The Preserve on Sunset Lake Sketch Plan At the meeting of June 20, 2018 the Parks Commission provided comments on a sketch plan submitted by Cheldon Frank for a residential development now known as “The Preserve on Sunset Lake”. Discussion included trails and dedication of park land adjacent to Sunset Lake. Frank has submitted an application and is requesting approval for a Preliminary Plat and Planned Unit Development (PUD). The Preliminary Plat and Planned Unit Development (PUD) includes 13 single family residential lots and 3 outlots to be known as “The Preserve on Sunset Lake. The property totals 136.7 acres. Frank is proposing to dedicate .93 acres adjacent to the city owned property on Sunset Lake for park dedication. The remaining park dedication fee would be $28,704 to satisfy park dedication requirements. Frank is requesting that the fee be waived. Staff recommends that the Parks Commission require the land and fee dedication be made. PLEASE SEE THE ATTACHED MEMO. November Meeting Date The regularly scheduled Parks Commission meeting will fall on the Wednesday before Thanksgiving on November 21. Staff recommends that the Parks Commission change the date of their next meeting to Wednesday, November 14. Approval of Minutes from the August 15, 2018 Meeting Rauschendorfer made a motion, Clarke seconded to approve the minutes of the August 15, 2018 Parks Commission meeting. Ayes: Clarke, Moore – Arcand, Rauschendorfer Abstained: Schmid, Tennyson, Haag Motion carried. 2. Oath of Office New Parks Commissioner Shawn Haag read the Oath of Office and was welcomed as a new member of the Parks, Recreation, and Open Space Commission. 3. Clearwater Creek Preserve Concept Plan Candace Amberg, Senior Landscape Architect with WSB & Associates, presented the Clearwater Creek Preserve Preferred Concept Plan including four potential phases and cost estimates. Highlights of the plan include an improved entrance off of 140th Street, several looped trails with boardwalks including 2 bridges over the creek, and east and west trail connections to residential areas. Page 2 of 3 Parks Commission Minutes September 19, 2018 Discussion included: Commissioners asked questions about the durability of simple boardwalks and one commissioner stated that it would mean that families would need to walk single file. Amberg shared information about the four phase areas and stated that they do not need to be done in any particular order. Rauschendorfer was surprised about the number of bridge but the Commission discussed needing them to cross the creek. After the plan was presented, Residents were invited to share their thoughts. One resident desired having the park improvements follow construction of the trail head on 140th Street. Another resident asked if horses were going to be allowed and who would fix the trails after the horses damage them. The Commission discussed that there are no plans to make enhancements for horses but that they are not planning to prohibit them at this time. A resident was concerned about the stormwater ponds adjacent to the park property that have flooded. Len Pratt discussed moving ahead and pursuing grants and other sources of funding including collaborating with local businesses. A residents stated that they would like designated winter trails so that the snow shoes, skis, and horses do not interfere with each other. They would like to see the trails groomed for cross country. A resident shared that they had been confronted by a bow hunter in the previous winter hunting season and asked if there were any plans to change the hunting regulations before it became an issue. There was additional discussion with the Parks Commission about the stormwater ponds and drainage. Residents inquired about how to help in the future. Clarke discussed the history of the park in that volunteers have made the majority of the trail improvements. He also discussed future plans and keeping residents involved. Clarke made a motion, Tennyson seconded to approve the Clearwater Creek Preserve concept plan. All Ayes. Motion Carried. 4. Bald Eagle Lake Access Hours A resident sent a letter was requesting evaluation of the hours of use at the Bald Eagle Lake access. It was reported that winter users are sometimes loud. The Commission discussed allowing ice fishing access and snowmobiles. Tennyson made a motion, Schmid seconded the change the Bald Eagle Lake access hours to 7:00 am until 10:00 pm. All Ayes. Preliminary Plat and PUD General Plan for a residential development to be known as “The Preserve on Sunset Lake” DATE: October 3, 2018 for the Parks Commission meeting of October 17, 2018 1.INTRODUCTION: At the meeting of June 20, 2018 the Parks Commission provided comments on a sketch plan submitted by Cheldon Frank for a residential development now known as “The Preserve on Sunset Lake”. Discussion included trails and dedication of park land adjacent to Sunset Lake. Frank has submitted an application and is requesting approval for a Preliminary Plat and Planned Unit Development (PUD). 