Minutes for the Planning Commission Meeting of Thursday. March 8. 2018 Commissioner Kleissler called the meeting to order at 7:01 p.m. PRESENT: Arcand, Derr, Kleissler, Lessard, Luchsinger, Tjernlund. ABSENT: None. STAFF: Rachel Juba, Planner Mark Erichson, City Engineer Shayla Denaway, Parks Planner Kendra Lindahl, Landform Planner Rachel Leitz, Community Development Assistant Approval of Minutes for the Planning Commission Meeting of February 22, 2018 Commissioner Arcand made a motion, seconded by Commissioner Tjernlund, to approve minutes for the meeting of February 22, 2018. All Ayes. Motion carried. Draft 2040 Comprehensive Plan Public Hearing Juba discussed the 2040 Comprehensive Plan process including meeting summaries, key updates from chapters, and a reminder on next steps for the plan. Some of the key updates included no land use map changes, updates to the housing plan to reflect affordable housing goals, updates to the economic development chapter to reflect current economic conditions, and updates to the sanitary sewer plan for waste water flow projections. She stated that a resiliency chapter has been added to the plan, which focuses on disaster preparedness and managing new technologies, updates to the transportation chapter plan for future improvements and safe crossings for all types of users, and an update of the water demand requirements were needed for the water supply and distribution chapter. Within the water resources management plan the City updated water conservation goals and strategies and the parks chapter was updated to evaluate City Park needs and update the Greenway Corridor map. Juba stated that if the Planning Commission recommended approval of the 2040 Comprehensive Plan it would be seen at the April 2" d City Council meeting. If approved at that level, the City would make final edits and distribute for a six month review. In November, the City would adopt the plan and send it to the Metropolitan Council for their review and approval. Once approval is received, the City would implement the Plan. Juba recommended the Planning Commission to open the public hearing and take all public comment. She stated that staff recommended approval of the 2040 Comprehensive Plan. Chair Kleissler opened the public hearing at 7:17 pm. Arnie Triemert, 15220 Everton Ave, approached the podium. Mr. Triemert stated he would like the proposed trail along Everton removed from the Draft Existing and Proposed Trails map. He stated this area will not be developed in the near future. John Udstuen, 15190 Everton Ave, approached the podium. He stated that this area has always requested to be left alone, which is one of the reasons the properties are still designated as Agricultural. He described that the 2030 Comprehensive Plan does not show a proposed path along Everton and he would like the proposed path removed from the Comp. Plan map, as it is already heavily used by surrounding residents. Planning Commission March 8, 2018 Page 2 Grace LaValle-Schostag, 5361 145th St, approached the podium. She stated that she was concerned about the water issues this area is facing and future development. She stated the City should continue to evaluate water conservation measures. She also explained that the City should evaluate the needs for parks within future developments because they all require substantial maintenance costs for the City. Laura Syring, 15149 Everton Ave, approached the podium. She stated that it has been a challenge to watch the City grow while trying to preserve their area. She stated that Everton Ave. is being heavily used and having a proposed trail on a map will invite more pedestrians to use their road. She was requesting the proposed path be removed from the Comp. Plan map. Kathleen Saniti, 5855 147th St, approached the podium. She expressed her concern on the snow plowing practices on 147th St, stating it was very difficult to get to her mailbox. She also requested more police enforcement on 147th St. because of speeding. Richard Meath, 15128 Everton Ave, approached the podium. He stated that he was against the proposed path along Everton Ave. Mr. Meath stated his concern that if a path is installed, surrounding residents whom would use the trail would commit crimes against his property and he would also have a lack of privacy. He stated that this area has requested to be left alone and believes the benefit of this area would be taken away from the people that live there if a future trail is proposed. Mr. Meath inquired as to who would pay for the future trail along Everton. Leroy Peltier, 15257 Everton Ave, approached the podium. He stated that there is already a bike path on Oneka Pkwy. and a proposed trail along Elmcrest Ave, so a future trail along Everton was not needed. He stated Everton Ave. is also very dangerous for pedestrians with traffic from the residential development to the east and commercial development to the west. Mr. Peltier stated that Everton Ave. is undersized and there are ditches alongside the road, which are pertinent to drainage of that area. He requested staff to keep the residents within this area updated on anything that would affect them. He stated that this area was formed for a reason and the residents that live here want to continue to keep their 10-12 acres of land. Laura Syring, 15149 Everton Ave, approached the podium. She described the illegal activities that have occurred on Everton Ave. and on their properties from surrounding residents. She stated that having a future trail along Everton Ave., marked on a map, would invite more issues to their area. Kathleen Saniti, 5855 147th St, approached the podium. She described