of having alternate members on the
commissions and will be bringing forth a recommendation to Council at a future meeting. Staff
recommends Council appoint David Fry to the Hugo Planning Commission, Shawn Haag to the
Hugo Parks Commission, and Maria Mulvihill to the Hugo Board of Zoning Appeals and
Adjustments.
H.1 Public Hearing on Vacation of Drainage and Utility Easement on Oneka Place
Development for Prairie Village Development
CPDC- Pratt -Oakwood, LLP, is requesting a vacation of the existing drainage and utility
easement located over a parcel that will be used for the development of Oneka Place. The
drainage and utility easement was used for drainage from the Prairie Village development to the
south. The drainage from that area will be incorporated into the Oneka Place development. New
drainage and utility easements will be placed on the lots at the time the final plat is recorded.
Staff is comfortable with the request to vacate the drainage and utility easements. Staff
recommends that the City Council approve the notice to vacate the drainage and utility easement.
I.1 Approve Appointments of Hopkin's Schoolhouse Committee Members
At its July 2, 2018 meeting, Council approve the formation of a committee to work on issues
related to the Hopkin's schoolhouse, specifically to proceed with a grant application to put the
structure on the Historical Register while exploring private public partnerships. The seven -
member committee is to be made up of one member of each of the commissions, a staff member,
and two residents. Each commission has selected a member and staff continues to work on
finding another resident to serve. Staff recommends Council select a council member to be on
the committee and appoint of EDA Commissioner Cindy Petty, Parks Commissioner Cathy
Arcand, Historical Commissioner Cynthia Schoonover, Planning Commissioner Matthew Derr
and resident Lynette Anderson, and one more resident yet to be determined to the Hopkins
Schoolhouse Committee.
J.1 Concept Plan for Frenchman Lofts
MWF Properties has proposed to develop a three story, 45-unit multifamily apartment complex
with both surface and underground parking upon an 18 acre parcel. The 18 acre parcel is located
northeast of Festival Foods within Frenchman Place. At their July 26th, 2018 meeting, Planning
Commission provided comments and feedback on the submitted concept plan. The applicant has
agreed to address comments made at the July 26th meeting. Staff recommends that the City
Council provide comments and feedback on the Frenchman Lofts concept plan.
L.1 Yellow Ribbon Network Report
Council Member Chuck Haas and Council Member Phil Klein will report to Council on the Yellow
Ribbon Network activities held recently.
M.1 TGK Automotive Groundbreaking Ceremony on Tuesday, August 7, 2018
TGK Automotive Specialists and Sullivan Day Construction has invited the Council to the
Groundbreaking Ceremony for TGK's new headquarters to be located at 13891 Forest Boulevard
North (former End Zone property). The ceremony will take place on Tuesday, August 7, 2108 at
9 a.m. Staff has posted this as a meeting if the Council would like to attend.
M.2 National Night Out Tuesday, August 7, 2018
Council has scheduled a meeting to attend National Night Out events on Tuesday, August 7,
2018. Staff will be providing Council a list of neighborhood events.
M.3 Lions Community Scramble Golf and YRN Fundraiser on Sunday, August 12, 2018
The Hugo Lions Club is sponsoring a Community Scramble Golf event with proceeds going to
the Hugo Yellow Ribbon Network. The event is scheduled for Sunday, August 12, 2108 at the
Oneka Ridge Golf Course. Registration begins at 7 a.m. with a shotgun start at 8:30 a.m.
MA Primary Election Tuesday, August 14, 2018
The State Primary Election will take place on Tuesday, August 14, 2018. Polls are open from 7
a.m. to 8 p.m. Voting information is available on the MN Secretary of State's website or contact
City Clerk Michele Lindau with questions on where to vote.
M.5 White Bear Lake Chamber Legislative Breakfast on Thursday, August 23, 2018
The Council has been invited to attend the White Bear Lake Chamber Legislative Breakfast in
the Oneka Room at Hugo City Hall on Thursday, August 23, 2018. This session will focus on
the tariff issue and its impact on the local business community. The program begins at 8:00 a.m.
with registration at 7:30 a.m. Staff recommends Council schedule this as a meeting if they
choose to attend.
M.6 Reschedule Midyear Budget Workshop
Council had scheduled a budget workshop for Thursday, August 23, 2018, at 9 a.m. This is the
same morning as the White Bear Lake Chamber Legislative Breakfast. Staff recommends
Council reschedule the Midyear Budget Workshop.
M.7 Reschedule September 3, 2018, Council Meeting to Tuesday, September 4, 2018, Due
to Labor Day Holiday
Each year, the Hugo City Council has to reschedule its first meeting in September due to the
Labor Day Federal Holiday. City staff recommends Council approve the rescheduling of the
September 3, 2018 City Council meeting to Tuesday, September 4, 2018.
M.8 BBO Cookout for YRN Fundraiser on Saturday, September 29, 2018
The Fry Group and eXp Realty are sponsoring a BBQ fundraiser on Saturday, September 29,
2018, from noon — 2 p.m. at Lions Park. Free BBQ ribs will be served until gone and all
donations will go to the Yellow Ribbon Network Foundation of Minnesota. Staff recommends
Council schedule the fundraiser as a meeting if they choose to attend.
M.9 Fall Cleanup on Saturday, October 6, 2018
The Annual Fall Cleanup is scheduled for Saturday, October 6, 2108 from 8 a.m. to noon at the
Hugo Public Works Building.
M.10 Fire Department Open House on Saturday, October 6, 2108
The Fire Department Open House will be held on Saturday, October 6, 2018 from 11 a.m. to 3
p.m. The Open House will include the Fearless Firefighter Fun Run 5K at 10 a.m. Registration
begins at 9 a.m. Staff recommends Council schedule the Fire Department Open House as a
meeting if they choose to attend.
M.11 Schedule City Wide Bus Tour for Saturday, October 6, 2018
Annually, the City holds a bus tour to of the City for Commission members, legislators, and
interested residents. This will be the City's 13th bus tour. Staff recommends Council schedule
the bus tour for Saturday, October 6, 2018, at 10 a.m. The starting location has not yet been
determined.
M.12 Notice of Vacancy on Brown's Creek Watershed District
Washington County has notified the City that the term of office for two Brown's Creek
Watershed District board members will expire on October 21, 2018. State Statute provides that
the County Board select watershed district managers from lists of nominees submitted by the
municipalities. Anyone interested in serving on the Brown's Creek Watershed District should
contact City Hall.

Haas requested a moment of silence to remember Carlos Wilcox, 27, of Cottage Grove; Daniel
Drevnick, 22, of Woodbury; and James Wertish, 20, of Olivia, who were killed in a missile
attack in Iraq on July 16, 2009.

Klein made motion, Miron seconded, to approve the minutes for the Gravel Roads Workshop
held on July 2, 2018, as presented.

Approval of the Agenda
Weidt made motion, Klein seconded, to approve the agenda as amended by moving the
Culpepper & Merriweather Circus from "Administrative Presentations" to "Appointments and

approval of an Offsite Gambling Permit for Merrick, Inc to conduct Purse Bingo at the American

Donation from Bald Eagle Sportsman Association to Hugo Yellow Ribbon Network
The Bald Eagle Sportsman Association (BESA) collected donations at their open house event
held in June. Nick Baumann, Vice President of the Bald Eagle Sportsman Association, presented
a donation of $674 to the Hugo Yellow Ribbon Network. Nick shared pictures from the event
and stated that, even though it rained, there were nearly 1,000 people who attended. The Council
thanked the Bald Eagle Sportsman Association for supporting the community.

Donation from White Bear Lake Lions Club to the Hugo Yellow Ribbon Network
White Bear Lake Lions Club Gambling Manager Jim Francis presented a donation to the Hugo
Yellow Ribbon Network in the amount of $5,000. Jim stated the funds were raised through
gambling, and the White Bear Lions Club feels good about supporting surrounding communities.
Council thanked him for the donation.
Lakes Center for Youth & Families Annual Report — Executive Director Matt Howard
The Lakes Center for Youth & Family Services, located in Forest Lake, has been providing
counseling services to youth and families in the City of Hugo for over 20 years. Executive
Director Matt Howard explained the center was previously called the "Youth Service Bureau".
Matt has worked there for 18 years and recently became the executive director. The center also
recently purchased new space using capital campaign funds. The organization is committed to
diversion, helping kids who are in trouble by avoiding process through the court system. Matt
stated that this was one of their most used services, and in the past year, the center was able to
help 15 youth, which saves taxpayers money. They also do mental health counselling and
enrichment, helping youth get into the workforce. Matt talked about their "Tried and True"
program, which gives kids hands-on learning, and stated he appreciated Hugo Power Equipment
for donating items for them to work on. Matt reminded Council of the All You Can Eat Taste
Event at the Winehaven Winery, and said he was pleased to have Washington County Deputy
Brandon Yetter receive the James Trudeau Award this year.
Culpepper & Merriweather Circus at Lions Park on Saturday and Sunday, July 21-22,
2018
The Hugo Lions Club will be sponsoring the Culpepper & Merriweather Circus at Lions Park on
Saturday and Sunday, July 21-22, 2018. Lions Member Pete Pederson talked about the
upcoming performances stating Showtimes are at 2 and 4:30 p.m. and tickets can be purchased in
advance at Wise Guys Pizza, Sager's Liquor, and Holiday Station Store. On July 21st at 9:30
a.m., they will be raising the tent followed by staff -led tours. All money raised goes towards
scholarships.

