Minutes for the Planning Commission Meeting of Thursday, April 27, 2017 Chair, Kleissler called the meeting to order at 7:01 p.m. PRESENT: Arcand, Kleissler, Knauss, Lessard, McRoberts, Tjemlund, Rosenquist. ABSENT: None. STAFF: Rachel Juba, Planner Rachel Leitz, Community Development Assistant Approval of Minutes for the Planning Commission Meeting of March 23, 2017 Commissioner Rosenquist made a motion, seconded by Commissioner McRoberts, to approve minutes for the meeting of March 23, 2017. All Ayes. Motion carried. Western Spring — Lot 2, Block 1, Bald Eagle Industrial Park Sixth Addition— Site Plan Leitz presented on a site plan application proposed for Western Spring on Lot 2, Block 1, Bald Eagle Industrial Park Sixth Addition. She stated the applicant is requesting approval of a site plan to construct a 36,854 square foot manufacturing, warehouse, and office facility on a 4.7 acre lot generally located north of 130th Street and east of Fenway Boulevard. Leitz described the site plan in more detail in regards to setbacks, building height, lot coverage, landscaping and lighting, mechanical equipment screening, street access and vehicle circulation, parking, drainage/grading, building architecture, and utilities. Leitz stated that the Commercial and Industrial Design Guidelines require all roof top mechanical equipment to be screened from view of adjacent properties and staff had concerns that the proposed method of screening will not adequately screen the equipment. She stated it was in staff's opinion that the parapet wall should be raised or some architecturally integrated element proposed to adequately screen the roof top mechanical equipment. Leitz concluded that staff has reviewed the site plan for consistency with ordinance standards and the commercial/industrial design guidelines and staff finds the proposed development complies with both. Leitz recommended that the Planning Commission discuss the proposed screening for the rooftop mechanical units. She also stated that staff recommends approval of the site plan for Western Spring, subject to the conditions listed in the resolution. Chair Kleissler invited the applicant to the podium to speak. Jack Shaw, Contractor with Shaw Construction, approached the podium. He stated that the owners are excited about this project. He discussed the proposed screening of the rooftop mechanical units and wanted to receive further feedback on the requirements for screening these units. Leitz stated that the applicant has provided sight line drawings and elevations for the rooftop mechanical units. She stated that previous projects that have proposed minimal parapets have had easily visible rooftop mechanical equipment. Leitz described that staff is willing to work with the applicant as the project moves forward on how to screen these units, however do recommend something architecturally is changed, like raising the parapet, to ensure adequate screening. Commissioner McRoberts asked the applicant to describe their screening proposal for the mechanical equipment further. Mr. Shaw stated that if the rooftop mechanical units are not adequately screened, the applicant would propose to paint the units the top coping color of the roof edge, which is a dark bronze. Mr. Shaw said that the owners Planning Commission March 23, 2017 Page 2 would rather paint the metal units, themselves, rather than installing a metal shroud around the units and have that as an extra cost and maintenance issue. Commissioner Tjernlund stated that he was comfortable with staff continuing to work with the applicant on adequate screening for those units. Commissioner McRoberts asked staff if they were comfortable with continuing to work with the applicant on adequate screening for the rooftop mechanical units. Leitz stated that the Commercial and Industrial Design Guidelines suggests having an architectural element that adequately screens the equipment from view, compared to the installation of a metal shroud if the mechanical equipment is not adequately screened. She stated that it is in staff's opinion that the parapet is increased to solve this issue ahead of time, however would continue to work with the applicant if the parapet is not raised to ensure the mechanical units are screened. Commissioner Arcand asked if the parapet was part of the main structure of the building. Mr. Shaw stated that the height of the parapet varies because the roofline slopes to the south. He stated that they are proposing to locate the units towards the center of the building to help with screening, as well. Commissioner McRoberts asked if there was a visibility issue with the mechanical units, if it would most likely be from the north elevation. Mr. Shaw stated there would more likely be a visibility issue from the north compared to the south elevation. He stated if there was an issue with screening, they would propose to paint those units the same color of the roof edge. Commissioner Rosenquist asked if low profile units were being installed and suggested those are looked into to help with the screening issue. Mr. Shaw stated he would be happy to look into low profile units and if something was still visible, he would be willing to paint the units the same color as the roof edge. Commissioner Rosenquist suggested looking into the low profile units and providing staff with elevations and site line drawings with those units to see if those would be adequately screened. Mr. Shaw stated he would be willing to do that. Commissioner Arcand asked the applicant if it would be possible to lower the portion of the roof where the mechanical units are proposed to be. Mr. Shaw stated that would not be feasible. Commissioner Tjernlund stated that he believed it was important to keep in mind that this is an industrial area. Mr. Shaw directed the Planning Commission to the site line visual provided in their packets. He stated that view was from Fenway. Mr. Shaw stated that he is trying to avoid having to burden the owners at the end of the project with screening these units further with costly upgrades and maintenance. Planning Commission March 23, 2017 Page 3 Commissioner Lessard suggested looking into the low profile units. Commissioner Rosenquist agreed. Mr. Shaw stated that he would be willing to look into the low profile units and if they can be seen, he would propose to paint those units. Commissioner McRoberts stated he agreed that low profile units should be installed and asked the applicant if that is possible for this building. Mr. Shaw stated he would have to look into it to ensure they would work for a building this size. Commissioner Tjernlund asked the applicant if the largest unit would be air conditioning units. Mr. Shaw stated yes. Commissioner Tjernlund stated he has experience with those units and they are generally about 4 ft. tall and are relatively large units. He believed it would be difficult, without knowing the makes and models, to ensure those are screened from view. He stated that he is unsure, knowing how large those units would have to be for a factory, if raising the parapet wall a couple of feet would screen the equipment from view. He stated that it was his opinion, with the location of the building from the road and the surrounding properties, he would be willing to be somewhat flexible on screening. Juba stated that the resolution states that staff will continue to work with the applicant to ensure the rooftop units are adequately screened. She stated she didn't believe the Planning Commission has to get into the details of the units at this time. Juba described that she is relatively cautious of site distance illustrations because no one knows what the height of the units will be and what is installed could be different. She stated that staff would typically recommend raising the parapet height in order to screen the rooftop mechanical units, which has more of a certainty that the units will be adequately screened. She stated that it was up to the Planning Commission to recommend the applicant to raise the parapet or continue to work with staff on how the units will be screened in the future. Juba stated she would not recommend painting the units to match the color of the roof. She described that usually roof top equipment is painted a light grey to blend in better with the sky. Chair Kleissler asked if the applicant has looked into raising the parapet. Mr. Shaw stated they have looked into that, however, there is a substantial cost with doing so. Commissioner McRoberts asked how much cost would be associated with raising the parapet out of the total project cost. Joe Alstatt, Western Spring Owner, approached the podium. He stated the cost is significant to them and they are trying to make an investment into the community with the proposed building. He described this area as an industrial area and stated he doesn't want the project to get caught up on screening of these units. Commissioner Arcand stated that they have had projects in the past that have had minimal screening of the rooftop mechanical units, so just want to ensure this project complies with the intent of the guidelines. Planning Commission March 23, 2017 Page 4 Mr. Shaw stated that they are working to screen the units and will continue to work with staff. He stated that would like some more clarification on the requirements because would rather not install a shroud if the units are visible. Commissioner McRoberts made a motion, Commissioner Rosenquist seconded, to recommend approval of the Western Spring site plan, subject to the conditions listed in the attached resolutions and the applicant to continue to work with staff on screening of the rooftop mechanical units. All Ayes. Motion carried. Commissioner Knauss asked the applicant what the intent was with the building they currently operate out of. Mr. Alstatt stated that it was their intention to vacate it. The Commissioners agreed that the building was a nice building and was excited for their growth in Hugo. 2040 Comprehensive Plan Update Juba gave an update on the ongoing 2040 Comprehensive Plan Update. She discussed the first open house, which was held on April 19th at City Hall. She stated that 130 people attended and gave a summary of the responses to the SWOT survey. Juba gave a quick notice of some of the upcoming meetings to look forward to. Adiournment Commissioner Rosenquist made a motion, Commissioner McRoberts seconded, to adjourn at 7:51 p.m. All Ayes. Respectfully Submitted, Rachel Leitz, Community Development Assistant Agenda Number D1 CITY OF HUGO COMMUNITY DEVELOPMENT DEPARTMENT Memorandum TO: Hugo Planning Commission FROM: Rachel Leitz, Community Development Assistant SUBJECT: Swimming Pool Ordinance DATE: May 17, 2017 for the Planning Commission meeting of May 25, 2017 1. BACKGROUND: City staff has been receiving many inquiries regarding Hugo's swimming pool requirements. The City does not have an official ordinance related to these requirements and has been following building code requirements and setbacks related to accessory structures when swimming pools are submitted for review. In discussions with residents and swimming pool installers/professionals, the City's setback requirements didn't accommodate for a reasonably sized pool or created an unusual site plan, which didn't allow residents to fully utilize their back yards. Because of these difficulties, staff was approached by many residents who wanted to discuss the variance process to accommodate their swimming pools. On February 9, 2017 City staff approached the Ordinance Review Committee (ORC) to discuss swimming pool requirements in Hugo, specifically related to setbacks, impervious surface, and location of noise making units. The ORC agreed that staff should begin drafting a swimming pool ordinance to address the number of variance requests the City was receiving. On March 6, 2017 City Council approved staff to begin preparing a swimming pool ordinance. Staff has now finished drafting the swimming pool ordinance with direction from the ORC and is ready to present it to the Planning Commission and public. 