2.DESCRIPTION: The Preliminary Plat and Planned Unit Development (PUD) includes 13 single family residential lots and 3 outlots to be known as “The Preserve on Sunset Lake. The property totals 136.7 acres of primarily existing farm land and is located southwest of Sunset Lake. It is currently zoned Rural Residential (RR) with a minimum lot size of 10 acres. In this this zoning district, smaller lots are allowed with a PUD provided that the maximum density stays at 1 unit per 10 acres. The applicant is requesting a PUD flexibility to allow a minimum lot size of 5 acres with a maximum density of 1 unit per 10 acres which meets the ordinance requirements. The applicant is proposing to dedicate park land adjacent to Sunset Lake. 3.PARKS COMMISSION DISCUSSION: At their meeting of June 20, 2018, the Parks Commission reviewed the sketch plan and provided informal comments. At that time, the plan showed three outlots. Outlot A was - 2 - Preserve on Sunset Lake October 17, 2018 was shown to owned by the Homeowners Association (HOA), preserve some wetlands and woodlands, and include a possible multi-purpose trail. Outlot B was to be dedicated to the City for the purposed of expanding the existing City property on Sunset Lake. To the south of Outlot B, the developer showed an association owned lake access (Outlot C). Generally, the Commission spoke favorably of both Outlot B and C being dedicated to the City for a park. The additional acreage would increase opportunities to improve the park properties and provide more safe access off of CR 7. The Commission discussed a fishing pier, kayak access, parking, picnicking, etc. The Commission also stated that they would like to see a trail on CR 7 as shown in the Trails Plan. 4. PROPOSAL: The developer is proposing to dedicate Outlot B. Altogether, the outlots include: Outlot A: Association Owned and Maintained Open Space with a Trail 30 Acres Outlot B: Land Dedicated to the City for Park Expansion 0.93 Acres Outlot C: Lake Access for Lot 4, Block 1 Unknown Trails The applicant is not proposing to construct any public trails or sidewalks. However, there are multi-purpose/equestrian trails shown in their proposal for the association owned open space. Open Spaces/Greenways This development is not in a Greenway Corridor. A portion of the wetland in Outlot A has been identified as a High Quality Wetland. There are also Ground Water Priority Areas that are shown to be used for stormwater ponding or a part of Outlot A. Parks The Parks, Trails, and Open Space Plan does not identify a need for a neighborhood park in this area because it is outside of the Metropolitan Urban Service Area (MUSA). However, the Parks Plan states that “providing access to and protect Hugo’s water resources including wetlands, lakes, and streams is encouraged to build a connected, multi-function parks system”. The City currently owns a .7 acre parcel that is wooded with a slope to the Sunset Lake shoreline. Outlot B would expand the existing park property along Sunset Lake. There are currently no plans to make park improvements to the property. It has not been a priority for the Parks Commission with their annual goal setting or capital improvement planning. -3 - Preserve on Sunset Lake October 17, 2018 5.PARK DEDICATION: The park dedication section of the City Code requires the applicant dedicate 10% of the developable acres for park land with a density of up to 3.99 units per acre. The current park dedication fee is $2,400 per unit. The developer is required to dedicate 11.4 acres or pay a fee of $31,200. The developer is proposing to dedicate Outlot B totaling .93 acres. This satisfies 8% of the requirement and therefore the remaining requirement would normally be satisfied by paying a fee which would be $28,704. However, the applicant is requesting that the park dedication fee be waived due to the high cost of the lake front property. The project as proposed is an open space concept utilizing a 5 acre minimum lot size. The overall density would remain as 10 acres, netting 13 lots for the subdivision. The open space concept will allow us to preserve 27.26 acres of open space area and an additional 0.93 acres is proposed to be donated to the City as an extension of their current park parcel that is owned on Sunset Lake. The 27.26 total acres of open space equates to 20.62% of the total area of the parcel to be subdivided and will offer trails for the residents for walking and horseback riding if desired. The open space has been designed to preserve the high valued natural wetland resource while allowing homes to be built on the existing farm fields of which would remain relatively untouched except for where the roadway needs to be constructed.Pads would not be constructed with the grading plan due to the number of natural walkout sites located on the plan as proposed. Prior to recording the final plat, we propose to split off a one-acre