Staff recommends Council approve the Claims Roster as presented.
Approve Resolution Appointing Election Judges for 2018 Primary and General Election
Hugo City Clerk Michele Lindau requested to appoint 37 individuals to serve as election judges
for the City of Hugo's Primary and General Elections in 2018. All election judges would receive
two hours of training, and many of the judges have served in several past elections. Adoption of
the Consent Agenda approved RESOLUTION 2018-21 APPOINTING ELECTION JUDGES
FOR PRIMARY AND GENERAL ELECTIONS IN THE YEAR 2018. $Q
Approve Renewal of Mining Permit for Mike Atkinson
The Mining Permit for Mike Atkinson on his property located on the south side of 147th Street
between Irish and Hyde Avenue expires on August 1, 2018. Atkinson applied to renew the
permit for another two years. For the past several years, the site had been used to stockpile
material, with no mining activity taking place. When the permit was renewed in 2012, the
Council allowed Atkinson to move forward with the Mining Permit renewal process without all
the conditions being met until the time mining operations begin again, due to the cost of meeting
those conditions. The requirements not being met are to biannually provide a topographic map
of the site, calculation of stockpiled material and amount of granular material left on site to be
mined, and a reclamation plan. Staff visited the site on July 11, 2018, and found there had been
no changes on the property. Adoption of the Consent Agenda approved the Mining Permit for
Mike Atkinson for property located on 147th Street North with the condition that all requirements
in the permit be met when/if mining activity began again.
Approve Renewal of Electrical Inspection Service Agreement for Brian Nelson Inspection
Services, Inc.
The City has contracted with Brian Nelson Inspection Services, Inc. to perform electrical
inspections in the City. His current contract stated he is paid 70% of the permit fees collected for
completed inspections. Brian had requested the contract be amended by increasing it to 75%,
which is equal to the state's percentage. Adoption of the Consent Agenda approved the amended
Electrical Inspection Services Agreement with Brian Nelson Inspection Services, Inc.
Approve Temporary Liquor License for Hugo Lions Club for Wilson Tool Picnic on
August 11, 2018
The Hugo Lions Club had submitted an application for a Temporary Liquor License to serve
alcohol at the Wilson Tool picnic on Saturday, August 11, 2018. The picnic will be held at the
Hanifl Fields. Adoption of the Consent Agenda approved the Temporary Liquor License for the
Hugo Lions Club.
Approve Reduction in the Letter of Credit for Everton Investment/Pratt Homes Fable Hills
5th Addition
Elmcrest Investment / Pratt Homes Fable Hills 5th Addition, the developer, had requested the
City reduce the letter of credit being held for the Fable Hills 5th Addition. Steve Duff had
inspected the work and recommended the reduction of the letter of credit being held for the

constructed improvements be reduced to $118,976, which is equal to 20% of the original letter of
credit $594882. Adoption of the Consent Agenda approved the reduction of the letter of credit to
$118,976 for the improvements in the Fable Hills 5th Addition.
Approve Permit for Merrick, Inc. for Purse Bingo at Hugo Legion on August 6, 2018
Merrick, Inc., which serves adults with developmental disabilities throughout the Twin Cities,
had applied for approval of an Off -Site Gambling Permit to conduct Purse Bingo for the
Hugo American Legion on Monday, August 6, 2018. The Gambling Control Board allows
an organization to give consent for a second organization to run bingo, provided they complete
the proper forms. Adoption of the Consent Agenda approved the Off -Site Gambling Permit for
Merrick, Inc. to conduct Purse Bingo at the Hugo American Legion.
Approve Location of Drug Takeback Box at Hugo City Hall
In the past, Council had indicated an interest in having a drug takeback box to be located at Hugo
City Hall. This would be a part of Washington County's drug takeback program that provides a
place for residents to get rid of unwanted medications in a safe manner. The box would be located
in the northeast corner of the City Hall lobby. This box would be anchored to the wall or floor and
monitored by the Washington County Sheriff's Office.
Mayor Weidt removed this from the Consent Agenda to allow Sheriff Dan Starry to talk about the
program. Starry stated that, so far, the County has collected over 38,000 pounds of unwanted
medication, helping reduce the chance of prescription medicines being used in the wrong manner.
The closest takeback box for Hugo residents is located in the Forest Lake Service Center. The
Sheriff's Office has worked with the Washington County Public Health Director to obtain a box to
be located in Hugo. Starry stated that this will be the fifth box located in Washington County and
the first one located off County -owned property. He also talked about the opioid epidemic and
Minnesota being one of the hubs for trafficking. Washington County is one of five counties that
received federal funding for takeback boxes.
Weidt made motion, Haas seconded, to approve a drug takeback box to be located in Hugo City

The Preserve on Sunset Lake Sketch Plan
Shlayba Inc. (Cheldon Frank) applied for review and comments on a sketch plan for the
subdivision of a 135 acre site for the development of 13 single family homes to be known as
"The Preserve on Sunset Lake". Community Development Director Rachel Juba explained the
property is located off 125th Street, southwest of Sunset Lake, and a plat was approved on the
same property in 2006 for 39 lots to be known as "Sunset Shores". At that time, the ordinance
allowed density bonuses, but it had since been rescinded. The property has existing wetlands,
but is primarily farm fields and is located in the Rural Residential District where the density is

one unit per ten acres. The homes would be located on 5-acre to 10-acre lots located off a cul-
de-sac in the center of the site, so the overall density of the project would be one unit per 10.38
acres. The applicant would retain a 23.4 acre site as open space owned by the Homeowners
Association (HOA) and dedicate an outlot north of 125th Street to the City for expansion of an
existing City owned park parcel. Another outlot would be lake access for one of the lots. Each
lot would have its own well and septic system on site. The applicant was looking for comments
on the concept plan. The next steps would be to apply to rezone the property from Rural
Residential (RR) to Planned Unit Development (PUD) and apply for a PUD General Plan and
Preliminary Plat.
Juba updated the Council on the discussions at the Planning Commission and the Parks
Commission. Comments were made on integrating all lots into the development to ensure
adequate access to the open space, and reconfigure some lots to not encroach on the wetland.
They agreed with the dedication of a 1.20 acre strip of land along the southwest side of Sunset
Lake for expansion of an existing City owned park property (.71 acres) that was dedicated to the
City with the Royal Haven Estates development. This property has not been improved.
Council talked about the lots that were disconnected from the development and whether they
should be included because there may be future benefits. Juba was also asked to clarify the
parkland dedication requirements, and she replied they would be paying some in land and the
remainder in cash. There was a question on whether the cul-de-sacs caused concern regarding
emergency access, and Juba replied that it had been discussed, and there were no concerns. Juba
was asked to provide information on the parcel extending across the street on the southeast
corner of the development, and she explained it could be sold to an adjacent property owner or
dedicated as right-of-way for CSAH7. There was a question on the parcel dedicated for lake
access for one lot and whether there would be trespassing issues. Juba agreed there was potential
for that. Water reuse was discussed, and it was explained there was a pond, but it was not certain
whether it would be big enough for water reuse.
The developer Cheldon Frank and his engineer, Todd Erickson, introduced themselves to
Council. They talked about the lots not being connected and explained they would still be a part
of the HOA and development. They also talked about the changes they made to provide all lots
access to the existing wetland and trails, in response the Planning Commission's comments.
Wetlands and infiltration was discussed and Erickson commented that taking the land out of farm
production will likely help lake quality. They also stated they would be having discussions with
the County on dedicating the southeast corner land as right -a -way.
Approve a Wetland Replacement Plan for Schwieters Company
Staff added this item to the agenda to consider an amendment to the previously approved
wetland replacement plan for the Schwieters development. The applicant was required to
purchase credits from a wetland bank for replacement of the impact to the wetlands, and they
were approved to purchase credits from Bank #1522, which are no longer available. They were
now requesting to purchase credits from Bank #1618.
Haas made motion, Klein seconded, to approve the wetland credits be purchased from Bank
#1618.

Update on the Yellow Ribbon Network
Council Member Chuck Haas and Phil Klein reported to Council on the Yellow Ribbon Network
activities held recently. Photos were shown of the home improvement project that was instigated
by the Washington County Sheriff's Office. There was a picture of the 347th Regional Support
Group, and Haas talked about the 134th Brigade Support Battalion who reached out for help with
their picnic. Captain Troy Davidson, who had visited Council before to discuss alcohol
prevention, had met with others for support. There is a Lions golf outing August 12th at the
Oneka Ridge Golf Course. Xcel energy is the next Burger Night sponsor, and they are trying to
help the Hugo Legion get new kitchen equipment. There are deployments coming up, and Hugo
YRN is offering support. Haas read a letter they received from a command chaplain. Schwieters
is providing care package items. The YRN helped a Marine family with car repairs and
providing them a needed washer and dryer.
Update on the One Water Summit
Council Member Klein added this to the agenda to provide an update on the One Water Summit
he had attended recently. The One Water Summit involved getting entities together to talk about
water conservation. There were 29 states represented and seven Native American nations. Klein
stated that he found it interesting that water conservation policies and projects have been led by
the states of Colorado, Washington, California, and Minnesota. He said he was approached by
Metropolitan Council Representative Sandy Rummel and told that what Minnesota is doing is far
beyond anyone else in the nation. Klein talked about the success of the Water Legacy Act and
the Met Council's willingness to work with cities. Klein stated he was proud of what the Council
and Hugo community has done and encouraged everyone to continue on this path. City
Administrator Bryan Bear explained that the conference was hosted in Minneapolis this year, and
the Metropolitan Council was a chief sponsor. Klein was invited as a VIP to the Conference as
part of the Minneapolis delegation.

Ribbon Cutting was scheduled for 3:30 p.m. on Thursday. He recommended Council schedule as
a meeting if they wished to attend.

Dear Mr. Lindau:
Please find enclosed Construction Pay Voucher No. 3 - Final for the above referenced project in the
amount of $35,158.96. The quantities completed to date have been reviewed and agreed upon by the
contractor, and we hereby recommend that the City of Hugo approve Construction Pay Voucher No. 3 -
Final for Peterson Companies, Inc. in the amount of $35,158.96. This amount reflects work certified
through July 12, 2018, with no retainage.
We have also enclosed the following required documents:
1. Satisfactory showing that the contractor has complied with the provisions of Minnesota
Statutes 290.92 requiring withholding state income tax (IC134 forms).
2. Evidence in the form of an affidavit that all claims against the contractor by reasons of the
contract have been fully paid or satisfactorily secured (lien waivers).
3. Consent of Surety to Final Payment certification from the contractor's surety.
4. One-year maintenance bond beginning from the date of acceptance.

