G.1 Donation to Yellow Ribbon Network — Bayport Gambling Manager Kelly Green The Bayport American Legion conducts gambling at Sal's Angus Grill. Bayport Legion Gambling Manager Kelly Green will present a donation to the Hugo Yellow Ribbon Network. G.2 Presentation of Commissioners Award - Commissioner Miron Washington County Commissioner Fran Miron will present the Commissioners Award to Council Member Beck Petryk for her work on the Transportation Advisory Board on behalf of Washington County. G.3 Sheriff Department Annual Report — Sheriff Dan Starry Sheriff Dan Starry will present to Council the Sheriff's Department's Annual Report for 2018. GA Good Neighbor Days — Lions Members Dan Balthazor The Hugo Good Neighbor Days Festival will be held Thursday, June 6th - Sunday, June 9th in Lions Park. The Hugo Lions Club will run the event similar to past years to include a parade, music, food, beer garden, petting zoo, carnival rides, and fireworks. Lions Dan Balthazor will be in attendance to answer any questions the Council may have and will request the Council co- sponsor the event by waiving the Special Event Permit fee and providing police services for the event, as in the past. H.1 Approval of Claims Staff recommends Council approve the Claims Roster as presented. H.2 Approve Annual Performance Review for Parks Planner Shayla Denaway Shayla Denaway was hired on May 11, 2009, as the Economic Development/Parks Intern. On May 3, 2010, Council approved promoting Shayla as the new Parks Planner. Public Works Director Scott Anderson recommends approval of the annual performance review for Parks Planner Shayla Denaway H.3 Approve Renewal of 2 a.m. License for the Blue Heron Grill Since May 2010, the Blue Heron Grill has held a license that permits the establishment to stay open until 2 a.m. This license is renewed annually with approval by the City Council. Staff recommends Council approve the renewal of the 2 a.m. license for the Blue Heron Grill. HA Approve Renewal of 2 a.m. License for Sal's Angus Grill Since May 2010, Sal's Angus Grill has held a license that permits the establishment to stay open until 2 a.m. This license is renewed annually with approval by the City Council. Staff recommends Council approve the renewal of the 2 a.m. license for Sal's Angus Grill. H.5 Approve Hiring of Public Works Seasonal Employees In the 2019 General Fund Budget, Council approved funding for six seasonal employee positions. Staff has spoken to several employees from last year who would like to return again this year. One of the positions is filled by two employees each working part time. Therefore, a total of seven employees are needed to fill the six seasonal positions. Seasonal Public Works Employees assist with mowing, garbage/litter removal, park maintenance, boulevard maintenance and general public works maintenance. Staff recommends Council approve the hire/re-hire of seasonal employees Jack Menne, Roland Guareschi, Marty Schwartz, Frank Weiss, Daniel Flaherty, Paxton Zirpel, and Zachary Kenoyer for the public works department. H.6 Approve Temporary On -sale Liquor License for the Lions Club for Good Neighbor Days The Hugo Lions Club has applied for a temporary on -sale liquor license to serve beer and Bloody Marys at the Hugo Good Neighbor Days festival June 6-9, 2019. Staff recommends Council approve the temporary on -sale liquor license for Good Neighbor Days. H.7 Approve Off -Site Gambling Permit for Hugo Legion for Good Neighbor Days Bingo The Hugo American Legion has applied for an Off -Site Gambling Permit to conduct Bingo at Hugo Good Neighbor days on June 6-9, 2019, at Lions Park. Staff recommends Council approve the Off -Site Gambling Permit for Good Neighbor Days. H.8 Approve Resolution for Planned Unit Development (PUD) Amendment for Adelaide Landing OP5 Adelaide (Excelsior Group) is requesting approval of a PUD Amendment to change the 70- foot wide single family lots to 65-foot wide single family lots. With the proposed PUD amendment and the previous PUD modifications, their total proposed lots would be 324, where 319 was approved with the original PUD request. The PUD amendment is consistent with the City's Comprehensive Plan and the approved Adelaide Landing PUD. The Planning Commission agreed that the proposed amendment was reasonable and it would not noticeably change the overall plan for the PUD. The Planning Commission unanimously recommended approval of the PUD amendment for OP5 Adelaide (Excelsior Group) for the development to be known as "Adelaide Landing", subject to the conditions listed in the resolutions. Staff recommends Council approve the Resolution approving the PUD amendment. H.9 Approve Resolution for Board of Trustees Request for Increase in Lump -Sum Pension The Board of Trustees for the Hugo Firefighter's Relief Association has formally requested City Council ratification of an increase of $100 per year of service in their lump -sum pension benefit. The Finance Department had reviewed this request and found it to be financially feasible and consistent with the Pension Fiscal Policy adopted in April, 2012. The Finance Department recommends the City Council ratify the Board of Trustees' request for a $100 increase in their lump -sum pension benefit and corresponding change to their by-laws. H.10 Accept Donation from the Bayport American Legion to the Hugo Fire Department The Bayport American