parcel to be given to the family member on the northern portion of the lot, which will except them out of the final subdivision and association.This is represented in the documents provided with the total boundary and legal description of the overall parcel excluding this area. With the proposed donation of land for the City Park expansion and the design of the project which allows for the preservation of the high value wetland on the site meets with the intent of the PUD ordinance allow for a lot size variation from the rural residential 10-acre standard lot size.The development will also include the planting of a dedicated buffer surrounding the wetland. The buffer will be a mixture of native grasses and wildflowers.We are also proposing 49 new trees be planted as a street scape for the project. The trees are all native species and will help to add interest to areas of the project were only farm fields exist today.In addition to the tree plantings we are proposing to transplant existing trees that exist in overgrown areas on the property. These transplanted trees would be relocated to the right of way along CSAH 7 in the vicinity of Lots 7, 8 and 9. THE PRESERVE ON SUNSET LAKE CONCEPT NARRATIVE Page 3 of 5 The only area of tree removal is a row of box elder trees that will be removed as part of the road and ponding construction. The ponding area incorporates treatment of nearly all of the road and new house construction directing the water through a rural road design and swale system to the ponding area that will outlet through an infiltration area to the existing wetland on the east side of the project. This wetland then outlets to Sunset Lake. Any disturbed area on site will be planted with either a native seed mix appropriate for the location or a fescue mix for lot areas. Minimal grading is planned for the project with grading for just the roads and storm water ponding areas following the natural contours of the land. The project is also proposed to be planted with deciduous and coniferous trees along the proposed roadway and around the proposed ponding area as shown on the proposed planting plan.These plantings will help naturalize the existing farm field and provide some interest as you drive into the development. D)PUD Parameters We are requesting flexibility to the 10 Acre lot size due to the large wetland on the site and the availability to create lots of a 5 Acre minimum size that will allow for the preservation of this high value natural resource. This is the only variation that we are requesting with this development. (1)The proposed use of this parcel is single family residential which is compatible and the same as the surrounding land uses and complies with the city’s comprehensive plan in that this area is designated for large rural residential lots. (2)We are not requesting any mixing of land uses with this proposal. (3)We are proposing smaller lot sizes to in turn preserve over 20% of the site for active and passive use. In allowing for flexibility of lot size also provides an avenue to be able to donate additional park land for use by the public on Sunset Lake. Trees are planned to be planted along the proposed roadway to create a streetscape along with trees planted in the ponding area to promote a naturalization of the proposed ponds. The flexibility allowed by this process also allows for us to locate the proposed roadway to save nearly all of the existing vegetation on the property.Additional trees are also proposed to screen the development from CSAH 7 on the southern border of the project. Existing farm field areas of the open space and areas that are disturbed in the open space will be planted with a native seed mix that includes native flowers that will further enhance the natural setting we can create with this flexibility provide to us with this process. Access to this parcel is from the north onto 125th Street North at the Hilo Avenue North intersection, which should also lessen any impact to the neighboring parcels and perception of traffic increases. THE PRESERVE ON SUNSET LAKE CONCEPT NARRATIVE Page 5 of 5 The location of the exit of the subdivision sits at the top of the hill with excellent sight visibility to the east and west and will not create any turning movement issues at the existing intersection. The existing home site on Lot 9, Block 2 will continue to use the existing home driveway to access CSAH 7. Access restriction is shown on the plat cover ing lots 7, 8 and a portion of lot 9 to limit use in the future.A traffic analysis has been provided with our documentation to the city that documents the anticipated traffic volumes. G)CONFLICTS WITH NEARBY LAND USES: As stated previously this is the same land use as the adjoining parcels and does not create any conflicts with the proposed use. H)PROPOSED PARKS AND OPEN SPACE: The list of the outlots can be found above with proposed uses listed. The project provides for open space that can be actively used by the