2. SWIMMING POOL ORDINANCE Many of the requirements within the swimming pool ordinance are guided by the building code, like permit requirements, fencing requirements, and setbacks from frost footings, septic systems, etc. The City's swimming pool ordinance provides all requirements in one location, while having special provisions for property line setbacks, noise making mechanical equipment, and building permit submittal requirements. Page 2 A. Types of Regulated Swimming Pools a. In -Ground Swimming Pools: any swimming pool that is built into the ground. b. Above -Ground Swimming Pools: any swimming pool that is built above the ground. i. Large Above -Ground Swimming Pools: a swimming pool with a capacity over 5,000 gallons and/or a wall height over 42 inches. ii. Small Above -Ground Swimming Pools: a swimming pool with a capacity of less than 5,000 gallons and wall height 24 inches to 42 inches. B. Summary of Requirements a. General standards for all swimming pools: i. The pump, filter unit, heating unit, or other noise -making mechanical equipment shall be screened from the view of any nearby dwelling or public street and located a minimum of thirty (30) feet from any adjacent or nearby dwelling. ii. Swimming pools shall not be located within any private or public utility easement, walkway, drainage, right of way, or other easements. iii. Except in the agricultural, long-term agricultural, rural residential, and future urban service zoning districts, no swimming pool shall be located or protrude in front of the principal building on the site, in relation to any public street. b. In -Ground Swimming Pools: i. Building permit is required (submittal requirements within the ordinance) ii. Setbacks (measured to the pool water): 1. Fifteen (15) foot rear yard setback. 2. Ten (10) foot side yard setback. 3. Six (6) feet from any principal structure or frost footing (i.e., deck). iii. Fencing is required (fencing requirements within the ordinance) c. All Above -Ground Swimming Pools: i. Setbacks (measured to the pool water): 1. Thirty (30) foot rear yard setback. 2. Ten (10) foot side yard setback. 3. Six (6) feet from any principle structure or frost footing (i.e., deck). d. Large Above -Ground Swimming Pools: i. Building permit is required (submittal requirements within the ordinance) ii. Fencing is required (fencing requirements within the ordinance) 2 Page 3 e. Small Above -Ground Swimming Pools: i. Above ground swimming pools of this size that are not surrounded by a fence must have a removable ladder that is removed at all times when the swimming pool is not in use. 3. IMPLICATIONS FOR THE CITY Staff has discussed how the swimming pool ordinance will effect residents that already have established swimming pools. From conversations with our Building Official, all permitted swimming pools would have had to meet the requirements of the building code, at that time. The swimming pool ordinance will be in effect for all swimming pools constructed or installed subsequently to the adoption of this ordinance. 4. CONCLUSION/RECOMMENDATION: The ORC agreed that the swimming pool ordinance is necessary to have the City's requirements in one location for clarification and ease of resident use. The ORC discussed prior requirements, specifically related to setbacks, and believed that in -ground pools did not create the same visual impact that an accessory structure does, therefore, was comfortable with reducing the rear yard setback requirements. The ORC believed large and small above -ground pools did create the same visual impact of accessory structures, therefore, did not change the rear yard setback requirements. The ORC made special provisions for all noise making mechanical equipment to help further reduce the impact of swimming pools to adjacent property owners. Staff recommends that the Planning Commission open the public hearing and receive comments from the public. Staff recommends approval of the swimming pool ordinance. Attachments: 1. Section 90-279: Swimming Pool Ordinance. 3 SWIMMING POOL ORDINANCE 2017 - CITY OF HUGO WASHINGTON COUNTY, MN ORDINANCE RELATING TO AND REGULATING SWIMMING POOLS TITLE: An ordinance adding Chapter 90, Article I, Sec. 90-1. — Definitions and Chapter 90, Article VI - Requirements for Specific Uses and Performance Standards. SWIMMING POOL ORDINANCE: Chapter 90, Article I, Sec. 90-1. — Definitions Add the following: Swimming Pool means any structure, basin, chamber, or tank designed to hold water to enable swimming, diving, recreational bathing, wading, or other leisure activities. In -Ground Swimming Pool means a swimming pool that is built into the ground. Above Ground Swimming Pool means a swimming pool that is built above ground. Small Above Ground Swimming Pool means a swimming pool with a capacity of less than 5,000 gallons and wall height 24 inches to 42 inches. Large Above Ground Swimming Pool means a swimming pool with a capacity over 5,000 gallons and/or a wall height over 42 inches. Chapter 90, Article VI — Requirements for Specific Uses and Performance Standards Add Sec. 90 — 279. — Swimming Pools. (a) Unlawful unless conditions met. It is unlawful for any person to construct, erect, install, replace, or maintain a swimming pool in the city, except in conformance with this section. (b) General standards for all swimming pools. All swimming pools must conform to all of the following standards: (1) One (1) swimming pool is allowed per lot. (2) A building permit shall be required for the erection of all in -ground swimming pools. In addition, a building permit shall be required for all above ground swimming pools with a capacity over 5,000 gallons and/or a wall height over 42 inches. These swimming pools shall be in compliance with the adopted City and State building code, electrical code, and plumbing code, as amended. Ordinance 2017 - Swimming Pools (3) Except in the agricultural, long-term agricultural, rural residential, and future urban service zoning districts, no swimming pool shall be located or protrude in front of the principal building on the site, in relation to any public street. (4) Swimming pools shall not be located within any private or public utility easement, walkway, drainage, right of way, or other easements. (5) The pump, filter unit, heating unit, or other noise -making mechanical equipment shall be screened from the view of any nearby dwelling or public street and located a minimum of thirty (30) feet from any adjacent or nearby dwelling. (6) Swimming pool lighting shall be directed toward the pool and not toward adjacent properties. (7) All access for construction or erection of a swimming pool shall be over the owner's land. The owner shall be liable for damages caused to any public or private property. Back -flushed water or water from swimming pool drainage shall be directed onto the owner's property or into approved public drainage ways and shall not be discharged into or onto any portion of a private sewage treatment system. (c) In -Ground Swimming Pools (1) A site plan must be submitted for approval by the community development director or designee before a permit is issued for any in -ground swimming pool. In addition, the applicant shall submit supplementary information including: a. Size of swimming pool. b. Impervious surface coverage of lot. c. Drawings (must be to scale and show the following): 1. Location of swimming pool. 2. Location of pump, filter unit, heating unit, or other noise -making mechanical equipment. 3. Required and proposed setbacks. 4. Location of principal structure, garage, and any accessory structures. 5. Location of fencing. 6. Location of easements. 7. Location of overhead electrical wires. 8. Location of well and septic (if applicable). 9. Any other improvements on the lot. 10. Drawings of any final treatments or finishes (decking, landscaping, fencing, etc.) proposed around the pool. (2) Setbacks (measured to the pool water) for in -ground swimming pools located in the urban residential or rural residential zoning districts are as follows: a. Fifteen (15) foot rear yard setback. b. Ten (10) foot side yard setback. c. Six (6) feet from any principal structure or frost footing (i.e., deck). Ordinance 2017 - Swimming Pools (3) In -ground swimming pools at locations served by a private well and/or sewage treatment system must meet the following setbacks (measured to the pool water): a. Twenty (20) feet from a water -supply well. b. Ten (10) feet from any septic tank. c. Twenty (20) feet from any soil treatment area. (4) All in -ground swimming pools shall be completely surrounded by a fence or wall, not less than four (4) feet high and not exceeding six (6) feet high. All gates or doors shall be equipped with a self-closing and self -latching gate or door with provisions for locking. This shall remain securely closed at all times. Fencing shall be installed prior to the filling of the pool. Please refer to section 90-227 for fence performance standards. (d) Above Ground Swimming Pools (1) General standards for all above ground swimming pools. All above ground swimming pools with a wall height exceeding 24 inches must conform to all of the following standards: a. Setbacks (measured to the pool water) for above -ground swimming pools located in the urban residential or rural residential zoning districts are as follows: 1. Thirty (30) foot rear yard setback. 