Legion conducts gambling at Sal's Angus Grill and has donated $5,000 to Hugo Fire Department. The Gambling Control Board requires approval of contributions to a unit of government. Staff recommends Council approve the donation from the Bayport American Legion of $5,000 to the Hugo Fire Department. H.11 Accept Donation from the Hugo American Legion to the Hugo Fire Department The Hugo American Legion and has donated $200 to Hugo Fire Department from its gambling proceeds. The Gambling Control Board requires approval of contributions to a unit of government. Staff recommends Council approve the donation from the Hugo American Legion of $200 to the Hugo Fire Department. I.1 130th Street Roundabout Improvement Project Bids for the 130th Street Improvement Project were received on April 30, 2019. A total of four bids were received with bids ranging from $2,650,716.57 to $3,188,066.71. The engineers estimate was $2,814,416.00. The low bidder is Dresel Contracting, Inc. who staff is familiar with and have had great success with on past projects. Staff is recommending the City Council consider these bids and approve the resolution awarding the contract in the amount of $2,650,716.57 to Dresel Contracting, Inc. based on the results of the bids received. I.2 Approve Award of Bid for 2019 Dust Control Protect Public Works Director, Scott Anderson, will provide the Council with the results of the bid opening for the Gravel Roads Dust Control project. J.1 Update on Gravel Roads For a number of years, Hugo has had performance issues with a number of its gravel roads. In 2018, the City Council authorized further evaluation of these gravel roads and a number of work sessions followed. The results of the information gathering and work sessions was to reclaim the gravel roads (mix the layers of existing gravel within the road structure), yielding a better gradation of material. Ingersoll Ave, 175th Street, Inwood Ave, and 180th Street (1.67 miles) were completed in 2018, and are now performing very well. Staff is recommending that the City completed the remaining 5.5 miles of problematic gravel roadways in 2019 at an estimated cost of $40,000. K.1 Discussion on "No Parking" Resolution for Rosemary Way At the April 15th City Council meeting, Council considered the Site Plan and Conditional Use Permit for the Rosemary Apartments. During the discussion, a comment regarding parking on Rosemary Way had come up from an individual in the audience. Rosemary Way is currently designed as a 32-ft wide roadway and is part of our State Aid Roadway system. Currently, there are not any parking restrictions along Rosemary Way. A number of options exist such as leaving the roadway with no parking restrictions, restrict parking on only one side, and restrict parking on both sides. Rosemary Way is a state aid roadway: however, the width doesn't meet their requirements for parking on both sides of the roadway and the long-term plan for Rosemary Way (as identified in the Comprehensive Plan), would not include parking along Rosemary Way. For that reason, staff recommends approving the attached no parking resolution and posting Rosemary Way as no parking. L.1 Update on the Yellow Ribbon Network Council Member Chuck Haas and Phil Klein will report to Council on the Yellow Ribbon Network activities held recently. N.1 Schedule Annual Performance Review for City Administrator Bryan Bear Bryan Bear has been employed with the City since May 3, 2004. Bryan served as the Community Development Director until being appointed the City Administrator on November, 7, 2011. Staff requests Council schedule the annual performance review for City Administrator Bryan Bear. N.2 Community Parks Funding Workshop on Mondav, May 13, 2019 Council has scheduled a workshop for Monday, May 13, 2019, to evaluate options for funding of improvements to community parks such as Lions Park, Irish Avenue Park, and Clearwater Creek Preserve Park. The workshop will be held in the City Hall Council Chambers at 7 p.m. N.3 130tl Street Neighborhood Meeting on Tuesday, May 14, 2019 A meeting with residents in the 130th Street neighborhood has been scheduled for Tuesday, May 14, 2019, to discuss the roundabout and street improvements. The meeting will be held in the Council chambers at City Hall from 7-8 p.m. Staff recommends Council schedule this as a meeting if they choose to attend. NA Law Enforcement Memorial Day on Wednesday, May 15, 2019 The Council has scheduled a meeting to attend the Law Enforcement Memorial Day service at the Historic Courthouse in Stillwater at noon on May 15, 2019. This event is hosted by the Washington County Sheriff's Office to honor Peace Officers and Correction Officers who have fallen in the line of duty. N.5 Fire Department Waffle Breakfast and Ladder Truck Ribbon Cutting on Saturday, May 18, 2019 The Council has scheduled a meeting to attend the Hugo Fire Department's first Waffle Breakfast on Saturday, May 18, 2019, from 8:30 — 11:30 a.m. at the Hugo Fire Station. A Ribbon Cutting for the new ladder truck will take place following the breakfast between noon and 12:30 p.m. N.6 Celebration of Waters Edge Stormwater Reuse Proiect on Wednesday, May 22, 2019 The Waters Edge Homeowner Association would like to celebrate the second season of their stormwater reuse project and hold a ceremonial "Flip the Switch" event to turn on their irrigation system and promote