F.1 Jerry Hromatka, President & CEO Northeast Youth & Family Services Northeast Youth and Family Services (NYFS), located in White Bear Lake, has been providing counseling services to youth and families in the City of Hugo for at least the past 20 years. The City pays NYFS $6,000 annually for this service. President and CEO Jerry Hromatka of the Northeast Youth & Family Services will present their annual report to Council. G. 1 Approval of Claims Staff recommends Council approve the Claims Roster as presented. G.2 Approve Performance Review for Building Department Secretary Debi Close Debi Close was hired as the City's Building Department Receptionist on March 20, 2006. For the past thirteen years, Debi has performed customer service duties both at the front counter and on the telephone scheduling inspections with contractors. Debi also works as the secretary to the Parks and Recreation Commission. Staff recommends Council approve the annual performance review for Building Department Receptionist Debi Close. G.3 Approve Lawful Gambling Exempt Permit for WBL Lacrosse Booster Club White Bear Lake High School Boys Lacrosse Booster Club has applied for a Lawful Gambling Exempt Permit to conduct Bingo at their fund raising event on April 14, 2019. The event will take place at the Hugo American Legion. Staff recommends Council approve the Lawful Gambling Exempt Permit for the WBL Lacrosse Booster Club for April 14, 2019. GA Approve Mutual Aid Agreement between Washington County, MN and St. Croix County, WI Fire Departments The Hugo Fire Department is requesting Council approve the Mutual Aid Agreement with the Fire Departments of Washington County, MN and of St. Croix County, WI. This agreement would make equipment, personnel, and other resources available to political subdivisions from other political subdivisions during an emergency situation or for designated training activities. Staff recommends Council approve the Mutual Aid Agreement inclusive of the Fire Departments of Washington County, MN and the Fire Departments of St. Croix County, WI. G.5 Approve Resolution Approving Easements for 13011 Street Improvement Project As previously directed, staff has developed construction plans and specifications for the reconstruction of 1301h Street from Highway 61 to Goodview Avenue. As part of the design, a roundabout is planned for 130th Street at Flay Avenue along with a pedestrian trail on the north side of 130th Street. Easement acquisition needs have been identified in the SE and SW quadrants of 130th Street and Flay Avenue to accommodate the construction of this roundabout. Staff has met with the property owners and Beaver Ponds Association representatives regarding the project, and they have agreed to the compensation values previously authorized by City Council. The roadway is proposed to be realigned at the east end of the project to align with Goodview Avenue perpendicularly creating easement needs in this location as well. Staff was previously authorized to offer the land owner $17,100 dollars for the associated acquisition. Staff has met with the land owner on numerous occasions and have negotiated a purchase price of $25,100. Staff is recommending City Council approve the purchase price of $25,100. G.6 Approve Resolution for Submission of 2040 Comprehensive Plan to Met Council In 2017, the City initiated the planning process to update the 2030 Comprehensive Plan that was completed in 2008. As part of the 2040 Comprehensive Plan update, the City has held several meetings with residents, Commissions, and Council to gather feedback and understand community priorities and what has changed since that time. The City Council reviewed the Comprehensive Plan and held a public hearing on April 4, 2018. At that time, Council approved the 2040 Comprehensive Plan for distribution to affected jurisdictions and to the Metropolitan Council for preliminary review. There were several jurisdictions that commented on the plan, including the Met Council. Staff has made minor revisions to the plan per the comments that were received. The plan is now ready for submittal to the Met Council for formal review and approval. Staff recommends adoption the resolution approving the 2040 Comprehensive Plan for Metropolitan Council review. G.7 Approve Resolutions for Oneka Place 211 Addition Final Plat and Development Agreement CPDC- Pratt -Oakwood, LLP, is requesting approval of a final plat on parcels located north of Oneka Parkway and 159th Street. The site is currently vacant. The City Council approved the preliminary plat and PUD for Oneka Place at its May 21, 2018, meeting and a final plat for 54 lots on August 8, 2018. The final plat will replat 14 lots, which were proposed to be 55 feet wide, from the Oneka Place final plat to create 12 lots that are now proposed to be 65 feet wide. Staff has administratively processed the approval of a PUD modification to allow the change in lot size. The lots meet the minimum lot standards and requirements outlined in the regulations for the Oneka Place PUD. Staff recommends approval the resolution approving the Final Plat and Development Agreement for Oneka Place 2nd Addition, subject to City Attorney review and approval. G.8 Approve Termination of Purchase Agreement with Cozzies for City Property At its September 17, 2018, meeting the City Council approved a purchase agreement with Chris Cosgrove, owner of Cozzies Tavern and Grill, for the City owned property along Highway 61. The project to develop the property into a restaurant did not move forward. Further, the purchase agreement expired on January 25, 2019. Staff has drafted a letter to Mr. Cosgrove providing notice of the termination. Staff recommended the City Council approve the termination and direct staff to send the notice to Mr. Cosgrove. G.9 Approve Advertisement of Bids for 2019 Dust Control Staff is requesting authorization from the City Council to advertise for bids for the City's 2019 gravel road dust control project. The City of Hugo currently applies dust control to approximately 28 miles of gravel roads located within its municipal boundaries. Following City Council approval, staff will advertise and solicit bids through the City newspaper and will hold a bid opening in early April. This will be followed by the Council considering bids in April. The dust control/stabilization would be applied in two separate applications, once in mid -May and again in early to mid -August. Staff recommends approval to advertise for bids for the City's 2019 gravel road dust control project. G.10 Approve Hiring of Liz Finnegan as Senior Engineering Technician Hugo's Senior Engineering Technician Steve Duff had retired effective January 31, 2018. After being unsuccessful in hiring a replacement, Council approve the rehiring of Steve for a seasonal position at their April 16, 2018, meeting. Staff recently advertised again for the position and received several applications. Staff is recommending the hiring of Liz Finnegan as the City's new Senior Engineering Technician effective March 11, 2019. Staff anticipates retaining Steve Duff in a part-time capacity as needed. G.11 Approve Resolution Authorizing Call of Outstanding 2007 G.O. Improvement Bonds In September 2007, the City issued $1,230,000 of G.O. Improvement Bonds to finance improvements on 129th Street and Oakshore Park Subdivision. The bonds were issued for 15 years with interest rates ranging from 4.0% to 4.15%. Assessments were levied against benefitting properties to finance bond repayment. As of today the principal remaining on the bonds is $260,000. These bonds are now callable and funds are available to pay off the issue. After factoring in the cost of redemption we will achieve a net present value benefit of $20,460. Since sufficient savings will be realized to proceed with the early retirement of these bonds staff recommends Council approve a Resolution Authorizing the Call of the Outstanding G.O. Improvement Bonds of 2007 effective May 1, 2019. G.12 Approve Pay Request No. 1 from CB&I, LLC for Water Tower #4 Construction CB&1, LLC, has submitted Pay Request No. 1 for the construction of Water Tower No. 4. It is common for cities to pay the contractor for their overhead costs, engineering and preparation/delivery of submittals on this type of project before the construction work begins. Site activity will begin in March with piles being driven for the foundation. Once a firm schedule is known, an update will be placed on the City website. Staff recommends Council approve Pay Voucher No. 1 for the Water Tower No. 4 project in the amount of $108,025.09. G.13 Approve Purchase of 2007 Caterpillar Pneumatic Tire Compactor During the Gravel Roads Workshop held on June 18, 2018, there was discussion on the importance of compacting the gravel roads in conjunction with the grading operations. Staff was directed to explore options in purchasing compaction equipment, and money was included for this in the 2019 budget. Staff has located a 2007 Caterpillar Pneumatic Tire Compactor at a cost of $36,500 through Ziegler Caterpillar located in Nevada. Staff is working to have the equipment inspected, and if satisfactory, a purchase would be negotiated and the equipment delivered to Ziegler Caterpillar in Columbus, MN. Purchase of this equipment would eliminate the need to rent similar equipment at an annual cost of $4,500. Staff recommends Council approve the purchase of a 2007 Caterpillar Pneumatic Tire Compactor for the price of $36,500 from Ziegler Caterpillar. G.14 Approve Appointment of Jason Palmquist as the Training Lieutenant on the Fire Department Fire Chief Kevin Colvard has selected Jason Palmquist to be the new Training Lieutenant on the Hugo Fire Department. Staff recommends Council approve the appointment of Jason Palmquist as the Training Lieutenant effective March 1, 2019. G.15 Approve Resignation of Jim Roettger as the Safety Lieutenant on the Fire Department Jim Roettger has requested to step down as Safety Lieutenant on the Fire Department. Jim will remain on the department as a Firefighter. Staff recommends Council approve the resignation of Jim Roettger as the Safety Lieutenant on the Hugo Fire Department effective March 1, 2019. H.1 Public Hearing on Off Sale Intoxicating Liquor License for Sean Lindholm for Sager's Liquor and Approval of Tobacco License Sean Lindholm, 1 C Cameo Lane, Lino Lakes, will be purchasing Sager's Liquor at 14849 Forest Boulevard, and has applied for an Off Sale Intoxicating Liquor License and Tobacco License for the store. City Ordinance requires a hearing to allow public comment on the granting of a liquor license. The applicant has paid the license and investigation fee, and nothing found in the preliminary background check would prohibit the issuance of a license. No license shall become effective until it has been approved by the Commission of Public Safety. Staff recommends Council open the public hearing to take comments and then approve the Off Sale Intoxicating Liquor License and Tobacco License for Sean Lindholm for Sager's Liquor, subject to receipt of proof of liquor liability insurance. H.2 Public Hearing on Off Sale 3.2% Liquor License for Knowlan's Super Market for Festival Foods Knowlan's Super Markets, Inc. has applied for an Off Sale 3.2% Liquor License to sell liquor at Festival Foods located at 14775 Victor Hugo Boulevard. City Ordinance requires a hearing to allow public comment on the granting of a liquor license. The applicant has provided a certificate of liability insurance, paid the license and investigation fee, and nothing found in the preliminary background check would prohibit the issuance of a license. After approval of a 3.2% Liquor License by Council, certification will be sent to the state. Staff recommends Council open the public hearing to take comment and then approve the 3.2% Liquor License for Festival Foods. H3. Public Hearing on Vacation of Easement for Oneka Place The applicant is requesting a vacation of the existing drainage and utility easement located over Outlot H and all lots contained in Block 5, Oneka Place. Outlot H and the lots will be replatted for the development of Oneka Place 2nd Addition. New drainage and utility easements will be placed on the lots at the time the final plat is recorded. Staff is comfortable with the applicant's requests to vacate the drainage and utility easements. Staff recommends that the City Council approve the notice to vacate the drainage and utility easement located over Outlot H and all lots contained in Block 5, Oneka Place. I.1 Approve Plans and Specifications for the 130th Street Improvement Proiect and Authorize Advertisement for Bids Plans and specifications for the 130th Street Improvement project have been prepared as previously directed by City Council. The project extends from Highway 61 east to Goodview Avenue and consists of full reconstruction of the roadway with a roundabout at Flay Avenue, and an 8-ft trail along the north side of 130th Street. Easements from necessary property owners have been agreed upon. The bid opening will be scheduled for April 30, 2019, at 10:00 a.m. with consideration of award anticipated to occur at the May 7, 2019 City Council meeting. Staff recommends Council approve the resolution approving the plans and specifications for the 130th Street project and authorize the advertisement for bids. J.1 Discussion on Proposed Code Amendments for Residential Facilities There are possible inconsistencies between the State Statute and Hugo City Code in regards to residential facilities, such as the definition and zoning provisions. It is in staff s opinion that the ordinance should be updated to ensure compliance with State Statute. Staff recommends the City Council authorize staff to have discussions with the Ordinance Review Committee (ORC) on