Approval of Minutes for the Planning Commission Meeting of August,23, 2018 Commissioner Derr made a motion, seconded by Commissioner Tjernlund, to approve minutes for the meeting of August 23, 2018. Six Ayes and one abstain by Commissioner Lessard, to approve minutes for the meeting of August 23, 2018. Motion carried. Public Hearing for Conditional Use Permit(CUP) for Scott Kersten at 5725 14811 Street Juba introduced the CUP for Scott Kersten for the property located east of Highway 61 and south of 1481h Street. The property is currently zoned as Central Business (C-1). The CUP will be used for the expansion of a legal non-conforming use of an automotive sale and repair business. The applicant has applied for a CUP in order to perform auto sales, auto body repair, and outside vehicle storage. These uses are permitted within the General Business District (C-2) with approval of a CUP. Juba also notes that there can be a total of 68 spaces for the property if the applicant chooses to pave and stripe the gravel parking area located on the proposed property. Juba also lists the CUP requirements which the applicant must follow. These requirements include the indoor storage of waste containers and adhering closely to the submitted site plan. Large vehicle haulers will also be prohibited from accessing the property and will not be allowed to park on the surrounding roads. Commissioner Arcand asked if the CUP would apply to the property at 5725 148t' Street. Chair Kleissler confirmed that the CUP would apply to the property at 5725 148a' Street. Commissioner Luchsinger requested to know who will be deciding an expansion in parking spaces for the property. Juba responds by stating that an expansion in parking spaces on the property would be considered if there was a complaint about a lack of parking or any other parking complications on the property. Therefore, the City would be determining if additional parking is needed for the property. Commissioner Fry asked why the CUP is for wholesale only. Juba responds by stating that staff catered to CUP to allow wholesale and retail. Planning Commission September 13,2018 Page 2 Commissioner Fry also asks if the fencing around the property will be chain-link or opaque. Juba responds by saying that the fencing will be chain-link. Chair Kleissler gave the applicant the opportunity to address the Planning Commission. Scott Kersten of 16332 Harrow Avenue North, approached the podium. Kersten assures the Commission that traffic at the property will be much less than the current traffic located at Kersten's other shop location. Chair Kleissler opens the public hearing at 7:17 p.m. Chair Kleissler closes the public hearing at 7:17 p.m. Commissioner Luchsinger makes a motion, seconded by Derr, to approve the CUP. All Ayes. Motion Carried. New Business Giguere introduced the use of an alternate Planning Commissioner. Giguere stated that during the selection process in which the City Council filled the vacant positions within the various Commissions including the Planning Commission, there were still some candidates that the Council wanted to keep involved within the community. City Council authorized staff to review and possibly revise ordnances and bylaws for each commission to allow the use of an alternate member. The main purpose of an alternate member would be to fill in for absent members during regular meetings. Giguere also explains that the alternate member would only be able to vote if they were filling in for an absent member. The alternate member would sit at the Dias and engage in discussion with other members. The alternate members would also vote at the same time as the other Commission members. Giguere states that staff recommends the Planning Commission allow the revision of the Commission's ordinance to allow the use of an alternate member. Commissioner Luchsinger agrees that the use of an alternate member is a good idea. Commissioner Arcand agrees. Commissioner Tjernlund makes a motion to approve the revision of the Commission's ordinance with the condition that staff have the ability to adjust the ordinance to address any technicalities that may arise as a result of using an alternate Commission member. Commissioner Luchsinger seconded. All Ayes. Motion Carried. Respectfully Submitted, Pierre Giguere Agenda Number E.1 CITY OF HUGO COMMUNITY DEVELOPMENT DEPARTMENT PLANNING AND ZONING APPLICATION STAFF REPORT TO: Hugo Planning Commission FROM: Kendra Lindahl, Landform SUBJECT: Shlayba, Inc. Request for a Rezoning, PUD General Plan, Preliminary Plat and Final Plat for "The Preserve on Sunset Lake" on property located south of 125t" Street North, east of Illies Avenue North and north of 120t" Street DATE: October 18, 2018for the Planning Commission Meeting of October 25, 2018 REVIEW DEADLINE: November 6, 2018 1. DESCRIPTION OF REQUEST: The applicant is requesting approval of a