Phase II of the project. It has been suggested the event be held on Wednesday, May 22, 2019, at 3:30 p.m. Staff recommends Council schedule this as a meeting or suggest a different date/time that would work best. N.7 Schedule Workshop with Victor Gardens North Village HOA for Monday, June 24, 2019 At its April 15, 2019, meeting, Council directed staff to schedule a meeting with the Victor Gardens North Village HOA to discuss issues raised at the meeting including the roundabout, traffic, and parks. Staff recommends Council schedule a meeting for Monday, June 24, 2019, at 7 p.m. O. Five property owners appeared before the board. The board was also presented with eight maintenance changes from the County. Hugo City Council Meeting Minutes for April 15, 2019 Page 2 of 10 Presentation of Certificates of Appreciation to Forest Lake High School Students Council Member Haas presented Certificates of Appreciation to Forest Lake High School Students Tayler Williamson and Mikayla Whitehill for their volunteer efforts supporting the Yellow Ribbon Network. Tayler and Mikayla organized a packing event at the Forest Lake High School. They collected coffee and money for postage. Approve Scope of Work for Public Works Facilities Study With direction from the City Council's goals and priorities, City staff had solicited proposals for a Public Works Department building space needs study. City Administrator Bryan Bear, Public Works Director Scott Anderson, and Lead Worker Mike Loeffler met with several firms experienced in site and building planning and design. After comparing three proposals based on price, experience, and references, staff had recommended acceptance of the proposal submitted by Jeffery Oertel of Oertel Architects in the amount of $12,500. Oertel Architects has extensive experience in the planning and design of public works facilities and understood the needs of a Public Works Department. Adoption of the Consent Agenda approved the acceptance of the proposal submitted by Jeffery Oertel of Oertel Architects in the amount of $12,500. Hugo City Council Meeting Minutes for April 15, 2019 Page 3 of 10 Approve Special Event Permit for New Life Church Summer and Fall Events New Life Church, 6000 148th Street North, had applied for a Special Event Permit to hold outdoor events on Sunday, June 9 and Sunday October 6, 2019. A Special Event Permit approved by Council was required because they would be using an amplified sound system. The June event will be an outdoor service at 9 a.m. followed by a potluck. The October event will be an outdoor gathering from 2-5:30 p.m. with a small band, hayrides, and outdoor games. Adoption of the Consent Agenda approved the Special Event Permit for New Life Church for their Spring and Fall events. Approve Extension of Site Plan and Variances for Multifeeder Technology in the Bald Eagle Industrial Park At its August 6, 2007, meeting, the City Council approved the site plan and variances for a 28,000 square foot manufacturing building submitted by Multifeeder Technology. Approval for site plans expire one year after City Council approval if a building permit is not approved and construction has not started on the building. The applicant did not construct the building and requested an extension of the site plan and variance approvals. Adoption of the Consent Agenda approved the extension of the site plan and variances, subject to all conditions listed in the approving resolutions. Approve Matt Drew as Safety Lieutenant on the Hugo Fire Department Matt Drew joined the fire department in December, 2015, and became a regular firefighter in December, 2017, after completing all probation requirements. Fire Chief Kevin Colvard recommended Matt Drew be appointed as the new Safety Lieutenant. Adoption of the Consent Agenda approved Matt Drew as Safety Lieutenant on the Hugo Fire Department effective April 1, 2019. Approve Lawful Gambling Exempt Permit for MSOLE at the Hugo Legion on June 9, 2019 Minnesota Supporting our Law Enforcement (MSOLE) had applied for a Lawful Gambling Exempt Permit to conduct raffles at their event on Sunday, June 9, 2019, to be held at the Hugo American Legion. Permits are issued by the MN Gambling Control Board but must first be approved by the City. Adoption of the Consent Agenda approved the Lawful Gambling Exempt Permit for MSOLE for their June 9, 2019, event. Approve Resolution Approving Application for CDA Grant for Hopkins Schoolhouse At its February 4, 2019, meeting, Council approved the marketing of the Hopkins Schoolhouse for a public/private partnership as recommended by the Hopkins Schoolhouse Committee. The Washington County Community Development Agency provides grants for projects intended to increase redevelopment readiness, spur new business, or assist with removing blighted properties. Staff had received a proposal from WSB to complete a Phase I Environmental Site Assessment, Asbestos and Regulated Materials Survey, and Land Survey for $8,080. Grants in amounts less than $10,000 required a match of $.20 to every $1. Adoption of the Consent Agenda approved the RESOLUTION NO.2019-16 APPROVING APPLICATION FOR PREDEVELOPMENT FINANCE FUNDING FOR HOPKINS SCHOOLHOUSE. Hugo City Council Meeting Minutes for April 15, 2019 Page 4 of 10 Approve Wetland Replacement Plan for Rosemary Apartments To accommodate the construction of a 45-unit apartment complex along Rosemary