Agreement
DATE: August 2, 2018, for the City Council Meeting of August 6, 2018.
REVIEW DEADLINE: August 17, 2018 (60-days)
1. PROPOSED MOTION:
Move to approve the resolution approving the Final Plat and Development Agreement for Oneka
Place. Approval of the Final Plat and Development Agreement requires a 3/5 vote of the City
Council.
2. DESCRIPTION OF REQUEST:
The applicant is requesting approval of a final plat and development agreement in order to plat
54 lots and 10 outlots on the 117 acre parcel located north of Oneka Parkway and 159th Street.
The site is currently vacant.
3. BACKGROUND:
The City Council reviewed will review an the preliminary plat and PUD for Oneka Place at its
May 21, 2018 meeting. The final plat will plat 54 lots from the Oneka Place preliminary plat. The
general street locations and lot layout are the same as the preliminary plat and PUD. The
applicant has addressed the conditions of the preliminary plat for revisions to the plans, The lots
meet the minimum lot standards and requirements outlined in the regulations for the Oneka Place
PUD.
The park dedication requirement will be met by dedication of Outlot I.

WHEREAS, CPDC — Pratt — Oakwood, LLP, has requested approval of a final plat
development to allow construction of 54 single family lots and 10 outlots on the 117 acre
property legally described as follows:
(See Attached)
WHEREAS, the Planning Commission has reviewed the preliminary plat and PUD at a
duly called Public Hearing and recommends approval, and;
WHEREAS, the City Council approved the preliminary plat and PUD at its meeting on
May 21, 2018.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by CPDC — Pratt — Oakwood, LLP„ for a final plat and development agreement,
subject to the following conditions:
A final plat is approved to allow the creation of 54 single family home lots and 10
outlots, in accordance with the application and plans received by the City on June 18,
2018, July 5, 2018, and July 27, 2018, except as amended by this resolution.
2. The development shall substantially comply with all plans and conditions of the
preliminary plat and PUD approval granted by the City Council on May 21, 2018.
3. Development standards shall comply with Resolution 2018-14 and 2018, as amended.
4. The developer shall comply with all conditions outlined in the City Engineer's memo
dated August 2, 2018, and revisions required in "red -lined" comments from the City
Engineer.
5. Outlot Use and Ownership:
a. Outlots A, B, C, D, E, F, G, and H, are proposed for storm water ponding,
wetlands, and landscaping and shall be deeded to the City.
b. Outlot J is proposed for a public park and storm water ponding and shall
be deeded to the City. Park dedication will be satisfied with land
dedication of Outlot J.
c. Outlot I shall be deeded to the City. The outlot can be used for access to
the parcel to the east and additional development.

d. Outlot K is proposed for future development and will retain its current
ownership. The outlot is unbuildable until a new plat has been approved
by the City.
6. The developer shall design and install a storm water re -use system for the irrigation of
the lots.
7. The landscaping planned for the plat shall be installed in one phase. The developer
shall take proper precautions to protect the trees as the homes are being built.
8. Staff will continue to work with the developer on the street lighting plan. Exact
locations of the street lights shall be reviewed and approved by City staff prior to
installation. The street lights shall be the Lantern style decorative light.
9. Final design of the entrance monument shall be reviewed and approved by staff prior
to installation.
10. Prior to the release of the final plat for recording, the developer shall comply with the
following conditions.
a. An HOA shall be established to own/operate/maintain the following:
i. landscaping within the outlots,
ii. landscaping along Oneka Parkway within the right-of-way,
iii. landscaping on proposed residential lots,
iv. all retaining walls,
v. and the water re -use system.
The HOA documents/covenants shall be reviewed and approved by staff.
b. The storm water re -use system shall be reviewed and approved by staff.
The storm water reuse system operation, encroachment, and maintenance
agreement shall be reviewed and approved by City staff.
c. An encroachment and maintenance agreements shall be reviewed and
approved by staff for access and maintenance of landscaping, signage, and
retaining wall with in Outlots A, B, C, D, E, F, G, and H, proposed to be
deeded to the City.
d. Landscape easement shall be placed over the residential lots where
proposed landscaping will occur. The HOA shall be required to maintain
the landscaping on the lots.
e. The developer shall comply with all conditions outlined in the City
Engineer's memos dated March 3, 2018 and July 27, 2018

f. The development shall comply with the Fire Chiefs requirements
regarding fire flow calculations, the location of fire hydrants, fire
department connections, and fire lane signage.
g. The developer shall obtain all necessary stormwater management and
WCA permits from the City.
h. The developer shall obtain all necessary local, state, and federal permits.
i. The developer shall vacate the existing easement on Outlot J.
j. Architectural design standards shall be reviewed and approved by staff.
k. The developer shall work with City staff to provide trail connections to the
proposed park to the east.
1. The developer shall enter into a development agreement, shall agree to
complete all improvements, and pay all fees as required by the agreement.
13. Prior to the issuance of building permits, the developer shall comply with the
following conditions.
a. The applicant shall record the final plat, development agreement and all other
documentation at Washington County and provide the City with proof of
recording.
b. The applicant shall submit three full sets of approved final plans to the City.
c. If a sales trailer is located in the property, a site plan and building elevations shall
be submitted for City review and approval.
14. Prior to the issuance of Certificate of Occupancy, the developer shall comply with the
following conditions:
a. The bituminous trail access to the park shall be installed per the construction
plans.

We have reviewed the final plat submittal for Oneka Place located at the northern extents of
Oneka Parkway, Ethan Trail, Farnham Avenue and Falcon Avenue. In particular, we have
reviewed the following plans related to this particular request:

Based on the review of the final plat documents, we offer the following comments related to this
application:
Final Plat
1. All Outlots with the exception of Outlot J (the area adjacent to the water tower) have
drainage and utility easements over them.
Grading, Street, and Utility Plans
2. Staff has worked through a number of iterations with Westwood Professional Services to
address comments on street and utility construction plans. Staff has a limited number of
minor remaining redline comments. We will issue the construction plan approvals once the
remaining comments have been resolved. We do not expect that any remaining plan chances
will have a significant impact on the final plat.

3. Project phasing has been evaluated to ensure that utility, stormwater and water reuse
accommodations are available for each phase. The phasing plan for grading identifies two of
the ponds to be utilized for stormwater reuse being completed with the phase 1 grading that
can accommodate the initial final plat area.
4. Water service is provided by connecting to the existing watermain located within Oneka
Parkway, Ethan Trail, and Falcon Avenue. 12" trunk watermain extends the entire length of
Oneka Parkway. Trunk watermain oversizing will be reimbursed by the City of Hugo.
5. Sanitary sewer service is provided from the southerly portion of the site by direct connection
to the existing systems within Oneka Parkway, Ethan Trail, and Falcon Avenue. The
northern extents of the proposed development are the limit of what can be served by gravity
sanitary sewer. As outlined in the comprehensive sanitary sewer system plan, a lift station
will be required directly to the north of Oneka Place for future development.
Stormwater Management
6. The applicant has submitted their Storm Water Management Plan for the site, including the
appropriate storage, rate control, treatment, and volume reduction. The applicant is utilizing
water reuse as a means to irrigate the development and meet a portion of the stormwater
management requirements. It is anticipated 4-5 million gallons of groundwater will be
conserved annually by use of stormwater reuse.
7. The stormwater reuse system will be located with lot -line drainage and utility easements,
road right of way, and outlots. The system will be owned and operated by the Homeowners
Association, and the City will have access to the system as needed for monitoring and
operation. The applicant is meeting approximately 50% of the volume reduction requirement
by utilizing water reuse. The remaining volume control requirement is met through the dead
pool storage provided in the NURP ponds.
8. A water balance analysis has been submitted as part of the stormwater submittal identifying
adequate water supply with the stormwater basins to sustain water reuse.
9. A detailed groundwater analysis has been submitted to identify the elevation of groundwater.
The findings have been used to identify minimum floor elevations that provide required
separation from groundwater.
Wetland
10. Wetland banking has been utilized by the developer to address wetland impacts within the
site.
Development Agreement
11. There are a number of development fees outlined within the City's Fee Schedule that will
become due as part of the final plat. The Development Fees are included within Exhibit C of the
Development Agreement.
12. A credit to the trunk area charge based on the anticipated reduction in water demand by using
stormwater reuse has been included as part of the Development Agreement.

DEVELOPMENT AGREEMENT
Oneka Place
THIS AGREEMENT, made and entered into this day of , 2018 by and
between the CITY OF HUGO, a Minnesota municipality organized under the laws of the State of
Minnesota (hereinafter referred to as "City"); and CPDC — Pratt — Oakwood, LLP (hereinafter
referred to as "Developer").

WHEREAS, the City Council of the City has, by Resolution Number 2018-14 on
May 21, 2018, approved the preliminary plat for a major subdivision as proposed by the Developer
to be known as "Oneka Place" ; and,
WHEREAS, the City Council of the City has, by Resolution Number 2018-15 on
May 21, 2018, approved the PUD general plan for a major subdivision as proposed by the
Developer to be known as "Oneka Place" ; and,
WHEREAS, the City Council of the City has, by Resolution Number
on , approved the final plat for a major subdivision as proposed by the Developer to be
known as "Oneka Place" (hereinafter referred to as the "Plat"); and,
WHEREAS, the Plat proposed a development of an approximately 56 acre parcel of
land into 54 residential lots and 10 outlots; and,
WHEREAS, it is the policy of the City to enter into development contracts as
contemplated in Minnesota Statutes §462.358, Subd. 2(a); and,
WHEREAS, the parties hereto desire to set forth their respective rights and
obligations of the parties to this Agreement.
NOW, THEREFORE, in consideration of the premises and of the mutual promises
and conditions contained herein, it is agreed by the parties hereto as follows:
A. GENERAL ENGINEERING CONDITIONS;
1. Escrow for City Costs and Fees. Developer shall, contemporaneously with
the execution of this Agreement, deposit with the City an escrow as outlined in Exhibit C to cover
the cost of legal fees, engineering and construction observation fees, administrative expenses, and
other costs related to this Plat.
All fees and costs incurred by the City in connection with the Plat shall be
charged against said escrow account which shall remain in effect until the expiration of the
warranty period for the Plat, as defined in paragraph 7, in all events said fees and costs shall be the
responsibility of the Developer and shall be paid on demand. Any funds remaining in the escrow
account after the completion of the warranty period shall be refunded to the Developer. In the event
that the escrow account herein is depleted, Developer agrees to post additional funds to replenish
the account and to cover projected City costs. Specifically, Developer agrees that the escrow
account shall maintain a balance of no less than $5,000.00. Developer shall be entitled, upon
request, to an itemized statement of all costs and fees charged against this escrow account.