that she has voiced her concerns previously and asked if they were going to be addressed. Richard Meath, 15128 Everton Ave, approached the podium. He stated his concern that a trail would be the catalyst in changing this areas character. Chair Kleissler closed the public hearing at 7:50 pm. Chair Kleissler directed staff to answer resident questions/concerns from the hearing. Juba first addressed Mrs. Saniti. She commented that Mrs. Saniti's comments were not related to the 2040 Comprehensive Plan, however, she would pass along her concerns and contact information to the Public Works Director. Planning Commission March 8, 2018 Page 3 Juba next addressed resident questions/concerns on the proposed future trail on Everton Ave. She stated that there is a "goat path" trail connecting the Waters Edge development to Everton Ave. currently in existence. She described that the Comp. Plan shows general areas where trails could go in the future and those trails are planned with either street reconstruction or with development. Erichson added that with a street reconstruction project, trail options are considered with the design of the road. During that process, resident input is encouraged in various meetings. He stated that the City's current reconstruction project, located on Oneka Lake Blvd., has a future trail corridor located along this road. With input from residents, that trail is not being constructed with the road project. Juba added that having a future trail marked within our Comp. Plan doesn't mean that it will be installed right away but opens options for the future, especially if the City would need land dedication or more room for installation of a future trail. Juba also stated that the City does not publicize the proposed trail system map to residents for their use. The map is purely for planning related purposes. She concluded by stating that more trail connections have been highly encouraged from comments received during the Comp. Plan process. Commissioner Tjernlund stated that it was his understanding that the proposed future trails on the map are only used as a guideline at the time of development or as a part of a street reconstruction project to add to the overall trail system within Hugo and connect to existing infrastructure around them. Juba next spoke on Mrs. LaValle-Schostag's comments. She stated that items related to the White Bear Lake lawsuit are not within the Comp. Plan, however, residents can stay informed by watching City Council meetings as Bryan Bear, City Administrator, has been giving updates. Juba also stated that Hugo has enough water to accommodate development occurring within the City and there have been many additions to the Comp. Plan regarding water conservation practices. Erichson stated that one order related to the White Bear Lake lawsuit is that a community must use under 90 gallons of water per day per person and Hugo has already accomplished this goal. Commissioner Tjernlund addressed the audience and stated that the Planning Commission is being updated on the White Bear Lake lawsuit regularly and taking the information in account as new development is proposed. Chair Kleissler stated that she believed the Comp. Plan was well written, has great images, and is easily readable. Regarding resident comments heard, Chair Kleissler stated that she believed the proposed future trail on Everton Ave. should be removed from the map, the City should put out a community wide reminder to slow down as the weather is getting nice and people are out walking, and the City should look at signage along Everton Ave. reminding residents of City ordinances while walking within that area. Commissioner Arcand stated that whether there is a line on a map or not, residents will walk in that location. He stated that there is already a path from constant use from residents in that area and it will continue to be used with the surrounding developments. Arcand believed having a trail there in the future might make it safer for pedestrians, home owners, and those driving down that road. Commissioner Tjernlund stated that he would like the future trail along Everton Ave. removed from the map because he believed there were enough trails in that area where connections could still be made while respecting that neighborhood and their wishes. Commissioner Tjernlund commented that he believed the Comp. Plan, overall, was well done. Planning Commission March 8, 2018 Page 4 Commissioner Arcand asked how that area was taken out of the MUSA. Juba stated that the neighborhood requested the City to take them out of the MUSA. She stated if they received a request from the area to be included within the MUSA, the City would accommodate the request. Commissioner Luchsinger asked how the trail along Everton Ave. would be paid for if it were constructed. Juba stated that either development or a road reconstruction project would spur a conversation about construction of a trail. If it were part of a development, the developer would pay for it and if it were part of a street reconstruction project, the City would pay for the entire project with assistance from the assessment policy. Juba stated that whether a trail was constructed or not with a road reconstruction project, resident assessments would be the same dollar amount. Commissioner Arcand requested Shayla Denaway, Parks Planner, to speak on the trail along Everton Ave. Denaway approached the podium. She stated that the future trail was added in this area for the 2040 Comp. Plan because it has been commented on and requested by other residents not in attendance of the public hearing. She reminded the Commission that the trail is