Way, MAT Properties submitted an application requesting approval to impact wetlands found on site. The applicant was proposing to impact 0.05 acres of wetland. Impacts are to two separate wetlands on the property and will impact a portion on the east side of the project and a portion on the west side of the project. MWF Properties was proposing to replace the wetlands that are impacted through the purchase of wetland credits from an existing approved wetland bank in Rosemary Way Mitigation Area. Based on staff s review of the application and supporting documentation, the requirements under the MN Wetland Conservation Act (WCA) had been met. Adoption of the Consent Agenda approved the MWF Properties application for sequencing and wetland replacement. Approve Wetland Replacement Plan for 165th Street Solar Farm To accommodate the development of a solar facility along 165th Street, Sunrise Energy Ventures (FastSun4, LLC) had submitted a revised application based on a previous joint application that was approved in November 2018. The revision included an increase in avoidable wetland impact that requires replacement from 0.165 acres to 0.197 acres. The applicant was proposing to replace the additional wetlands that are impacted through the purchase of wetland credits. Based on staff s review of the application and supporting documentation, the requirements under the MN Wetland Conservation Act (WCA) had been met. Adoption of the Consent Agenda approved the Sunrise Energy Ventures application for sequencing and wetland replacement. Approve Resolutions Approving Oneka Place 3rd Addition Final Plat and Development Agreement CPDC — Pratt — Oakwood, LLP, had requested approval of a final plat and development agreement to plat 54 residential lots and 3 outlots from the Oneka Place preliminary plat. This will develop a 13.7 acre piece of property legally described as Outlots J and K, Oneka Place. The site was currently vacant. The lots met the minimum lot standards and requirements for the Oneka Place PUD. Adoption of the Consent Agenda approved RESOLUTION 2019-17 APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR CPDC — PRATT — OAKWOOD, LLP, ON PROPERTY LOCATED NORTH OF ONEKA PARKWAY AND NORTH OF 159TH STREET FOR ONEKA PLACE 2nd ADDITION. Update on Waters Edge Water Reuse Project Phase II At the April 1, 2019, City Council meeting, the City Council approved the Rice Creek Watershed District Cost -Share Agreement for the Water's Edge Phase 2 Water Reuse Improvement Project. City Engineer Mark Erichson provided a summary of the Phase I project that retrofitted the existing irrigation system to irrigate 30 acres using stormwater instead of City potable water. This project was done in partnership with the Rice Creek Watershed District, Metropolitan Council, and the Waters Edge Homeowner Association. The HOA now wanted to expand the project to irrigate another 40 acres, and the RCWD has agreed to provide a grant of $185,760. Like Phase One, the system would be maintained by the HOA, and they would pay the annual water bill to the City to recover costs. Both projects will save an estimated 20-30 million gallons of water, which reduces the construction of future water infrastructure, cleans up stormwater, and makes it Hugo City Council Meeting Minutes for April 15, 2019 Page 5 of 10 less expensive for the HOA to irrigate. Erichson explained the next steps included developing a work plan, finalizing agreements and having a neighborhood meeting. Klein thanked Erichson and the Waters Edge HOA for being the first HOA to convert their water system. Klein made motion, Petryk seconded, to approve RESOLUTION 2019-18 AUTHORIZING PREPARATION OF PLANS AND SPECIFICATIONS FOR THE WATER'S EDGE PHASE II WATER REUSE IMPROVEMENT PROJECT. All Ayes. Rosemary Apartments Site Plan, CUP, and Frenchman Place 4th Addition Final Plat MWF Properties had requested approval of a site plan and Conditional Use Permit (CUP) for a three story approximately 80,000 square foot apartment building (including an underground parking lot) for property located north of Rosemary Way and west of Everton Avenue. Community Development Director Rachel Juba explained that apartments are allowed in the Medium Density Multiple Family Residential (R-5) with a CUP. The property is 18.15 acres, including several wetlands for a total of 4.6 acres buildable, and the density of the project would be ten units per acre, meeting the zoning district regulations. The applicant was also requesting approval of a final plat for Frenchman Place 3rd Addition, consistent with the preliminary plat. Juba updated the Council on the public hearing held at the Planning Commission meeting on March 28, 2019. The Planning Commission generally liked the plan but had a few questions on the building height, parking, drainage, and architecture. There were a number of residents that spoke at the meeting and raised concerns about affordable housing, building height, storm water drainage, parking, fire protection, and park space. Juba responded to the comments explaining how they met City Code. She stated that whether or not it is affordable housing is not addressed in the Code. There would be a need for a variance if the building was to be over 35 feet in height, and it was acknowledged there is a lack of parks in the area. She stated the developers will be the owners, and they will have an onsite management