amendments to the City Code in regards to residential facilities to become compliant with State Statute. L.1 Update on the Yellow Ribbon Network Council Members Chuck Haas and Phil Klein will update the Council on the activities of the Yellow Ribbon Network to date. M.1 "Those Were The Days" Historical Commission Event on Thursday, March 14, 2019 The Hugo Historical Commission will hold another "Those Were the Days" event on March 14, 2019, from 5:30 — 8 p.m. A similar event was held in October of 2018. The Commission will have collected items on display and is inviting the public to bring in albums, photo, documents or any other artifacts in. The event will be held in the Oneka Room, and the Council is invited to attend. M.2 Hugo Good Neighbors Food Shelf Pasta Dinner on Friday, March 22, 2019 The Hugo Good Neighbors Food Shelf will hold their 8th Annual Pasta Dinner on Friday, March 22, 2019, from 6-9 p.m. at the Hugo American Legion. This is a fundraiser to help feed over 175 families per month in the Hugo, Centerville, Lino Lakes, and White Bear Lake Area. Staff recommends Council schedule this as a meeting if they choose to attend. M.3 Hugo and Oneka PTA Adult Game Night on Friday, March 29, 2019 Hugo Elementary and Oneka Elementary School PTA is hosting an Adult Game Night for adults 21 years and older. This event will take place on March 29, 2019, from 6-10:30 p.m. at the Hugo American Legion. Staff recommends Council schedule this as a meeting if they choose to attend. M.4 Cleanup Days on Saturday, April 13 and October 12, 2019 Public Works Director Scott Anderson has worked with Washington County to secure Saturday, April 13 and October 12, 2019, for the spring and fall cleanup dates. As in the past, the event will take place at the Public Works Building from 8 a.m. to noon. Motion carried. Parks Commission Annual Report Parks Planner Shayla reviewed the 2018 goals and the action items related to them. Accomplishments of the Parks Commission included the master planning of Clearwater Creek Preserve, visioning exercise for Irish Avenue Park, and installation of new playground equipment at Lions Park. The Commission supported widened shoulders in the Oneka Lake Boulevard and Harrow Avenue improvement project to allow for bicycle and pedestrian traffic, and they provided comments on the Clearwater Cove, Oneka Place, Adelaide Landing Developments. Minor Park improvements were done by the Public Works Department as time permitted. Recreation programs such as Park Play Days, Memory Caf6, Bazillion Performances, Snow Princess Performers, and the Tour de Hugo were done in partnerships with Washington County Library, Sheriff's Office, White Bear Lake Schools, and/or other local sponsors. Approve Annual Performance Review for Public Works Worker Neal Nelson Neal Nelson was hired on January 3, 2017, as a Public Works Worker. Adoption of the Consent Agenda approved the Annual Performance Review Neal Nelson. Approve Agreement with Northeast Youth and Family Services Northeast Youth and Family Services (NYFS), located in White Bear Lake, has been providing counseling services to youth and families in the City of Hugo for many years. The City had paid NYFS $6,000 annually since the year 2009, and NYFS would continue providing service at that amount. Adoption of the Consent Agenda approved the agreement with NYFS for counseling services for 2019. Approve Agreement with Lakes Center for Youth & Families, Inc. The Lakes Center for Youth & Family Services, located in Forest Lake, has been providing counseling services to youth and families in the City of Hugo for many years. The City had paid the Lakes Center $6,000 annually since the year 2009, and the Lakes Center will continue providing service at that amount. Adoption of the Consent Agenda approved the agreement with Lakes Center for counseling services for 2019. Approve CUP Review for Tom and Joanne Benick - 5777 165th Street North Thommes and Thomas Land Clearing, operated by Tom and Joanne Benick, has a conditional use permit (CUP) to allow for the processing and storage of firewood, recycling of tree waste, and wood chipping at 5777 165th Street North. Staff visited the property on January 2, 2019, and was not aware of any complaints or violations on site. The Planning Commission considered this at their meeting on January 24, 2019, and recommended approval of the review of the CUP. Adoption of the Consent Agenda approved the review of the CUP for Tom and Joanne Benick. Approve CUP Review for Kieger Enterprises - 5885 165th Street North Kieger Enterprises has a conditional use permit (CUP) to operate an environmental clean-up business, garden center, and landscaping supply business for property located at 5885-165th Street North. Upon inspection of the property on October 22, 2018, staff observed that an additional building was constructed on the property without a building permit. Staff recommended renewal of the CUP for Kieger Enterprises with the condition that the building is removed from the property prior to June 1, 2019. At its January 24, 2019, meeting the Planning Commission considered the review of the (CUP) and recommended approval of the resolution with the condition that the non -compliant building be removed prior to June 1, 2019. Adoption of the Consent Agenda approved RESOLUTION 2019-3 APPROVING THE RENEWAL OF THE CONDITIONAL USE PERMIT FOR KIEGER ENTERPRISES INC LOCATED AT 5885 165TH STREET NORTH. Hugo City Council Meeting Minutes for February 4, 2019 Page 4 of 8 Approve SUP Review for Bald Eagle Sportsman Association - 6557 125" Street North The Bald Eagle Sportsmen's Association (BESA) has a SUP to operate a gun club on property located at 6557 125th Street. Staff visited the gun club on December 17, 2018, to review the SUP and found that the property was generally maintained. The Planning Commission considered the request at its meeting on January 10, 2019, and recommended approval of the review of the SUP. Adoption of the Consent Agenda approved the SUP Review for the Bald Eagle Sportsman Association. Approve Advertisement for Public Works Summer Seasonal Workers In past years, the City hired seasonal Public Works positions to help maintain the City's park system and building grounds as well as assist in road patching crews and other work as needed. These positions were approved in the 2019 General Fund Budget. Adoption of the Consent Agenda approved the advertisement of Seasonal Public Works positions. Approve Adoption of New Water Resource Management Plan Approve Ordinance Adoption Rice Creek Watershed District Rules Approve New MOU with Rice Creek Watershed District The City's Water Resource Management Plan (WRMP) is used as a guide for the City on administration and implementation of all stormwater management activities within the City. The plan was approved by the City Council in 2015, and was formally approved by the Rice Creek Watershed District (RCWD) on July 25, 2018. The plan states that the City will continue to be the Local Government Unit (LGU) that is responsible for reviewing and approving all activities regarding stormwater management, erosion and sediment control, and floodplain and wetland alterations. Currently, the City has a memorandum of understating (MOU) that outlines what rules the City will administer on behalf of the RCWD and the terms that will be followed. To retain the regulatory authority over these items, the City needs to update the MOU and adopt the RCWD rules relating to these areas. Approve Resolution Restricting Parking on 130t' Street from TH61 to Goodview Avenue 130th Street is proposed to be reconstructed as a 26-foot from face -of -curb to face -of -curb, urban section roadway to comply with the design standards set forth by MnDOT as required by Municipal State Aid (MSA) funding. As this segment along 130th Street is proposed to include concrete curb and gutter, a resolution for Council consideration approves restricting parking along both sides 130th Street from Forest Boulevard (TH 61) to Goodview Avenue to accommodate the proposed roadway width of 26-foot as measured from face -of -curb to face -of - curb. The event will be held at the Hugo American Legion. Adoption of the Consent Agenda approved the Lawful Gambling Exempt Permit for the Minnesota Waterfowl Association. Approve Appointment of Colin Emans as Training Captain on the Fire Department Fire Chief Kevin Colvard had selected Colin Emans to be the new Training Captain. Adoption of the Consent Agenda approved Colin Emans as the Training Captain effective February 1, 2019. Approve Appointment of Ross Hoernemann as Administrative Captain on the Fire Department Fire Chief Kevin Colvard had selected Ross Hoememann to be the new Administrative Captain. Approve Resolution Consenting to Rice Creek Watershed District Ditch Maintenance At its December 17, 2018, meeting, Council listened to a presentation from the Rice Creek Watershed District on the planned maintenance to Judicial Ditch 3 and Judicial Ditch 2, Branches 1 and 2. An informational meeting was held at City Hall on January 28, 2019, to provide the public information on this project. State Statute grants RCWD the authority to do this maintenance in accordance with the Watershed Law, rather than the drainage code in State Statute, subject to concurrence by the City Council. Under the Watershed Law, costs would be paid from general taxes throughout the RCWD rather than benefitted lands assessment as traditionally required under state statute. Adoption of the Consent Agenda approved RESOLUTION 2019-6 FOR APPROVAL TO CONDUCT DRAINAGE PROCEEDINGS FOR ANOKA-WASHINGTON JUDICIAL DITCH 3 and WASHINGTON JUDICIAL DITCH 2 BRANCHES 1 & 2 UNDER THE WATERSHED LAW. Approve Resolution Approving Adelaide Landing 3rd Addition Final Plat and Development Agreement The Excelsior Group had requested approval of a final plat in order to plat 22lots and 1 outlot for Adelaide Landing 3rd Addition. The City Council reviewed the preliminary plat and PUD for Adelaide Landing at its May 1, 2017 meeting. The City Council approved the final plat for the first phase of the development consisting of 81 residential lots and 70 residential Lots in the second phase. This final plat request will plat 22 additional lots from the Adelaide Landing preliminary plat. The lots meet the minimum lot standards and requirements outlined in the regulations for the Adelaide Landing PUD. Adoption of the Consent Agenda approved RESOLUTION 2019-7 APPROVING A FINAL PLAT AND DEVELOPMENT AGREEMENT FOR OP5 ADELAIDE, LLC FOR ADELAIDE LANDING 3rd ADDITION. Hugo City Council Meeting Minutes for February 4, 2019 Page 6 of 8 Approval of City Council Focus Goals and Ongoing Priorities for 2018 The Council held a goal setting workshop on Tuesday, January 22, 2019, for the purpose of setting goals and priorities for 2019. City Administrator Bryan Bear had compiled items discussed during the workshop and reviewed them with the Council. Bryan explained these goals serve as guide to help staff to prioritize work during the coming year. He reviewed priorities related to conservation, economic development, community development, infrastructure, parks, public safety, and administration. Klein made motion, Petryk seconded, to approve the 2019 City Council Goals and ongoing priorities. All Ayes. Motion carried. Update on Hopkins Schoolhouse At its July 2, 2018, meeting, Council approved a committee to explore options for the future of the Hopkins Schoolhouse. Historic Preservation Consultant Olivia Schiffman reported on the progress of the committee and their recommendation. The seven -member committee had met several times and discussed all options for the schoolhouse and obstacles. It was concluded by the committee that there were several benefits to a public private partnerships, and a big benefit would be if the City would give financial support. Olivia shared a marketing flyer for the lease of the Hopkins Schoolhouse for a public/private partnership and reviewed the development criteria stating the committee was recommending the Council approve it and move forward with publishing the marketing flyer. Miron, who served on the committee, talked about the agreement of the group to form a public private partnership, and he felt there needed to be discussions on where the City was financially in supporting it. Klein recognized that a fair amount of work needed to be done, which may get expensive, and suggested the County may be able to help reduce the cost. Haas questioned how a business would be taxed if it operated out of the schoolhouse. City Administrator Bear replied that it would be taxed as used, so it would be commercial. Petryk asked if the lease amount would be fairly inexpensive, and Schiffman replied that it would be discussed when reviewing proposals. Haas guessed it would take well over $100,000 to get the property in shape for someone to use, and said he would be very hesitant to do that without knowing the benefit to the City. Weidt acknowledged there were many unknown variables which made it hard to determine support of the project, but he would like to see what proposals come forward. Motion carried. Update on Yellow Ribbon Network Council Member Chuck Haas and Phil Klein reported to Council on the Yellow Ribbon Network activities held recently. The Council was provided financial reports from the YRN treasurer showing a significant amount of help was given over the year. In January, the YRN received a request from a disabled Forest Lake veteran for mortgage assistance, which was fulfilled by Forest Lake VFW gambling proceeds. They partnered with the YRN of Washington County to help a soldier that needed financial assistance. The YRN helped a military member get a new washing machine and assisted a solider with moving their residence. January's