only constructed via development or a road construction project. Juba stated that the Comp. Plan ensures trail connections are looked at in certain locations. She described that these connections are easier to obtain when developers understand a connection is planned within the City's Comp. Plan. Commissioner Lessard stated that neither development nor road reconstruction would happen without the area property owners' input and general consent, therefore, he sees no harm in planning for a future trail on Everton Ave. Commissioner Arcand agreed with Commissioner Lessard. Commissioner Arcand motioned, Commissioner Luchsinger seconded to approve the 2040 Comprehensive Plan, as presented. Ayes: Arcand, Derr, Lessard, Luchsinger Nays: Kleissler, Tjemlund Motion carried. Juba asked the Commissioners who didn't approve the plan if their vote was solely based off planning a future trail along Everton Ave. Commissioner Kleissler and Tjemlund stated that was accurate. Request for a preliminary plat and final plat for "Weston Estates" located south of 165th St. and east of Highway 61 (Forest Blvd.) DATE: March 29, 2018 for the Planning Commission Meeting of April 12, 2018 ZONING: Future Urban Service (FUS) 60 -DAY REVIEW DEADLINE: April 21, 2018 1. DESCRIPTION OF REQUEST: The applicant is seeking approval of a preliminary plat and final plat to allow for the alteration of ten parcels to become four parcels. The applicant is proposing the modification to move property lines and combine parcels within this area to reduce non - conformities and the number of total parcels. The applicant is not proposing development of the property. They are simply requesting to clean up the miscellaneous parcels with lot combinations and property line adjustments. 2. BACKGROUND: The applicant has lived within this neighborhood for a long period of time and is now selling the properties. A new buyer and neighbors have contracts to purchase some of the land, which would result in many property line adjustments, lot combinations, and extensive legal descriptions. The applicant has proposed a preliminary plat and final plat to alter ten existing parcels to become four parcels. Most of the parcels within the proposed plat were single family properties, except one unique parcel that is strewn about the properties. City staff does not know a full history of this specific parcel, however does believe it was proposed streets at one point in time. In 1987 this property was sold as a tax forfeited property and has remained as a separate parcel. Weston Estates Preliminary Plat & Final Plat Page 2 3. CONTEXT: A. Surrounding Land Use and Zoning The subject properties are zoned Future Urban Service (FUS) and have a Mixed Use (MIX) land use according to the 2030 Comprehensive Plan. There are three parcels excluded from the plat, but within the neighborhood, that share the same zoning and land use designations. The property to the south is zoned General Business (C-2) and Single Family Detached Residential (R-3) and has both a MIX and Low Density Residential (LD) land use designation. The property to the east is a four acre single family residence also zoned FUS with a MIX land use designation. Properties to the north are single family homes, zoned FUS with a MIX land use designation. The property to the west, across TH 61, is zoned Restricted Industrial (RI -1) and has an Industrial (IND) land use. This property is currently being operated as an industrial business. B. Natural Site Characteristics Currently the area has three parcels that have single family homes on them and seven vacant parcels. The properties are relatively flat and heavily wooded. A large portion of the site is within the floodplain. 4. ANALYSIS: A. Level of City Discretion in Decision -Making The City's discretion in approving or denying a preliminary plat is limited to whether or not the proposed plat meets the standards outlined in the Comprehensive Land Use Regulations. If it meets these standards, the City must approve the preliminary plat. B. Consistency with Ordinance Standards PRELIMINARY PLAT Lot Requirements The FUS zoning district requires a minimum lot size of 20 acres, lot width of 300 ft. and lot depth of 480 ft. None of the existing parcels within the proposed plat conform to the requirements of the FUS zoning district. Parcel 1: This single family home currently sits on approximately 0.51 acres. The plat indicates the east property line extending approximately 40 ft. further east, therefore, creating an approximately 0.64 acre parcel. Although this property will still not meet FUS lot size standards, this change will reduce the non -conformities by increasing the lot size as well as the lot width. Weston Estates Preliminary Plat & Final Plat Page 3 Parcel 2: This single family home currently sits on approximately 0.5 acres. The plat indicates a change in property lines that will result in a parcel that is approximately 2.80 acres. This property will meet the FUS lot size standards for lot depth, however will not meet other lot size standards. Nonetheless, the proposed change will further reduce the non -conformities by increasing the lot size. In addition, this parcel is currently a land- locked parcel and does not have access onto 165th St. Although the proposed parcel will not meet the lot width standards, it further reduces the non -conformity by giving the parcel access to 165th St. Parcel 3: This parcel is comprised of many vacant parcels. These parcels will be combined and some of the unique "old roadway" property will be added to it. The resulting parcel will be approximately 4.08 acres. The property will meet the minimum lot width