company. The Planning Commission recommended approval of the applications, subject to the conditions on the resolutions, by a vote of 6 to 1. The nay vote resulted from a concern that the project did not meet the character of the area. Juba explained that after the public hearing, staff was contacted by Everton Avenue residents and a meeting was held on April 8 to talk about drainage in their area. It was also noted that the area was master planned in 2008, and it was proposed then to use this lot for an apartment building. Juba explained the criteria of approval for a CUP and how the project met it. She explained that if the standards and criteria are met, the Council must approve it. Whether it is an affordable housing project is irrelevant, and she explained it would be Section 42 housing, which is very different from Section 8. Petryk asked if there were age restriction guidelines and occupancy numbers. She also questioned the ability to get to the school by sidewalk. Juba responded there were trails along Rosemary Way but no trails along Everton Avenue. She referred the other questions to the developer. Petryk stated she liked the underground parking and the onsite management. Hugo City Council Meeting Minutes for April 15, 2019 Page 6 of 10 Haas talked about the renderings and stated it would be nice to have a more substantial area for a park. He asked if there was any stormwater reuse in the project, and Rachel responded that there would not be enough water on the property to accommodate water reuse. Miron talked about the surrounding properties and asked what could occupy the Commercial Zoning District to the south. Juba responded that it was a general business district that included a lot of uses. Klein talked about the height of the apartment building in relation to the heights of other buildings in the area, and he didn't seem to think that it would be out of place. He addressed the concern about income and said the occupants would be workers, and an affordable place to live made sense. Mayor Weidt acknowledged the residents in the audience and opened the floor to allow public comment. Arnie Triemert, 15220 Everton Avenue North, stated he was still concerned about the water and he wanted something in writing saying that if it floods, it will be taken care of. City Administrator Bryan Bear said the City could provide the information to him for his review, and all calculations indicated there would not be a problem. John Udstuen, 15190 Everton Avenue North, thanked staff and Council for listening to what was being said. He stated the developer has a responsibility to do more for the kids. He talked about the ordinance not addressing the raising of grades to increase building height, and stated the variance to height should not be allowed. Erin Kimball, 4505 Rosemary Way, was concerned about parks and kids playing in the streets. She had presented a petition to Council with 51 signatures of people who opposed the project. She asked that Council consider the residents already living in the area. Doug Millard, 4470 Rosemary Way, was concerned about the increased traffic on Rosemary Way stating there was a tractor trailer that had been parked there causing sight issues. He also commented on the height of the building and the eight -foot pad that would be built to accommodate underground parking. Shawna Kelsey, 4503 Rosemary Way, said she was concerned over the lower income housing with single parent families, lack of a bus line nearby, and the safety of kids playing in street. Catherine Clark, 4498 Rosemary Way, talked about the roundabout and how their association maintains it. She said the semis from Festivals Foods are ruining it, and she was concerned about the increase in traffic there. There were no more comments, and Mayor Weidt closed the public hearing. Rachel addressed the comments about the pad and height of the building saying that all developments typically need to be raised to meet groundwater separation requirements. She also addressed the roundabout saying the City maintains the road and the HOA maintains the landscaping. Hugo City Council Meeting Minutes for April 15, 2019 Page 7 of 10 Council noted that the roundabout was a separate issue from this application. They asked the City Engineer to address Rosemary Way. City Engineer Mark Erichson stated it was a state aid route and an alternative to the County road. He stated it was designed to carry the anticipated volume of traffic, and staff could look into "no parking" on that road. The Mayor invited Property Development Manager Chris Stokka, 7645 Lindale Avenue South, Richfield, up to the podium to speak. In response to Council questions, he stated that they have 10-20% senior population in their buildings, but most are younger. The maximum capacity per unit is generally two residents per bedroom. The tot lot is the same as the ones they have used in 60-unit developments. There would also be an indoor community room and fitness center. He stated that parking, based on other developments, has shown that two stalls per unit is more than enough, and they have more than that. Underground units would be assigned, and surface stall are unassigned. There is no designated guest parking. Stokka talked about onsite management saying there is an onsite manager, maintenance worker, and caretaker. Their policy is to have one of them live onsite and