Minutes for the Planning Commission Meeting of Thursday, January 10, 2019 Chair Kleissler called the meeting to order at 7:01 p.m. PRESENT: Arcand, Derr, Fry, Kleissler, Lessard, Luchsinger, Mulvihill, Tjemiund. ABSENT: None. STAFF: Rachel Juba, Community Development Director Emily Weber, Community Development Assistant Approval of Minutes for the Planning Commission Meeting of October 25, 2018 Commissioner Arcand made a motion, seconded by Commissioner Tj emlund, to approve minutes for the meeting of October 25, 2018. All Ayes. Motion carried. Ordinance Adopting Rice Creek Watershed District by Reference Juba started by giving background information on the City's Water Resource Management Plan, which guides the City on administration and implementation on all stormwater management practices in the City. The plan was approved by the City Council in 2015 and at that time the City put together goals and policies that were intended to guide the City moving forward. Since then, the Rice Creek Watershed District went through rule changes so the City sent out the new plan in July 2018 to align with those changes. That plan was approved. The new Water Resource Management Plan will be incorporated into the 2040 Comprehensive Plan. The plan states that the City will continue to be the local governing unit (LGU), meaning the City is responsible for reviewing and approving all activities regarding stormwater management, erosion control, floodplain alterations, and wetland alterations. The City has a memorandum of understanding that outlines what rules can be administered on behalf of Rice Creek Watershed District. To retain authority, the City will need to update the memorandum of understanding and adopt the new Rice Creek Watershed District rules by reference. One thing to note is that the City has been following these rules since 2004 when they began exercising its LGU authorities. These rules apply to any activity that happens in the City. Juba went on to explain each rule in detail. Staff recommended approval of the ordinance as written. Staff recommended that the Planning Commission open the public hearing and take all comments. Chair asked if there were any questions. Arcand asked staff to clarify that the City had to apply to the Rice Creek Watershed District to be the LGU and Juba confirmed that yes, the City went through the process to become the LGU. Kleissler opened the public hearing at 7:09 pm. Kleissler closed the public hearing at 7:09 pm. Derr commented that to see the stormwater reuse ponds in use today, not just on plans, is really neat and is a tremendous credit to the City. Arcand made motion to approve that the City adopt the Rice Creek Watershed District Rules C, D, E, and F by reference as a standalone ordinance. Derr seconded. All ayes. Motion carried. Planning Commission January 10, 2019 Page 2 Bald Eagle Sportsmen's Association SUP Review — 6557 125th St Weber started with a background on the Bald Eagle Sportsmen's Association and their previous SUP review. The SUP was last reviewed and amended September 22, 2016 when an additional building was added to the property. Condition 19 of the permit states that the permit shall be reviewed prior to December 1 st of the even -numbered years or if the SUP is amended or violated. Staff visited the gun club on December 17, 2018. Staff noticed there are areas of the fence that need to be repaired and maintained, which was discussed with the President of BESA and he stated the fence will be fixed. Weber also stated that no complaints have been made against the BESA in the last few years. Staff is not aware of any violations of the existing permit and finds BESA to be in compliance with the SUP. Staff recommended approval of the SUP review and invited BESA President David Arcand forward if he would like to address the Planning Commission at that time. Mr. Arcand came forward to comment on the fact that very little has changed with the use of the property other than the verbiage the BESA uses to describe the association. They prefer gun and archery club over gun club as currently majority of the facility is used for archery trails. Chair Kleissler asked if there were any questions. Commissioner Fry commented on how well the association is ran and Mr. Arcand responded that they strictly monitor shooting hours on the property as to comply with their permit. The association enforces a penalty for any member who violates these conditions. Derr motioned to renew the SUP for the Bald Eagle Sportsmen's Association for two years, Fry seconded. All ayes. Motion carried. Approval of 2019 Goals Juba reviewed the goals that were discussed at the goal setting workshop on December 20, 2018. The Planning Commission set a goal of zoning ordinance text amendments which involves scheduling regular Ordinance Review Committee meetings and evaluating and revising the shoreland, small cells, subdivision, and PUD sections of the City Code. Staff is currently updating the small cells ordinance. Small cells are small wireless technologies that are put on existing utility or light poles by the wireless providers to boost data. Another goal set by the Planning Commission is to provide training for Commission members that covers procedures and land use training. The last goal topic for 2019 is presentation