2. Development Plans. In accordance with the policies and ordinances of the
City, and subject to all City resolutions and approvals in connection herewith, the Developer shall
construct the proposed improvements (hereinafter referred to as the "Improvements"). All
Improvements shall be constructed and installed pursuant to the terms and conditions herein set
forth in accordance with the plans approved and listed on Exhibit A, subject to all City resolutions
and approvals listed in Exhibit B, subject to final approval by the City, and in accordance with City
standards and requirements including those listed herein. In addition, all public street, utility, and
storm drainage improvements shall comply with the City's adopted specification book and the
reasonable direction of City staff.
3. Authorization to Proceed with Construction. Developer agrees not to
commence any grading, utility or street work within the Plat until the following are completed:
1) Construction plans are approved by the City and distributed.
2) Pre -construction conference is held.
3) Notice to Proceed is issued.
4. Construction Observation. The City, for its benefit, will provide staff of
its choosing to provide construction observation for the Improvements outlined in this Agreement.
All costs associated with construction observation and inspection will be the responsibility of the
Developer. The Developer shall allow City staff and City consultants access to the Plat to allow for
this work to occur.
5. Miscellaneous Requirements.
a) Property Corners: All property corners as identified on the Plat
must be monumented with iron surveyor's pipes by the Developer prior to final project acceptance,
as defined in paragraph 7 of this Agreement.
b) Drainage Easements: Drainage easements shall be dedicated on
the Plat so as to cover any wetlands and stormwater ponding areas located below the 100-year high
water levels.
c) Soils Testing: Soils inspection and compaction testing by a
registered professional engineer shall be accomplished on all lots where filling is required, in
accordance with the approved Grading, Drainage, and Erosion Control Plan. A minimum of one
(1) compaction test for all developed lots shall be obtained for every two (2) foot increment of fill
that is placed. A summary of all inspections and compaction tests for all developed lots shall be
provided to the City upon completion of the grading and shall be provided for a respective lot prior
to the issuance of a building permit for such lot.

d) Private Utilities: All private utilities that are installed, including
electricity, telephone, natural gas and cable television, shall be installed underground.
e) Mailboxes: Developer shall coordinate mailbox locations with the
United States Postal Service.
f) Street Lights: Street lights shall be installed within the Plat
according to the Street Lighting Plan, which will first be approved by the City Engineer. Developer
shall also submit its Street Lighting Plan to the applicable power company for its review, comment
and approval. The installation of the street lights shall be coordinated with the applicable power
company so that the street light system is installed, constructed and operated in such a manner as
will harmoniously exist with other street lights within the area.
g) Working Hours: Construction activity, including equipment
startup and fueling, can only occur between the hours of 7:00 a.m. and 7:00 p.m. Monday through
Friday; 8:00 a.m. and 5:00 p.m. on Saturdays; at no time on Sundays or holidays.
h) Street Sweeping: Developer shall sweep and/or otherwise clean all
streets, as needed, within and adjacent to the Development property as a result of construction
activities associated with the Plat until final acceptance of the Improvements. If the streets are not
maintained in a manner acceptable to the City, after reasonable notice to the Developer the City will
arrange for the street sweeping at Developer's cost.
i) Placement of Bituminous Wear Course: The bituminous wear
course can be placed on all streets once all of the following have occurred:
A Certificate of Occupancy has been issued for at least 75%
of the lots or a cash escrow in the amount of $10,000 has
been deposit with the City which will be held until 75% of
the lots have received Certificates of Occupancy. At the
City's discretion, the wear course may be placed prior to
having 75% occupancy. If applicable, the warranty period
shall be extended an additional one (1) year for a total of two
(2) years from final acceptance. In no case shall the wear
course be placed with less than 50% occupancy.
2. The base course on all streets has been in place for at least
one full freeze -thaw cycle.
3. City staff or its assignees have visually inspected all
roadways and curb within the Development, and any repairs
necessary as a result of said inspection are complete and
written approval issued.
6. Proiect Completion: The Improvements listed herein on Exhibit A, including
street, sanitary sewer, storm sewer, and municipal water, shall be completed subject to the approval

of the City in accordance with the approved plans. All Improvements shall be substantially
completed to the reasonable satisfaction and approval of the City within twelve (12) months of the
execution of this Agreement. Substantial completion shall consist of all work with the exception of
placement of the bituminous wear course and completion of the final punchlist. The Developer
shall be excused from the strict completion date set forth herein if written notice is received from
the Developer of the existence of causes over which the Developer has no control which will delay
the completion of the work and approved in writing by the City. In that event, the City may extend
the date or dates herein specified.
7. Project Acceptance: Final project acceptance will be considered by the City
Council once the following have been completed:
(a) All Improvements are installed according to the approved plans.
(b) All punchlist items are completed.
(c) All Record Drawing information has been provided to the City to its
satisfaction.
(d) Escrow account for City costs and fees is current in accordance with the
provisions of this Agreement.
(e) The City receives confirmation via lien waivers that contractors or other
parties have been paid for the work completed.
(f) The City receives a written request from the Developer to accept the
Improvements.
8. Record Drawing Requirements and Engineer's Certification. Following
completion of all development activities and prior to the release of security and acceptance of
Improvements, the Developer and/or their assignee shall provide to the City "as -built" plans for the
Improvements listed on Exhibit A. This information shall be provided to the City in the following
formats:
(a) 1-set mylar drawings (22" x 34") for all Improvements.
(b) 1-set paper drawings (22" x 34") for all Improvements.
(c) Individual Adobe.pdf (or approved equivalent) for all plan sheets and the
final plat.
All Record Drawings shall include the following information:
(a) All bench marks shown on plans (bench marks shall be top nut of hydrants).
(b) Swing ties to all gate valves shown on plans (ties should be to manholes,
catch basins, hydrants or other permanent objects.
(c) Swing ties to curb stops shown on plans (ties should be to manholes, catch
basins, hydrants, property corners or other permanent objects).
(d) Top of casting and invert elevation for all structures.

(e) All pipe sizes, material type, pipe classification, grades and lengths
(f) All horizontal and vertical curve data in the appropriate location on the
plans.
(g) Televised report of the sanitary sewer with videotape.
(h) Swing ties to any manhole or catch basin outside the roadway area.
(i) A text file including the x, y and z coordinates (based on Washington
County's coordinate system) for the following:
1. All curb stops
2. All hydrants
3. All gate valves
4. All manholes located outside of the roadway
9. Construction Warranty and Financing of Improvements. The Developer agrees
to construct the Improvements described herein at its own expense and in accordance with City
specifications. The Developer shall engage at its own expense a registered, professional civil
engineer to prepare plans and specifications for the Improvements and shall submit the same to the
City for review and approval. The Developer represents and warrants that all of the Improvements
made as a part of this development shall be guaranteed to be properly functioning as designed for a
period of not less than one (1) year following acceptance of the entire project by the City. In the
case of any material or labor that is supplied and that is reasonably rejected by the City as defective
or unsuitable, then the rejected materials shall be removed and replaced with approved material,
and the rejected labor shall be done anew to the reasonable satisfaction and approval of the City at
the sole cost and expense of the Developer. In any event, none of the warranty periods expressed
herein shall begin to run until all of the Improvements within the Plat have been approved and
accepted by the City.
The Developer's engineer shall certify that grading within the Plat was completed in
accordance with the approved Grading, Drainage and Erosion Control Plan before the City issues
any building permits. The Developer shall remain ultimately responsible for accurate grading of all
lots and shall correct any deficiencies in grading that may be discovered until the certificate of
occupancy is issued or the developer is released from its obligation under this Agreement as
outlined in paragraph 7 above.
10. Signs. The Developer shall prepare a plan for all regulatory, directional and street
name signs to be within the Plat. The plan shall be reviewed and approved by the City's public
works department. Upon plan approval, the City's public works department shall install all public
signage within the Plat. The installation of all private signage shall be the responsibility of the
Developer. All costs related to the installation of public signage shall be the responsibility of the
Developer and will be deducted from the Developer's escrow account. The Developer shall post
funds as outlined in Exhibit C prior to the City's public works department beginning the
installation.