2. Ten (10) foot side yard setback. 3. Six (6) feet from any principle structure or frost footing (i.e., deck). b. Above -ground pools at locations served by a private well and/or sewage treatment system must meet the following setbacks (measured to the pool water): 1. Tom Weidt, Mayor Attest: Michele Lindau, City Clerk Agenda Number D.2 CITY OF HUGO COMMUNITY DEVELOPMENT DEPARTMENT Memorandum TO: Hugo Planning Commission FROM: Rachel Juba, Planner SUBJECT: Parking Ordinance Revisions DATE: May 19, 2017 for the Planning Commission meeting of May 25, 2017 1. BACKGROUND: In reviewing the zoning code, staff has found the existing parking requirements to be quite excessive based on our experience with the typical demand for parking associated with various uses and also when compared with ordinances in other communities. For that and other reasons, staff is proposing zoning text amendments to address the excessive parking requirements found in the parking ordinance. In addition to the review of the parking requirements for each use, the Ordinance Review Committee (ORC) reviewed the entire ordinance and made recommendations on revisions. 2. SUMMARY OF REVISIONS: Number of Parking Spaces Required One of the significant revisions to the ordinance was the number of parking spaces required for each use. The required number of minimum parking spaces table was revised to reduce the amount of uses regulated and to reduce the number of parking spaces required for each use. Any use that is not listed in the table will be assigned a parking requirement by staff and ultimately approved by the City Council. There are two new items that were also added to this section, the allowance and requirements for parking deferment and shared parking. The City has been practicing these methods for parking and approving them with development projects, but the ordinance previously did not outline the allowance or provide any guidance on how it can be used. Parking Ordinance Text Amendment Page 2 Prohibited Parking There are several sections of the City Code related to prohibited parking and it is difficult to figure out what section to review in regards to providing information to residents. In addition to the revisions, staff combined all sections of the City Code relating to prohibited parking to be added to the parking ordinance. This also includes the existing regulations for parking and storage of large recreational equipment, such as recreational vehicles (RV's). The other sections of the City Code related to prohibited parking are proposed to be deleted and added to the parking ordinance. Revisions to Other Sections of the Code Because of the revisions to the parking ordinance, a few minor revisions were required to the driveway and landscaping ordinances. 3. CONCLUSION/RECOMMENDATION: The ORC reviewed the parking ordinance and recommended approval of the revisions to the Planning Commission. Revised Landscape Ordinance (red -lined) 5. Ordinances for Adoption (2) EXISTING Sec. 90-253. - Parking and loading. It is unlawful for any person to construct any building or facility, or to use a property, unless such property shall have adequate parking, loading, driveway, and access road facilities, as required in this section. It is unlawful for any person to construct any parking area, loading area, driveway or access road, except in conformance with this chapter. (1) Parking areas for five or more vehicles must be approved by the city engineer prior to construction. (2) Parking facilities shall be constructed to meet the following design requirements: a. Except for handicapped parking spaces and parallel parking spaces, each parking space shall not be less than nine feet wide and 20 feet in length, exclusive of access aisles. b. Parking spaces designated for handicapped parking shall meet the requirements of the Americans with Disabilities Act. c. Parallel parking spaces shall be at least 22 feet in length and eight feet in width. d. Except for single-family and townhouses, parking areas shall be constructed so that circulation between parking bays or aisles occurs within the parking areas, and does not encroach on any public street or road right-of-way. e. Driveway access to parking areas shall comply with section 90-222, except that no parking lot entrance may be located within 60 feet of the intersection of two public streets. f. No curb cut shall exceed 32 feet in width on state highways, or 24 feet in width for all other public roads, except by conditional use permit. g. The grade elevation of any parking area or driveway shall not exceed ten percent. h. As a minimum, each parcel of land shall be allowed one curb cut on a city street; otherwise, one curb cut shall be allowed for each 150 feet of road frontage on a city collector street, and one curb cut for each 125 foot of frontage on all other city streets. Credit for fractions of the required frontage shall not be granted. L Curb cuts on county roads and state highways shall meet the requirements of the permitting agency. j. Except in the agricultural, long-term agricultural and rural residential districts, all parking areas shall be paved with bituminous, concrete, pavers, or other approved dustless and erosion -resistant material. Positive drainage control through use of curb, gutter, storm sewer, or approved means shall channel all stormwater from parking areas into a public drainage channel. Treatment of stormwater runoff shall comply with national urban runoff protection standards prior to discharge into the public stormwater drainage system, unless the property is served by a regional treatment facility. k. Except for single-family homes, and driveways to garages at townhouse sites, all parking stalls shall be delineated by white or yellow painted lines at least four inches in width. I. Except for single- and two-family dwellings, all off-street parking areas shall have a continuous concrete perimeter curb around the entire parking lot. m. All open, off-street parking areas of five or more spaces shall be screened from abutting residential districts and uses. n. Adequate snow storage space shall be provided so as to maintain the minimum number of required parking spaces in the winter months. If excessive snow cannot be stored on site while maintaining the minimum number of parking spaces required, the owner of the parking area shall remove the snow from the site. Page 1 o. Back of curb of all parking areas shall be a minimum of five feet away from all property lines, ten feet where abutting a residentially zoned lot. (7) Within the shoreland district of the city, parking areas, driveways, access roads, and loading areas shall be: a. Constructed to make use of existing topography and vegetative screening to shield such facilities from view off the public waterbody, as much as feasible. b. Setback from the ordinary high-water level to the same extent as required structures in subsection 90-137(1). c. Constructed to avoid bluff impact zones and shore impact zones. (8) Within any residential zoning district, parking of any truck or vehicle exceeding 9,200 pounds licensed gross vehicle weight on any property or public street is prohibited, except under the following conditions: a. Vehicles lawfully delivering goods, products, or services to a property may be parked for a reasonable period of time on the property or adjacent street to deliver such goods, products or services. b. Vehicles used in construction activities may be parked or stored on the site of such construction activities for a reasonable period of time to complete the work. Parking of these vehicles on a city street is allowed only by permit issued by the city engineer. c. Vehicles primarily used in the conduct of agricultural activities may be parked on the property where the agricultural activities are undertaken, or the farmstead of the vehicle owner. d. Licensed recreational vehicles stored inside a building or on lots exceeding 2'/2 acres in size. Page 6 (9) Parking ramps and related facilities may be exempted from the strict provisions of this section if approved by the city engineer. (Prior Code, § 1195-530.1; Ord. No. 2010-453, § 3, 12-6-2010) Page 7 PROPOSED REVISIONS Sec. 90-253. Parking and loading. (a) Unlawful unless conditions met. It is unlawful for any person to construct any building or facility, or to use a property, unless such property shall have adequate parking, loading, driveway, and access road facilities, as required in this section. It is unlawful for any person to construct any parking area, loading area, driveway or access road, except in conformance with this chapter. (b) Purpose and Intent. The regulations of parking and loading in this section is to alleviate or prevent congestion of the public right of way and to promote the safety and general welfare of the of the public by establishing minimum requirements for parking and loading of motor vehicles upon various parcels of land and for structures. (c) General Standards. (1) Parking areas for five or more vehicles must be approved by the City Engineer prior to construction. (2) Back of curb of all parking areas shall meet the following setbacks: Public Right -of -Way 10 feet Residentially Zoned Property 10 feet All Other Property Lines 5 feet (3) No parking areas shall be constructed on a public road right-of-way or drainage and utility easement without approval of the City Council. (4) Curb Cut and Driveway Access Locations. a. Driveway access to parking areas shall comply with section 90-222 Driveways, except that no parking entrance may be located within 60 feet of the intersection of two public streets. b. Curb cuts on State highways and County roads shall meet the requirement of the permitting agency. c. Accesses to a property shall be minimized to amount needed to allow proper circulation on the site. As a minimum, each parcel of land shall be allowed one curb cut on a city street; otherwise, one curb cut shall be allowed for each 150 feet of road frontage on a city collector street, and one curb cut for each 125 foot of frontage on all other city streets. Credit for fractions of the required frontage shall not be granted. In no case shall the separations be less than outlined above, unless unique