someone always available by phone. Weidt stated they needed to add amenities to the playground and invest more into it. He asked how many they have built and operated. Stokka replied there will be 30 by the end of the year, and they have all been Section 42. They built in Forest Lake in 2012 and 2016, and there are few vacancies. Stokka stated they do credit and criminal background checks and require landlord references. They also look for income limits to see if they qualify and have the ability to pay rent. Stokka talked about building height saying they did submit a variance request. He said he thought the site limitations warranted a variance, and they plan to leave it at 38 '/2 feet. City Administrator Bryan Bear stated that the variance was not under review for this evening, and there was no guarantee it would be approved. City Attorney Dave Snyder reviewed with Council the analytical framework to use when considering a CUP. The application needed to be judged by the strict requirements of the zoning code. If it's concluded that the applicant has met the criteria in the ordinance, the courts have indicated they are entitled to a permit. Snyder talked about Section 8 as opposed to Section 42 and income levels stating those are areas beyond the scope of a zoning request and have no bearing on the outcome of the decision. Questions about property values and traffic are natural inquires, but what the courts have insisted on is that there needed to be objectionable evidence. In staff s view, the request met the limited criteria, and there have been enhancements to the project that the City could not force. He reminded Council of the limited discretion they work with, and he requested they focus on the evaluation criteria. He added that there has been enough discussion to have afforded amenities to the project that would not otherwise have been there. Weidt talked about the City's mix of housing types and the City's goal to provide an opportunity for people to afford to live in Hugo. He indicated this location was a good place for this housing type in Hugo, and for those reasons, he supported the development. He acknowledged the need for a park. Update on the Yellow Ribbon Network Council Members Chuck Haas and Phil Klein updated the Council on the activities of the Yellow Ribbon Network to date. Haas showed photos of cards the Girl Scouts sent to the troops with cookies. He talked about Minnesota National Guard State Chaplain Buddy Winn's annual Christmas show where he mentioned the command hooks the YRN had sent all over. The YRN received a memorial donation of $500 and company donations from volunteers. The Council of Catholic Women raised over $2,000 in a bake sale and sent the YRN a check for $300. They recently held the Welcome Home Pheasant hunt for 8 5 1 " Vertical Engineering Company. Wild Wings donated an additional 85 pheasants to the soldiers along with pheasant recipes. The YRN assisted a solider with medical issues. Burger night this month will be hosted by the Washington County Sheriff's Office. The American Legion mistakenly scheduled their open house for the kitchen that night, which they will be rescheduling. PLANNING COMMISSION UPDATE: At its April 25, 2019, meeting the Planning Commission held a public hearing and considered the request. There were two residents that spoke during the public hearing. They had questions about tree preservation and the landscape plan. Staff stated that they are preserving additional trees on the northeast portion of the development, that were previously planned to be removed. A new landscape plan will be reviewed and approve with a final plat application that would include that area. The Planning Commission agreed that the proposed amendment was reasonable and it would not noticeably change the overall plan for the PUD. The Planning Commission unanimously recommended approval of the PUD amendment to the City Council, subject to the conditions listed in the resolution. 2. DESCRIPTION OF REQUEST: The applicant is requesting approval of a PUD amendment to change the 70-foot wide single family lots to 65-foot wide single family lots. There was a previous administratively approved PUD modification that allowed a revision to the plan that changed six 85-foot side lots to eight 65-foot wide lots, adding 2 additional lots to the overall development. With the proposed PUD Page 2 amendment and the previous PUD medication, there total proposed lots would be 324, where 319 was approved with the original PUD request. 2. BACKGROUND: The applicant has approval of a Preliminary Plat and Planned Unit Development (PUD) for a residential development. The property totals 216.6 acres. The property includes wetlands and floodplain for a total buildable acreage of 146.2 acres. The development was approved to include 319 single family residential lots. CONTEXT: A. Surrounding land Use and Zoning The property to the north is zoned Low Density Multiple Family Residential (R-4) and occupied by the Pineview Meadows townhome development. The properties to the east, south, and west are zoned Single Family Detached Residential (R-3) and occupied by the Country Ponds, Beaver Ponds, and Birch Tree Ponds residential developments. The properties to the west, across Page 3 Highway 61, are zoning General Industrial (I-3) and are occupied by industrial uses. There are also a few vacant parcels to the east that are also zoned Single Family Detached Residential (R- 3). B. Natural Characteristics of Site The properties are currently vacant and do contain some challenges regarding an existing drainage ditch, floodplain, and high ground water. The properties are relatively flat with approximately 57 acres of wetlands. The area south of the Xcel Energy powerlines has been graded and three phases have started for the development. There have been 70 building permits issued for new homes in the development. 