rezoning to PUD, PUD general plan, preliminary plat and final plat for the development of 13 single family homes on 136.7 acres to be known as "The Preserve on Sunset Lake". The property has existing wetlands but is primarily farm fields with one existing home in the southeast portion of the site. The homes will be located on 5- to 10-acre lots located off a cul-de-sac in the center of the site. Each lot would have its own well and septic system on site. The applicant would retain a 27.26-acre Outlot A as open space owned by the Homeowners Association (HOA), dedicate a 0.93-acre Outlot B north of 125th Street to the City for an expansion of an existing City owned park parcel and a 0.07-acre Outlot C that will provide lake access for Lot 4. The overall density of the project is 1 unit per 10.52 acres. The applicant is also seeking approval of a final plat for the subdivision. The final plat does not require Planning Commission review but will be reviewed by the City Council with the rezoning, PUD general plan and preliminary plat. 2. PARKS, RECREATION AND OPEN SPACE COMMISSION REVIEW The Parks, Recreation and Open Space Commission reviewed this item at their October 17t" meeting. There was discussion about the value of the outlot proposed to be dedicated to the City. Staff noted that earlier that day, the applicant submitted an email with a suggested land valuation and a request that no cash be required, but staff did not have time to review the materials before the meeting. The Preserve on Sunset Lake Page 2 The Commission discussed the options and voted unanimously to recommend that the City accept Outlot B to satisfy a portion of the park dedication requirements for this PUD and take the remaining park dedication in cash. The Commission recommended that the City Council consider the land valuation based on an appraisal report from a source acceptable to both the City and the applicant. The Commission recommended that staff and the developer work to gather this information prior to the City Council meeting. 3. CONTEXT: A. Surrounding Land Use and Zoning The surrounding properties are outside of the MUSA and are zoned rural residential and consist of single family homes on large lots. Sunset Lake is located northeast of the site. B. Natural Site Characteristics The majority of the site consists of gently sloping uplands that has been previously farmed. The site consists of one large high-quality wetland on the east side, adjacent to Sunset Lake, and two smaller wetlands located on the southeast corner and eastern edge of the site. A small portion of the site is located on the eastern side of 125th Street with frontage along the southwest portion of Sunset Lake. The site contains significant variation in elevation, with portions of the site significantly higher than the water elevation of the lake. There is an existing single family home on the eastern side will be incorporated into the development. A portion of the property is located within the floodplain district. The floodplain is located entirely in the open space and is classified as Zone A special flood hazard area by FEMA. Zone A floodplains do not have an established base flood elevation. No improvements are shown in this area. The adjacent Sunset Lake is a DNR protected water body. The shoreland overlay boundary extends 1,000 feet from the ordinary high water level of the lake. There are some lots along the east side of the proposed road that are within the boundary. C. Background In 2006, a request from Benchmark Properties for a Rural Preservation Program Preliminary Plat was approved for"Sunset Shores" consisting of 39 single family homes on these properties. That ordinance allowed density bonuses but has since been rescinded. At that time, the City accepted a park dedication proposal which included expansion of the existing City owned park property on Sunset Lake and a 35-acre outlot that included wetlands, park improvements, and trails. In July 2018, the City Council reviewed a sketch plan for this project. The Council generally indicated support for the project and provided direction to the applicant about desired changes to the plan. The applicant has worked to try to address those issues with this plan. On September 17, 2018, the City Council approved a lot line adjustment to add one acre from this property to the Wlaschin property at 7755 125th Street North. The Preserve on Sunset Lake Page 3 4. ANALYSIS: A. Level of City Discretion in Decision-Making The City has a relatively high level of discretion in approving or denying a rezoning application. The proposed zoning for a property must be consistent with the City's Comprehensive Plan. If the proposed zoning is not consistent with the Comprehensive Plan, the City must deny the rezoning application. The Zoning Ordinance and Map are the enforcement tools used to implement the goals and standards set