11. Drainage Easements.
a) Work within Easements: No improvements, landscaping, or grading,
other than Improvements shown on the approved plans, shall be permitted in dedicated drainage
easements without the prior written permission of the City and any regulatory agency having
jurisdiction.
b) Maintenance Responsibilities: The Developer and its successors in
interest, including all individual homeowners, shall be responsible for routine maintenance of all
storm water management ponds, wetlands, and drainage areas within easements dedicated to the
City on their property. Routine maintenance shall include litter removal, mowing and maintenance
of the property adjacent to pond or wetland areas. In the case of drainage swales, routine
maintenance includes the removal of obstructions from the swale as necessary to maintain proper
drainage in addition to the aforementioned items. The City shall be responsible for non -routine
maintenance of storm water ponds within the easements, including pond dredging, maintenance of
the storm water inlet(s) and outlet(s) pipes, and erosion control at outlet and inlet locations. Such
maintenance shall be completed as deemed necessary by the City.
12. Wetland Signage: Permanent signage shall be placed along wetland edges as
outlined in the City's General Specification and Standard Details Manual or approved equal by the
City.
13. Lowest Floor Elevations. All minimum floor elevations shall comply with Section
90-171 of the Hugo Zoning Ordinance, the City's Comprehensive Stormwater Management Plan,
or the approved Grading, Drainage, and Erosion Control Plan, whichever is more restrictive.
Except as may be specifically allowed under Exhibit A, no building shall be constructed on any of
the lots herein unless the lowest floor elevation is at least three (3) feet above the 100-year flood
elevation or four (4) feet above the high groundwater elevation, whichever is greater, for the subject
property. Additionally, the lowest floor elevation shall be specifically referenced and designated,
for each lot, on a certificate of survey, which survey shall be provided to the City before any
building permits are issued for any lots within the Plat.
14. Landscaping. All disturbed areas within the Plat shall be landscaped in accordance
with the approved landscape plans, the City ordinances, and the City's General Specification and
Standard Details Manual. All landscaping shall be complete, established and growing within sixty
(60) days of issuance of a Certificate of Occupancy, except that, if the certificate of occupancy is
issued between the dates of October 1 and May 1, then the landscaping required herein shall be
complete, established and growing no later than July 1. All front yards, side yards and back yards
shall be fully sodded. All landscaped areas shall be tilled or otherwise worked mechanically in
order to loosen compacted soils and shall contain at least four (4) inches of black dirt containing no

more than 35% sand. Unless specific arrangements are made and agreed to by the City, all
landscaping installed within the Plat shall be maintained by the Developer and its successors.
All areas, other than proposed street areas, disturbed by grading activities on the site shall be
seeded. Seeding shall be immediate upon completion of grading activities or as directed by the City
Engineer. Seeding shall be completed as follows:
a) All areas shall be restored with a minimum of four (4) inches of adequate
topsoil prior to seeding.
b) Upland areas shall be seeded in accordance with the grading, drainage, and
landscape plans listed in Exhibit A. The rate of application shall be one hundred (100) pounds per
acre. Areas seeded shall be mulched with Type 1 mulch at a rate of two (2) tons per acre. All
mulch shall be disk anchored.
c) Wetlands, wetland replacement areas and storm water ponding areas shall be
seeded with MN/DOT Seed Mixture 25B, or as required by the permitting regulatory agency. The
minimum rate of application shall be thirty (30) pounds per acre, or as recommended by the
supplier.
d) All seeded areas shall be maintained for the term of this Agreement. Upland
areas shall be mowed as necessary or as directed by the City Engineer.
e) All disturbed areas within the development shall be maintained to limit
vegetation growth to less than ten (10) inches except designated natural areas or designated open
spaces as shown on the approved plans.
15. Safe Rooms. The Developer shall require all builders to offer a safe room as an
option to any and all potential homebuyers. All safe rooms offered and built within the City
must meet or exceed FEMA requirements and standards.
B. ESCROWS, CHARGES AND UTILITY OVERSIZING:
Developer shall pay the escrows, fees and charges listed on Exhibit C.
C. SPECIAL PLANNING REQUIREMENTS:
The Plat shall be built and maintained in accordance with the planning requirements
listed on Exhibit A hereto, and any miscellaneous requirements listed on Exhibit B hereto.
D. ADMINISTRATIVE REQUIREMENTS:
1. Miscellaneous Provisions. Developer specifically understands that this Plat
approval is given subject to the following requirements:

i
a) Expiration. The final plat documents for the Plat, which is the first
phase of the Clearwater Cove preliminary plat, have been submitted to the City Council within one
hundred twenty (120) days of preliminary plat approval. The final plat must be recorded with the
Washington County Recorder (and the mylar "hardshells" must be fully executed) within sixty (60)
days of the City Council motion giving final plat approval, unless such deadline is extended by the
City Council in its sole discretion, or else said approval shall be null and void. All fees relating to
this subdivision shall be paid by the Developer, including the cost of recording documents with
Washington County.
b) Recording. The developer shall record this Agreement with
Washington County simultaneous with the recording of the Plat, and shall forward confirmation of
recording of the Plat and this Agreement to the City prior to the issuance of building permits. All
applicable conditions of Plat approval must be met before any deeds are stamped for recording and
prior to the recording of the Plat at the Washington County Recorder's Office. Plat approval shall
be contingent upon compliance with the approved plans for the Improvements and upon
compliance with this Agreement.
c) Model Homes. In the event that site grading is approved by the City
prior to Plat approval and/or execution of this Agreement, posting of security and filing of the Plat,
the Developer shall be entitled to one (1) building permit per housing unit type on lots that abut
existing streets or roadways, subject to final approval by the City. No model homes may be
constructed or utilized until at least one (1) lift of bituminous has been installed from said model
home lot providing access to a public street or roadway outside of the Plat. No certificate of
occupancy shall be issued for any model or other home until all necessary public improvements and
utilities have been installed and the utilities have been successfully tested. Prior to this, and at the
time that a model home passes final inspection, a model home may only be used by Developer's
staff or realtors for purposes of showing the models to potential buyers. No model home may be
used until landscaping conforming to City ordinance and paragraph 14 of this Agreement has been
installed except that, if the certificate of occupancy is issued between the dates of October 1 and
May 1, then the landscaping required herein shall be complete, established and growing no later
than July 1.
d) Sales Trailers. The developer may be entitled to a maximum of one
(1) temporary sales office (sales trailer) for this and all subsequent phases of the development for a
period of time not to exceed nine (9) months. Upon receipt of an acceptable site plan, a sales trailer
may be approved by the City Community Development Director prior to the first model home being
available for showing. The trailer is subject to the issuance of a building permit, shall meet all
applicable building codes, shall be fully skirted, shall be suitably landscaped, shall contain
sufficient parking for the size of the office, and shall have safe and suitable access to a paved,
public roadway. The trailer shall be removed, and the site shall be restored within seven (7) days
following the date that a model home passes final inspection.

e) Deviations. No material deviations from the approved Plat shall be
allowed unless approved in writing by the City. Approval herein is also given subject to full
compliance with the conditions of approval and findings adopted by the City Council in connection
with the approval of the development.
f) Certificates of Survey. A certificate of survey shall be provided to
the City Building Inspector for each lot at the time a building permit is requested for the lot.
Attached to the certificate of survey shall be an erosion control plan for the lot showing location and
type of all erosion control measures to be used on the lot, and spot elevations, tree preservation plan
shall be submitted for each home site.
g) Outhouses. The Developer shall provide on -site a sufficient number
of portable outhouses to be available for the persons who will be working on -site until
Improvements are accepted according to the plans in Exhibit A.
h) Property Owners Association. When required as a condition of
approval outlined in Exhibit B, the Developer agrees to form a property owners association,
membership in which shall be mandatory for all of the lots within this development. The property
owners association shall be responsible for maintenance and repair of all common elements as
listed in the property owners association documents within this development and the same shall be
maintained in good condition in accordance with all City ordinances and reasonable directions of
the City. Developer agrees to provide a copy of the property owners association documents to the
City prior to the recording of the final plat. In the event of failure or refusal of any property owners
association to so maintain or repair the common elements then the City may, with seven days
written notice and without regard to the requirements or formalities of Minn. Stat. §429 perform the
work and assess each of the lots within the plat for the cost of the work.
i) Intentionally deleted
j) The property owners association documents shall advise owners of
all lots of the requirements of this Agreement as follows: THE LAND WITHIN THIS PLAT,
INCLUDING THE LAND CONVEYED HEREIN, IS BOUND BY RESTRICTIONS IN A
DEVELOPMENT AGREEMENT. SAID DEVELOPMENT AGREEMENT IS ON FILE
AT THE OFFICE OF THE WASHINGTON COUNTY RECORDER.
k) Developer acknowledges that a separate development agreement will
be entered into at the time of final plat approval of subsequent phases in the developmentThat
Development Agreement will address, among other things, necessary improvements to be made,
financial guarantees to be provided, and the amount of the development fees to be paid by the
Developer.

1) Developer shall remove all tree waste, junk, miscellaneous debris,
junk vehicles, and any other personal property from the Plat which does not comply with the City
Zoning Ordinance until final acceptance of the Improvements.
E. DAMAGES AND DEFAULT:
1. Developer agrees to pay liquidated damages to the City if any lot has a real
estate closing occur before all public improvements within the Plat are certified as being
substantially completed by the City. Specifically, Developer agrees to immediately pay to the City
liquidated damages in the amount of Ten Thousand Dollars ($10,000.00) for each lot closing which
occurs in violation of this paragraph. The City shall be authorized to retain an appropriate
percentage of the financial guarantee referred to in paragraph 4 as security for payment of any
liquidated damages owed to the City. Model Homes are exempt from this section.
2. Developer agrees to pay liquidated damages to the City, in the amount of
Five Thousand Dollars ($5,000.00), if the Developer encroaches upon any City road right-of-way or
utility easement not permitted on the plans without first obtaining a written permit from the City
expressly authorizing said encroachment. The City shall be authorized to retain an appropriate
percentage of the financial guarantee referred to in paragraph 4 as security for payment of any
liquidated damages owed to the City.
3. Events of Default.
a) Events of Default Defined. The following shall be "Events of
Default" under this Agreement and the term "Event of Default" shall mean, whenever it is used in
this Agreement, any one or more of the following events:
1. Subject to unavoidable delays, failure by Developer to commence
and complete construction of the Improvements pursuant to the
terms, conditions and limitations of this Agreement.
2. Failure by Developer to substantially observe or perform any
material covenant, condition, obligation or agreement on their part to
be observed or performed under this Agreement.
b) Remedies on Default. Whenever any Event of Default occurs, the
City, subject to any rights of third parties agreed to by the City pursuant to this Agreement, or
otherwise by written, executed instrument of the City, may take any one or more of the following:
1. The City may suspend its performance under the Agreement until it

receives assurances from Developer, deemed adequate by the City,
that Developer will cure their default and continue their
performance under the Agreement. Suspension of performance
includes the right of the City to withhold permits including, but not
limited to, building permits.
2. The City may initiate such action, including legal or administrative
action, as is necessary for the City to secure performance of any
provision of this Agreement or recover any amounts due under this
Agreement from Developer, or immediately draw on the financial
Letter of Credit, as set forth in this Agreement.
4. Enforcement by City; Damages. The Developer acknowledges the right of
the City to enforce the terms of this Agreement against the Developer, by action for specific
performance or damages, or both, or by any other legally authorized means. The Developer also
acknowledges that its failure to perform any or all of their obligations under this Agreement may
result in substantial damages to the City; that in the event of default by the Developer, the City may
commence legal action to recover all damages, losses and expenses sustained by the City; and that
such expenses may include, but are not limited to, the reasonable fees of legal counsel employed
with respect to the enforcement of this Agreement.
F. THIS AGREEMENT:
1. Release of Agreement. This Agreement shall run with the land and may be
recorded against the title to the property. After the Developer has completed the work required of it
under this Agreement, at the Developer's request the City will execute and deliver to the Developer
a release.
2. Warranty of Title. Developer warrants and represents to the City that it is
the fee owner of the land described herein, except for a portion of the property, and that it has
authority to execute this Agreement, with consent from the other fee owner, and agree to the
conditions hereof and to subject the land hereto. Developer also represents and warrants that the
use for which this development is sought will not violate any restrictive covenants applying to the
property.
3. Binding Effect. This Agreement shall be deemed to be a restrictive
covenant and the terms and conditions hereof shall run with the land described herein and be
binding on and inure to the benefit of the heirs, representatives and assigns of the parties hereto, and
shall be binding upon all future owners of all or any part of the subdivision, and shall be deemed
covenants running with the land. Reference herein to the Developers, if there be more than one,
shall mean each and all of them.

