HomeMy WebLinkAbout2019.03.04 RESO 2019-10 Final Plat and DA for Oneka Place 2nd AdditionRESOLUTION 2018-10 APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR CPDC — PRATT — OAKWOOD, LLP, ON PROPERTY LOCATED NORTH OF ONEKA PARKWAY AND NORTH OF 159TH STREET FOR ONEKA PLACE 2nd ADDITION WHEREAS, CPDC — Pratt — Oakwood, LLP, has requested approval of a final plat development to allow construction of 12 single family lots and 1 outlot on the property legally described as follows: Outlot H, Oneka Place Lots 1-14, Block 5, Oneka Place WHEREAS, the Planning Commission has reviewed the preliminary plat and PUD at a duly called Public Hearing and recommends approval, and; WHEREAS, the City Council approved the preliminary plat and PUD at its meeting on May 21, 2018. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by CPDC — Pratt — Oakwood, LLP„ for a final plat and development agreement, subject to the following conditions: 1. A final plat is approved to allow the creation of 12 single family home lots and 1 outlot, in accordance with the application and plans received by the February 1, 2019, except as amended by this resolution. 2. The development shall substantially comply with all plans and conditions of the preliminary plat and PUD approval granted by the City Council on May 21, 2018. 3. Development standards shall comply with Resolution 2018-14 and 2018-15, as amended. 4. The developer shall comply with all conditions outlined in the City Engineer's memo dated February 28, 2018, and revisions required in "red -lined" comments from the City Engineer. 5. Outlot Use and Ownership: a. Outlots A is proposed for storm water ponding, wetlands, and landscaping and shall be deeded to the City. 6. The developer shall design and install a storm water re -use system for the irrigation of the lots. 7. The landscaping planned for the plat shall be installed in one phase. The developer shall take proper precautions to protect the trees as the homes are being built. Resolution 2019-10 Page 2 8. Staff will continue to work with the developer on the street lighting plan. Exact locations of the street lights shall be reviewed and approved by City staff prior to installation. The street lights shall be the Lantern style decorative light. 9. Final design of the entrance monument shall be reviewed and approved by staff prior to installation. 10. Prior to the release of the final plat for recording, the developer shall comply with the following conditions. a. An HOA shall be established to own/operate/maintain the following: i. landscaping within the outlots, ii. landscaping along Oneka Parkway within the right-of-way, iii. landscaping on proposed residential lots, iv. all retaining walls, v. and the water re -use system. The HOA documents/covenants shall be reviewed and approved by staff. b. The storm water re -use system shall be reviewed and approved by staff. The storm water reuse system operation, encroachment, and maintenance agreement shall be reviewed and approved by City staff. c. An encroachment and maintenance agreements shall be reviewed and approved by staff for access and maintenance of landscaping, signage, and retaining wall with in Outlots proposed to be deeded to the City. d. The developer shall comply with all conditions outlined in the City Engineer's memos dated March 3, 2018 and July 27, 2018 e. The development shall comply with the Fire Chief's requirements regarding fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. f. The developer shall obtain all necessary stormwater management and WCA permits from the City. g. The developer shall obtain all necessary local, state, and federal permits. h. Architectural design standards shall be reviewed and approved by staff. i. The developer shall work with City staff to provide bituminous trail connections to the proposed park to the east. Resolution 2019-10 Page 3 j. The developer shall enter into a development agreement, shall agree to complete all improvements, and pay all fees as required by the agreement. 13. Prior to the issuance of building permits, the developer shall comply with the following conditions. a. The applicant shall record the final plat, development agreement and all other documentation at Washington County and provide the City with proof of recording. b. The applicant shall submit three full sets of approved final plans to the City. c. If a sales trailer is located in the property, a site plan and building elevations shall be submitted for City review and approval. 14. Prior to the issuance of Certificate of Occupancy, the developer shall comply with the following conditions: a. The bituminous trail access to the park shall be installed per the construction plans.