in the Comprehensive Plan. The City has a relatively high level of discretion in approving PUDs. A PUD must be consistent with the City's Comprehensive Plan. The City may impose reasonable requirements in a PUD not otherwise required if the City deems it necessary to promote the general health, safety and welfare of the community and surrounding area. The City's discretion in approving or denying a preliminary plat is limited to whether or not the proposed plat meets the standards outlined in the Comprehensive Land Use Regulations. If it meets these standards, the City must approve the preliminary plat. B. Consistency with Ordinance Standards The applicant is requesting PUD flexibility from the lot size and lot width requirements in the RR district. In exchange for this flexibility, the developer is preserving open space and a high-quality wetland in a 27-acre outlot with multi-purpose trails that will be owned and maintained by the HOA and architectural standards that will result in higher quality homes than would be required by the ordinance minimum standards. PUD General Plan Building Materials/Elevations The applicant has provided architectural design guidelines to ensure quality home design with a number of similar characteristics. The guidelines encourage quality architecture with front porches and standards to reduce the impact of the garages. These increased design standards are one of the benefits of the PUD. Lot Standards The site is located in the Rural Residential zoning district and the Shoreland Overlay district. Sunset Lake is identified as a Recreational Development lake. While none of the lots are riparian, all property within 1,000 feet of the lake is in the shoreland district. The development must comply with both the RR and Shoreland District standards. The applicant's plan does not show the lot width dimension. Plans must be revised to show this dimension. Lighting Section Sec. 90-273 of the City Code requires residential developments in the agricultural and rural residential development areas, to provide at least one 100-watt high-pressure sodium vapor street light at each public street intersection. The plans do show this required fixture at the intersection of Hilo/125th and it will be installed by the developer. Signage No neighborhood signage is proposed. Landscaping The development is required to provide two overstory trees per front yard of each residential lot. During the sketch plan review the City recommended that applicant provide additional landscaping along the perimeter of the site to provide buffers from the roadways and native plantings in the open space where possible. Any disturbed area on site will be planted with either a native seed mix appropriate for the location or a fescue mix for lot areas. The plans show 49 new trees be planted in the front yards and near the stormwater management pond. The applicant is also proposing to transplant a number of existing trees and relocated to the right of way along CSAH 7 in the vicinity of Lots 7, 8 and 9. Wetlands The site contains three wetlands. The wetlands were delineated within the site and the Technical Evaluation Panel (TEP) approved the delineation in on October 16, 2018. No The Preserve on Sunset Lake Page 5 wetland impacts are proposed and drainage and utility easements are provided over these wetlands. The largest wetland is a high-quality wetland located in Outlot A, the open space that will be preserved and managed by the HOA. The plans must be revised to show the delineated wetland boundaries and ensure that all wetlands are fully covered by the drainage and utility easements. Shoreland The adjacent Sunset Lake is a DNR protected water body. The shoreland overlay boundary extends 1,000 feet from the ordinary high-water level of the lake. There are some lots (Lots 2-4 and 9) that are within the boundary. The minimum lot size is 40,000 square feet and minimum lot width is 150 feet in the shoreland district. The proposed single family homes must not exceed 25 feet in height. Grading/Drainage The applicant is proposing to utilize swales, culverts and ponding for stormwater management. The applicant is showing a stormwater pond between Lots 5 and 6, Block 2. A City permit is required for the Stormwater Management Plan. The applicant is working with the City Engineer to address the outstanding issues on their stormwater management plan for the development. The applicant will need to meet all City stormwater management requirements, including appropriate storage, rate control, treatment, and volume reduction. Utilities Each home site will be served by private well and septic. Washington County has reviewed the preliminary plans and indicated that the sites are viable for septic systems. Detailed plans must be submitted to Washington County for approval prior to issuance of a building permit. Streets The site is bounded by three