APPROVING A CONDITIONAL USE PERMIT FOR SCOTT KERSTEN TO
ALLOW AUTO SALES, AUTO BODY REPAIR SHOP, AND OUTDOOR
VEHICLE STORAGE USE ON THE PROPERTY LOCATED AT 15587 FOREST
BOULEVARD NORTH
WHEREAS, Scott Kersten, requested approval of a conditional use permit to allow auto
sales, auto body repair shop, and outdoor vehicle storage use on the property located at
15587 Forest Boulevard North
(See attached Exhibit A)
WHEREAS, the Planning Commission has reviewed said conditional use permit at a duly
called public hearing on August 9, 2018, and recommends approval subject to the
conditions listed in the conditional use permit.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
conditional use permit for Scott Kersten to allow auto sales, auto body repair shop, and
outdoor vehicle storage use on the property located at 15587 Forest Boulevard North with
the following findings:
1. The auto sales, auto body repair shop and outdoor vehicle storage may only be
permitted in the General Business (C-2) district by a CUP, but is otherwise permitted by
law.
2. The use is allowed in the General Business (C-2) district and will keep with the spirit
and intent of the ordinance, which is intended to provide a location for commercial
businesses.
3. The use is consistent with the character of this General Business zoning classification.
The City's Comprehensive Plan identifies this area as Commercial, however the uses in
the area are industrial uses. The character of the area will not change noticeably, since the
prior use was manufacturing business that included outdoor storage.
4. Staff does not foresee any problems with utilities or drainage since there is not
construction going on that will alter the site.
5. The use has adequate access onto Highway 61.
6. The use is not located within the floodplain.
7. The use is existing and does not obstruct the floodplain or increase the potential for
flooding.
8. The use does not damage or reduce the benefits from any public waters.

9. The use does not involve the use of watercraft.
10. The use is screened and is not visible from any public waters.
11. The use does not impact any wetlands.
12. The applicant will be responsible for obtaining all state and local permits.
13. The vehicle storage area will be adequately screened from adjacent residential uses
and public right-of-ways. The applicant has stated that he would install landscaping along
the south property line to further buffer from the residentially zoned property to the east.
Alternatively the applicant could install a privacy fence along the south side.
14. All requirements of the conditional use permit shall be met.