4. ANALYSIS: A. Level of Discretion in Decision Making The City has relatively high level of discretion in approving a PUD. A PUD must be consistent with the City's comprehensive plan. The City may impose reasonable requirements in a PUD not otherwise required if the City deems it necessary to promote the general health, safety, and welfare of the community. B. Consistency with Ordinance Standards Planned Unit Development The 2030 Comprehensive Plan shows the land use being Low Density Residential (LD). The PUD is consistent with the Comprehensive Plan in terms of land use and density. The Adelaide Landing PUD general plan has offered a creative and efficient method to planning the site, all which meets the intent of the PUD ordinance. It is in staff s opinion that the PUD amendment meets the intent of the PUD ordinance, and is consistent with the PUD general plan. The applicant is proposing a residential net density of 2.2 units per 1 acre, which fits the requirements of a PUD. Although the applicant is requesting flexibility on lot sizes and setbacks, the density meets the ordinance standards. Parks/Trails A majority of the trails have been graded in the development and boardwalks are being installed. The trails will be paved this spring. The remaining land for the park is to be dedicated with Adelaide Landing 4th Addition that is likely to be completed this year. The Parks Commission has been discussing partnering on the installation of the park improvement with the developer. The goal of the Parks Commission and developer is that the park improvements, including a parking lot, will be completed this year. Grading In response to neighbors' concerns over preserving an existing tree line in the northeast corner of the development, changes have been made to the plans. Most of the trees were planned to be removed in this area to accommodate a stormwater pond and storm sewer pipe. The developer has reviewed the plans and agree that the a revision to the plan to preserve as many trees as they can would be reasonable. The developer has made revisions to preserve at least 15 feet, and in some areas much more, of trees in this areas. The developer relocated the storm sewer pipe on the plans to avoid the need to disturb the area and trees. 5. CONCLUSION: Staff believes that the layout of the proposed Adelaide Landing PUD general plan exceeds the City's standards for residential developments. The developer has offered a more creative and efficient approach to the existing constraints of the property through the site design layout. The PUD amendment is consistent with the City's Comprehensive Plan and the approved Adelaide Landing PUD. It is in staff s opinion that the applicant meets all the requirements necessary to approve the PUD amendment. 6. STAFF RECOMMENDATION: Staff recommends approval of the PUD amendment for OP5 Adelaide (Excelsior Group) for the development to be known as "Adelaide Landing", subject to the conditions listed in the resolutions. Page 5 7. PLANNING COMMISSION RECOMMENDATION: The Planning Commission agreed that the proposed amendment was reasonable and it would not noticeably change the overall plan for the PUD. The PUD general plan was approved to allow the creation of 319 single family residential lots and 10 outlots. OP5 Adelaide, LLC has been developing Adelaide Landing per the approved Preliminary Plat and PUD since 2017. Currently, I" and 2nd Additions are substantially completed with 150 finished lots in the process of being purchased for home construction by our builder partners, MI Homes, Creative Homes and Derrick Custom Homes. 3`d Addition was granted Final Plat approval by the City Council February 2019 and is expected to be substantially complete Summer 2019. GENERAL DESCRIPTION OF REQUEST OP5 Adelaide is requesting a PUD Amendment to address changes to the future development on the north half of the Adelaide Landing site (north of the powerlines). In order to meet market demands, OP5 Adelaide is requesting a PUD Amendment to include the following: • Change the approved 70-foot single family lots to 65-foot lots (following the same standards as the currently approved 65-foot single family lots within the project). This will add 5 total lots to entire 216-acre development, bringing the total lots under this PUD to 324 lots. This addition of lots changes the gross density to 1.6 units per acre, compared to the previously approved 1.5 units/acre and maintains as net developable density of 2.2 units/acre as previously approved. All other PUD requirements as originally approved will remain in place. There is no change to the lot count on the south half of the project. The policy sets the optimum pension benefit level as the average lump -sum benefit provided by relief associations that receive state fire aid within 10% of the amount received by the Hugo Firefighter's Relief Association, as last