circumstances are present and are reviewed and approved by the Community Development Director or designee. Except for single-family and multi -family housing, parking areas shall be constructed so that the circulation between bays and/or aisles occurs within the parking areas, and does not encroach on any public street or road right -of way. e. Except in the agricultural, long-term agricultural, future urban service, and rural residential zoning districts, all parking shall be paved with bituminous, concrete, pavers, or other approved dustless and erosion -resistant material. Positive drainage control through the use of curb, gutter, storm sewer, or approved means shall channel all stormwater from the parking areas into a public stormwater drainage system. Treatment of stormwater runoff shall comply with national urban runoff protection standards prior to discharge into the public stormwater drainage system, unless the property is serviced by a regional treatment system. f. Except for single-family and townhomes, all off-street parking areas shall have a continuous concrete perimeter curb around the entire parking lot. g. Except for single-family and townhomes, all parking stalls shall be delineated by white or yellow painted lines at least four inches in width. Page 2 h. The grade elevation of any parking area or driveway shall not exceed ten percent. Other grade elevations shall be reviewed and approved by the City Engineer. i. Adequate snow storage space shall be provided to maintain the minimum number of parking spaces in the winter months. If excessive snow cannot be stored on site, while maintaining the minimum number of parking spaces required, the property owner shall remove the snow from the site. j. Driveway turnarounds may be required by the City Engineer, where necessary, to avoid interference with traffic flow on any public street. k. Parking ramps and related facilities may be exempted from the strict provisions of this section if approved by the City Engineer. (2) Landscaping a. All open, off-street parking areas of five or more spaces shall be landscaped in accordance with Section 90-181. (3) Lighting a. Exterior lighting shall be directed down and shielded (downcast cut-off fixture) from adjacent properties and roadways and shall be in accordance with Section 90-239. b. The maximum height of parking lot lighting adjacent to or within residential areas shall be 20 feet. (e) Number of Spaces Required. (1) Calculating Parking Space Requirements. In calculating parking space requirements, the following rules shall apply: a. When determining the number of off-street parking spaces results in a fraction, each fraction shall constitute another space. b. In facilities where patrons or spectators occupy benches, pews, or similar seating facilities, each 22 inches of such seating facilities shall be counted as one seat for the purposes of determining parking requirements. c. For structures containing two or more types of uses, the parking requirements shall be determined independently, and combined to determine the total off-street parking spaces required. d. On -street parking shall not be used when calculating the number of parking spaces require for a use, unless approved by the City Council. (2) The minimum number of parking spaces designated in the following table shall be provided for the use specified, unless the property is part of a shared parking system approved with a Planned Unit Development (PUD) or a variance is granted by the City Council. The parking spaces shall be evaluated in accordance with this section in any zoning district whenever a new use is established or existing use is enlarged. Fractions over one-half shall be count as one additional space. (3) Other Uses. Any use not in the parking requirements in this section shall be assigned a parking requirement by the Community Development Director or designee (4) Parking Deferment. A portion of the parking area required under this section may be remain unimproved until such time as the City Council deems that it must be improved to adequately serve the parking demand. Such delayed construction of parking may be permitted only after the City Council is satisfied that the initial occupancy of the premises will be adequately served by the lesser number of parking spaces and only after approval of a final development plan clearly indicating the location, design, traffic circulation, and other development requirements of the deferred parking. The land area shall be delineated for future parking and shall be brought to finish grade and landscaped, and shall not be used for building, storage, loading or other purposes. a. The applicant shall enter into a development agreement, to be recorded against the property, which includes a clause requiring the owner to install the additional parking spaces, upon a finding of the Community Development Director or designee that such additional parking spaces are necessary to accommodate the use. (5) Shared Parking. Parking facilities for a combinatiori of buildings, structures, or uses may be provided collectively in any zoning district provided that the total number of spaces Page 5 provided shall equal the sum of the separate requirements of each use. A lesser number of parking spaces than required for each use may be allowed with approval of the City Council provided that each use is compatible in regards to peak parking periods. Shared curb cuts and access drives shall be encouraged. Where shared parking and accesses are utilized, easements and maintenance agreements shall be placed on the shared areas and recorded against the properties. (f) Shoreland District. (1) Within the shoreland district of the City, parking areas, driveways, access roads and loading areas shall meet the following: a. Designed and constructed to make use of existing natural vegetation and topography to screen such facilities from view of the public waterbody, as much as feasible. b. Setback from the ordinary high water level (OHW) to the same extent required for structures in subsection 90-137 (1). c. Constructed to avoid bluff impact zones and shore impact zones. (g) Prohibited Parking. (1) Parking Restrictions for Vehicles and Trailers. a. In order to expedite the prompt and efficient removal of snow from the streets of the city it is unlawful for any person to stop, stand or park any vehicle or trailer or permit the same to stand on any street within the city between the hours of 2:00 a.m. and 7:00 a.m. from November 1 until March 31 of the following year. At all times of the year it is unlawful for any person to stop, stand or park any vehicle or trailer or permit it to stand on any public street within the city between the hours of 2:00 a.m. and 7:00 a.m. after a continuous or intermittent snowfall, during which there has been an accumulation of two inches or more of snow on any street, until the snow has been plowed or removed to the full width of the street. b. No person shall park any vehicle or trailer on any street within the City for an excess of 72 hours. c. Vehicles and trailers may be parked in the front yard, provided it is kept on an established driveway, and is entirely on the equipment owner's property. d. Within any residential zoning district, parking of any vehicle or trailer exceeding 9,200 pounds licensed gross vehicle weight on any property or public street is prohibited, except under the following conditions: 1. Vehicles lawfully delivering goods, products, or services to a property may be parked for a reasonable period of time on the property or adjacent street to deliver such goods, products or services. 2. Vehicles used in construction activities may be parked or stored on the site of such construction activities for a reasonable period of time to complete the work. Parking of these vehicles on a city street is allowed only by permit issued by the city engineer. Page 6 3. Vehicles primarily used in the conduct of agricultural activities may be parked on the property where the agricultural activities are undertaken, or the farmstead of the vehicle owner. e. Any vehicle parked in violation of these sections more than two times in any 30 -day period may be towed pursuant to Minn. Stats. § 169.041. Violation of this section shall constitute a petty misdemeanor. (2) Large Recreational Vehicles. As defined under Section 90-1. a. Except for on properties zoned agricultural, long-term agricultural, rural residential or future urban service, all lakeshore property, and all properties at least one acre in size, large recreational equipment units shall be parked or stored within a building, except that large recreational equipment may be parked or stored on the property outside of a building under the following conditions: 1. No more than two large recreational equipment units shall be parked or stored outside of a building on the property, with not more than one unit being located in the front yard and no more than one unit being located in the rear yard. 2. For properties exceeding one-half acre in size, no more than three large recreational equipment units shall be parked or stored outside of a building on the property, with not more than one unit being located in the front yard and no more that one unit being located in the rear yard. 3. Large recreational equipment may be parked in the front yard, provided it is kept on an established driveway, and is entirely on the equipment owner's property. Recreational equipment shall not be parked or stored on public property, in a street right-of-way, or closer than 30 feet from the curb, except that between one week before Memorial Day and one week after Labor Day recreational equipment may be parked no closer than ten feet from the curb. 4. Large recreational equipment may be parked in the side yard abutting an attached or detached garage, provided the area is surfaced with asphalt, concrete, or crushed decorative rock. If the area is surfaced with asphalt or concrete, the surface shall be no closer than five feet from the side lot line. If the area is surfaced with decorative crushed rock, the surface shall be no closer than one foot from the side lot line. Parking or storage of large recreational equipment on the side yard abutting the principal building is prohibited. 5. Large recreational equipment may be parked in the rear yard, no closer than five feet from the rear lot line, five feet from the side lot lines, and not located within a drainage or utility easement. 