APPROVING FINDING OF FACT FOR REZOING FOR SHLAYBA, INC.
FOR "THE PRESERVE ON SUNSET LAKE" ON PROPERTY LOCATED SOUTH OF 125TH
STREET NORTH, EAST OF ILLIES AVENUE NORTH AND NORTH OF 120TH STREET
WHEREAS, Shlayba, Inc. has requested approval of a rezoning to PUD to allow construction of
13 single family lots and 3 outlots on the 139.7 -acre property legally described as follows:

WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing
and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HUGO, MINNESOTA, that it should and hereby does support the request for the reclassification
of the zoning to PUD for the property, based on the following findings:
The proposed PUD is appropriately located and will maintain the current development
pattern in the area.
2. The requested PUD flexibility will improve site design by allowing preservation of
wetlands, open space and natural features while maintaining the City density standards.
3. The PUD allows for a more creative and efficient approach to land use within the city,
while at the same time protecting 'and promoting the health, safety, comfort, aesthetics,
economic viability, and general welfare of the city primarily through preservation of open
space and nature features.
4. The development will preserve and enhance natural features and open spaces.
5. The development will provide efficient public streets and utilities.
6. The development would establish of appropriate transitions between differing land uses.