This Agreement shall be placed of record so as to give notice hereof to
subsequent purchasers. The cost of said recording shall be borne by the Owner and charged against
the escrow account.
4. Restrictions on Transfer/Indemnification. Developer agrees to defend
and hold the City, and its officials, employees and agents, harmless against any and all claims,
demands, lawsuits, judgments, damages, penalties, costs and expenses, including reasonable
attorney's fees, arising out of actions or omissions by Developer, their employees and agents, in
connection with the Project. No transfer or assignment shall be made without City approval and
any assignment or transfer without such approval shall be void.
5. Incorporation by Reference. All general and special conditions, plans,
special provisions, proposals, specifications and contracts for the Plat and for any Improvements
furnished and let pursuant to this Agreement shall be and hereby are made a part of this Agreement
by reference as if fully set out herein in full.
6. Developer will comply with and promptly perform all of its obligations
under this Agreement.
7. Evidence of Title. Developer shall furnish the City with evidence of fee
ownership of the property being platted by way of an attorneys title opinion or title insurance
commitment dated not earlier than thirty (30) days prior to the execution of the Plat.

APPROVAL CONDITIONS
1. A final plat is approved to allow the creation of 54 single family home lots and 10 outlots, in
accordance with the application and plans received by the City on June 18, 2018, July 5,
2018, and July 27, 2018, except as amended by this resolution.
2. The development shall substantially comply with all plans and conditions of the preliminary
plat and PUD approval granted by the City Council on May 21, 2018.
3. Development standards shall comply with Resolution 2018-14 and 2018, as amended.
4. The developer shall comply with all conditions outlined in the City Engineer's memo dated
August 2, 2018, and revisions required in "red -lined" comments from the City Engineer.
5. Outlot Use and Ownership:
a. Outlots A, B, C, D, E, F, G, and H, are proposed for stormwater ponding,
wetlands, and landscaping and shall be deeded to the City.
b. Outlot J is proposed for a public park and stormwater ponding and shall be deeded
to the City. Park dedication will be satisfied with land dedication of Outlot J.
c. Outlot I shall be deeded to the City. The outlot can be used for access to the parcel
to the east and additional development.
d. Outlot K is proposed for future development and will retain its current ownership.
The outlot is unbuildable until a new plat has been approved by the City.
6. The developer shall design and install a stormwater re -use system for the irrigation of the
lots.
7. The landscaping planned for the plat shall be installed in one phase. The developer shall take
proper precautions to protect the trees as the homes are being built.
8. Staff will continue to work with the developer on the street lighting plan. Exact locations of
the street lights shall be reviewed and approved by City staff prior to installation. The street
lights shall be the Lantern style decorative light.

9. Final design of the entrance monument shall be reviewed and approved by staff prior to
installation.
10. Prior to the release of the final plat for recording, the developer shall comply with the
following conditions.
a. An HOA shall be established to own/operate/maintain the following:
i. landscaping within the outlots,
ii. landscaping along Oneka Parkway within the right-of-way,
iii. landscaping on proposed residential lots,
iv. all retaining walls,
v. and the water re -use system.
The HOA documents/covenants shall be reviewed and approved by staff.
b. The stormwater re -use system shall be reviewed and approved by staff. The
stormwater reuse system operation, encroachment, and maintenance agreement
shall be reviewed and approved by City staff.
c. An encroachment and maintenance agreements shall be reviewed and approved by
staff for access and maintenance of landscaping, signage, and retaining wall with
in Outlots A, B, C, D, E, F, G, and H, proposed to be deeded to the City.
d. Landscape easement shall be placed over the residential lots where proposed
landscaping will occur. The HOA shall be required to maintain the landscaping on
the lots.
e. The developer shall comply with all conditions outlined in the City Engineer's
memos dated March 3, 2018 and July 27, 2018
f. The development shall comply with the Fire Chief s requirements regarding fire
flow calculations, the location of fire hydrants, fire department connections, and
fire lane signage.
g. The developer shall obtain all necessary stormwater management and WCA
permits from the City.
h. The developer shall obtain all necessary local, state, and federal permits.
i. The developer shall vacate the existing easement on Outlot J.

j. Architectural design standards shall be reviewed and approved by staff.
k. The developer shall work with City staff to provide trail connections to the
proposed park to the east.
1. The developer shall enter into a development agreement, shall agree to complete
all improvements, and pay all fees as required by the agreement.
13. Prior to the issuance of building permits, the developer shall comply with the following
conditions.
a. The applicant shall record the final plat, development agreement and all other
documentation at Washington County and provide the City with proof of recording.
b. The applicant shall submit three full sets of approved final plans to the City.
c. If a sales trailer is located in the property, a site plan and building elevations shall be
submitted for City review and approval.
14. Prior to the issuance of Certificate of Occupancy, the developer shall comply with the
following conditions:
a. The bituminous trail access to the park shall be installed per the construction plans.

ESCROWS, FEES AND CHARGES
a) Escrow for City Costs and Fees. Developer shall deposit sufficient
escrow with the City as outlined in Section A. 1. The required beginning balance in the account is
calculated at $66,314.00. This sum is calculated to be four percent (4%) of the estimate of the
required Improvements to be installed to serve the development, plus $5,000 which is the minimum
balance required in the account.
b) Cash Escrow or Letter of Credit. Developer shall provide a financial
guarantee to the City, in the form of a cash escrow or letter of credit, in the amount equal to one
hundred twenty-five percent (125%) of the estimated amount of the required Improvements,
including the future Oneka Parkway and roadway crossing of Clearwater Creek. . This amount has
been calculated by the City Engineer to be $1,916,037.00. This amount may be reduced upon
request of the Developer and approved by the City. At no point shall the Letter of Credit be
reduced below ten percent (10%) of the original amount. The City shall have the right to retain the
financial guarantee until the Improvements have been completed to the satisfaction of the City and
the warranty period has expired.
c) Storm Water Trunk Fee. The Developer shall pay the City a Storm
Water Trunk Fee in the amount of $51,714.66. This sum is calculated to be $0.07 per square foot
for the 439,738 square feet of net developable area within the Plat. This fee shall be paid before the
Plat is signed by the City.
d) Storm Water Ponding Fee. The storm water ponding requirement has
been met by the Developer through the incorporation of on -site ponding. No storm water ponding
fee will be applied.
e) Snow Plowing. Developer agrees to pay a one-time lump sum cash
escrow to the City to cover the cost of snow plowing the roads within the plat, during the first snow
season, before the roads are formally accepted by the City of $.50 per lineal foot. The Developer
shall post a cash escrow with the City in the amount of $1,348.00 ($0.50 x 2696 = $1,348.00).
f) Sealcoatin . The Developer shall post a one-time lump sum cash
escrow with the City in the amount of $10,784.00 to cover the cost of the first sealcoating of the
streets in the Plat. This sum is calculated to be $4.00 per foot for the 2696 feet of streets within the
Plat.

sewer trunk fee in the amount of $88,128.00. This sum is calculated to be $1,632 per lot for the 54
residential lots within this phase.
1) Water Trunk Fee. The Developer shall pay the City water trunk fee in the
amount of $68,796. This sum is calculated to be $1,960 per lot, with credit provided for the
stormwater reuse/irrigation system based on the anticipated reduction in water demand. The
reduction is calculated at 35%, resulting in a trunk water fee amount of $1,176 per lot. The total is
based on the reduced per unit fee applied to the 54 lots in the plat.

BACKGROUND

As per Minn. Stat. 471.345, subd. 15, for a contract estimated to exceed $25,000, a municipality must consider the
availability, price and quality of supplies, materials, or equipment available through the state Cooperative Purchasing
Venture (CPV) before buying through another source. If a municipality does not utilize the CPV, it may contract for the
purchase of supplies, materials, or equipment without regard to the competitive bidding requirements if the purchase is
through a national municipal association's purchasing alliance or cooperative created by a joint powers agreement that
purchases items from more than one source on the basis of competitive bids or competitive quotations.
The Houston -Galveston Area Council (HGAC) is a nationwide government procurement service striving to make the
governmental procurement process more efficient. All contracts available to participating members have been
awarded by virtue of a public competitive procurement process compliant with state statutes.
HGAC primarily offers products that are used in Public Safety and Public Works departments. A wide variety of capital
equipment is under contract and can be customized to fit the City's specific requirements.
HGAC has more than 40 years of experience in cooperative purchasing and serves more than six thousand local
governments across the United States, including 199 Minnesota public entities. There are no annual membership dues
required to purchase thru HGAC. To become a member (end -user) the City must enter into a Contract with HGAC that
can be terminated upon 30 days written notice.
HGAC offers an expedited procurement process which can eliminate the need for preparing detailed specifications
while satisfying all other requirements for competitive bidding. This can greatly the assist the Fire Department in
procuring equipment that can be paid for with grant funds. It can even streamline the process of procuring fire trucks.
RECOMMENDATION
The Finance Department recommends that the City Council authorize the execution of a contract with HGAC subject to
review by the City Attorney.