6. In the case of a corner lot, large recreational equipment may be stored on the side of an attached or detached garage adjacent to a public street, but shall be located at least 20 feet from the public right-of-way. 7. Large recreational equipment may be parked or stored temporarily while being loaded or unloaded or during routine maintenance and servicing not exceeding 72 hours. Page 7 8. Parking of licensed large recreational equipment is prohibited on all public streets except while being loaded or unloaded for a period not to exceed 24 hours. 9. The community development director or his designee may approve an alternate location for an item that does not meet the technical restrictions set forth in this section but that otherwise complies with the intent of this section. Such approval may be accompanied by a screening plan designed to minimize the impact to the surrounding properties. Page 8 Sec. 90-222. - Driveways. (a) It is unlawful for any person to construct or maintain a driveway, except in accordance with these regulations. (b) Driveways are allowed in all zoning districts of the city by permit issued by the city building official for platted property, or the city engineer for unplatted property. (c) Driveway access to all county roads and state highways requires a permit from the agency controlling the road or highway. Private driveway access to County Road 4, County Road 8, and Forest Boulevard (T.H. 61) will be allowed only where no viable alternative exists. (d) Except in the Long Term Agricultural, Agricultural, Rural Residential, and Future Urban Service zoning districts. (e) Driveways shared by two or more separate parcels or lots of land may be permitted only by conditional use permit. An access easement and maintenance agreement shall be recorded against the properties that contain the shared driveway. (f) Driveways may cross or encroach upon wetland area only by permit from the appropriate regulatory authority. (g) Driveways may cross or encroach upon a public drainage easement only by conditional use permit. (h) Driveways crossing a public road ditch in platted areas require a minimum 15 inches reinforced concrete pipe with aprons. In other areas, a minimum 15 -inch corrugated metal pipe is an acceptable alternative. A higher standard in dimension or materials may be required by the city engineer for public safety or to maintain drainage. Property owners are required to keep such culverts in good repair and free from obstructions. (i) Driveways located in the floodplain overlay district shall meet the requirements of section 90-138. (j) Driveways shall connect to a public road at an angle between 60 and 90 degrees as measured along the driveway's edge from the road connection point to the building front yard setback line. (k) Only one driveway permit will be granted per lot or parcel of land, except one or more additional permits may be approved by the city engineer if such accesses will not impede traffic or pose a public safety risk. (1) Driveways must meet the minimum design requirements for the zoning district in which they are located, as specified in this subsection. However, in no case shall the width of a driveway exceed 35 percent of the lot width, as measured at the required front yard setback. (a) Generally. The city recognizes that adequate landscaping makes for a more attractive community, provides habitat for wildlife, improves surface water quality, reduces radiant heat, curtails air and noise pollution, and increases property values. For these reasons, this section establishes minimum landscaping requirements for the development and use of property in the city. (b) Plan. A landscaping plan shall be provided to the city for approval as part of all commercial, industrial, and multifamily housing site plans. Such plan shall describe, as a minimum: (1) Established and proposed drainage patterns on the site. (2) The location, number, size, and type of all mature trees existing on the site, and identification of those to be removed. Mature trees are defined as trees measuring a minimum of six inches in diameter or larger for deciduous trees and measuring four inches in diameter or larger for coniferous trees, measured 54 inches above the ground. (3) The location, number, type, and size of all trees and shrubs to be planted, as well as the type of mulch to be used. (4) The location and description of all ground covers to be planted or preserved. (5) The location of all street, utility, and drainage easements located on the site. (6) Relationship of landscaping to the structures and facilities proposed for the site. (7) A chart showing the number of trees, shrubs, etc., proposed. (c) Percentage amount to be expended. An amount not less than one percent of the cost of improvements made as part of a development, meeting one or more of the conditions listed below, shall be expended on landscaping. The landscaping plan and supervision of landscaping improvements shall be made by a landscaping professional and approved by the city council. (1) Multifamily housing development, including town homes, containing ten or more housing units. (2) All commercial and industrial development. (d) Tree preservation. Wherever feasible, shade trees with a trunk diameter of six inches or more, and evergreen trees over 25 feet in height, shall be preserved as part of land development activities. (e) Obstructions. No vegetation, fence, berm, or other visual obstruction over two feet tall shall be placed, or allowed to develop, within ten feet of the intersection of any public streets where both streets have a speed limit of 35 miles per hour or less. In this case, the intersection shall be considered the edge of the curb or travel portion of the roadway. Where one or more of the streets have a speed limit in excess of 35 miles per hour, such setback requirement shall be 20 feet. Trees that overhang the setback requirement shall have their branches trimmed to provide unobstructed visibility to a point ten feet above the centerline gradient of the abutting streets. Public utility poles, street lights, and regulatory signs constructed may be located in the setback area with approval of the city engineer. (f) Planting in public places. No tree, shrub, or other organic matter, except low -growing ground covers, shall be planted or allowed to grow in public road rights-of-way without approval by the city council. (g) Planting near power lines. No tree shall be planted under or near an overhead power line that may grow to interfere with power transmission. Large mature -height trees, may not be planted under or within 30 feet of overhead power lines. Care shall be taken not to cause damage to underground utilities and services when planting. Excavations over 18 inches deep require prior notification of utility companies and the locating of underground facilities through the state's Gopher State One -Call system. (h) Cutting, damaging trees. No person shall cut, remove, trim, or in any way damage any tree on any property owned by the city, or shall create any condition hazardous to any tree on city property without approval of the city's public works director. Page 1 (i) Intensive clearing. Intensive clearing of vegetation in shoreland areas is not allowed. Limited clearing of trees, shrub cutting, and pruning of trees is allowed to provide view to the water from the principal dwelling site and to accommodate placement of stairways, landings, picnic areas, access paths, livestock watering areas, beach and watercraft access areas, and permitted water -oriented accessory structures and facilities provided that: (1) Clearing of vegetation shall be limited as much as possible. No vegetation shall be removed which would lead to erosion, bank slumping or change to the topography of shoreland or public waters. (2) The screening of structures, vehicles, or other facilities, as viewed from the water, assuming summer leaf on conditions, is not substantially reduced. (3) Existing shading of water surfaces is preserved along lakes, rivers and streams. Q) Bluffs. For regulations on bluffs, see section 90-169. (k) Wetlands. Wetland areas shall be left undisturbed and allowed to retain their natural vegetative cover. Where wetlands are restored or replaced, vegetative cover shall be planted or allowed to grow in accordance with the wetland type desired. (1) Buffer strips. Buffer strips of natural upland vegetation, free of noxious weeds and materials, up to 50 feet wide are encouraged along wetlands, lakes, rivers, and streams. (m) Screening. Safe and attractive screening shall completely block from view the activities or uses requiring the screening from all public right-of-way and adjacent properties. (n) Parking and loading areas. (1) The perimeter area of all parking and loading areas shall be landscaped. Landscaping performed in parking and loading areas shall apply towards meeting the other landscaping requirements of its zoning district. This perimeter area shall be a minimum of ten feet wide where it abuts a public street and residentially , ied property and feet wide at other areas. The perimeter area shall be measured from the street right-of-way or lot line to back of curb. Sidewalks shall not be included when determining the landscaping requirement for the perimeter area. The perimeter area shall be covered with approved ground cover, as herein defined, and include an average of at least one evergreen or shade tree per 30 feet of perimeter frontage, as measured at the outer edge of the perimeter area. This does not require trees to be equally spaced within the frontage area. (2) Areas containing parking spaces for over 40 cars and all parking and loading areas exceeding 10,000 square feet shall have a minimum of five percent of their interior area set aside for landscaping. Landscaping areas must be a minimum of 100 square feet to be included in the total area required to meet this requirement. These areas will be covered with approved ground covers and a minimum of one tree shall be planted for every 100 square feet of landscaped area. (o) Single-family housing. All yard areas are to be covered with an approved ground cover. Two overstory deciduous shade trees shall be maintained in the front yard of each home site. Where five or more trees are planted as part of a development, no more than 20 percent of the trees planted to meet this requirement shall be of the same species. No tree, shrub, or other plant, except approved ground cover, shall be planted or allowed to grow in public road right-of-way without approval of the city council. (p) Multifamily housing. All lot areas not covered by buildings, parking and