public streets and new public street cul de sac (Hilo Avenue Alcove North) off 125th Street North is planned to serve 11 of the 13 lots. As part of the sketch plan review, the Council asked the developer to look for a way to provide access for all the homes off this new public street, but due to existing conditions, the applicant was not able to do so. The existing house on the new Lot 9 will retain the existing driveway access on to Illies Avenue (CSAH 7) and Lot 4 is proposed to have a new driveway on 125th Street. The City Engineer has reviewed the two new proposed access points for safety and visibility and finds them to be appropriately located. The County Public Works department has reviewed the plans and finds the proposed right-of-way dedication and improvements acceptable. The County will require that one of the driveways on Lot 9 be removed. This issue will be required to be resolved as part of the County right-of-way permit. Sidewalks/Trails The developer has proposed a private multi-use trail loop (with a section of boardwalk to cross the wetland) in Outlot A for use by the developments residents. The preservation The Preserve on Sunset Lake Page 6 of this 27-acre private open space amenity and the trail loop is one of the benefits of the PUD. The City Parks Plan shows a future trail along 12511 Street and staff recommends that a 10-foot trail easement be dedicated on the south side of the street. This would be in the same location as the 10-foot drainage and utility easement and would allow an opportunity for a future trail behind the ditch. Park Dedication and Open Space The City currently owns a 0.7-acre park parcel that is wooded with a slope to the Sunset Lake shoreline. Outlot B (0.93 acres) is proposed to be dedicated to the City for park purposes to expand the existing park property along Sunset Lake. There are currently no plans to make park improvements to the property. It has not been a priority for the Parks, Recreation and Open Space Commission with their annual goal setting or capital improvement planning. The park dedication section of the City Code requires the applicant dedicate 10% of the developable acres for park land with a density of up to 3.99 units per acre. The current park dedication fee is $2,400 per unit. The developer is required to dedicate 11.4 acres or pay a fee of$31,200. The developer is proposing to dedicate Outlot B totaling 0.93 acres. Staff finds that this satisfies 8% of the requirement and therefore the remaining requirement would normally be satisfied by paying a fee which would be $28,704. The applicant is requesting that the park dedication fee be waived due to the high cost of the lake front property and provided some information from an appraiser about the valuation on October 17th. Staff did not have adequate time to review the information before the Parks, Recreation and Open Space Commission meeting. The Commission considered this and recommended that the City accept Outlot B to satisfy a portion of the park dedication requirements for this PUD and take the remaining park dedication in cash. The Commission recommended that the City Council consider the land valuation based on an appraisal report from a source acceptable to both the City and the applicant. The Commission recommended that staff and the developer work to gather this information prior to the City Council meeting. C. Conclusions Staff has reviewed the PUD general plan and preliminary plat for consistency with the applicable standards outlined in the Comprehensive Land Use Regulations and the applicable PUD standards and finds that the applications are generally consistent with the standards with the conditions of approval as recommended in the attached resolutions. 5. RECOMMENDATION: Staff recommends approval of the rezoning, PUD and preliminary for Shlayba, Inc., subject to the conditions listed in the attached resolutions. FOR "THE PRESERVE ON SUNSET LAKE" ON PROPERTY LOCATED SOUTH OF 125T" STREET NORTH, EAST OF ILLIES AVENUE NORTH AND NORTH OF 120TH STREET WHEREAS, Shlayba, Inc. has requested approval of a Planned Unit Development to allow construction of 13 single family lots and 3 outlots on the 136.7-acre property legally described as follows: (See Attached) WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Shlayba, Inc. for a PUD general plan, subject to the following conditions: 1. A PUD general plan/site plan is approved to allow development of 13 single family home lots and 3 outlots, in accordance with the application and plans received by the City on August 20, 2018 and revisions received on September 5, 2018, September 6, 2018, October 8, 2018 and October 12, 2018, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the requested final plat. 3. The Covenants shall be revised to: a. Reference Outlot C in paragraph 3, page 1. b. State that the Outlot A and C are unbuildable. c. Note that no structures are allowed on Outlot C and that it can only be sold with Lot 4. 