Burger Night was sponsored by Lake Area Bank, and February's sponsor is the Bald Eagle Sportsman Association. Haas shared a picture of employees who did a packaging event led by the folks from Ship Thrifty. Legislative Town Hall Meeting on Saturday, February 9, 2019 City Administrator Bryan Bear informed Council State Legislators Senator Roger Chamberlain and Representative Linda Runbeck had scheduled a Town Hall Meeting for Saturday, February 9, 2019, from 10:00-11:30 a.m. This meeting was intended to be a listening session. Under no circumstances, however, shall a party be required to pay on behalf of itself and other parties, any amounts in excess of the limits on liability established in its Home State applicable to any one party. The limits of liability for some or all of the parties may not be added together to determine the maximum amount of liability for any party. d. The intent of this subdivision is to impose on each Requesting Party a limited duty to defend and indemnify a Responding Party for claims arising within the Requesting Party's jurisdiction subject to the limits of liability under the laws of its Home State. The purpose of creating this duty to defend and indemnify is to simplify the defense of claims by eliminating conflicts among defendants, and to permit liability claims against multiple defendants from a single occurrence to be defended by a single attorney. Section 9. Charges to the Requesting Party. a. No charges will be levied by a Responding Party to this agreement for assistance rendered to a Requesting Party under the terms of this agreement unless that assistance continues for a period of more than 12 hours. If assistance provided under this agreement continues for more than 12 hours, the Responding Party may submit to the Requesting Party an itemized bill for the actual cost of any assistance provided after the initial 12 hour period, including salaries, overtime, materials and supplies and other necessary expenses; and the Requesting Party will reimburse the party providing the assistance for that amount. b. Such charges are not contingent upon the availability of federal or state government funds. Section 10. Duration. This agreement will be in force from the date of execution and shall continue until terminated. As part of the 2040 Comprehensive Plan update, the City has held several meetings with residents, Commissions, and Council to gather feedback and understand community priorities and what has changed since that time. 2. City Council Meeting The City Council reviewed the Comprehensive Plan and held a public hearing on April 4, 2018. At that time, Council approved the 2040 Comprehensive Plan for Distribution to affected jurisdictions and to the Metropolitan Council for preliminary review. 3. Affected Jurisdictions Review Local governments are required to share their proposed plan updates with affected jurisdictions at least six months before they submit their plans to the Metropolitan Council for review. The City of Hugo is then required to respond to comments from affected jurisdictions submitted within the six- month period. As required by the Metropolitan Council, the City of Hugo provided a draft of the Comprehensive Plan to adjacent and affected jurisdictions for their review. The City adhered to the mandatory six-month review period. The City of Hugo received written responses from the Metropolitan Council, the Housing Justice Center, the Transportation Division of Anoka County, the City of Columbus, MN DNR, Forest Lake Area School District, the City of Lino Lakes, Mahtomedi Public School District, MN DOT, Rice Creek Watershed District, the City of Scandia, Stillwater Area Public School District, the All Parks Alliance for Change, and Washington County. 4. Updates to the 2040 Comprehensive Plan No major updates to the Comprehensive Plan were required as a result of the remainder of affected jurisdictions feedback. The following is a list of the primary updates that were incorporated into the 2040 Comprehensive Plan: • Interactive links were developed for the document, making navigation easier Landform®, SensiblyGreen® and Site to Finish® are registered service marks of Landform Professional Services, LLC. • • • • • Language was generally reviewed for consistency, and updated to reflect additional tools and changes in regional policies or planning efforts • Language pertaining to ongoing or completed projects within the City of Hugo or Washington County was updated to reflect the current project status • General document cleanup was undertaken A comprehensive response to affected jurisdiction comments and list of changes made to the Comprehensive Plan in response is included as Attachment C. The City of Hugo received a letter on June 1, 2018 from the Metropolitan Council providing feedback on 2040 Comprehensive Plan. A comprehensive response to Metropolitan Council comments dated March 4, 2019 will be submitted to the Metropolitan Council as part of our 2040 Comprehensive Plan submittal (Attachment D). City staff engaged in further discussion with the Metropolitan Council pertaining to forecasts for population, households and employment for 2040. Staff attended an in -person meeting and communicated additionally via e-mail correspondence. The Metropolitan Council adopted 2040 forecasts of 29,000 population, 11,900 households, and 4,000 employment. However, because the Metropolitan Council and the City of Hugo have committed to property owners certain land use designations and to be eligible for municipal sewer and water by being within the MUSA, the City advocated to continue to use previous forecasts of 40,000 population, 11,900 households and 4,500 employment. These forecasts are from the previous 2030 Comprehensive Plan forecasts. The Metropolitan Council agreed to allow the City of Hugo to continue to use the higher forecasts so long as the comprehensive plan explicitly states that: • The City of Hugo was using a previously forecasted population forecast from 2030, a population of 40,000. • The City is using the previous 2030 forecasts to honor commitments to property owners relating to land use designations and municipal sewer and water eligibility • The City of Hugo discourages leap frog development and the City will monitor growth in a manageable way. • Extension of utilities is development driven. • The City of Hugo has the capacity and can serve approximately 425 units per year, but that number would be decreased with the Met Council's forecast. • Sewer districts depend on one another and the sequencing of sewer extensions is key. • The forecasts do not have an impact on the Met Council system. Based on the comments from the Metropolitan Council from the pre -review letter and further discussions, the City of Hugo made the following primary changes to the draft of the Comprehensive Plan: Post submittal of the draft Comprehensive Plan to the City Council of the City of Hugo, the Metropolitan Council posted new data on the Community Profile for Hugo. This data was primarily sourced from the ACS 2013-2017. Per the request of the Metropolitan Council, City staff incorporated all new data posted by the Metropolitan Council within the appropriate text, tables, and charts. Changes were made by majority to Chapter 2: Community Background, Chapter 3: Land Use Plan, Chapter 4: Housing Plan and Chapter 6: Parks Trails and Open Space Plan. City Council - 2040 Comprehensive Plan Update March 4. 2019 �7 El • As a result of discussions on population projects with the Metropolitan Council, staff revised the Comprehensive Plan document to clearly acknowledge the Met Council 2040 forecasts for population, households and employment. The draft was reviewed for clarity and directly stated that Hugo is using the previous forecasts (2030, population of 40,000) because the Met Council and the City have committed to property owners certain land use designations and eligibility for municipal sewer and water by being within the MUSA boundary. To this end, the document also utilized the 2020 employment forecast of 3,000 to reflect the most recent employment estimate for Hugo. • Additional graphics were inserted into the document, including a community designations map and regional bike trials map that were produced by the Metropolitan Council. • The text within Chapter 4: Housing Plan was reviewed to clarify references to adopted housing policy and language was strengthened. An appendix to Chapter 4: Housing Plan was also included. • Language revisions were made to the Comprehensive Sanitary Sewer Plan, including revisions and finalized population, household, and employment projections to complete the 2040 projected wastewater flows for areas that have been provided by the Metropolitan Council and included in the plan, the assignment of 2040 growth forecasts for the trunk sewer capacity analysis was finalized, and the assignment of 2040 growth forecasts by Metropolitan interceptor facility were finalized. • An updated appendix 4 for the Water Supply Plan (Appendix 9-1) was provided for Chapter 9: Comprehensive Water Supply and Distribution Plan, although it has not yet been resubmitted to DNR. was revised to address forecast discrepancies and provide updated list of planned improvements. An updated Appendix 4 was provided. • Appendix 13-1: Capital Improvement Plan was reviewed to ensure consistency with all updated language throughout the plan, particularly regarding growth management. 5. Next Steps The Metropolitan Council will review the formally submitted Comprehensive Plan for compliance with regional plans and either approve it or recommend changes to bring the plan into compliance with regional plans. After the Comprehensive Plan is approved by the Metropolitan Council, the City Council will adopt the Comprehensive Plan. Then, the City will need to begin working on the adopted implementation items, including an update to the Zoning Map and ordinances to ensure compliance with the Comprehensive Plan. 6. Recommended Action Adopt the attached resolution approving the 2040 Comprehensive Plan for Metropolitan Council review. This action requires a 3/5 vote of the City Council. Summary of Changes, Housing Justice Center: Based on the comments from the Housing Justice Center, the City of Hugo made the following changes to the draft of the Comprehensive Plan: • Clarified the City of Hugo's approach to providing affordable housing • Modified "Chapter 4: Housing Plan" to provide clearer references to the City of Hugo's adopted housing policies • Updated the housing portion of "Ch. 13 Implementation Plan" to comply with requirements by the Metropolitan Council Summary of Changes, Anoka County: Based on the comments from the Transportation Division of Anoka County, the City of Hugo made the following changes to the draft of the Comprehensive Plan: • Revised the maps within "Chapter 8: Transportation Plan" to include a label for Anoka County at the western corporate boundary with Lino Lakes • Included the "Other Arterials" roadway type in the legend of the "Existing Functional Road Classification Map" • Revised the title of the "Existing Traffic Volumes Map" to include the year the traffic volume counts were identified • Verified, rounded and adjusted the label placements on the "Forecasted Traffic Volumes Map" Summary of Changes, MN DNR: Based on the comments from the MN DNR, the City of Hugo made the following changes to the draft of the Comprehensive Plan: • Revised "Park" to read "Parks and Wildlife Management Areas" on the "Greenway Corridor Map" • Revised the colors of "High -Quality Wooded Areas" and "Natural Wooded Areas" on the Greenway Corridor Map to increase legibility Revised the name of "DNR Park" to read "DNR Wildlife Management Area (WMA)" to more accurately reflect the park area. This change was made in all map instances where "DNR Park" was labeled Re -framed the photograph on p. 190 to remove the sign that read "State Trail" since there are no state trails in Hugo Summary of Changes, Rice Creek Watershed District: Based on the comments from the Rice Creek Watershed District, the City of Hugo made the following changes to the draft of the Comprehensive Plan: • The "Watershed District Map" was updated to reflect current boundaries • Several instances of "non -protected wetlands" were revised to read "wetlands" to provide clarity • The language within the Comprehensive Plan regarding the CSAH 8 realignment was updated to reflect the project's completion • The language within the Comprehensive Plan regarding the gravel pit located within the city was updated to reflect the city's purchase of the property and intent to remediate the site • The stated acreage of wetlands within the city was made consistent throughout the Comprehensive Plan document • A consistent title was chosen for the City of Hugo's Water Resources Management Plan and the title was made consistent throughout the Comprehensive Plan document City staff further noted that the Water Resources Management Plan that will be included as the appendix in the final document of the Comprehensive Plan will be the version of the Water Resources Management Plan that is that is approved by the watershed districts, Metropolitan Council, and Washington County. We have reviewed the questions and comment from Metropolitan Council staff and our responses can be found below. The preliminary review process found the Parks, Surface Water Management, Solar Access, and Aggregate Resource sections complete for review and did not identify any major system issues or policy conflicts. Responses to additional advisory comments submitted to the City of Hugo by the Metropolitan Council are included below. Comments provided on Parks (Michael Larson, 651-602-1407) Summary of Advisory Comment: Staff offered the advisory comment that Map 6-5 may be