loading areas, driveways, or other approved impervious surfaces shall be covered with an approved ground cover, and landscaped to meet the following minimum standards: (1) One overstory deciduous shade tree per housing unit. (2) One coniferous tree per housing unit. (3) One ornamental tree for every 1,000 square feet of building or one ornamental tree for every 100 feet of site perimeter, whichever is greater Page 2 (4) One ornamental shrub for every 200 square feet of building or one shrub for every 30 feet of site perimeter, whichever is greater. (5) Credit for large trees. The city council may, at their discretion, give credit for trees exceeding the minimum planning size requirements. The city may reduce the required number of plantings by up to ten percent when trees in excess of the minimum size requirements are provided. (6) Equivalent planting materials. The following substitutions may be made for the minimum landscape requirements: a. An equivalent of up to 50 percent of the required number of overstory trees may be substituted with the use of ornamental trees. In such case, not less than three ornamental trees shall be provided for each one required overstory tree substituted. b. An equivalent of up to 50 percent of the required number of ornamental trees may be substituted with the use of shrubs. In such case, not less than 20 shrubs shall be provided for each one required ornamental tree substituted. (q) Commercial/industrial areas. All lot areas not covered by buildings, parking and loading areas, driveways, or protected wetland area shall be covered with an approved ground cover and landscaped to meet the following minimum standards: (1) One overstory deciduous shade tree for every 2,000 square feet of total building area or one tree for every 100 feet of site perimeter, whichever is greater. (2) One coniferous tree for every 2,000 square feet of building or one coniferous tree for every 200 feet of site perimeter, whichever is greater. (3) One ornamental tree for every 2,000 square feet of building or one ornamental tree for every 200 feet of site perimeter, whichever is greater. (4) One shrub for every 300 square feet of building or one shrub for every 30 feet of site perimeter, whichever is greater. (5) Credit for large trees. The city council may, at their discretion, give credit for trees exceeding the minimum planning size requirements. The city may reduce the required number of plantings by up to ten percent when trees in excess of the minimum size requirements are provided. (6) Equivalent planting materials. The following substitutions may be made for the minimum landscape requirements: a. An equivalent of up to 50 percent of the required number of overstory trees may be substituted with the use of ornamental trees. In such case, not less than three ornamental trees shall be provided for each one required overstory tree substituted. b. An equivalent of up to 50 percent of the required number of ornamental trees may be substituted with the use of shrubs. In such case, not less than 20 shrubs shall be provided for each one required ornamental tree substituted. (r) Site restoration. All property disturbed by mining, excavation or fill, or by other uses that disturb the vegetative cover of the property, and that shall lie fallow or undisturbed thereafter, shall be restored as soon as practicable. As a minimum, such restoration shall include: (1) A minimum of four to six inches of topsoil shall be applied to all areas to be seeded. Topsoil shall be of the type that naturally exists on the site, and is to be generally free of debris, rock, roots, noxious weeds, or any substance potentially toxic to plant growth. The surface area where topsoil is to be added shall be loosened to a depth of two inches, and the topsoil shall be mixed within this depth to ensure binding. (2) The seedbed shall be tilled to a minimum depth of four inches and fertilizer applied in accordance with the recommendations of the University of Minnesota Extension Service. (3) Minnesota Department of Transportation Standard Prairie Grass Seed Mix, suitable for the site, shall be applied at a uniform rate as recommended by the producer through drilling, broadcast Page 3 spreading, or hydroseeding. A good quality straw mulch shall be applied at a rate not less than 4,000 pounds per acre on all slopes of four to one or greater, then anchored using disks or netting. (4) A mixture of deciduous and coniferous trees, at an average density not less than ten per acre, shall be planted at areas of the property owner's choice. These trees may be grouped into stands for the purposes of erosion control, buffering, or wildlife habitat. No more than 20 percent of the trees planted to meet this requirement shall be of the same species. (5) Vegetative Buffering. When required, vegetative buffering shall interrupt the view of the objects being buffered from public road rights-of-way and adjacent property. No more than 15 lineal feet of the object being buffered shall be visible from public road rights-of-way and adjacent properties without a vegetative interruption extending from the base of the object to a minimum height of six feet. Coniferous and deciduous trees and shrubs may be used to fulfill this requirement. (s) Sizes of plantings. Plantings, except for site restoration activities in the rural development area, must be of the size indicated in this subsection, and meet the American Standard for Nursery Stock published by the American Association of Nurserymen. Bare root plants may be allowed if specifically approved as part of the site development plan, otherwise all plants must be balled and burlaped, or container grown. (1) Overstory deciduous trees: 2.5 -inch caliper (2) Coniferous trees: six feet in height. (3) Shrubs: a. Deciduous shrubs: three -gallon pot. b. Coniferous shrubs: five -gallon pot. (4) Ornamental trees: 1.5 -inch caliper. (t) Minimum installation requirements. Minimum installation requirements are that: (1) All deciduous and coniferous trees shall be staked and guyed per national nurseryman's standards. Deciduous trees shall have branches trimmed to a point six feet above the ground. (2) Adequate fertilizer, water, and mulch shall be provided to ensure plant survival and successful growth. Plantings shall be inspected at least bi-weekly during the first growing season, with dead and severely damaged plants replaced as needed. (3) All open areas shall be sodded over four inches of topsoil. (4) Undisturbed areas and wetlands containing natural vegetation may be maintained if they are free from foreign and noxious materials. (u) Table of landscaping materials. Property owners are responsible to ensure that landscaping is maintained in an attractive condition free from invasive and noxious weeds and materials, as defined by the state department of natural resources. The owner shall replace any required vegetation within two years of planting, including damaged or dead trees, shrubs, ground covers, and sodding. Blue grass and similar ornamental lawn covers shall be kept cut so as not to exceed 12 inches in height. It is unlawful for any person to construct any parking area, loading area, driveway or access road, except in conformance with this chapter. (b) Purpose and Intent. The regulations of parking and loading in this section is to alleviate or prevent congestion of the public right of way and to promote the safety and general welfare of the of the public by establishing minimum requirements for parking and loading of motor vehicles upon various parcels of land and for structures. Curb cuts on State highways and County roads shall meet the requirement of the permitting agency. c. Accesses to a property shall be minimized to amount needed to allow proper circulation on the site. As a minimum, each parcel of land shall be allowed one curb cut on a city street; otherwise, one curb cut shall be allowed for each 150 feet of road frontage on a city collector street, and one curb cut for each 125 foot of frontage on all other city streets. Credit for fractions of the required frontage shall not be granted. In no case shall the separations be less than outlined above, unless unique circumstances are present and are reviewed and approved by the Community Development Director or designee. Except in the agricultural, long-term agricultural, future urban service, and rural residential zoning districts, all parking shall be paved with bituminous, concrete, pavers, or other approved dustless and erosion -resistant material. Positive drainage control through the use of curb, gutter, storm sewer, or approved means shall channel all stormwater from the parking areas into a public stormwater drainage system. Treatment of stormwater runoff shall comply with national urban runoff protection standards prior to discharge into the public stormwater drainage system, unless the property is serviced by a regional treatment system. f. Except for single-family and townhomes, all off-street parking areas shall have a continuous concrete perimeter curb around the entire parking lot. g. Except for single-family and townhomes, all parking stalls shall be delineated by white or yellow painted lines at least four inches in width. h. The grade elevation of any parking area or driveway shall not exceed ten percent. Other grade elevations shall be reviewed and approved by the City Engineer. i. Adequate snow storage space shall be provided to maintain the minimum number of parking spaces in the winter months. If excessive snow cannot be stored on site, while maintaining the minimum number of parking spaces required, the property owner shall remove the snow from the site. j. Driveway turnarounds may be required by the City Engineer, where necessary, to avoid interference with traffic flow on any public street. k. Parking ramps and related facilities may be exempted from the strict provisions of this section if approved by the City Engineer. Exterior lighting shall be directed down and shielded (downcast cut-off fixture) from adjacent properties and roadways and shall be in accordance with Section 90-239. b. The maximum height of parking lot lighting adjacent to or within residential areas shall be 20 feet. (e) Number of Spaces Required. (1) Calculating Parking Space Requirements. In calculating parking space requirements, the following rules shall apply: a. When determining the number of off-street parking spaces results in a fraction, each fraction shall constitute another space. b. In facilities where patrons or spectators occupy benches, pews, or similar