THIS INTERLOCAL CONTRACT ("Contract"), made and entered into pursuant to the Texas Interlocal Cooperation Act,
Chapter 791, Texas Government Code (the "Act"), by and between the Houston -Galveston Area Council, hereinafter referred
to as "H-GAC," having its principal place of business at 3555 Timmons Lane, Suite 120, Houston, Texas 77027, and City of
Hugo, Minnesota, a local government, a state agency, or a non-profit corporation created and operated to provide one or more
governmental functions and services, hereinafter referred to as "End User," having its principal place of business at 14669
Fitzgerald Ave N Hugo, MN 55038.
WITNESSETH
WHEREAS, H-GAC is a regional planning commission and political subdivision of the State of Texas operating under
Chapter 391, Texas Local Government Code; and
WHEREAS, pursuant to the Act, H-GAC is authorized to contract with eligible entities to perform governmental functions and
services, including the purchase of goods and services; and
WHEREAS, in reliance on such authority, H-GAC has instituted a cooperative purchasing program under which it contracts
with eligible entities under the Act; and
WHEREAS, End User has represented that it is an eligible entity under the Act, that its governing body has authorized this
Contract on 08/06/2018 (Date), and that it desires to contract with H-GAC on the terms set forth below;
NOW, THEREFORE, H-GAC and the End User do hereby agree as follows:
ARTICLE 1: LEGAL AUTHORITY
The End User represents and warrants to H-GAC that (1) it is eligible to contract with H-GAC under the Act because it is one
of the following: a local government, as defined in the Act (a county, a municipality, a special district, or other political
subdivision of the State of Texas or any other state), or a combination of two or more of those entities, a state agency (an
agency of the State of Texas as defined in Section 771.002 of the Texas Government Code, or a similar agency of another
state), or a non-profit corporation created and operated to provide one or more governmental functions and services, and (2) it
possesses adequate legal authority to enter into this Contract.
_ARTICLE 2: APPLICABLE LAWS
H-GAC and the End User agree to conduct all activities under this Contract in accordance with all applicable rules,
regulations, and ordinances and laws in effect or promulgated during the term of this Contract.
ARTICLE 3: WHOLE AGREEMENT
This Contract and any attachments, as provided herein, constitute the complete contract between the parties hereto, and
supersede any and all oral and written agreements between the parties relating to matters herein.
ARTICLE 4: PERFORMANCE PERIOD
The period of this Contract shall be for the balance of the fiscal year of the End User, which began 01/01/2018 and ends
12/31/2018. This Contract shall thereafter automatically be renewed annually for each succeeding fiscal year, provided that
such renewal shall not have the effect of extending the period in which the End User may make any payment due an H- GAC
contractor beyond the fiscal year in which such obligation was incurred under this Contract.
ARTICLE 5• SCOPE OF SERVICES
The End User appoints H-GAC its true and lawful purchasing agent for the purchase of certain products and services through
the H- GAC Cooperative Purchasing Program. End User will access the Program through HGACBuy.com and by submission
of any duly executed purchase order, in the form prescribed by H-GAC to a contractor having a valid contract with H-GAC.
All purchases hereunder shall be in accordance with specifications and contract terms and pricing established by H-GAC.
Ownership (title) to products purchased through H-GAC shall transfer directly from the contractor to the End User.
ARTICLE 6: PAYMENTS
H-GAC will confine each order and issue notice to contractor to proceed. Upon delivery of goods or services purchased, and
presentation of a properly documented invoice, the End User shall promptly, and in any case within thirty (30) days, pay H-
GAC's contractor the full amount of the invoice. All payments for goods or services will be made from current revenues
available to the paying party. In no event shall H-GAC have any financial liability to the End User for any goods or services
End User procures from an H- GAC contractor.
ARTICLE 7: CHANGES AND AMENDMENTS
This Contract may be amended only by a written amendment executed by both parties, except that any alterations, additions, or
deletions to the terms of this Contract which are required by changes in Federal and State law or regulations are automatically
incorporated into this Contract without written amendment hereto and shall become effective on the date designated by such
law or regulation.
H-GAC reserves the right to make changes in the scope of products and services offered through the H-GAC Cooperative
Purchasing Program to be performed hereunder.
ARTICLE 8: TERMINATION PROCEDURES
H-GAC or the End User may cancel this Contract at any time upon thirty (30) days written notice by certified mail to the other
party to this Contract. The obligations of the End User, including its obligation to pay H-GAC's contractor for all costs
incurred under this Contract prior to such notice shall survive such cancellation, as well as any other obligation incurred under
this Contract, until performed or discharged by the End User.
ARTICLE 9: SEVERABILITY
All parties agree that should any provision of this Contract be determined to be invalid or unenforceable, such determination
shall not affect any other teen of this Contract, which shall continue in full force and effect.
ARTICLE 10: FORCE MAJEURE
To the extent that either party to this Contract shall be wholly or partially prevented from the performance within the term
specified of any obligation or duty placed on such party by reason of or through strikes, stoppage of labor, riot, fire, flood, acts
of war, insurrection, accident, order of any court, act of God, or specific cause reasonably beyond the parry's control and not
attributable to its neglect or nonfeasance, in such event, the time for the performance of such obligation or duty shall be
suspended until such disability to perform is removed; provided, however, force majeure shall not excuse an obligation solely
to pay funds. Determination of force majeure shall rest solely with H-GAC.
ARTICLE 11: VENUE
Disputes between procuring party and Vendor are to be resolved in accord with the law and venue rules of the State of
purchase.

debt service, and estimates of the amounts by which energy or operating costs will be
reduced.
A guaranteed energy -savings contract that includes a written guarantee that savings
will meet or exceed the cost of energy conservation measures is not subject to competitive
bidding requirements of section 471.345 or other law or city charter. The contract is not
subject to section 123B.52.
A municipality may enter into a guaranteed energy -savings contract with a qualified
provider if. after review of the report, it finds that the amount it would spend on the energy
conservation measures recommended in the report is not likely to exceed the amount to be
saved in energy and operation costs over 20 years from the date of final installation if the
recommendations in the report were followed, and the qualified provider provides a
written guarantee that the energy or operating cost savings will meet or exceed the costs of
the system. The guaranteed energy -savings contract may provide for payments over a
period of time, not to exceed 20 years.
A municipality may enter into an installment payment contract for the purchase and
installation of energy conservation measures. The contract must provide for payments of
not less than 1/20 of the price to be paid within two years from the date of the first
operation, and the remaining costs to be paid monthly, not to exceed a 20-year term from
the date of final acceptance.
A municipality entering into a guaranteed energy -savings contract shall provide a
copy of the contract and the report from the qualified provider to the commissioner of
commerce within 30 days of the effective date of the contract.
Guaranteed energy -savings contracts may extend beyond the fiscal year in which they
become effective. The municipality shall include in its annual appropriations measure for
each later fiscal year any amounts payable under guaranteed energy -savings contracts
during the year. Failure of a municipality to make such an appropriation does not affect the
validity of the guaranteed energy -savings contract or the municipality's obligations under
the contracts.
Subd. 14. Damage awards. In any action brought challenging the validity of a
municipal contract under this section, the court shall not award, as any part of its
judgment, damages, or attorney's fees, but may award an unsuccessful bidder the costs of
preparing an unsuccessful bid.
Subd. 15. Cooperative purchasing. (a) Municipalities may contract for the
purchase of supplies, materials, or equipment by utilizing contracts that are available
through the state's cooperative purchasing venture authorized by section 16C.11. For a
contract estimated to exceed $25 000, a municipality must consider the availability, price
and quality of supplies, materials, or equipment available through the state's cooperative
purchasing venture before purchasing through another source.
(b) If a municipality does not utilize the state's cooperative purchasing venture, a
municipality may contract for the purchase of supplies, materials, or equipment without
regard to the competitive bidding requirements of this section if the purchase is through a
national municipal association's purchasing alliance or cooperative created by ajoint
powers agreement that purchases items from more than one source on the basis of
competitive bids or competitive quotations.
Subd. 16. Reverse auction. Notwithstanding any other procedural requirements of
this section, a municipality may contract to purchase supplies, materials, and equipment
using an electronic purchasing process in which vendors compete to provide the supplies,
materials, or equipment at the lowest selling price in an open and interactive environment.
A municipality may not use this process to contract for services, as defined by section
16C.02. subdivision 17, or a service contract, as defined by section 16C.02, subdivision 7a.
Nothing in this subdivision must be construed to prohibit a municipality from adopting a
resolution, rule, regulation, or ordinance relating to minimum labor standards under
subdivision 7. or procurement from economically disadvantaged persons under subdivision
8.
Subd. 17. Electronic sale of surplus supplies, materials, and equipment.
Notwithstanding any other procedural requirements of this section, a municipality may
contract to sell supplies, materials, and equipment which is surplus, obsolete, or unused

Move approval of the attached notice vacating the drainage and utility easements.
2. DESCRIPTION OF REQUEST:
The applicant is requesting a vacation of the existing drainage and utility easement located over a
parcel that will be used for the development of Oneka Place. The drainage and utility easement
was used for storm water drainage from the Prairie Village development to the south. The
drainage from that area will be incorporated into the Oneka Place development. New drainage
and utility easements will be placed on the lots at the time the final plat is recorded. Staff is
comfortable with the applicants requests to vacate the drainage and utility easements.
3. RECOMMENDATION:
Staff recommends that the City Council approve the notice to vacate the drainage and utility
easement.

