APPROVING A SITE PLAN AND CONDITIONAL USE PERMIT FOR MWF
PROPERTIES FOR AN APARTMENT BUILDING ON THE PROPERTY
LOCATED NORTH OF ROSEMARY WAY AND WEST OF EVERTON
AVENUE NORTH
WHEREAS, MWF Properties, has requested approval of a site plan and conditional use
permit for an apartment building on the property legally described as;
Outlot B, Frenchman Place
WHEREAS, the Planning Commission has reviewed said site plan and conditional use
permit at a duly called a public hearing on March 28, 2019, and recommends approval
subject to the conditions listed in this resolution.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the site
plan and conditional use permit for MWF Properties for an apartment building with the
following findings:
1. Approval is contingent upon City Council approval of the Final Plat for Frenchman
Place 3rd Addition.
2. All items on the Engineer's memo and "red -line" detailed engineering comments
that have been sent directly to the developer's engineer dated March 22, 2019,
shall be met.
3. The development shall be consistent with the plans submitted on February 15,
2019, and as amended by this resolution.
4. Prior to the installation of any signs, the developer shall obtain a sign permit.
5. Any areas of the street and sidewalk along Rosemary Way that are disturbed from the
construction access into the site shall be restored to the City's satisfaction.
Prior to the issuance of a building permit:
6. The Final Plat for Frenchman Place 3rd Addition shall be recorded.
7. The landscape plan shall be revised based on staffs comments. The landscape plan
shall be reviewed and approved by staff.
8. The developer shall submit final design cut sheets for the pole and wall mounted light
fixtures to be reviewed and approved by staff.
9. The developer shall revise the grading plan to remove steep slopes and level the grade
around the building.

10. The developer shall provide plans showing the height of the building to 35 feet or
apply for approval of a variance.
11. The developer shall provide cut -sheets pole and wall mounted fixtures will need to be
reviewed and approved by staff. Shields shall be added to the lights to reduce glare.
12. The developer shall revise the plans to include two fire hydrant locations. Staff will
continue to work with the application on the final location.
Landscaping
13. Landscaping shall be added to the north side of the building to screen the proposed
condensers.
14. The developer shall provide staff with planting details for landscaping proposed on
the slopes of the property.
15. The developer shall revise the landscape plan to be reviewed and approved by staff.
Architecture
16. The developer shall provide details on the locations and colors of the gutters and
down spouts. The gutter and downspout system shall be integrated into the building
design, including color, and shall be reviewed and approved by staff.
17. Add cast stone to the north side of the building to match the rest of the building.
18. The internal air conditioning unit vents shown on the plans shall match the color of
the adjacent siding, shakes, or stone.
19. Where feasible the window headers/lintels are shown on the 1" floor, should be added
to the 2nd and 3rd floor,
20. The peaked roof sections should be evaluated on whether they could be widened to
create a more balanced design.
21. Cast stone shall be added to the pillars.
22. The developer shall continue to work with staff on the building material colors.
23. The developer shall revise the architecture plans to be reviewed and approved by
staff.
Prior to issuance of a Certificate of Occupancy:

24. The developer will be responsible for maintaining stormwater facilities and
vegetation proposed as a part of the project. A maintenance agreement between the
City and the developer shall be reviewed and approved by the City then recorded
against the property prior to the start of grading activities on the site.
25. All roof top and ground mechanical equipment must be screened from view of
adjacent properties. Staff shall review and approve the locations. All ground -level
mechanical units shall be low profile and located to the side or rear of the building
and shall be screened from view of adjacent properties. Staff shall perform an
inspection when equipment is installed to ensure compliance with City code.
26. All required landscaping shall be fully installed.
27. Drainage and utility easements shall be dedicated to the City over the stormwater
management facilities and wetlands