seating facilities, each 22 inches of such seating facilities shall be counted as one seat for the purposes of determining parking requirements. c. For structures containing two or more types of uses, the parking requirements shall be determined independently, and combined to determine the total off-street parking spaces required. d. On -street parking shall not be used when calculating the number of parking spaces require for a use, unless approved by the City Council. (2) The minimum number of parking spaces designated in the following table shall be provided for the use specified, unless the property is part of a shared parking system approved with a Planned Unit Development (PUD) or a variance is granted by the City Council. The parking spaces shall be evaluated in accordance with this section in any zoning district whenever a new use is established or existing use is enlarged. (3) Other Uses. Any use not in the parking requirements in this section shall be assigned a parking requirement by the Community Development Director or designee (4) Parking Deferment. A portion of the parking area required under this section may be remain unimproved until such time as the City Council deems that it must be improved to adequately serve the parking demand. Such delayed construction of parking may be permitted only after the City Council is satisfied that the initial occupancy of the premises will be adequately served by the lesser number of parking spaces and only after approval of a final development plan clearly indicating the location, design, traffic circulation, and other development requirements of the deferred parking. The land area shall be delineated for future parking and shall be brought to finish grade and landscaped, and shall not be used for building, storage, loading or other purposes. a. The applicant shall enter into a development agreement, to be recorded against the property, which includes a clause requiring the owner to install the additional parking spaces, upon a finding of the Community Development Director or designee that such additional parking spaces are necessary to accommodate the use. (5) Shared Parking. Parking facilities for a combination of buildings, structures, or uses may be provided collectively in any zoning district provided that the total number of spaces provided shall equal the sum of the separate requirements of each use. A lesser number of parking spaces than required for each use may be allowed with approval of the City Council provided that each use is compatible in regards to peak parking periods. Shared curb cuts and access drives shall be encouraged. Where shared parking and accesses are utilized, easements and maintenance agreements shall be placed on the shared areas and recorded against the properties. (f) Shoreland District. (1) Within the shoreland district of the City, parking areas, driveways, access roads and loading areas shall meet the following: 7 Ordinance 2017- Parking and Loading Page 8 of 10 a. Designed and constructed to make use of existing natural vegetation and topography to screen such facilities from view of the public waterbody, as much as feasible. b. Setback from the ordinary high water level (OHW) to the same extent required for structures in subsection 90-137 (1). c. Constructed to avoid bluff impact zones and shore impact zones. (g) Prohibited Parking. (1) Parking Restrictions for Vehicles and Trailers. a. In order to expedite the prompt and efficient removal of snow from the streets of the city it is unlawful for any person to stop, stand or park any vehicle or trailer or permit the same to stand on any street within the city between the hours of 2:00 a.m. and 7:00 a.m. from November 1 until March 31 of the following year. At all times of the year it is unlawful for any person to stop, stand or park any vehicle or trailer or permit it to stand on any public street within the city between the hours of 2:00 a.m. and 7:00 a.m. after a continuous or intermittent snowfall, during which there has been an accumulation of two inches or more of snow on any street, until the snow has been plowed or removed to the full width of the street. b. No person shall park any vehicle or trailer on any street within the City for an excess of 72 hours. c. Vehicles and trailers may be parked in the front yard, provided it is kept on an established driveway, and is entirely on the equipment owner's property. d. Within any residential zoning district, parking of any vehicle or trailer exceeding 9,200 pounds licensed gross vehicle weight on any property or public street is prohibited, except under the following conditions: 1. Vehicles lawfully delivering goods, products, or services to a property may be parked for a reasonable period of time on the property or adjacent street to deliver such goods, products or services. 2. Vehicles used in construction activities may be parked or stored on the site of such construction activities for a reasonable period of time to complete the work. Parking of these vehicles on a city street is allowed only by permit issued by the city engineer. 3. Vehicles primarily used in the conduct of agricultural activities may be parked on the property where the agricultural activities are undertaken, or the farmstead of the vehicle owner. e. Any vehicle parked in violation of these sections more than two times in any 30 -day period may be towed pursuant to Minn. Stats. § 169.041. Violation of this section shall constitute a petty misdemeanor. (2) Large Recreational Vehicles. As defined under Section 90-1. a. Except for on properties zoned agricultural, long-term agricultural, rural residential or future urban service, all lakeshore property, and all properties at least one acre in size, large recreational equipment units shall be parked or stored within a building, except Ordinance 2017- Parking and Loading Page 9 of 10 that large recreational equipment may be parked or stored on the property outside of a building under the following conditions: 1. No more than two large recreational equipment units shall be parked or stored outside of a building on the property, with not more than one unit being located in the front yard and no more than one unit being located in the rear yard. 2. For properties exceeding one-half acre in size, no more than three large recreational equipment units shall be parked or stored outside of a building on the property, with not more than one unit being located in the front yard and no more that one unit being located in the rear yard. 3. Large recreational equipment may be parked in the front yard, provided it is kept on an established driveway, and is entirely on the equipment owner's property. Recreational equipment shall not be parked or stored on public property, in a street right-of-way, or closer than 30 feet from the curb, except that between one week before Memorial Day and one week after Labor Day recreational equipment may be parked no closer than ten feet from the curb. 4. Large recreational equipment may be parked in the side yard abutting an attached or detached garage, provided the area is surfaced with asphalt, concrete, or crushed decorative rock. If the area is surfaced with asphalt or concrete, the surface shall be no closer than five feet from the side lot line. If the area is surfaced with decorative crushed rock, the surface shall be no closer than one foot from the side lot line. Parking or storage of large recreational equipment on the side yard abutting the principal building is prohibited. 5. Large recreational equipment may be parked in the rear yard, no closer than five feet from the rear lot line, five feet from the side lot lines, and not located within a drainage or utility easement. 6. In the case of a corner lot, large recreational equipment may be stored on the side of an attached or detached garage adjacent to a public street, but shall be located at least 20 feet from the public right-of-way. 7. Large recreational equipment may be parked or stored temporarily while being loaded or unloaded or during routine maintenance and servicing not exceeding 72 hours. 8. Parking of licensed large recreational equipment is prohibited on all public streets except while being loaded or unloaded for a period not to exceed 24 hours. 9. The community development director or his designee may approve an alternate location for an item that does not meet the technical restrictions set forth in this section but that otherwise complies with the intent of this section. Such approval may be accompanied by a screening plan designed to minimize the impact to the surrounding properties. Section 4. DESCRIPTION OF REQUEST: The applicant is requesting approval of a site plan to construct seven (7) buildings totaling 21,700 square feet for a ministorage facility. The 3.27 acre lot is generally located north of 152nd Street and east of Forest Boulevard within the Peloquin Industrial Park. 2. CONTEXT: A. Surrounding Land Use and Zoning The properties to the east and south are part of the Peloquin Industrial Park. The properties are zoned General Industrial (I-3) and are generally occupied by industrial businesses, however there are some single family homes located within the General Industrial zoning district to the south. The properties to the north are zoned General Business (C-2) and are occupied by single family homes. The property to the west, across TH 61, is zoned Single Family Detached Residential (R-3) and currently has a single family home with some agricultural activities occurring on the property. Existing Site Characteristics The 3.27 acre property does contain some challenges in regards to an existing drainage ditch, floodplain, high ground water, wetlands, right-of-way dedication, and a sanitary sewer pipe going through the property. The site has been farmed for several years and is relatively flat with trees along the east property line. 3. BACKGROUND: The site is generally located north of 152nd Street and east of TH 61. The applicant is proposing to construct seven (7) buildings for a total of 21,700 square feet for a ministorage facility. The proposed buildings are requested to be a variety of sizes with varying unit sizes. The site is proposed to be run completely electronically with no property management on site. 4. ANALYSIS: A. Level of City Discretion in Decision -Making The City's discretion in approving or denying a site plan is limited to whether or not the proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If it meets these standards, the City must then approve the site plan. B. Consistency