6. Park Dedication shall be a combination of land and cash-in-lieu of land. a. The preliminary plat for the proposed Preserve on Sunset Lake is located south of 125th Street, west of Illies Avenue, and north of 120th Street. The proposed development consists of the original 136 acre Wlashin parcel. Wetlands: The site contains wetlands on the east-central portion of the site and are proposed to be entirely located in an Outlot and not be impacted by road construction or future home sites. Wetland 01 is considered a sloped wetland,created by the transition from sandy soils to muck. There is as much as 30' of elevation change from the type 3 wetland portion in the northeast portion of the wetland and the upslope southwestern terminus. Based on this,the hydrology of wetland 01 appears to be fed by surface water drainage from the adjacent uplands and not groundwater;though this is not supported by borings or other groundwater data. Development of the site needs to ensure surface water drainage to wetland 01 is not reduced from existing rate and volume to maintain existing wetland hydrology. 3. Storm Water Management: The applicant will need to obtain a permit from the City for their Storm Water Management Plan within the site, including the appropriate storage, rate control, treatment, and volume reduction. The applicant is utilizing swales, culverts and ponding. Stormwater management proposed has been reviewed and comments have been provided to the applicant. These comments currently being addressed. The comments provided are not significant and are not expected to alter the preliminary plat. A summary of the requirements are listed below: a. The site must meet volume reduction requirements of treating 1.1 inches off new impervious areas. b. Rate control from the site must be less than existing for the 2-year, and 10-year rainfall event. Rate control for the 100-year event must be limited to 0.1 cfs/acre. c. Lowest building opening must be 3 feet above the 100-year HWL of the existing wetlands and/or stormwater BMP's, 3 feet above the highest known groundwater elevation and 4 feet above the flood plain. d. An easement must be established over stormwater management facilities, stormwater conveyances, ponds, wetlands, on-site floodplain up to the 100-year flood elevation. e. Any offsite drainage must be included in the submitted drainage maps and models. Transportation 1. Access Locations: The proposed public roadway access location is appropriately aligned with the access point located directly across from Hilo Avenue. A sight distance analysis has been conducted at this access location and sight distance is adequate. The access to lot 4 has been relocated from directly across from Homestead Avenue to a location to the east as sight distance on the inside portion of the curve was limited. 2. Future Trail Location: The Comprehensive plan identifies a future trail along 125a' Street. The proposed 10-ft drainage and utility easement along 1251h Street should also allow for trail construction in the future. Sanitary Sewer and Water Service 1. Sewer and Water: The property is not located in the MUSA. The property is proposed to have individual sewage treatment systems and individual wells for the proposed 12 parcels. Development Agreement Ms. Rachel Juba October 18, 2018 Page 3 1. There are a number of development fees outlined within the City's Fee Schedule that will become due as part of the final plat. The Development Fees are included within Exhibit C of the Development Agreement. We are working directly with the applicant's engineer to finalize the grading, street, and storm sewer construction plans, specifications, and details. We will issue the drainage permit and construction plan approvals once the remaining issues have been resolved. The project as proposed is an open space concept utilizing a 5 acre minimum lot size and lots less than 300-ft wide at the front setback. The overall density would remain as 10 acres, netting 13 lots for the subdivision. The open space concept will allow us to preserve 27.26 acres of open space area and an additional 0.93 acres is proposed to be donated to the City as an extension of their current park parcel that is owned on Sunset Lake. The 27.26 total acres of open space equates to 20.62% of the total area of the parcel to be subdivided and will offer trails for the residents for walking and horseback riding if desired. The open space has been designed to preserve the high valued natural wetland resource while allowing homes to be built on the existing farm fields of which would remain relatively untouched except for where the roadway needs to be constructed. Pads would not be constructed with the grading plan due to the number of natural walkout sites located on the plan as proposed. Prior to recording