and lot depth requirements for the FUS zoning district. The parcel will continue to not meet the minimum lot size requirements, however, the non -conformity will decrease as the lot size will be larger than the many existing smaller parcels that it now consists of. Parcel 4: This single family home currently sits on approximately 0.35 acres. The plat indicates the property will be combined with another existing parcel to the east as well as a piece of the unique "old roadway" property. The resulting parcel will be approximately 0.59 acres. This property will meet the FUS lot size standards for lot width, however will not meet other lot size standards. Nevertheless, the proposed changes will reduce the non -conformities by increasing the lot size. The existing parcels do not meet the lot requirements of the FUS zoning district. The proposed plat reduces the non -conformities of each property. It is in staff's opinion that the proposed plat is more in conformity with the FUS zoning district standards for lot size than the existing conditions. Setbacks The FUS zoning district requires a 40 foot front yard setback, a 20 foot side yard setback, and a 50 foot rear yard setback. Parcel 1: There are three structures on this site. The existing house meets all setbacks for the FUS zoning district. The existing garage meets the front and rear yard setbacks, however is approximately 11 feet from the west property line. The shed meets the front and side yard setbacks, however is approximately three feet from the south property line. Although the proposed plat does not assist in reducing the setback non -conformities for this lot, they do not increase the existing the non -conformities. Parcel 2: There are two structures on this site. Both the existing house and garage meet the front and side yard setbacks, however do not meet the rear yard setback for the FUS zoning district. With the proposed plat, both the existing house and garage will meet the 50 foot rear yard setback and be in conformity with the FUS zoning district. Parcel 3: There are no structures on this property. Parcel 4: There are two structures on this site. The existing house meets the front and rear yard setbacks, however is approximately 17 feet from the east property line. The existing garage meets the front and side yard setbacks, however is approximately six feet Weston Estates Preliminary Plat & Final Plat Page 4 from the south property line. Since this property is proposed to be combined with other parcels, it results in the parcel having three "front yards" and two "side yards." The existing house would still not meet the side yard setback, however the proposed changes would not increase the existing non -conformity. The existing garage would not meet the 20 foot side yard setback, however, the non -conformity would be reduced as it no longer is required to meet a 50 foot rear yard setback. All but parcel three have multiple structures on site. The proposed plat would put all structures on parcel two in conformity with the FUS zoning district setbacks. Structures on parcels one and three would still not meet the setback standards in the FUS zoning district, however the proposed plat does not increase the existing non -conformities. It is in staff's opinion that the proposed plat is more in conformity with the FUS zoning district standards for setbacks than the existing conditions. Streets/Access The applicant has proposed to dedicate right-of-way (ROW) to the City on both TH 61 and 165th St. The applicant has proposed to dedicate 30 feet of ROW to the City on 165th St. and 150 feet on TH 61. At the time of development, the City will request an additional 39 feet of ROW as part of the TH 61 corridor plan, which requires a 150 foot wide corridor for future expansion. Additionally, City staff will further evaluate street access into the site upon development of any of the proposed parcels. Parcels one, two, and the parcel to the west of parcel one currently have one shared access onto 165th St. The applicant and these property owners have recorded a shared driveway agreement at the County. Drainage/Grading The applicant is not proposing any grading to the properties within the plat, therefore, drainage will not change within the site. 165th St. is classified as a rural road and has ditches on both sides that accommodates drainage from the road. At the time of development, installation of storm sewer will be further evaluated. Wetlands/Floodplain The applicant has not completed a wetland delineation of the site. City staff will required a wetland delineation to be completed at the time of development of any of the proposed parcels. Much of the property within the plat is within the floodplain. Floodplain, including the floodplain elevation, will need to be further evaluated upon development of any of the proposed parcels. Weston Estates Preliminary Plat & Final Plat Page 5 Utilities The occupied properties are all served by private well and septic systems and currently, do not have access to City utilities. The properties are within the Metropolitan Urban Service Area (MUSA), which means the properties are eligible to receive City utilities in the future. According to our municipal sewer and water service plan, the proposed plat is planned to be served by a 33 inch trunk sanitary sewer pipe and 12 inch watermain that is planned to be located along 165th St. The City's Comprehensive Plan also indicates that the proposed plat is within a search area for a future well location. Upon development of the site, City staff will further evaluate adequately supplying the area with City utilities. Park Dedication Park dedication is required of all land subdivided for residential purposes. The applicant has not created any new lots, therefore, it not required to dedicate parkland or pay any park dedication fees for the plat. 5. CONCLUSION: The applicant is proposing a plat to clean up miscellaneous parcels with lot combinations and property line adjustments. Many of the existing parcels do not meet FUS zoning district standards for lot requirements or setbacks. It is in staff's opinion that the proposed plat is reducing existing non -conformities and is a good way to attain greater compliance of the FUS zoning district standards. The applicant is not proposing to develop the property. At the time this area develops, further evaluation will need to occur regarding streets/access, drainage/grading, wetlands/floodplain, and utilities. 