future residents of this subdivision. We are proposing that 0.93 Acres be donated to add to the current park land that the City owns on Sunset Lake to allow for the creation of a small parking lot for access to the lake. This area is identified as Outlot B on the proposed plan. This area is considered a high value and we respectfully request that our parkland fee be waived for donation of this shoreland area. The small Outlot C is proposed to be retained and owned by Lot 4, Block 1 to allow for a private dock to be installed to use for access to the lake. I)PROPOSED INFRASTRUCTURE: The project is proposed to connect to 125th Avenue North and extend a rural city street section south, ending at a cul de sac. Each of the proposed lots would have their own well and septic. Each of the lots have been tested and found able to support a conventional drain field. This testing will require the review and approval of Washington County.Due to the large lot size the owners of the lots will have some flexibility on home site location. The design of the septic and subsequent well locations may vary from the plan. The wells would be required to remain a minimum of 50-ft from each of the proposed drain fields. THE PRESERVE ON SUNSET LAKE CONCEPT NARRATIVE Page 6 of 5 Storm sewer would be handled for rate, water quality and infiltration in swales, culverts and ponding. The existing low points of the project would be used for ponding to limit the amount of earthwork moving for the site.Grading the site will require the permitting from the City and from the MPCA for their general storm water permit. The City will be included in correspondence to the watershed and also receive a copy of the state NPDES permit and SWPPP document. The proposed roadway has been presented as a rural section with 12-foot drive lanes and 4-foot gravel shoulders. Each of the driveways has a designed location with a culvert to allow flow of water through the rural swale section along the roadway.Each of these culverts have been designed to accommodate the 100 year flood event. J)CONSTRUCTION SCHEDULE: We would like to move this project along as fast as the city’s meeting schedule and review time will allow. We would anticipate construction to start this year with a model home being built for the spring parade of 2019. (a) (b) Sec. 90-324. - Park dedication. General dedication standards. In order to develop a system of parks within the community to serve the public's health and recreational needs, a percentage of the net buildable acreage based on the density of all land subdivided for residential purposes shall be dedicated to the city as public parkland. The city finds that the more dense a development is, the more demand for park land it creates since lots can be smaller affording less private recreational space and more occupants per acre. The following formula will be used to determine the dedication requirement where a land dedication is required: Density Percentage of Land to be Dedicated (of the buildable land) 0—3.99 units per acre 10 percent 4.00—5.99 units per acre 11 percent 6.00—7.99 units per acre 13 percent 8.00—9.99 units per acre 15 percent 10.00 < units per acre 17 percent The land so dedicated shall be subject to approval by the city council in accordance with the city's Comprehensive Plan for parks. At the city council's discretion, a parkland dedication fee may be accepted or required instead of or connection with land dedication. The parkland dedication fee shall be set annually by the city council and adopted as part of the city's fee schedule. The parkland dedication fee shall be charged for each dwelling unit originated by the subdivision or development of any property in the city, not including any dwelling unit that may be in existence at the time of the adoption of the ordinance from which this article is derived, or which is subject to an approved development agreement with the city that includes a parkland dedication provision. Appeal process. The parkland dedication fee may be appealed to the city council before the city council makes a decision on the final plat and shall be calculated as follows: The percentage of land to be dedicated will be multiplied by the fair market value of the net buildable acreage. The fair market value shall be determined by the city council, following their review of a current appraisal submitted to the city at the developer's expense. The appraisal shall be made by appraisers who are approved members of the SREA or MAI, or equivalent real estate appraisal societies. If the city receives written notice of a dispute over the parkland dedication fee before approval of the final plat, the developer shall pay the fee into an escrow account pending a decision of an appeal of the fee. If an appeal is not filed within 60 days following approval of the final plat, or if the person aggrieved by the fee does not prevail on the appeal, then the funds paid into escrow must be transferred to the city.