the final plat, we propose to split off a one-acre parcel to be given to the family member on the northern portion of the lot, which will except them out of the final subdivision and association. This is represented in the documents provided with the total boundary and legal description of the overall parcel excluding this area. With the proposed donation of land for the City Park expansion and the design of the project which allows for the preservation of the high value wetland on the site meets with the intent of the PUD ordinance allow for a lot size variation from the rural residential 10-acre standard lot size. The development will also include the planting of a dedicated buffer surrounding the wetland. The buffer will be a mixture of native grasses and wildflowers. We are also proposing 49 new trees be planted as a street scape for the project. The trees are all native species and will help to add interest to areas of the project were only farm fields exist today. In addition to the tree plantings we are proposing to transplant existing trees that exist in overgrown areas on the property. These transplanted trees would be relocated to the right of way along CSAH 7 in the vicinity of Lots 7, 8 and 9. THE PRESERVE ON SUNSET LAKE CONCEPT NARRATIVE Page 3 of 5 The only area of tree removal is a row of box elder trees that will be removed as part of the road and ponding construction. The ponding area incorporates treatment of nearly all of the road and new house construction directing the water through a rural road design and swale system to the ponding area that will outlet through an infiltration area to the existing wetland on the east side of the project. This wetland then outlets to Sunset Lake. Any disturbed area on site will be planted with either a native seed mix appropriate for the location or a fescue mix for lot areas. Minimal grading is planned for the project with grading for just the roads and storm water ponding areas following the natural contours of the land. The project is also proposed to be planted with deciduous and coniferous trees along the proposed roadway and around the proposed ponding area as shown on the proposed planting plan. These plantings will help naturalize the existing farm field and provide some interest as you drive into the development. D) PUD Parameters We are requesting flexibility to the 10 Acre lot size due to the large wetland on the site and the availability to create lots of a 5 Acre minimum size that will allow for the preservation of this high value natural resource. This is the only variation that we are requesting with this development. (1) The proposed use of this parcel is single family residential which is compatible and the same as the surrounding land uses and complies with the city's comprehensive plan in that this area is designated for large rural residential lots. (2) We are not requesting any mixing of land uses with this proposal. (3) We are proposing smaller lot size and width to in turn preserve over 20% of the site for active and passive use. This flexibility allows for reason this PUD ordinance was written to allow for the preservation of high value natural areas. Trees are planned to be planted along the proposed roadway to create a streetscape along with trees planted in the ponding area to promote a naturalization of the proposed ponds. The flexibility allowed by this process also allows for us to locate the proposed roadway to save nearly all of the existing vegetation on the property. Additional trees are also proposed to screen the development from CSAH 7 on the southern border of the project. Existing farm field areas of the open space and areas that are disturbed in the open space will be planted with a native seed mix that includes native flowers that will further enhance the natural setting we can create with this flexibility provide to us with this process. Access to this parcel is from the north onto 125" Street North at the Hilo Avenue North intersection, which should also lessen any impact to the neighboring parcels and perception of traffic increases. THE PRESERVE ON SUNSET LAKE CONCEPT NARRATIVE Page 5 of 5 The location of the exit of the subdivision sits at the top of the hill with excellent sight visibility to the east and west and will not create any turning movement issues at the existing intersection. The existing home site on Lot 9, Block 2 will continue to use the existing home driveway to access CSAH 7. Access restriction is shown on the plat covering lots 7, 8 and a portion of lot 9 to limit use in the future. A traffic analysis has been provided with our documentation to the city that documents the anticipated traffic volumes. The access to Lot 4, Block 1 has been moved to the southeast to allow for increase stopping sight distance which meets 40 mph guidelines. G) CONFLICTS WITH NEARBY LAND USES: As stated previously this