6. STAFF RECOMMENDATION: Staff recommends approval of the preliminary plat and final plat, subject to the conditions listed in the attached resolutions. ATTACHMENTS: 1. Resolutions 2. Location map 3. Preliminary Plat and Final Plat RESOLUTION 2018 - APPROVING A PRELIMINARY PLAT AND FINAL PLAT FOR MIKE CRESSMAN FOR "WESTON ESTATES" GENERALLY LOCATED SOUTH OF 165TH STREET AND EAST OF HIGHWAY 61 (FOREST BLVD.) WHEREAS, Mike Cressman has requested approval of a preliminary plat and final plat to allow for the alteration of ten parcels to become four parcels to be known as "Weston Estates" located south of 165th Street and east of Highway 61 (Forest Blvd.) and is legally described as follows: (See attached) WHEREAS, the Planning Commission has reviewed said preliminary plat and final plat and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the preliminary plat and final plat to Mike Cressman for "Weston Estates" subject to the following conditions: 1. A preliminary plat and final plat is approved to allow the creation of 4 lots, in accordance with the plans received by the City on February 20, 2018 except as amended by this resolution. 2. The properties are subject to the Future Urban Service (FUS) zoning district standards. No variances are granted or implied. 3. Any development shall comply with the comments in the Engineer's memo dated April 5, 2018. 4. Park dedication is not required for this development since no additional lots were created. 5. Prior to development of the property, further evaluation will need to occur regarding site and lot layout, streets/access, drainage/grading, wetlands/floodplain, and utilities. Prior to issuance of a single family building permit: 6. The site plan must meet all requirements outlined in the FUS zoning district standards. 7. Any and all future structures must meet all City code and building code requirements. 8. The applicant must provide a grading plan that reflects the current topography and proposed grading. 9. The applicant must provide an approved wetland delineation from the local governing unit's technical evaluation panel (TEP) prior to development of the property. Resolution 2018 - Page 2 10. The lowest floor elevation shall be reviewed and approved by the City and shall meet the City requirements in regards to groundwater and floodplain elevation. 11. In particular, we have reviewed the following plans related to this particular request: • Preliminary Final Plat dated February 20, 2018 prepared by E.G. Rud & Sons, Inc. • Unrecorded Final Plat dated February 20, 2018 prepared by E. G. Rud & Sons, Inc. Based on the review of the preliminary and final plat, we offer the following comments related to this application: Preliminary and Final Plat 1. The plat provides for the alteration of ten (10) parcels into four (4) parcels by moving property lines, combining parcels, and providing right-of-way along Trunk Highway 61 and 165th Street. 2. Front and side yard drainage and utility easements have been provided on lots 1-4, block 1 that are consistent with Hugo requirements. 3. 30 -ft right-of-way has been provided along 165"' Street 4. Right-of-way along Trunk Highway 61 has been provided, resulting in a 111 -ft of right of way. At the time of future development of these properties, the City will request an additional 39 -feet of right-of-way as outlined in the Trunk Highway 61 Corridor Plan, resulting in a 150 -ft wide corridor for future expansion of trunk Highway 61. The application does not include any proposed site improvements at this time. The subject properties are zoned Future Urban Service (FUS) with a Mixed Use land use designation. Each of the occupied properties are served by private wells and individual sewage treatment systems. The following information related to potential development potential is for informational purposes only. The property is located in the Metropolitan Urban Service Area as identified in the City of Hugo 2040 Comprehensive Plan, meaning municipal utilities (sanitary sewer and watermain) are planned to be extended to this area as development in Hugo progresses in this direction. 6. Trunk watermain and trunk sanitary sewer are proposed to extend from the south and west and in time will extend to this area. 7. Further specific evaluation of utility service to these properties will be evaluated at the time of development. Wetlands/Floodplain 8. Upon preliminary review of the platted area, a significant portion of the platted area is located within the floodplain. Future development of this area will require review of the flood plain to understand flood plain elevations and associated implications for future development. 9. Any future development of the created parcels will require wetland delineations for any wetlands located on the site. Thank you for the opportunity to provide comments on this project.
