HomeMy WebLinkAboutPC 01.10.19Minutes for the Planning Commission Meeting of Thursday, January 10, 2019 Chair Kleissler called the meeting to order at 7:01 p.m. PRESENT: Arcand, Derr, Fry, Kleissler, Lessard, Luchsinger, Mulvihill, Tjemiund. ABSENT: None. STAFF: Rachel Juba, Community Development Director Emily Weber, Community Development Assistant Approval of Minutes for the Planning Commission Meeting of October 25, 2018 Commissioner Arcand made a motion, seconded by Commissioner Tj emlund, to approve minutes for the meeting of October 25, 2018. All Ayes. Motion carried. Ordinance Adopting Rice Creek Watershed District by Reference Juba started by giving background information on the City's Water Resource Management Plan, which guides the City on administration and implementation on all stormwater management practices in the City. The plan was approved by the City Council in 2015 and at that time the City put together goals and policies that were intended to guide the City moving forward. Since then, the Rice Creek Watershed District went through rule changes so the City sent out the new plan in July 2018 to align with those changes. That plan was approved. The new Water Resource Management Plan will be incorporated into the 2040 Comprehensive Plan. The plan states that the City will continue to be the local governing unit (LGU), meaning the City is responsible for reviewing and approving all activities regarding stormwater management, erosion control, floodplain alterations, and wetland alterations. The City has a memorandum of understanding that outlines what rules can be administered on behalf of Rice Creek Watershed District. To retain authority, the City will need to update the memorandum of understanding and adopt the new Rice Creek Watershed District rules by reference. One thing to note is that the City has been following these rules since 2004 when they began exercising its LGU authorities. These rules apply to any activity that happens in the City. Juba went on to explain each rule in detail. Staff recommended approval of the ordinance as written. Staff recommended that the Planning Commission open the public hearing and take all comments. Chair asked if there were any questions. Arcand asked staff to clarify that the City had to apply to the Rice Creek Watershed District to be the LGU and Juba confirmed that yes, the City went through the process to become the LGU. Kleissler opened the public hearing at 7:09 pm. Kleissler closed the public hearing at 7:09 pm. Derr commented that to see the stormwater reuse ponds in use today, not just on plans, is really neat and is a tremendous credit to the City. Arcand made motion to approve that the City adopt the Rice Creek Watershed District Rules C, D, E, and F by reference as a standalone ordinance. Derr seconded. All ayes. Motion carried. Planning Commission January 10, 2019 Page 2 Bald Eagle Sportsmen's Association SUP Review — 6557 125th St Weber started with a background on the Bald Eagle Sportsmen's Association and their previous SUP review. The SUP was last reviewed and amended September 22, 2016 when an additional building was added to the property. Condition 19 of the permit states that the permit shall be reviewed prior to December 1 st of the even -numbered years or if the SUP is amended or violated. Staff visited the gun club on December 17, 2018. Staff noticed there are areas of the fence that need to be repaired and maintained, which was discussed with the President of BESA and he stated the fence will be fixed. Weber also stated that no complaints have been made against the BESA in the last few years. Staff is not aware of any violations of the existing permit and finds BESA to be in compliance with the SUP. Staff recommended approval of the SUP review and invited BESA President David Arcand forward if he would like to address the Planning Commission at that time. Mr. Arcand came forward to comment on the fact that very little has changed with the use of the property other than the verbiage the BESA uses to describe the association. They prefer gun and archery club over gun club as currently majority of the facility is used for archery trails. Chair Kleissler asked if there were any questions. Commissioner Fry commented on how well the association is ran and Mr. Arcand responded that they strictly monitor shooting hours on the property as to comply with their permit. The association enforces a penalty for any member who violates these conditions. Derr motioned to renew the SUP for the Bald Eagle Sportsmen's Association for two years, Fry seconded. All ayes. Motion carried. Approval of 2019 Goals Juba reviewed the goals that were discussed at the goal setting workshop on December 20, 2018. The Planning Commission set a goal of zoning ordinance text amendments which involves scheduling regular Ordinance Review Committee meetings and evaluating and revising the shoreland, small cells, subdivision, and PUD sections of the City Code. Staff is currently updating the small cells ordinance. Small cells are small wireless technologies that are put on existing utility or light poles by the wireless providers to boost data. Another goal set by the Planning Commission is to provide training for Commission members that covers procedures and land use training. The last goal topic for 2019 is presentation topics. This includes an overview of existing conditions and future improvements to Highway 61 as well as a recap of design guidelines set for the City. Kleissler asked staff if goals can be amended and Juba responded by saying the goals can be discussed and amended at any time throughout the year. Lessard made a motion to approve the 2019 Planning Commission goals. Arcand seconded. All ayes. Motion carried.