improved by providing a distinction between a proposed segment of the regional Hardwood Creek Regional Trail that follows an alignment south of 140th Street and a local interim route using existing and planned local trails, given the limited space between the railroad tracks and edge of Highway 61. Staff further suggested that the distinction be explained in the text. City Response: The City of Hugo reviewed the materials and determined that Map 6-5 and accompanying language were appropriate. No change was made to the draft 2040 Comprehensive Plan. Comments provided on Surface Water Management (Jim Larsen, 651-602-1159) Summary of Advisory Comment: Council staff requested that the City notify the Council of the dates the Watershed Districts approve the LSWMP, and the date the City adopts the LSWMP, when those dates are available. Additionally, they requested that the finalized LSWMP be included as part of the formal Plan submittal - either as a free-standing chapter or an appendix. City Response: The LSWMP was included as Appendix 10-1 to the Comprehensive Water Resource Management Plan. The plan was approved by BCWD on December 18, 2017, CMSCWD on January 10, 2018 and RCWD on July 25, 2018 and by the City of Hugo on February 4, 2019. Comments provided on Solar Access Protection & Development (Cameran Bailey, 651-602-1212) Corrin Wendell 1 March 4, 2019 Summary of Advisory Comment: Staff offer additional "strategy" resources to include in the Plan to assist the City in realizing its stated goals and supporting its stated policies City Response: The City of Hugo reviewed the language within the draft 2040 Comprehensive Plan related to solar access protection and development and considered including additional resources. No change was made to the draft 2040 Comprehensive Plan. Summary of Advisory Comment: By requesting a free Community Energy Profile Report from Xcel Energy, the City may calculate how much of the City's electricity consumption across the residential, municipal, commercial, and industrial sectors, may be offset by the development of solar energy systems. Enrolling in SolSmart, MN GreenStep Cities, and Xcel's Partners in Energy programs provide the technical, policy, and planning assistance to then realize that solar energy offset potential. The Metropolitan Council's factsheet "Applying Rooftop Generation Potential to Your Community" provides further insight into this sort of analyses. City Response: The City of Hugo noted the additional resources available. No change was made to the draft 2040 Comprehensive Plan. The preliminary review process found the Forecasts, Transportation, Wastewater, Community and Subsurface Sewage Treatment Systems (SSTS) Water Supply, and Implementation sections incomplete for review and noted changes in the Plan were needed before the Comprehensive Plan is submitted to the Council for formal review. Comments provided on Forecasts (Dennis Farmer, 651-602-1552) Summary of Comments for Completeness: Throughout the document, the City uses its previous 2030 Comprehensive Plan forecasts, but assumes those forecasts would be achieved a decade later. The Plan uses these forecasts in the Land Use Plan, the Housing Plan, the Comprehensive Water Supply and Distribution Plan, and the Comprehensive Sanitary Sewer Plan. The Transportation Plan uses two sets of Transportation Analysis Zone forecasts: one based on Metropolitan Council forecasts and another based on the city -preferred forecasts. The Transportation Plan states that the Metropolitan Council -based TAZ forecasts were used to identify roadway capacity. The adopted Metropolitan Council forecasts, and the forecasts used in the City's Plan, are shown below. This is consistent with Council policy articulated in Thrive MSP 2040, which states that the Council "will provide necessary infrastructure to honor existing 2030 commitments for land to be included in the Metropolitan Urban Service Area by 2040." Corrin Wendell March 4, 2019 City Response: The City of Hugo discussed this issue with Metropolitan Council planning staff (in an August 30, 2018 meeting with Metropolitan Council staff, an October 23, 2018 email from Rachel Juba to Lisa Barajas confirming the strategy and approval of this approach from Corrine Wendell in a November 7, 2018 email). In the 2040 Comprehensive Plan, we acknowledge the Metropolitan Council 2040 forecast and state we are using the previous forecasts (2030, population of 40, 000) because the Metropolitan Council and the City have committed to property owners certain land use designations and to be eligible for municipal sewer and water by being the MUSA. Summary of Comments for Completeness: The Plan states that the City "anticipates continued growth in the community and will plan to serve" the higher forecasts. The Plan does not, however, provide evidence that the City will likely grow at a faster rate than the Council's adopted forecasts. We also note that the Plan also does not appear to address the discrepancy between the City's 2020 employment forecast of 2,600 and recent estimates, which are higher. City Response: See response above. The City of Hugo has discussed this issue at length with Metropolitan Council planning staff. Summary of Comments for Completeness: While the City may plan for growth beyond its official Metropolitan Council forecasts, it should do so in manner that is consistent with Council adopted forecasts. All land use and infrastructure planning should consider additional growth to be post-2040. Alternatively, the City can propose higher forecasts, accompanied by evidence of the likelihood of higher growth rates. The City can also amend its Plan in the future if it experiences growth rates that suggest the need for higher forecasts. City Response: See response above. The City of Hugo has discussed this issue at length with Metropolitan Council planning staff. Summary of Comments for Completeness: The Comprehensive Sanitary Sewer Plan needs to include forecasts of sewered households and employment for years 2020, 2030, and 2040. Table 11-7 should contain sewered household and employment forecasts for each of the decades of 2020, 2030, and 2040. Sewer planning should consider growth beyond official Council forecasts to be post-2040. City Response: See response above. The City of Hugo has discussed this issue at length with Metropolitan Council planning staff. Summary of Comments for Completeness: The Comprehensive Water Supply and Distribution Plan, including the water demand forecasts (Table 9-4), are inconsistent with Metropolitan Council forecasts. Water supply planning should consider growth beyond official Council forecasts to be post-2040. City Response: See response above. The City of Hugo has discussed this issue at length with Metropolitan Council planning staff. Summary of Advisory Comment: Metropolitan Council staff find the original 2030 Comprehensive Plan housing and population forecasts to be too high based upon recent and emerging housing market trends. Corrin Wendell March 4, 2019 The Council estimates that the City had approximately 5,740 housing units in 2016. Assuming that every housing unit in the City becomes occupied, the City would still need to average over 410 new housing units over the next 24 years to accommodate 15,600 households by 2040. This would be a historically high growth rate for the City. By comparison, between 1999 and 2008, Hugo's highest 10-year period of growth in recent history, the City averaged just under 315 building permits per year. City Response: See response above. The City of Hugo has discussed this issue at length with Metropolitan Council planning staff. Summary of Advisory Comment: The Plan's employment forecasts for 2030 and 2040 appear reasonable. Council staff recommend that the City utilize a 2020 employment forecast of 3,000 (the same as the adopted forecast for 2020) to reflect the most recent employment estimate for Hugo (about 2,900 jobs in 2017). The City should communicate with Council staff and formally request any changes to their adopted forecasts prior to submitting the Plan for formal review. City Response: The City of Hugo utilized a 2020 employment forecast of 3,000. Comments provided on Land Use (Michael Larson, 651-602-1407) Land Use: Community Designations Summary of Comments for Completeness: Although the Plan describes the community designations for Hugo, it doesn't provide a map, which is required. We also recommend briefly describing the geographic areas with references to the map. City Response: The City of Hugo amended the Land Use Plan to include the Community Designations Map. Summary of Comments for Completeness: The Agricultural and Large Lot Residential designations describe an average of 1 unit per 10 acres over the entire district. This description is inconsistent with regional land use policy, as it could conceivably allow higher density development in certain locations in ways that result in the premature demand for urban services. The policy should be clarified, such as by including references to clustered development on individual property, or the use of tools like transfer of development rights to cluster development over multiple properties. Guiding density should not otherwise vary from property to property within the district. City Response: The City of Hugo does not allow clustering. No change was made to the draft 2040 Comprehensive Plan. Land Use: Agricultural Preserves Program Summary of Comments for Completeness: The City has properties that are enrolled in the Agricultural Preserves Program. Communities must guide these areas as 1 unit per 40 acres as required by Minn. Stat. 473H.03. The Plan proposes guiding these areas as Agriculture, which allows 1 unit per 10 acres. City Response: The 2040 Comprehensive Plan addressed the Agricultural Reserves Program through the zoning map, which includes the 1 per 40 restriction. Language was also added to the Land Use Plan guiding Long Term Agricultural property as 1 unit per 40 acres. Land Use: Future Land Use and Staging Summary of Comments for Completeness: The Plan needs to include a table that identifies the acreage by land use designation and the 10-year timeframe for development. Corrin Wendell March 4, 2019 City Response: The plan was updated to include this table. Summary of Comments for Completeness: On page 52, the City's Growth Management Policies describes accommodating a rolling five- year average of 420 new residential units per year. The section further describes that the MUSA will be expanded in an orderly, contiguous, and sequential manner. The City is likely aware that there are no plans to further expand the MUSA for the planning horizon, as the forecasted level of growth can be more than accommodated by existing MUSA in the City. The City may be referring to its own local urban service area. City Response: The Councils assumption is correct. The City of Hugo amended the language for clarity. Summary of Comments for Completeness: While the Plan articulates the principles of orderly and contiguous development, it does not provide geographic and tabular detail to illustrate and document planned future development. City Response: The City of Hugo has not and does not intend to adopt a staging plan or revise the MUSA boundary. Growth management is as outlined in the plan. Summary of Comments for Completeness: The MUSA area within the City accommodates more than the forecasted growth for the City. The Plan should map likely 10-year staging areas and quantity the numerical impact of growth consistent with Metropolitan Council's 2040 forecasts. These should include areas that are currently within the City's local urban service area (i.e., infill development) as well as areas currently zoned as Future Urban Service. The City's 2040 Sanitary Sewer System Map identifies the location of future sanitary service lines throughout the entire Future Urban Service area. City Response: The City of Hugo revised the growth management policy to explicitly state that we discourage leap frog development and we will monitor the growth in a manageable way. The City also strengthened the growth management section. We also explicitly state that the extension of utilities is development driven. • Evaluate the capacity in sewer system at serve the 2030 forecast per what is required by the Metropolitan Council for the Comprehensive Plan. • State that we have capacity and are able to serve approximately 420 units per year, but the Metropolitan Council's forecast were approximately 346 units per year, therefore the City will use a rolling average over 5 year increments provided the annual residential permits does not exceed 420 units. • Strengthen our sewer plan to talk about how sewer districts depend on another. Sequencing of the sewer extensions. • This does not have an impact on the Metropolitan Council system. Summary of Comments for Completeness: It is appropriate for the City to consider the future build -out of the MUSA. However, the Plan should identify and quantify staging areas that are consistent with current Council forecasts. Should the pace of development accelerate and exceed Council forecasts, the City can amend its forecasts and staging plans. City Response: As agreed to in prior discussions with Metropolitan Council staff, the City has not and does not intend to adopt a staging plan or revise the MUSA boundary. Growth management is as outlined in the plan. Summary of Comments for Completeness: On page 53, Table 3-1 2040 Land Use identifies each guiding land use, the "developable acres" and "percent of total developable land in the City." There is no context for this table nor is it clear what constitutes "developable." The table should identify what areas were netted out of this calculation. Furthermore, Corrin Wendell March 4, 2019 