reported by the Office of the State Auditor. According to the Office of the State Auditor, ten other lump -sum relief associations received state fire aid in 2018 within 10% of the amount received by Hugo. These associations are located in: Cambridge, Becker, Isanti, Ham Lake, Little Falls, Fergus Falls, New Prague, Park Rapids, Vadnais Heights, and Waconia. Staff feels that this is a very good sampling of associations. Using data from these ten associations, we can establish the optimum pension benefit level at $3,855 per year of service. While this average is $155 above our current benefit amount, staff recommends that we reach this average through multi -year step increases. To begin, staff recommends an immediate increase of $100. The Board of Trustees voted to increase their lump -sum pension benefit from $3,700 per year of service to $3,800 and is asking the City Council to ratify this increase as well as approve a revision to the by-laws incorporating this new benefit level. FINANCIAL STATISTICS The Finance Department has reviewed the financial status of the relief association and finds that the recommended increase will result in the following: Total Pension Assets: $1,812,377 (projected year-end balance) Total Pension Liability: $1,249,006 (after $100 increase) Projected Surplus: $ 563,371(45% of liability) Staff has run some projections (see attachment) that show the investment portfolio can withstand a 27% market correction while still maintaining a surplus. RECOMMENDED PENSION BENEFIT LEVEL INCREASE Staff is recommending the City Council approve a motion to ratify the Board of Trustees request for a $100 increase in the lump -sum pension benefit and approve a change to the by-laws incorporating this new benefit level. This will bring Hugo's pension benefit to $3,800 per year of service (within $55 of the optimum level described above). (2) If the member has no Surviving Spouse or surviving children, the member's benefit shall be distributed in a lump sum to the estate of the member AILWICLE XIII SERVICE PENSIONS Section 13.1. Lump Suns Pension: The exclusive pension benefit provide by the Association shall be a defined benefit lump sum service pension, paid based on the members years of active service. Upon meeting the requirements in Section 13.2 of this article, the member shall be entitled to the benefit amount for each year that the member has served as an active member of the fire department. In accordance with, Minnesota Statute 424A.10, the Association shall pay a supplement benefit to the qualified member in addition to the lump sum pension. The amount of this benefit shall equal ten (10) percent of the regular lump sum distribution, but in no case shall exceed one thousand dollars ($1,000.00). This supplemental benefit shall be reimbursed to the Association, in accordance with Minnesota Statute 424A.10 Section 13.2. Eligibility Requirements: To be eligible to receive a service pension a member must meet all of the following requirements. (1) Be at least fifty (50) years of age; (2) Have terminated from the Fire Department (3) Have completed at least ten (10) years of active service with the fire department before termination; and (4) Have been a member of the Association at least ten (10) years prior to such termination. Independent Expertise Encouraged: Because of the varying circumstances in each member's retirement planning, optional benefit payment methods are offered. The result of these work sessions was to reclaim 1.67 miles of roadways (Ingersoll o Avenue, 175th St, Inwood Ave, 180th Street) to improve the overall gradation of the class 5 roadway material, assess how the reclaimed roadways perform, and determine if it is worthwhile Z to pursue reclaiming the remaining 5.5 miles of problem gravel roadways in 2019. Public works m staff was also authorized to purchase a rubber tire roller to as a way to improve our grading practices. During the discussion, a comment regarding parking on Rosemary Way had come up from an individual in the audience. Rosemary Way is currently designed as a 32-ft wide roadway and is part of our State Aid Roadway system. Currently, there are not any parking restrictions along Rosemary Way. Staff has three options that currently exist. These options are as follows: 1. Continue to leave Rosemary Way without parking restrictions and monitor to determine if parking becomes an issue. Parking on both sides of Rosemary Way does not meet State Aid Standards based on roadway width, although we have this situation throughout much of Hugo. The roadway was built and later added to our state aid street system. If the roadway was designed as a state aid roadway and constructed using state aid funds, MNDOT would have required a no parking resolution for at least one side of the roadway based on the design width. 2. Restrict Parking on one side of Rosemary Way. This would meet state aid standards based on the existing roadway width. 3. Restrict Parking on both sides of Rosemary Way. This would meet state aid standards based on the existing width of the roadway. While one could argue any one of the options is acceptable at this time, the long-term plan for Rosemary Way (as identified in the Comprehensive Plan), would not likely allow parking along Rosemary Way. For that reason, staff recommends approving the attached no parking resolution and posting Rosemary Way as no parking.