is the same land use as the adjoining parcels and does not create any conflicts with the proposed use. H) PROPOSED PARKS AND OPEN SPACE: The list of the outlots can be found above with proposed uses listed. The project provides for open space that can be actively used by the future residents of this subdivision. We are proposing that 0.93 Acres be donated to add to the current park land that the City owns on Sunset Lake to allow for the creation of a small parking lot for access to the lake. This area is identified as Outlot B on the proposed plan. This area is considered a high value and we respectfully request that our parkland fee be waived for donation of this shoreland area. We feel that this is a valid request in that the Park Board turned down our original proposed donation of Outlot A, which would have met the area requirement in exchange for the smaller Outlot B parcel. The small Outlot C is proposed to be retained and owned by Lot 4, Block 1 to allow for a private dock to be installed to use for access to the lake. I) PROPOSED INFRASTRUCTURE: The project is proposed to connect to 125" Avenue North and extend a rural city street section south, ending at a cul de sac. Each of the proposed lots would have their own well and septic. Each of the lots have been tested and found able to support a conventional drain field. Due to the large lot size the owners of the lots will have some flexibility on home site location. The design of the septic and subsequent well locations may vary from the plan. The wells would be required to remain a minimum of 50-ft from each of the proposed drain fields. Storm sewer would be handled for rate, water quality and infiltration in swales, culverts and ponding. The existing low points of the project would be used for ponding to limit the amount of earthwork moving for the site. Grading the site will require the permitting from the City and from the MPCA for their general storm water permit. The City will be included in correspondence to the watershed and also receive a copy of the state NPDES permit and SWPPP document. The proposed roadway has been presented as a rural section with 12-foot drive lanes and 4-foot gravel shoulders. Each of the driveways has a designed location with a culvert to allow flow of water through the rural swale section along the roadway. Each of these culverts have been designed to accommodate the 100 year flood event. J) CONSTRUCTION SCHEDULE: We would like to move this project along as fast as the city's meeting schedule and review time will allow. With the design of the homes, open space,trails,wetland preservation, and prairie restoration it creates a unique quality neighborhood. All home plans, detached garage plans, and any other outbuilding for The Preserve on Sunset Lake will be required to be approved by the developer Shlayba Inc.Architectural Design Committee. HOME ORIENTATION It's important to maintain decent placement of homes to provide adequate exposure of the view of rolling hills, it natural prairie,trails, and wetlands. ;_:`' Minimum setbacks throughout The Preserve on Sunset Lake will be: 75 feet front yard setback 25 Feet side yard internal - 50 Feet rear setback Emphasis on front porches that create a welcoming approach from the street to the home. To achieve a more natural look, boulders and stone are preferred but other decorative block or stone veneer can be approved. 2 HOME DESIGN DETAILS & GUIDELINES The Preserve on Sunset Lake's vision is to create a distinctive neighborhood by having quality builders, charming homes, and attractive landscaping. To achieve this, we want homes designs that are aesthetically appealing on the outside and have functional floor plans inside. Because of this we will be selective on the builders that will be used in the development. They need to have a good understanding in the quality build that we will be looking for. Home Style: Traditional builds using stick frame construction or timber frame construction will be preferred, anything else will need to be approved by Shlayba Inc Architectural Committee. Recommended home designs of large front porches, dormers over garages, stone chimney's, cupolas, and quality exterior building materials. Porches: �+ Are essential in the design of the home. Size is ,k encouraged to be large for an inviting home front design. This will allow outdoor living and the enjoyment of the rolling countryside views that The Preserve on Sunset Lake provides. Where smaller porch or entry is designed, it is encouraged to create a patio area suitable for outdoor seating. Porch flooring material can consist of concrete, stamped concrete, natural stone, or composite decking. Any differentiation must be requested to and approved by Shlayba Inc Architectural Committee. Roof Materials: Should be consistent with design and style of home. Preference is to have weaved valleys or use pre- finished metal or cooper. Aluminum valleys will not be acceptable. Materials can be architectural shingles, wood shake, metal, slate, or standing seam metal. Any other material needs to be approved by Shlayba Inc Architectural Committee. Colors should fit in with exterior siding of the home. A minimum of 8/12 pitch is required on all gables which face the street on homes and accessory buildings unless approved by Shlayba Inc Architectural Committee. Continuous ridge vents are recommended over the use of box vents. 