it is not clear what is meant by developable areas that are guided as Agriculture, since this is contrary to the objective of this guiding land use. City Response: The table in the Comprehensive Plan has been updated. Summary of Comments for Completeness: On page 179, the City provides a forecast allocation by TAZ that is "based on the City of Hugo Land Use Plan as detailed in Chapter K. " The City needs to provide a TAZ allocation based on planned land uses that is consistent with adopted forecasts and informed by land use staging by decade. City Response: The staging of the land use by TAZ is illustrated in Table 8-9. The forecasts projections are based on anticipated growth for in each TAZ. No changes were made. Summary of Comments for Completeness: On page 40, the Plan describes the use of the Future Urban Service District, a zoning district that represents "transition areas that are physically eligible, fiscally practical, and generally suitable for future staging of urban services." Prior to providing urban services, these areas are guided with a residential density of 1 dwelling unit per 10 acres. This is inconsistent with statements on page 52, Growth Management Policies, which describe limiting development within the 2040 MUSA to one unit per 20 acres or less density. The City's intended policies should be consistently referenced throughout the Plan. City Response: The text was amended to address this comment. Summary of Comments for Completeness: Page 60, High Density Residential. There is inconsistency between the density range stated in the text and the range stated in the accompanying table. Allowed density ranges for land use categories need to be consistently referenced throughout the Plan. City Response: The text was corrected Summary of Advisory Comment: Page 33, Land Use: The 2010 Generalized Land Use map does not use the most current available data. Other representations of existing land use are in Figure 3 under the Water Resources Management Plan and Figure 9 of the Wellhead Protection Plan. You may wish to consider sorting the table from largest use of land to smallest rather than alphabetically. City Response: The Comprehensive Plan document was updated to include this new data. Summary of Advisory Comment: Representation of Land Use Policy: Figure 11 from the Wellhead Protection Plan refers to 2030 Planned Land Use rather than the 2040 Planned Land Use. Also, the Draft 2040 Land Use Plan and Figure 4 from the Water Resources Management Plan represent future land uses differently. Maps that represent planned land uses should be consistent throughout the Plan. City Response: The maps were reviewed and updated. Summary of Advisory Comment: Page 34, Land Use Categories: This section includes use of the terms "category" as well Corrin Wendell March 4, 2019 "designation." The latter suggests land use policy rather than a description of existing land use. The Plan in fact uses the term "designation" in Chapter 31 Land Use Plan. You may wish to consider consistent use of the term "category". Alternatively, you could simply refer to "existing land use". You may also wish to consider relocating references to the 2030 Land Use Plan, including the map on page 36 (Map 2-5). This is potentially confusing to the reader, as it addresses current land use policy (from 2030 Plan) rather than either existing land uses or proposed new policy for the 2040 Plan. Consider providing this map as background context in the following chapter. City Response: Noted. Summary of Advisory Comment: In the Residential section in the second column, the introductory paragraph refers to the "existing land use plan". The reader may think that this references the land use plan in the Hugo 2030 Comprehensive Plan. City Response: Noted. Summary of Advisory Comment: Page 37, Zoning District Overview: You may wish to consider relocating this content from the Community Background chapter to either the Land Use Plan chapter or the Implementation Chapter. Summary of Advisory Comment: Page 50, Land, Use, Managing Growth: The second paragraph under Diversified Rural appears to be misplaced. It relates more to the previous section titled Emerging Suburban. City Response: Noted. Summary of Advisory Comment: Page 158, Summary of Regional Strategies: The last sentence of the last paragraph addresses planned regional transit investments in Hugo. This statement appears to be misplaced. It relates to the previous paragraph, as well as to a similar paragraph on page 50. City Response: Noted. Comments provided on Housing (Tara Beard, 651-602-1051) Housing: Existing Housing Summary of Comments for Completeness: The narrative analysis of existing housing needs is not sufficient. While the Plan does discuss much of the existing housing data, comprehensive plans that are consistent with Council policy will clearly identify their existing housing needs and prioritize them. Ideally, these priorities would be included in an implementation table and connected to the use of available tools. To be consistent, all housing tools described will be linked clearly and consistently to stated housing needs. City Response: Staff reviewed the text and clarified references to our adopted policy. Summary of Comments for Completeness: Some existing housing data requirements are missing, and others are not provided in numerical values. These include the following: • The number of publicly subsidized housing units, including number of senior affordable and units affordable to people with disabilities is missing. While the narrative allows one to back into the numbers of affordable senior housing and notes no other subsidized housing exists, this should be provided in a clear, numerical way. • The percent of owner -occupied and rental housing data are provided, but numerical values should be shown. Corrin Wendell March 4, 2019 • The Plan should include data on the percentage or numerical value regarding the existing number of existing single-family homes and multi -family homes. City Response: The tables within the housing plan were updated to include the required data. Housing: Guiding Land Use and Density Summary of Comments for Completeness: Land guided to address the City's allocation of affordable housing need for 2021-2030 is not sufficiently described for review. To be complete, the following items need to be addressed: • The Plan needs to include a staging table indicating that the acres meant to address the need (specifically High Density Residential and Mixed Use Residential) are expected to develop between 2021 and 2030. • As noted in the Land Use section of this letter, there is inconsistent information about the High Density Residential land use. On Page 60, the narrative says that HOR requires a minimum of 8 units/acre, but in the summary to the right the minimum density is 6 units/acre. • On page 83, the Plan describes the need for policies that will allow the opportunity for the development of 834 new affordable housing units between 2018 and 2040. The forecasted need for new affordable housing of 834 new units is only for the decade 2021-2030. Land guided to address that need must also be shown as expected to develop within that same decade to adequately address those units. City Response: The plan and table were updated. Affordable Housing Tools Summary of Comments for Completeness: Tools that the City could consider to address housing needs are not adequately described and do not include sufficient description of what types of housing needs the City would consider using them to support, or, if applicable, when they would be considered. Mention of existing agencies that have housing assistance is not sufficient. The specific tools available at those agencies (and others) must be described and the level of local support of those tools (some of which require local match dollars, technical assistance, or formal support) must be noted. City Response: The text was updated to strengthen the language that references our adopted policy. We have added an appendix to the Comprehensive Plan document outlining the City's Livable Communities Action Plan. Summary of Comments for Completeness: Simply describing a tool that exists, or that a tool may be considered or supported (with no sense of when or why). is not sufficient to let developers of affordable housing to know what types of projects are worth engaging the City on. City Response: We updated the document with this information that was developed by the Metropolitan Council after our plan was completed. Corrin Wendell March 4, 2019 Advisory Comment: It is unclear if the statement on page 95 is meant to serve as a local fair housing policy. To clarify, a local fair housing policy does not mean that the City's should or can manage or administer Fair Housing complaints. A local fair housing policy rather ensures the City is aware of Fair Housing requirements with regard to housing decisions and provides sufficient resources to educate and refer residents who feel their Fair Housing rights have been violated. This can be as simple as having links to resources on the city'swebsite. City Response: Noted. The text in this chapter was updated to strengthen the language that references our adopted policy. We have added an appendix to the Comprehensive Plan document outlining the City's Livable Communities Action Plan. Advisory Comment: The Council will require a local fair housing policy as a requirement to draw upon Livable Communities Act awards beginning in 2019. Rehabilitation resources, conversion to a co- operative (if not one already), local notice -of -sale, or first -look provisions could be considered. City Response: See previous response. Advisory Comment: The Council strongly encourages the City to consider a mixed -income housing policy. Mixed income policies have been adopted by Golden Valley, Brooklyn Park, Edina, and others. Acknowledging this tool and committing to explore it could address many of the City's housing goals and is highly recommended. City Response: A Mixed -Income Housing Policy was added to the Housing Plan Implementation Strategies found within the Implementation Plan. Comments provided on Transportation (Russ Owen, 651-602-1739) The Plan is incomplete for Transportation. To be complete the Plan will need to address the following items. Regional Bicycle Transportation Network Summary of Comments for Completeness: While the Plan discusses the Regional Bicycle Transportation Network, it does not include a map showing the Tier 2 alignments. The current draft map 6-5 ("Existing and Proposed Corrin Wendell March 4, 2019 Trails Map") could be edited to include this in relation to the local bicycle network, both existing and planned. City Response: The Regional Bicycle Transportation Network map showing the Tier 2 alignments was added to the document. Advisory Comments: When the City is closer to a request to change the functional classification for 170th Street as described on page 166, the City will need to submit a request to the Council for approval of the classification change. Washington County administers the SSTS program for the City, carrying out all permitting, inspecting, maintenance management, and enforcement. County SSTS Ordinance 196 is consistent with Minnesota Pollution Control Agency Rules (Minnesota Rules Chapter 7080-7083) and Council 2040 Water Resources Policy Plan requirements. City Response: This section has been updated per Washington County review comments. Advisory Comment: Council staff requests that the City confirm whether there are any private Community Wastewater Treatment facilities operating in the City. City Response: There are no private Community Wastewater Treatment Facilities in the City. Comments Provided on Water Supply (Lanya Ross, 651-602-1903) The Plan is incomplete for Water Supply. To be complete for review, the Plan needs to address the following issues: Summary of Comments for Completeness: The City prepared a local water supply plan in 2017. This plan was reviewed by both the Minnesota Department of Natural Resources (DNR) and Metropolitan Council. Metropolitan Corrin Wendell 13 March 4, 2019 Council comments were shared with the DNR on March 29, 2017. The plan was recently amended and is being reviewed again. City Response: The plan was resubmitted to the DNR on January 30, 2018. Per an update e-mail from the DNR dated January 14, 2019, the plan is still under review and the DNR was awaiting comments from the Metropolitan Council, which were dependent on the resolution of forecast issues. Summary of Comments for Completeness: Although the amended water supply plan now includes additional information about the methods for population projections and related water demand (page 15), the 2040 population projections in Table 7 of the amended plan remain inconsistent with the Council's forecasts. Also, the information reported in Tables 6, 12, and 13 is inconsistent with the information provided in Appendix 4: Capital Improvement Plan. As the City works to resolve issues with the population projections and related water demand, please ensure any changes are reflected in the appropriate Capital Improvement Plan sections of the water supply plan. City Response: The forecast discrepancy is addressed in the Forecast section replies above. The Appendix 4: CIP attached to the Water Supply Plan was from the City's 2030 Plan because the 2040 Plan was still being finalized. An updated list of Planned Improvements is included in the Comprehensive Water Supply and Distribution Plan and is available upon request. Comments Provided on Implementation (Michael Larson, 651-602-1407) The Plan is incomplete for Implementation. To be complete, the Plan needs to address the following items: Capital Improvement Program (CIP) Summary of Comments for Completeness: The CIP in