WASHINGTON COUNTY, MINNESOTA
A RESOLUTION AUTHORIZING NEGOTIATIONS AND/OR EMINENT DOMAIN TO
AQUIRE THE PROPERTY
AREAS NEEDED FOR THE 130TH STEET IMPROVEMENT PROJECT
WHEREAS, The City of Hugo has initiated the 130TH Street Improvement Project (the Project),
including reconstruction of 130th Street; a roundabout at the intersection of 130th Street and Flay
Avenue; realignment of the intersection at 130th Street and Goodview Avenue; street and utility
construction; new pedestrian facilities; and
WHEREAS, the construction schedule for the Project contemplates that the Project will be
completed during the 2019 construction season; and
WHEREAS, it is necessary that the City obtain title and possession of the areas identified in
Exhibit A for the parcel as shown below:
$25,100.00 — Parcel 3 — Kevin Peltier — PID #29.031.21.44.0001
by negotiation where the owner has agreed to the amount identified above.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
HUGO, MINNESOTA acquisition is hereby authorized as follows:
Offers are made for the necessary easements for the parcels identified in Exhibit A,
pursuant to Minnesota Statute.
This resolution was adopted by the City Council of the City of Hugo on the 4th day of March,
2019, by a vote of four Ayes and No Nays

Landowner's Property
All that part of the Southeast Quarter of the Southeast Quarter of the Southeast quarter of
Section 29, Township 31 North, Range 21 West. Subject to easements.
Description of Permanent Public Street, Roadway, Highway, and/or Right -of -Way Easement
A 66.00 foot permanent easement for public street, roadway, highway, and/or right-of-way
purposes over, under, and across a portion of the Landowner's Property. The centerline of said
easement is described as follows:
Commencing at the southeast corner of the Southeast Quarter of the Southeast Quarter of the
Southeast Quarter of said Section 29; thence on an assumed bearing South 89 degrees 55 minutes
31 seconds West a distance of 33.00 feet to the westerly right-of-way line of Goodview Avenue
North; thence North 00 degrees 43 minutes 55 seconds East along said westerly right-of-way line
343.82 feet to the beginning of said centerline; thence North 89 degrees 26 minutes 49 seconds
West a distance of 38.81 feet; thence southwesterly a distance of 228.95 feet, along a tangential
curve concave to the south having a radius of 693.00 feet and a central angle of 18 degrees 55
minutes 44 seconds; thence South 71 degrees 37 minutes 27 seconds West, tangent to said curve, a
distance of 105.33 feet; thence southwesterly 267.44 feet, along a tangential curve concave to the
north having a radius of 1000.00 feet and a central angle of 15 degrees 19 minutes 23 seconds to
the westerly line of said Southeast Quarter of the Southeast Quarter of the Southeast Quarter, and
said centerline there terminating.
Description of Temporary Construction Easement
A temporary easement for construction purposes over, under, and across a portion of the
Landowner's Property, described as follows:
Commencing at the southeast corner of the Southeast Quarter of the Southeast Quarter of the
Southeast Quarter; thence on an assumed bearing South 89 degrees 55 minutes 31 seconds West a
distance of 33.00 feet to the westerly right-of-way line of Goodview Avenue North; thence North 00
degrees 43 minutes 55 seconds East along said westerly right-of-way line 376.82 feet to the point of
beginning of the land to be described; thence North 89 degrees 26 minutes 49 seconds West along
the northerly right-of-way line of 1301h Street North a distance of 38.81 feet; thence continuing
southwesterly along said right-of-way line a distance of 239.85 feet, along a tangential curve
concave to the south having a radius of 726.00 feet and a central angle of 18 degrees 55 minutes 44
seconds; thence continuing along said right-of-way line South 71 degrees 37 minutes 27 seconds
West, tangent to said curve, a distance of 105.33 feet; thence continuing along said right-of-way line
southwesterly 256.52 feet, along a tangential curve concave to the north having a radius of 967.00
feet and a central angle of 15 degrees 11 minutes 56 seconds to the westerly line of said Southeast
Quarter of the Southeast Quarter of the Southeast Quarter; thence continuing along said westerly
line North 00 degrees 34 minutes 52 seconds East a distance of 0.98 feet; thence 150.96 feet along a
curve concave to the north, not tangent to last described line, with a chord bearing North 76
degrees 55 minutes 39 Seconds East with a central angle of 07 degrees 47 minutes 11 seconds;
thence North 73 degrees 02 minutes 03 seconds East a distance of 174.94 feet; thence North 71
degrees 40 minutes 16 seconds East 285.81 feet to said westerly right-of-way line; thence
continuing along said right-of-way line South 00 degrees 43 minutes 55 seconds West 62.07 feet to
the point of beginning.