with Ordinance Standards Site Plan Phasing Plan The proposed development is planned to be constructed in two phases. Phase one would include the grading and construction of the storm sewer for the entire site as well as construction of the stormwater basin. The applicant has indicated they will then place curb and gutter, bituminous paving, and restoration associated with phase one. The applicant plans to construct four (4) buildings in phase one, as well as install all landscaping and fencing associated with phase one. Phase two would include the placing of curb and gutter, bituminous paving, and restoration associated with phase two. The applicant plans to construct the final three (3) buildings in phase two, as well as install all landscaping and fencing associated with phase two. The proposed phasing plan and requirements have been added as a condition of approval. Setbacks The proposed development has complies with the 30 -foot front and rear yard setback. The ordinance requires a side yard setback equal to the height of the building, in no case less than 10 feet. The proposed development complies with the setback requirements. Gopher State Ministorage Site Plan Page 3 Building Height The General Industrial zoning district has a maximum building height of 50 feet. The building height will be approximately 17 feet. The proposed plan complies with the height requirements. Building Coverage and Lot Coverage The ordinance limits the lot area to be covered by a building up to 40% and covered by impervious surface up to 80%. The proposed site plan complies with the coverage requirements. Fencing/Screening The Commercial and Industrial Design Guidelines require all mechanical equipment to be screened from view of adjacent properties. The applicant is not proposing any exterior mechanical equipment. The ordinance requires all exterior storage areas to be screened from view from the adjacent properties. All exterior storage areas are required to be stored on pavement. The applicant is not proposing any exterior storage. The applicant has proposed black chain link fence between the buildings on the west side and bordering the east side of the parking/loading area. The applicant has indicated the fencing is generally not used for screening of their site, but more towards security purposes. Landscaping and Lighting Section 90-181 of the Zoning Ordinance provides landscaping requirements for industrial developments. In order to meet the landscape requirements for the proposed site, 18 overstory deciduous trees, 10 coniferous trees, 10 ornamental trees, and 72 shrubs would be required to be installed. The applicant is not proposing to alter the existing landscape buffer on the east side of the property that borders the ditch. Because of this, the City has reduced the number of required trees by 10%. The applicant is proposing to install 10 overstory deciduous trees, 20 coniferous trees, 6 ornamental trees, and 69 shrubs. The applicant has done a good job with incorporating the fencing into their landscape plan. Staff is comfortable with the variation in plantings because of the unique site constraints. The proposed landscape plan meets overall ordinance requirements. Because of the sewer easement and right-of-way dedication, the applicant has proposed landscaping and stormwater management within the easement areas. Staff is comfortable with this request and has added a condition of approval that an encroachment agreement is executed with the applicant. The ordinance requires lighting to consist of cut-off fixtures and for light cast on adjacent property and roads not to exceed 1/2 foot candle measured at the property line or 1 foot candle measured at the street's centerline. The applicant has proposed wall mounted downcast light fixtures on the building. The proposed lighting plan meets ordinance requirements. Gopher State Ministorage Site Plan Page 4 Street Access and Vehicle Circulation The site has access from 152nd Street North. The applicant is proposing one entrance into the site with a secure entrance for ministorage renters. The applicant is proposing a variety of drive aisle widths to account for a variety of vehicles and storage possibilities. The smallest drive aisle width is 24 feet, which is the minimum drive aisle width within the City Code. The drive aisle widths will allow multiple users to use the site at the same time. Because of the constraints of the site, the applicant has not proposed circulation around the buildings. Staff is comfortable with the dead end aisles, as the aisles are a relatively short length. 39 feet of right-of-way adjacent to TH 61 is proposed for dedication to the City. The right-of- way is part of the TH 61 corridor plan, which requires a 150 foot wide corridor for future expansion. It shall be a condition of approval that the 39 feet of ROW is granted to the City for the TH 61 future expansion. Parking Section 90-253 of the City Code provides parking requirements. Based on the proposed use, no parking spaces are required. Users of the site will pull up next to their units, unload/load, and leave the site. Trails There is a City trail (Hardwood Creek Trail) on the west side of TH 61. The applicant is not proposing any sidewalks or trails with this development. Building Architecture The building material for the site consists of integrally colored tan split face block and tan hardi board smart siding. The building will have a maroon split face block band to further break up the building mass. The roof is proposed to be a metal copper color with the metal garage doors a red/maroon color. The intent is to ensure the building is constructed of quality materials that require minimum maintenance. The site plan was planned to keep the garage doors hidden from view from TH 61 and adjacent properties. It is in staff's opinion that the proposed building is well designed and appealing and meets the Commercial and Industrial Design Guidelines. Signage The Peloquin Industrial Park monument sign is located on this site. The applicant plans to keep the sign on the property and may, at a later date, propose a new monument sign for the Industrial Park. Gopher State Ministorage Site Plan Page 5 The applicant is not currently proposing a sign on the building. Staff has discussed with the applicant that a sign permit application will be required before the installation of any sign on the property or building. It has been added as a condition that a sign permit application will be required to be reviewed and approved by City staff prior to any sign installation. Drainage/Grading The rules of Rice Creek Watershed District for Stormwater Management (in addition to City requirements) apply to the site. The applicant has proposed an infiltration basin and a pretreatment basin to address these requirements. The basin has been sized to accommodate the impervious area on site and includes a swale that encroaches into the property dedicated to the City for MnDOT ROW purposes. Staff will add a condition of approval that a drainage and utility easement over these areas shall be reviewed and approved by staff prior to recording. Staff is comfortable with the request to allow this small area in the City ROW for drainage purposes and it shall be added as a condition that this area is included in an encroachment agreement with the applicant. The City stormwater trunk fee will apply to this parcel, and will be calculated and collected at the time of building permit. Utilities The applicant is not proposing to connect to City utilities for this project, however, there is a sewer pipe that runs through the east side of the property. The applicant has done a good job to accommodate for future City maintenance on this pipe. It is a condition of approval that the sewer easement is added into the drainage and utility easement document to be reviewed and approved by City staff prior to recording. Fire Protection Plan The applicant has proposed to locate a fire hydrant in the right of way on the north side of 152nd St. N. and west of the proposed entrance to the site. This proposal will allow the fire department proper access to the site in case of emergency. Wetlands In December 2016, the Technical Evaluation Panel (TEP) approved a wetland delineation for the site. The applicant is not proposing to impact any wetlands on site. CONCLUSION: Staff has reviewed the site plan for consistency with ordinance standards and the commercial/industrial design guidelines. Staff finds the proposed development complies with ordinance standards and the commercial/industrial design guidelines. 6. The following information was received for review: ■ Preliminary Civil Plans, prepared by Advanced Engineering Concepts, dated May 2017 • Storm Water Management Plan, dated March 16, 2017 • Floodplain Memo, dated February 23, 2017 ■ Geotechnical Report, prepared by Interstate Geotechnical Engineering, Inc, dated April 4, 2017 ■ Proposed easement documents Staff has had ongoing review since January of 2017 and had provided comments to the applicant and their engineer. Based on the review of the final plans, we offer the following comments: General 1. The applicant has shown easements granting the additional 39 -ft of ROW along TH 61 for future expansion purposes. The applicant is also providing drainage and utility easements over the existing sanitary sewer that extends along the eastern edge of the property, wetlands, and ponding areas. Staff has provided comments on these documents and will work with the applicant to finalize the easements. 2. Stormwater requirements have been met. 3. The FEMA flood elevation is 930.0 while the modeled RCWD flood elevation is 926.4 for the adjacent ditch. The applicant has proposed low floor openings of 932.00, providing for a 2 -ft freeboard to the FEMA floodplain. RCWD's rules require low openings of buildings to be 2 -ft above the FEMA Floodplain, while Hugo typically requires a 3 -ft separation. Since there is such a large discrepancy in Flood Elevations and due to various sight constraints, a two -foot separation as requested is acceptable. 4. The applicant has some alterations to the floodplain that do not alter the elevation of the flood elevation. The applicant will be submitting a letter of Map Amendment (LOMA) seeking approval from the DNR and FEMA and will be required to follow their processes and procedures. 5. Stormwater Trunk Area Charges apply to the buildable portion of the site which in this case excludes the 39 -ft ROW being granted, wetlands, and area encompassed by our existing sanitary sewer.