Appendix 13-1 lists the five-year CIP for Parks and Streets, and directs the reader to the Implementation Plan for the Comprehensive Water Resources Plan. The Plan should include an overall CIP, or CIP summary, that identifies major capital investments over five years for each of the areas of transportation, sewers, parks and open space, and water supply facilities. Please also see detail regarding capital investments under Wastewater comments above. The CIP must align with development staging, which is missing from the Plan as noted above. As relevant, the Plan should specify the timing and sequencing of these public investments. If any of these planning areas do not have needs for capital investment, the CIP should state as such. City Response: As discussed and agreed to with Metropolitan Council staff, the City is not adopting a staging plan. We reviewed our CIP to ensure that these issues are addressed. Advisory Comment:_Implementation strategies include tasks related to the potential for development in Eastern Hugo as well as exploring development opportunities in the Northern Gateway mixed use areas. The Plan, including the Implementation Chapter, should include tasks and greater detail related to how, where, when, and why new development staging areas will open up. The policy of including a rolling five-year average of land supply is geographically in specific and, at 420 permits per year, likely overstates the future demand. WITNESS: WHEREAS, the City Council of the City has, by Resolution Number 2018-14 on May 21, 2018, approved the preliminary plat for a major subdivision as proposed by the Developer to be known as "Oneka Place" ; and, WHEREAS, the City Council of the City has, by Resolution Number 2018-15 on May 21, 2018, approved the PUD general plan for a major subdivision as proposed by the Developer to be known as "Oneka Place" ; and, WHEREAS, the City Council of the City has, by Resolution Number 2019 on March 4, 2019, approved the final plat for a major subdivision as proposed by the Developer to be known as "Oneka Place" (hereinafter referred to as the "Plat"); and, WHEREAS, the Plat proposed a development of an approximately 3 acre parcel of land into 12 residential lots and 1 outlots; and, WHEREAS, it is the policy of the City to enter into development contracts as contemplated in Minnesota Statutes §462.358, Subd. 2(a); and, WHEREAS, this development agreement applies to all of the residential lots and outlots within the Oneka Place 2" a plat, as legally described in Exhibit G. WHEREAS, the parties hereto desire to set forth their respective rights and obligations of the parties to this Agreement. NOW, THEREFORE, in consideration of the premises and of the mutual promises and conditions contained herein, it is agreed by the parties hereto as follows: A. GENERAL ENGINEERING CONDITIONS; 1. Escrow for City Costs and Fees. Developer shall, contemporaneously with the execution of this Agreement, deposit with the City an escrow as outlined in Exhibit C to cover the cost of legal fees, engineering and construction observation fees, administrative expenses, and other costs related to this Plat. All fees and costs incurred by the City in connection with the Plat shall be charged against said escrow account which shall remain in effect until the expiration of the warranty period for the Plat, as defined in paragraph 7, in all events said fees and costs shall be the responsibility of the Developer and shall be paid on demand. Any funds remaining in the escrow account after the completion of the warranty period shall be refunded to the Developer. In the event that the escrow account herein is depleted, Developer agrees to post additional funds to replenish the account and to cover projected City costs. Specifically, Developer agrees that the escrow account shall maintain a balance of no less than $5,000.00. Developer shall be entitled, upon request, to an itemized statement of all costs and fees charged against this escrow account. 2 2. Development Plans. In accordance with the policies and ordinances of the City, and subject to all City resolutions and approvals in connection herewith, the Developer shall construct the proposed improvements (hereinafter referred to as the "Improvements"). All Improvements shall be constructed and installed pursuant to the terms and conditions herein set forth in accordance with the plans approved and listed on Exhibit A, subject to all City resolutions and approvals listed in Exhibit B, subject to final approval by the City, and in accordance with City standards and requirements including those listed herein. In addition, all public street, utility, and storm drainage improvements shall comply with the City's adopted specification book and the reasonable direction of City staff. 3. Authorization to Proceed with Construction. Developer agrees not to commence any grading, utility or street work within the Plat until the following are completed: 1) Construction plans are approved by the City and distributed. 2) Pre -construction conference is held. 3) Notice to Proceed is issued. 4. Construction Observation. The City, for its benefit, will provide staff of its choosing to provide construction observation for the Improvements outlined in this Agreement. All costs associated with construction observation and inspection will be the responsibility of the Developer. The Developer shall allow City staff and City consultants access to the property to allow for this work to occur. 5. Miscellaneous Requirements. a) Property Corners: All property corners as identified on the Plat must be monumented with iron surveyor's pipes by the Developer prior to final project acceptance, as defined in paragraph 7 of this Agreement. b) Drainage Easements: Drainage easements shall be dedicated on the Plat so as to cover any wetlands and stormwater ponding areas located below the 100-year high water levels. c) Soils Testing: Soils inspection and compaction testing by a registered professional engineer shall be accomplished on all lots where filling is required, in accordance with the approved Grading, Drainage, and Erosion Control Plan. A minimum of one (1) compaction test for all developed lots shall be obtained for every two (2) foot increment of fill that is placed. A summary of all inspections and compaction tests for all developed lots shall be provided to the City upon completion of the grading and shall be provided for a respective lot prior to the issuance of a building permit for such lot. 3 d) Private Utilities: All private utilities that are installed, including electricity, telephone, natural gas and cable television, shall be installed underground. e) Mailboxes: Developer shall coordinate mailbox locations with the United States Postal Service. f) Street Lights: Street lights shall be installed within the Plat according to the Street Lighting Plan, which will first be approved by the City Engineer. Developer shall also submit its Street Lighting Plan to the applicable power company for its review, comment and approval. The installation of the street lights shall be coordinated with the applicable power company so that the street light system is installed, constructed and operated in such a manner as will harmoniously exist with other street lights within the area. g) Working Hours: Construction activity, including equipment startup and fueling, can only occur between the hours of 7:00 a.m. and 7:00 p.m. Monday through Friday; 8:00 a.m. and 5:00 p.m. on Saturdays; at no time on Sundays or holidays. h) Street Sweeping: Developer shall sweep and/or otherwise clean all streets, as needed, within and adjacent to the Development property as a result of construction activities associated with the Plat until final acceptance of the Improvements. If the streets are not maintained in a manner acceptable to the City, after reasonable notice to the Developer the City will arrange for the street sweeping at Developer's cost. i) Placement of Bituminous Wear Course: The bituminous wear course can be placed on all streets once all of the following have occurred: A Certificate of Occupancy has been issued for at least 75% of the lots or a cash escrow in the amount of $10,000 has been deposit with the City which will be held until 75% of the lots have received Certificates of Occupancy. At the City's discretion, the wear course may be placed prior to having 75% occupancy. If applicable, the warranty period shall be extended an additional one (1) year for a total of two (2) years from final acceptance. In no case shall the wear course be placed with less than 50% occupancy. 2. The base course on all streets has been in place for at least one full freeze -thaw cycle. 3. City staff or its assignees have visually inspected all roadways and curb within the Development, and any repairs necessary as a result of said inspection are complete and written approval issued. 6. Proiect Completion: The Improvements listed herein on Exhibit A, including street, sanitary sewer, storm sewer, and municipal water, shall be completed subject to the approval 4 of the City in accordance with the approved plans. All Improvements shall be substantially completed to the reasonable satisfaction and approval of the City within twelve (12) months of the execution of this Agreement. Substantial completion shall consist of all work with the exception of placement of the bituminous wear course and completion of the final punchlist. The Developer shall be excused from the strict completion date set forth herein if written notice is received from the Developer of the existence of causes over which the Developer has no control which will delay the completion of the work and approved in writing by the City. In that event, the City may extend the date or dates herein specified. 7. Project Acceptance: Final project acceptance will be considered by the City Council once the following have been completed: (a) All Improvements are installed according to the approved plans. (b) All punchlist items are completed. (c) All Record Drawing information has been provided to the City to its satisfaction. (d) Escrow account for City costs and fees is current in accordance with the provisions of this Agreement. (e) The City receives confirmation via lien waivers that contractors or other parties have been paid for the work completed. (f) The City receives a written request from the Developer to accept the Improvements. 8. Record Drawing Requirements and Enjineer's Certification. Following completion of all development activities and prior to the release of security and acceptance of Improvements, the Developer and/or their assignee shall provide to the City "as -built" plans for the Improvements listed on Exhibit A. This information shall be provided to the City in the following formats: (a) 1-set mylar drawings (22" x 34") for all Improvements. (b) 1-set paper drawings (22" x 34") for all Improvements. (c) Individual Adobe.pdf (or approved equivalent) for all plan sheets and the final plat. All Record Drawings shall include the following information: (a) All bench marks shown on plans (bench marks shall be top nut of hydrants). (b) Swing ties to all gate valves shown on plans (ties should be to manholes, catch basins, hydrants or other permanent objects. (c) Swing ties to curb stops shown on plans (ties should be to manholes, catch basins, hydrants, property corners or other permanent objects). (d) Top of casting and invert elevation for all structures. (e) All pipe sizes, material type, pipe classification, grades and lengths (f) All horizontal and vertical curve data in the appropriate location on the plans. 5 (g) Televised report of the sanitary sewer with videotape. (h) Swing ties to any manhole or catch basin outside the roadway area. (i) A text file including the x, y and z coordinates (based on Washington County's coordinate system) for the following: 1. All curb stops 2. All hydrants 3. All gate valves 4. All manholes located outside of the roadway 9. Construction Warranty and Financing of Improvements. The Developer agrees to construct the Improvements described herein at its own expense and in accordance with City specifications. The Developer shall engage at its own expense a registered, professional civil engineer to prepare plans and specifications for the Improvements and shall submit the same to the City for review and approval. The Developer represents and warrants that all of the Improvements made as a part of this development shall be guaranteed to be properly functioning as designed for a period of not less than one (1) year following acceptance of the entire project by the City. In the case of any material or labor that is supplied and that is reasonably rejected by the City as defective or unsuitable, then the rejected materials shall be removed and replaced with approved material, and the rejected labor shall be done anew to the reasonable satisfaction and approval of the City at the sole cost and expense of the Developer. In any event, none of the warranty periods expressed herein shall begin to run until all of the Improvements within the Plat have been approved and accepted by the City. The Developer's engineer shall certify that grading within the Plat was completed in accordance with the approved Grading, Drainage and Erosion Control Plan before the City issues any building permits. The Developer shall remain ultimately responsible for accurate grading of all lots and shall correct any deficiencies in grading that may be discovered until the certificate of occupancy is issued or the developer is released from its obligation under this Agreement as outlined in paragraph 7 above. 