topics. This includes an overview of existing conditions and future improvements to Highway 61 as well as a recap of design guidelines set for the City. Kleissler asked staff if goals can be amended and Juba responded by saying the goals can be discussed and amended at any time throughout the year. Lessard made a motion to approve the 2019 Planning Commission goals. Arcand seconded. All ayes. Motion carried. DATE: January 16, 2019 for the Planning Commission Meeting of January 24, 2019. ZONING: Restricted Industrial (RI -1) and Future Urban Service (FUS) 1. DESCRPTION OF REQUEST: Thommes and Thomas Land Clearing has a CUP to operate a land clearing business located on 5725 165h Street North. Condition 1 of the permit states that it shall be subject to renewal every 24 months. The last CUP renewal was in June of 2016. Staff visited the property on January 2, 2019 and noted that the applicant has been conducting the same operation on the property but the intensity of the use over the last several years has declined. 2. CONCLUSION/RECOMMENDATION: Staff is not aware of any violations of the existing conditional use permit. The staff finds Thommes and Thomas Land Clearing to be in compliance with the CUP. WHEREAS, the Planning Commission has reviewed said conditional use permit at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the conditional use permit renewal for Thommes and Thomas on property located at 5725. 101' Street, subject to the following conditions: I . This permit shall be subject to renewal every 24 months beginning with the date of approval by the City Council. The Council, upon a recommendation from the Planning Commission, may add conditions to the Conditional Use Permit to mitigate any nuisances that exist on the property. 2. The activities on the site shall be limited to the storage, sorting, chipping, sawing, burning, and sale of tree waste and brush, in accordance with the approved site plan. 3. All burning activities, unless specifically permitted by the City Fire Marshall, shall be conducted within a Mobile Air Curtain Burner approved for such use by the Minnesota Department of Natural Resources and the Minnesota Pollution Control Agency. The burner shall be operated in accordance with the manufacturers standards and recommendations, as well as the rules and regulations of the Minnesota Pollution Control Agency. 4. No open burning is permitted on the site unless specifically permitted by the City Fire Marshall, the Minnesota Department of Natural Resources, and the Minnesota Pollution Control Agency. 5. Hours of operation for the site shall be from 7:00 am. to 7:00 p.m., Monday through Friday, except legal holidays. Hours of operation on Saturday shall be from 7:00 Rm. to 6:00 p.m., except legal holidays. The Mobile Air Curtain Burner shall be allowed to operate 24 hours per day Monday through Saturday, except legal holidays. 6. No machinery, equipment, or vehicles shall be stored on the site, except processing equipment necessary for the conduct of permitted activities. 7. The permitee shall maintain access for fire fighting equipment to all storage areas and processing facilities at all times, as determined adequate by the City Fire Marshall. Resolution 2001- 75 Page 2 8. Access to the site shall be controlled by a gate, which shall be closed and locked at all times an employee of the permitee is not on the site. "No Trespassing" signs shall be posted at the entrance gate. 9. Exterior storage of tree waste on bare ground, and in accordance with the approved site plan, is recognized as a lawful non -conforming use of the property. Pavement of the tree waste storage areas is not required. 10. The pearnitee shall maintain the vegetative screening along the south property line to screen on-site activities from view from adjacent properties and public road right-of- way. 11. The permitee shall reimburse the City for any and all costs the City incurs in responding to fires that occur, on or off the site, due to the permitee's activities on this site. 12. The permitee shall hold the City of Hugo, its employees and agents harmless for all activities undertaken by the permitee under the terms of this permit. The permitee shall maintain liability insurance, naming the City of Hugo as an additional insured, in an amount not less than $1,000,000 for operations undertaken on this site during the duration of this permit. 13. No advertising signs are permitted on the site. 14. Vehicle weight restrictions on public roads shall be observed at all tunes. 15. All brush, wood, refuse, and other materials brought on to the site shall be removed from the site prior to expiration of this permit. 16. The penmitee shall deposit $5,000.00, in cash or security acceptable to the City's Finance Director, with the City to guarantee the permitee's performance under the terms of this permit. Conditional use permit review for property located at 5885 -165th Street North DATE: January 18, 2019, for the Planning Commission Meeting of January 24, 2019. 