1. PLANNING COMMISSION UPDATE:
The Planning Commission reviewed and commented on the sketch plan at its July 28, 2018
meeting. They were generally comfortable with the overall site layout, land use, and location for
the development. However, the commission would like to see changes made to the buildings
architectural design.
• The Commission wanted the applicant to remain focused on making sure the development.
blends well with its surrounding environment.
• The Commission showed focus towards the exterior design of the building.
• The Commission recommended that the applicant implement larger projections, more wall
and roof breaks, as well as additional features such as a wainscot.
• The Commission also recommended four-sided architecture, but realizes the back of the
building may not be seen easily.
• In addition, the Commission requests that the applicant provide turning templates and
measurements for the proposed underground parking lot within its future site plan.
The applicant has agreed to address the recommended changes. The applicant has also applied for
federal Housing Tax Credits and has stated that it must remain within the financial range of the
tax credits the applicant expects to receive from the Washington County Community Development
Agency (CDA). The applicant has recommended that adding greater variation in exterior design

to the front side of the building and less on the back side may allow for an architectural design that
is more fluent with the City's multifamily building design guidelines.
1. BACKGROUND:
Starting in 2008, the City Council approved a rezoning, preliminary plat and final plat for a
phased development on 54.1 acres known as Frenchman Place. Developments within Frenchman
Place include medical buildings, a daycare, and a church. The proposed Frenchman Lofts
apartment project is proposed to be located on an outlot of Frenchman Place.
2. DESCRIPTION OF REQUEST:
The applicant, MWF Properties, has proposed to develop a three story, 45-unit multifamily
apartment complex with both surface and underground parking upon an 18 acre parcel. The
footprint of the apartment is approximately 19,000 square feet. The total building square footage
is approximately 75,000 square feet including the below ground garage.
The applicant has stated that approximately 4.5 acres are buildable. The applicant has a purchase
agreement to buy the property from the owner. The property is located northeast of Festival Foods.
The site contains wetlands, therefore a wetland delineation will be required. Buildable acreage for
the site will then be determined. The project is proposed to provide rental housing to working class
families who earn 60% of the area median income or less. This equates to $40,000 to $65,000
depending on household size. The applicant will be applying for Section 42 Housing Tax Credits
(LIHTC). In return for these credits, NEW Properties is required to rent to households earning
60% of the area median income. The applicant is requesting informal comments on a sketch plan
for the Frenchman Lofts apartment project.
3. SITE CONCEPT
A. Application Process
The applicant is requesting sketch plan comments prior to a formal approval. The next steps for
the application would be to submit a request for approval of the following applications:
1. Site Plan
2. Conditional use permit (CUP)
3. Final plat
B. Comprehensive Plan
Hugo's comprehensive plan includes a focus to promote the development of low to moderate
income housing for city residents. This plan is intended to maximize the city's ability to develop
affordable and life cycle housing to promote efficient and well -integrated development.

Land Use
The property is guided Medium Density Residential (MD) in the 2030 Land Use Plan. Within the
MD Land Use, the standard density is between six and ten units per acre. The shown buildable
acreage of the site is 4.6 acres. With 45 units planned, there will be 9.78 units per acre. This site
plan meets zoning density requirements and could help fulfill the city's goals of providing
residents with affordable housing options. In addition, 12 units per acre is allowed with a
Planned Unit Development (PUD).
C. Current Zoning
The site is zoned Medium Density Multifamily Residential (R-5). The R-5 zoning district
includes a number of permitted, accessory, and conditional uses. This zoning district is intended
to provide a life -cycle housing by offering an alternative to single-family detached housing.
Apartment buildings are classified as a conditional use under the City's R-5 zoning regulations,
therefore a CUP will be required. The Sketch plan meets the density requirements of a minimum
of 10 units per acre.
D. Multifamily Building and Site Design Guidelines
In 2005, the City adopted Multi -family Design Guidelines. The intent of the guidelines is to
articulate the vision of the City to ensure high quality multi -family units are constructed. These
guidelines are to be utilized with the existing 2030 Comprehensive Plan and City Zoning Code.
The applicant has only provided the building elevations for the front of the building facing south.
The elevations illustrate the building having windows of various shapes and sizes. The elevations
show the building having breaks in its facade and roof line. The building also has pillars located
next its front entrance. It's unclear on the dimensions of the projections, however the minimum
depth shall be two feet. The elevations do show a wall break with different materials and colors
approximately two-thirds up the wall. The building shall have equal architecture on all sides that
consist of high quality materials.
In terms of building materials, multi -family buildings should be designed with a mixed variety of
high -quality materials including brick, stone, stucco, EIFS, cementitious lap siding or related
materials. High quality materials other than lap siding must cover at least 25% of the building
and should be incorporated on all sides. Coloration of the building is also an important factor.
Bold colors are encouraged for building materials.
The building is shown having at least four different materials including shake siding, lap siding,
cast stone, and smooth face and rock face block in various light and dark colors. The base of the
building consists of heavier smooth face and rock face blocks with lighter materials being placed
above. The stone and block materials appear to cover at least 25% of building facade, but it is
unclear since the applicant only provided the front elevation. The building also has metal roofing
placed above the main entrance. The stone and block shall be on all sides of the building and
wrap around the corners of the building. The colors of the building are various brownish gray
colors.

Focus should also be directed towards the screening of mechanical equipment. Mechanical
equipment must be accessible for maintenance but must also be screened in a manner that is
aesthetically pleasing. Screening methods could include fences and landscaping. The sketch plan
does not illustrate mechanical equipment locations or screening.
The applicant will be required to provide details and elevations for all sides of the building with
a formal application. Although there are some good elements in the architecture of the building,
the applicant does need to work on items in regards to the architecture to meet the City's Multi-
family Design Guidelines. Staff recommends the following to be incorporated into the design:
1. The elevations should be further articulated to break-up the building on all elevations.
2. Additional vertical and horizontal wall and roof line variations.
3. Larger overhangs on the building.
4. Ensure 25% of the building or more includes stone/block. A wainscot around the
building would help the design.
5. Work on four-sided architecture.
E. General Site Layout
The sketch plan shows the overall layout of the proposed building, site access, drainage, surface
parking as well as the general location of underground parking access. The building positioned
closer to the center of the parcel. A walk-in entrance to the building will be located on the
southern side of the building near its center and in close proximity to the planned parking lot.
Walkways and Amenities
The plan shows a sidewalk being constructed with access to the walkway along Rosemary Way.
Site amenities include secure access, in unit laundry, a community room, a fitness center, an
outdoor children's play area, as well as on -site management, and manager's office. A manager
will be present within the building during business hours and will remain on call when not
present on the property. The property will also have a maintenance team for routine internal
repairs while external maintenance including lawn care and snow removal will be contracted out.
Parking and Traffic Circulation
The submitted sketch plan depicts a single access onto the property from Rosemary Way. The
plan also shows 45 parking stalls within its surface parking lot as well as a curved ramp located
on the northwest end of the building leading to an underground parking area containing 55
parking stalls. In total, 99 parking stalls are planned for the site. Each apartment unit will receive
an assigned parking stall within the underground parking lot. Any additional underground stalls
will be provided to tenants on a first come, first serve basis.
Staff has asked that the developer provide a more detailed description of the curved access ramp
and underground parking lot to understand traffic flow and accessibility. As the project
advances, the applicant will be asked to provide turning templates to ensure appropriate
maneuverability with both surface and underground parking lots.

Waste Storage
Dumpsters used to hold waste will be stored in the underground parking lot. On designated pick-
up days, dumpsters will be wheeled up to the surface to be emptied. Dumpsters will then be
placed back into the underground lot.
F. Housing/Rental Rates
Monthly rental rates will differ between units based on the number of rooms per unit. Rental
rates for one bedroom units will be $660-$820 per month. Rates for two -bedroom units will be
$950-$1,025 per month and rates for three -bedroom units will be $1,200 per month.
G. Grading and Drainage
The sketch plan depicts a constructed water filtration basin located on the southeast side of the
building. The basin runs almost parallel to the single access road leading to Rosemary Way. The
plan also illustrates a 30-foot wetland setback which runs along the north and northwestern section
of the site.
The 18.15 acre site contains a substantial amount of wetlands. The site will require a wetland
delineation to identify the location of the wetland boundary. The applicant will also need to work
with the Technical Evaluation Panel (TEP), the City Water Resources Engineer as well as
Environmental Scientist to obtain the necessary permits related to the wetland delineation and
stormwater management. If the applicant proposed to impact the wetlands, they shall obtain the
necessary permits for that as well.
Park Dedication
The applicant will be required in the amount of $2,400 per unit. The total park dedication for the
project will be $108,000.
4. CONCLUSION/RECOMMENDATIONS:
The MWF Properties staff have done a good job providing and representing a basic sketch plan
for the project. There are some items the applicant will need to work on in regards to the
architecture.
Staff recommends that the Planning Commission provide feedback on the sketch plan to MWF
Properties. Below are areas MWF Properties would like feedback on:

Introduction
This application is for a sketch plan review of the property identified by PID: 1903121210013.
Background on site
The current use of the property is raw land. The total property consists of 18.15 acres, however
a majority of the site is either wetland or covered by a conservation easement that prohibits
construction. This leaves the total buildable acreage approximately 4.6 acres (excluding any
potential wetland credits). The site is zoned R-5 Medium Density Residential.
Proposed project
MWF Properties is looking to pursue the development of a three-story multifamily housing
project that would consist of 45 housing units in a three-story apartment complex with
underground parking. The anticipated unit mix is 6 1-bedroom, 24 2-bedroom, and 15 3-
bedroom units. The number of units is allowable with a conditional use permit that will be
submitted in the fall of this year.
The project will consist of a mixture of surface and underground parking that will equate to at
least 90 stalls, or two units of parking to every one unit.
In addition to underground parking, on site amenities would include: secure access, in unit
laundry, on site management including a manager's office, a community room, a fitness center,
and an outdoor children's play area. The project would be rented to working class families
("workforce housing") who earn 60% of the area median income or less. This equates to
$40,000 to $65,000 depending on household size.

State statute provides that the County Board will select watershed district managers from lists of nominees
submitted by the municipalities that are wholly or partially in the watershed district. The list must contain at
least three nominees for each manager's position to be filled. The list must be submitted to the County at least
60 days prior to the expiration of the term of office of a manager. If no list is submitted or if the list is not