10. Suns. The Developer shall prepare a plan for all regulatory, directional and street name signs to be within the Plat. The plan shall be reviewed and approved by the City's public works department. Upon plan approval, the City's public works department shall install all public signage within the Plat. The installation of all private signage shall be the responsibility of the Developer. All costs related to the installation of public signage shall be the responsibility of the Developer and will be deducted from the Developer's escrow account. The Developer shall post funds as outlined in Exhibit C prior to the City's public works department beginning the installation. 11. Drainage Easements. a) Work within Easements: No improvements, landscaping, or grading, other than Improvements shown on the approved plans, shall be permitted in dedicated drainage easements without the prior written permission of the City and any regulatory agency having 0 jurisdiction. b) Maintenance Responsibilities: The Developer and its successors in interest, including all individual homeowners, shall be responsible for routine maintenance of all storm water management ponds, wetlands, and drainage areas within easements dedicated to the City on their property. Routine maintenance shall include litter removal, mowing and maintenance of the property adjacent to pond or wetland areas. In the case of drainage swales, routine maintenance includes the removal of obstructions from the swale as necessary to maintain proper drainage in addition to the aforementioned items. The City shall be responsible for non -routine maintenance of storm water ponds within the easements, including pond dredging, maintenance of the storm water inlet(s) and outlet(s) pipes, and erosion control at outlet and inlet locations. Such maintenance shall be completed as deemed necessary by the City. 12. Wetland Signage: Permanent signage shall be placed along wetland edges as outlined in the City's General Specification and Standard Details Manual or approved equal by the City. 13. Lowest Floor Elevations. All minimum floor elevations shall comply with Section 90-171 of the Hugo Zoning Ordinance, the City's Comprehensive Stormwater Management Plan, or the approved Grading, Drainage, and Erosion Control Plan, whichever is more restrictive. Except as may be specifically allowed under Exhibit A, no building shall be constructed on any of the lots herein unless the lowest floor elevation is at least three (3) feet above the 100-year flood elevation or four (4) feet above the high groundwater elevation, whichever is greater, for the subject property. Additionally, the lowest floor elevation shall be specifically referenced and designated, for each lot, on a certificate of survey, which survey shall be provided to the City before any building permits are issued for any lots within the Plat. 14. Landscaping. All disturbed areas within the Plat shall be landscaped in accordance with the approved landscape plans, the City ordinances, and the City's General Specification and Standard Details Manual. All landscaping shall be complete, established and growing within sixty (60) days of issuance of a Certificate of Occupancy, except that, if the certificate of occupancy is issued between the dates of October 1 and May 1, then the landscaping required herein shall be complete, established and growing no later than July 1. All front yards, side yards and back yards shall be fully sodded. All landscaped areas shall be tilled or otherwise worked mechanically in order to loosen compacted soils and shall contain at least four (4) inches of black dirt containing no more than 35% sand. Unless specific arrangements are made and agreed to by the City, all landscaping installed within the Plat shall be maintained by the Developer and its successors. All areas, other than proposed street areas, disturbed by grading activities on the site shall be seeded. Seeding shall be immediate upon completion of grading activities or as directed by the City Engineer. Seeding shall be completed as follows: a) All areas shall be restored with a minimum of four (4) inches of adequate topsoil prior to seeding. 7 b) Upland areas shall be seeded in accordance with the grading, drainage, and landscape plans listed in Exhibit A. The rate of application shall be one hundred (100) pounds per acre. Areas seeded shall be mulched with Type 1 mulch at a rate of two (2) tons per acre. All mulch shall be disk anchored. c) Wetlands, wetland replacement areas and storm water ponding areas shall be seeded per the Final Landscape Plan dated June 6, 2018, and revised July 27, 2018. The minimum rate of application shall be thirty (30) pounds per acre, or as recommended by the supplier. d) All seeded areas shall be maintained for the term of this Agreement. Upland areas shall be mowed as necessary or as directed by the City Engineer. e) All disturbed areas within the development shall be maintained to limit vegetation growth to less than ten (10) inches except designated natural areas or designated open spaces as shown on the approved plans. 15. Safe Rooms. The Developer shall require all builders to offer a safe room as an option to any and all potential homebuyers. All safe rooms offered and built within the City must meet or exceed FEMA requirements and standards. B. ESCROWS, CHARGES AND UTILITY OVERSIZING: Developer shall pay the escrows, fees and charges listed on Exhibit C. C. SPECIAL PLANNING REQUIREMENTS: The Plat shall be built and maintained in accordance with the planning requirements listed on Exhibit A hereto, and any miscellaneous requirements listed on Exhibit B hereto. D. ADMINISTRATIVE REQUIREMENTS: 1. Miscellaneous Provisions. Developer specifically understands that this Plat approval is given subject to the following requirements: a) Expiration. The final plat documents for the Plat, which is the first phase of the Oneka Place preliminary plat, have been submitted to the City Council within one hundred twenty (120) days of preliminary plat approval. The final plat must be recorded with the Washington County Recorder (and the mylar "hardshells" must be fully executed) within sixty (60) days of the City Council motion giving final plat approval, unless such deadline is extended by the City Council in its sole discretion, or else said approval shall be null and void. All fees relating to this subdivision shall be paid by the Developer, including the cost of recording documents with Washington County. b) Recording. The developer shall record this Agreement with Washington County simultaneous with the recording of the Plat, and shall forward confirmation of recording of the Plat and this Agreement to the City prior to the issuance of building permits. All applicable conditions of Plat approval must be met before any deeds are stamped for recording and 8 prior to the recording of the Plat at the Washington County Recorder's Office. Plat approval shall be contingent upon compliance with the approved plans for the Improvements and upon compliance with this Agreement. c) Model Homes. In the event that site grading is approved by the City prior to Plat approval and/or execution of this Agreement, posting of security and filing of the Plat, the Developer shall be entitled to one (1) building permit per housing unit type on lots that abut existing streets or roadways, subject to final approval by the City. No model homes may be constructed or utilized until at least one (1) lift of bituminous has been installed from said model home lot providing access to a public street or roadway outside of the Plat. No certificate of occupancy shall be issued for any model or other home until all necessary public improvements and utilities have been installed and the utilities have been successfully tested. Prior to this, and at the time that a model home passes final inspection, a model home may only be used by Developer's staff or realtors for purposes of showing the models to potential buyers. No model home may be used until landscaping conforming to City ordinance and paragraph 14 of this Agreement has been installed except that, if the certificate of occupancy is issued between the dates of October 1 and May 1, then the landscaping required herein shall be complete, established and growing no later than July 1. d) Sales Trailers. The developer may be entitled to a maximum of one (1) temporary sales office (sales trailer) for this and all subsequent phases of the development for a period of time not to exceed nine (9) months. Upon receipt of an acceptable site plan, a sales trailer may be approved by the City Community Development Director prior to the first model home being available for showing. The trailer is subject to the issuance of a building permit, shall meet all applicable building codes, shall be fully skirted, shall be suitably landscaped, shall contain sufficient parking for the size of the office, and shall have safe and suitable access to a paved, public roadway. The trailer shall be removed, and the site shall be restored within seven (7) days following the date that a model home passes final inspection. e) Deviations. No material deviations from the approved Plat shall be allowed unless approved in writing by the City. Approval herein is also given subject to full compliance with the conditions of approval and findings adopted by the City Council in connection with the approval of the development. f) Certificates of Survey. A certificate of survey shall be provided to the City Building Inspector for each lot at the time a building permit is requested for the lot. Attached to the certificate of survey shall be an erosion control plan for the lot showing location and type of all erosion control measures to be used on the lot, and spot elevations, tree preservation plan shall be submitted for each home site. g) Outhouses. The Developer shall provide on -site a sufficient number of portable outhouses to be available for the persons who will be working on -site until Improvements are accepted according to the plans in Exhibit A. 0 h) Property Owners Association. When required as a condition of approval outlined in Exhibit B, the Developer agrees to form a property owners association, membership in which shall be mandatory for all of the lots within this development. The property owners association shall be responsible for maintenance and repair of all common elements as listed in the property owners association documents within this development and the same shall be maintained in good condition in accordance with all City ordinances and reasonable directions of the City. Developer agrees to provide a copy of the property owners association documents to the City prior to the recording of the final plat. In the event of failure or refusal of any property owners association to so maintain or repair the common elements then the City may, with seven days written notice and without regard to the requirements or formalities of Minn. Stat. §429 perform the work and assess each of the lots within the plat for the cost of the work. i) Intentionally deleted j) The property owners association documents shall advise owners of all lots of the requirements of this Agreement as follows: THE LAND WITHIN THIS PLAT, INCLUDING THE LAND CONVEYED HEREIN, IS BOUND BY RESTRICTIONS IN A DEVELOPMENT AGREEMENT. SAID DEVELOPMENT AGREEMENT IS ON FILE AT THE OFFICE OF THE WASHINGTON COUNTY RECORDER. k) Developer acknowledges that a separate development agreement will be entered into at the time of final plat approval of subsequent phases in the development. That Development Agreement will address, among other things, necessary improvements to be made, financial guarantees to be provided, and the amount of the development fees to be paid by the Developer. 1) Developer shall remove all tree waste, junk, miscellaneous debris, junk vehicles, and any other personal property from the Plat which does not comply with the City Zoning Ordinance until final acceptance of the Improvements. E. DAMAGES AND DEFAULT: 1. Developer agrees to pay liquidated damages to the City if any lot has a real estate closing occur before all public improvements within the Plat are certified as being substantially completed by the City. Specifically, Developer agrees to immediately pay to the City liquidated damages in the amount of Ten Thousand Dollars ($10,000.00) for each lot closing which occurs in violation of this paragraph. The City shall be authorized to retain an appropriate percentage of the financial guarantee referred to in paragraph 4 as security for payment of any liquidated damages owed to the City. Model Homes are exempt from this section. 2. Developer agrees to pay liquidated damages to the City, in the amount of Five Thousand Dollars ($5,000.00), if the Developer encroaches upon any City road right-of-way or utility easement not permitted on the plans without first obtaining a written permit from the City expressly authorizing said encroachment. The City shall be authorized to retain an appropriate 10 percentage of the financial guarantee referred to in paragraph 4 as security for payment of any liquidated damages owed to the City. 3. Events of Default. a) Events of Default Defined. The following shall be "Events of Default" under this Agreement and the term "Event of Default" shall mean, whenever it is used in this Agreement, any one or more of the following events: Subject to unavoidable delays, failure by Developer to commence and complete construction of the Improvements pursuant to the terms, conditions and limitations of this Agreement. 