3 Fireplace: Chases are required to be compatible to the style of home. The use of cement board, stone, brick, masonry are all acceptable. Flues must be boxed with a decorative cap/screen. All other material use must be approved by Shlayba Inc Architectural Committee. Window and Door Trim: All doors and windows should have window trim to enhance the exterior of the home. Trim should complement the home style and be — consistent on all sides of the home. - The use of window grills and shutters are also encouraged to be used. Shutters designs should look useable and sized proportionately for the . - window. - M E Siding: Must be of LP, cement fiber board, natural wood,stucco, brick, stone or stone-veneer. The use of vinyl siding is not recommended to keep the style of design consistent throughout the neighborhood. Exterior colors must be submitted to Shlayba Inc Architectural Committee for approval. Home colors shouldn't be similar to direct neighbors of the house. Different color combinations are encouraged to create more curb appeal for the design of the home. On September 11, 2018 representatives from the Department conducted soil observations on Lots 1-4, Block 1 and Lots 1-9, Block 2. The geocodes for the parcels are 3403121310002, 3403121420001, 3403121430001, and 3403121340001. Based on the observations conducted on September 11, 2018, and the submitted soil observations conducted by Septic Check, the proposed lots appear to have suitable soil for individual sewage treatment systems and the Department is approving the proposed subdivision as suitable to accommodate long-term sewage treatment. It should be noted that the soil testing conducted for this lot was preliminary and only for the purpose of determining suitability of this lot to support long-term sewage treatment. Section 9.5 of the Washington County Development Code, Chapter Four, Individual Sewage Treatment System Regulations(Washington County Ordinance#206) states: Complete soil testing on each individual lot must be conducted prior to permit issuance independent of any prior subdivision or lot approval testing. For permit issuance, a minimum of four(4) soil observations encompassing the proposed sewage treatment area are required. At least one soil observation must be performed in the portion of the soil treatment area anticipated to have the most limiting conditions. Larger areas may be required where conditions of use, soils, topography, or vegetation require. Before an installation permit can be issued by the Department for a specific subsurface sewage treatment system at least four additional soil borings, following the requirements laid out in section 9.5 of Washington County ordinance#206, must be conducted by a designer licensed by the Minnesota Pollution Control Agency. For each lot, rope off and protect both the primary and secondary individual sewage treatment system areas from all traffic. Any excavation in the primary and secondary individual sewage treatment system areas would nullify this approval and may subsequently cause the lot to be declared unbuildable. The minor subdivision is approved only for the lot configuration submitted in the application. Any changes to the lot configurations will nullify this approval. The project is a 13 lot subdivision with 27.26 acres of open space on 136.7 acres of land with access to 1251 Street. Based on the plans submitted, we offer the following comments: • The proposed local street ends at a cul-de sac at Blk 2, Lot 8. No direct access to County State Aid Highway (CSAH) 71120th Street is proposed. • The future right-of-way width along CSAH 7 is 120 feet (60 feet from the centerline of the roadway). The current preliminary plat, dated 9/06/2018, identifies 60 feet from the centerline of CSAH 7 which is acceptable to the county. • The additional CSAH 7 right-of way shown on the southeast corner of the plat is acceptable to the County. • There are two existing driveways at the existing home site (Blk 2, Lot 9). One will no longer be necessary since no large farm vehicles will need to access the site in the future. Washington County Traffic staff will be analyzing the sight distance of both driveways and will provide the access with the best sight distance. The other driveway shall be removed and the ditch restored within the right-of-way. A right-of-way permit will be required for the work.