1. OVERVIEW: Kieger Enterprises has a conditional use permit (CUP) to operate an environmental clean- up business, garden center, and landscaping supply business for property located at 5885- 165t` Street North. On April 15, 2000, the city council approved the CUP for the environmental clean-up business which includes vehicle repair facilities, cold storage, exterior storage of vehicles and equipment, and company offices. On May 8, 2003, the City Council approved an amendment to the conditional use permit to allow a portion of the property to be used as a garden center and a landscape supply business. The conditional use permit amendment was approved subject to seventeen conditions of approval. One of the conditions of approval is that the CUP shall be reviewed and renewed after an initial two year period, with a four year review and renewal period thereafter. On September 16, 2013, the City Council approved the renewal of the CUP and directed staff to review the CUP again in four years to ensure the applicant continues to meet city ordinances and the conditions of approval. The four year review of the CUP is due for review and renewal. 2. ANALYSIS: Upon inspection of the property on October 22, 2018, staff observed that an additional building was constructed on the property without a building permit. Further, condition number 11 in the CUP states that "the number of buildings, amount outdoor storage, and uses identified on the site plan dated February 14, 2000 and the application dated April Kieger CUP Page 2 15, 2000, shall not be enlarged or expanded, unless a new conditional use permit is applied for and approved". The applicant did not apply for a CUP amendment or receive approval of a building permit for the building. Further, the building does not meet the commercial and industrial construction standards and would not receive approval from staff. Staff has discussed this with the applicant and the applicant has agreed to remove the building from the property prior to June 1, 2019. Staff is comfortable with this proposal and has added it as a condition of approval of the CUP review in the attached resolution. If the applicant does not remove the building prior to June 1, 2019, the applicant will be in violation of the CUP and staff will initiate the process of revoking the CUP because of non-compliance. The property is generally maintained and meets the remaining conditions outlined in their CUP. There are a few new businesses located on the property and all are similar in nature to what is allowed by the CUP. Staff is not aware of any complaints or issues related to the operation of Kieger enterprises. 3. RECOMMENDATION: Staff recommends renewal of the CUP for Kieger Enterprises with the condition that the building is removed from the property prior to June 1, 2019. The CUP shall be reviewed at that time and again in four years to ensure Kieger Enterprises continues to meet all city ordinances and conditions of approval. ATTACHMENTS: 1. Location Map 2. The conditional use permit also allows for a landscape supply and garden center on the property. The applicant shall obtain the necessary permits from Washington County for the storage of any hazardous waste material. 11. The number of buildings, amount of outside storage, and uses identified on the site plan dated February 14, 2000 and the application dated April 15, 2000 shall not be enlarged or expanded, unless a new conditional use permit is applied for and approved. 12. There shall be no outside storage of any junk or inoperable equipment or vehicles. 13. The normal hours of operation shall be limited to 7:00 am. to 7.00 pxn., Monday through Friday and 7.00 a.m. to 2:00 p.m. on Saturday for all maintenance and operation of equipment on the site (including the moving of vehicles on and off the Resolution 2003-17 Page 3 site), unless it is for the purpose of mobilizing equipment in response to an emergency, or for street cleaning or snow plowing operations. 14. The garden center and landscape supply business shall be allowed to operate from 7:00 a.m. to 8:00 p.m., Monday through Saturday, and 10:00 am. to 4:00 p.m. on Sunday (the Environmental Cleanup Building must comply with the hours listed in condition 13), provided no heavy equipment is used A small bobcat may be used to load vehicles. The garden anter and landscape supply business shall comply with the existing hours of operation on Monday through Saturday. 15. One monument advertising sign not to exceed 40 square feet and one business identification/direction sign not to exceed 32 square feet shall be permitted on the property. The signs shall not exceed 10 feet in height. 16. None of the existing buildings located on the property shall be used for retail sales. 17. The applicant shall maintain the emergency vehicle access and circulation route as indicated on the plans received by the City on August 1, 2000. 10. All hazardous waste and non -recyclable waste products produced by the applicant's business and other operations on the site shall be disposed of in accordance with applicable local, County, State, and Federal laws. The applicant shall obtain the necessary permits from Washington County for the storage of any hazardous waste material. 11. The number of buildings, amount of outside storage, and uses identified on the site plan dated February 14, 2000 and the application dated April 15, 2000 shall not be enlarged or expanded, unless a new conditional use permit is applied for and approved. 12. There shall be no outside storage of any junk or inoperable equipment or vehicles. 13.