2. Failure by Developer to substantially observe or perform any material covenant, condition, obligation or agreement on their part to be observed or performed under this Agreement. b) Remedies on Default. Whenever any Event of Default occurs, the City, subject to any rights of third parties agreed to by the City pursuant to this Agreement, or otherwise by written, executed instrument of the City, may take any one or more of the following: The City may suspend its performance under the Agreement until it receives assurances from Developer, deemed adequate by the City, that Developer will cure their default and continue their performance under the Agreement. Suspension of performance includes the right of the City to withhold permits including, but not limited to, building permits. 2. The City may initiate such action, including legal or administrative action, as is necessary for the City to secure performance of any provision of this Agreement or recover any amounts due under this Agreement from Developer, or immediately draw on the financial Letter of Credit, as set forth in this Agreement. 4. Enforcement by City; Damages. The Developer acknowledges the right of the City to enforce the terms of this Agreement against the Developer, by action for specific performance or damages, or both, or by any other legally authorized means. The Developer also acknowledges that its failure to perform any or all of their obligations under this Agreement may result in substantial damages to the City; that in the event of default by the Developer, the City may commence legal action to recover all damages, losses and expenses sustained by the City; and that such expenses may include, but are not limited to, the reasonable fees of legal counsel employed with respect to the enforcement of this Agreement. 11 F. THIS AGREEMENT: 1. Release of Agreement. This Agreement shall run with the land and may be recorded against the title to the property. After the Developer has completed the work required of it under this Agreement, at the Developer's request the City will execute and deliver to the Developer a release. 2. Warranty of Title. Developer warrants and represents to the City that it is the fee owner of the land described herein and that it has authority to execute this Agreement, with consent from the other fee owner, and agree to the conditions hereof and to subject the land hereto. Developer also represents and warrants that the use for which this development is sought will not violate any restrictive covenants applying to the property. 3. Binding Effect. This Agreement shall be deemed to be a restrictive covenant and the terms and conditions hereof shall run with the land described herein and be binding on and inure to the benefit of the heirs, representatives and assigns of the parties hereto, and shall be binding upon all future owners of all or any part of the subdivision, and shall be deemed covenants running with the land. Reference herein to the Developers, if there be more than one, shall mean each and all of them. This Agreement shall be placed of record so as to give notice hereof to subsequent purchasers. The cost of said recording shall be borne by the Owner and charged against the escrow account. 4. Restrictions on Transfer/Indemnification. Developer agrees to defend and hold the City, and its officials, employees and agents, harmless against any and all claims, demands, lawsuits, judgments, damages, penalties, costs and expenses, including reasonable attorney's fees, arising out of actions or omissions by Developer, their employees and agents, in connection with the Project. No transfer or assignment shall be made without City approval and any assignment or transfer without such approval shall be void. 5. Incorporation by Reference. All general and special conditions, plans, special provisions, proposals, specifications and contracts for the Plat and for any Improvements furnished and let pursuant to this Agreement shall be and hereby are made a part of this Agreement by reference as if fully set out herein in full. 6. Developer will comply with and promptly perform all of its obligations under this Agreement. 7. Evidence of Title. Developer shall furnish the City with evidence of fee ownership of the property being platted by way of an attorneys title opinion or title insurance 12 commitment dated not earlier than thirty (30) days prior to the execution of the Plat. A final plat is approved to allow the creation of 12 single family home lots and 1 outlot, in accordance with the application and plans received by the February 1, 2019, except as amended by this resolution. 2. The development shall substantially comply with all plans and conditions of the preliminary plat and PUD approval granted by the City Council on May 21, 2018. 3. Development standards shall comply with Resolution 2018-14 and 2018-15, as amended. 4. The developer shall comply with all conditions outlined in the City Engineer's memo dated , and revisions required in "red -lined" comments from the City Engineer. 5. Outlot Use and Ownership: a. Outlots A is proposed for storm water ponding, wetlands, and landscaping and shall be deeded to the City. 6. An HOA shall be established to own/operate/maintain the following: i. landscaping within the outlots, ii. landscaping along Oneka Parkway within the right-of-way, iii. landscaping on proposed residential lots, iv. all retaining walls, v. and the water re -use system. 17 The HOA documents/covenants shall be reviewed and approved by staff. b. The storm water re -use system shall be reviewed and approved by staff. The storm water reuse system operation, encroachment, and maintenance agreement shall be reviewed and approved by City staff. c. An encroachment and maintenance agreements shall be reviewed and approved by staff for access and maintenance of landscaping, signage, and retaining wall with in Outlots proposed to be deeded to the City. d. The developer shall comply with all conditions outlined in the City Engineer's memos dated March 3, 2018 and July 27, 2018 e. The development shall comply with the Fire Chief s requirements regarding fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. f. The developer shall obtain all necessary stormwater management and WCA permits from the City. g. The developer shall obtain all necessary local, state, and federal permits. h. Architectural design standards shall be reviewed and approved by staff. i. The developer shall work with City staff to provide bituminous trail connections to the proposed park to the east. j. The developer shall enter into a development agreement, shall agree to complete all improvements, and pay all fees as required by the agreement. 13. Prior to the issuance of building permits, the developer shall comply with the following conditions. a. The applicant shall record the final plat, development agreement and all other documentation at Washington County and provide the City with proof of recording. b. The applicant shall submit three full sets of approved final plans to the City. c. If a sales trailer is located in the property, a site plan and building elevations shall be submitted for City review and approval. 14. Prior to the issuance of Certificate of Occupancy, the developer shall comply with the following conditions: a. Imp. Bonds of 2007 DATE: For the City Council Meeting of March 4, 2019 DESIRED COUNCIL ACTION Adoption of Resolution Authorizing the Call of the Outstanding G.O. Imp. Bonds of 2007 On September 17, 2007, the City issued $1,230,000 of G.O. Improvement Bonds and used the proceeds to construct public improvements on 129th Street and Oakshore Park Subdivision. The bonds were issued for 15 years with interest rates ranging from 4.0% to 4.15%. Assessments totaling $1,677,627 were levied against benefiting parcels to finance bond repayment. No property taxes have been levied for this bond issue. As of today the remaining principal on the bonds is $260,000. As is common with special assessment projects, many of the assessments were either prepaid or paid off early. The balance of special assessments to be collected is only $25,306. This has resulted in a fund balance that is sufficient to pay off the remaining bond principal. After factoring in the cost of redemption, the financial analysis prepared by Springsted calculates a Net Present Value benefit of $20,640 or 7.25% of the refunded debt service. Thus, sufficient savings will be realized to proceed with the early retirement of these bonds. RECOMMENDATION Staff is recommending the City Council approve a resolution that "calls" these bonds on May 1, 2019. Resolution Authorizing the Call of the Outstanding G.O. Imp. At that workshop, staff discussed the importance of compacting the gravel roads in conjunction with the grading operations. In turn, Council directed staff to explore options for the purchase of compaction equipment. Public Works staff has worked with the Finance Department and money was included in the 2019 Budget Document for this purchase. Staff has been actively searching for quality used compaction equipment. The following piece of equipment is available through Ziegler Cat: 2007 Caterpillar PS-150 Pneumatic Tire Compactor (cost $36,500) Details: CAT 3054C DIT diesel engine (100 HP) Two -speed throttle Dual braking system Hydrostatic transmission 9-tire all wheel oscillation Roadway lights and canopy 2,971 engine hours This piece of equipment is located in Nevada. Staff is working with a nearby Caterpillar dealer to have a certified Caterpillar service technician inspect the equipment and provide a list of any deficiencies. If staff is satisfied with the results of the inspection, a purchase would be negotiated and the equipment would be delivered to Ziegler Caterpillar in Columbus, Minnesota. Additionally, each year the City rents a similar piece of equipment to use during the application of dust control, which is applied twice a year. This results in a yearly rental cost of approximately $4500. The purchase of this piece of equipment would eliminate the need to rent. BACKGROUND: Cities have a wide range of discretion in developing a zoning ordinance. City zoning requirements can range from very complex to minimal. However, all city zoning authority and regulation is subject to the Municipal Planning Act per Minnesota State Statute. The Act has specific provisions related to local planning. The provisions that will be discussed in this memo are State licensed residential facilities. State Statute provides regulations for licensed residential facilities in regards to permitted uses in residential zoning districts. The regulations were put in place to provide protection against discrimination of the facilities, including where they are located. The statute does not define the term "state licensed residential facility". Presumably the term encompasses a whole host of residential facilities (group homes, treatment centers, foster homes, etc) that are state licensed, at least to the extent they serve persons with disabilities. Further, the City is required to meet all of the State laws for residential zoning districts for licensed residential facilities. Summary of State Statute Regulations Residential Facilities The State Statute requires cities to allow licensed residential facilities serving six or fewer persons as a permitted use in all single family residential zoning districts. Additionally, it requires cities to allow licensed residential facilities serving between seven and 16 persons as a permitted use in all multi -family zoning districts. For multi -family zoning districts cities may require a conditional use permit (CUP) in order to assure proper maintenance and operation of a facility, provided that no conditions shall be imposed on the facility which are more restrictive than those imposed on other conditional uses of residential property in the same zones, unless the additional conditions are necessary to protect the health and safety of the residents of the residential facility. Page 2 Summary of Hugo City Code Regulations for Residential Facilities Currently the Hugo City Code allows residential facilities between one to six persons as a permitted use and between seven and 16 persons as a conditional use in all residential zoning districts, including Rural Residential (RR), Future Urban Service (FUS), Agricultural (AG), and Long Term Agricultural (LA) zoning districts. The code includes a definition for residential facilities, as define below: Residential facility means any facility licensed by the state or county, which for gain or otherwise, regularly provides one or more persons with 24 hours per day care, food, lodging, training, education, supervision, habilitation, rehabilitation, and treatment. Residential facilities include, but are not limited to institutions under the control of the commissioner of public welfare, foster homes, haivay houses, residential treatment centers, maternity shelters, group homes, residential programs, or schools for handicapped children. It seems as though the intent of the City Code definition was to allow a type of facility that is transient in nature that provides a number of services for a temporary period of time. It names several facilities that would be of a transient nature as examples of what are allowed. Under this definition, assisted living facilities, or other uses of that type, where people would move out of their home and live full time in the facility, would not apply. State Statute covers a wide variety of licensed residential facilities, which may include assisted living facilities, or other uses of that type. It is unclear, but may be best to assume it does. 2. CONCLUSION: There are inconsistencies between the State Statute and Hugo City Code in regards to residential facilities, such as the definition and zoning provisions. It is in staff s opinion that the ordinance should be updated to ensure compliance with State Statute. 3. RECOMMENDATION: Staff recommends the City Council authorize staff to have discussions with the Ordinance Review Committee (ORC) on amendments to the City Code in regards to residential facilities to become compliant with State Statute.
