APPROVING A MINOR SUBDIVISION AND VARIANCE FOR THE
PROPERTY GENERALLY LOCATED NORTH OF 140TH STREET NORTH
AND WEST OF FLAY AVENUE NORTH
WHEREAS, an application has been filed by Darin Moxness, 10040 140ffi Street North,
that requests approval of a minor subdivision and variance for a property located at 14032
Flay Avenue North
WHEREAS, the subject property is legally described as follows:
LOTS 5 AND 6, BLOCK 1, TRAEGER'S ADDITION PLAT 2, WASHINGTON COUNTY,
MINNESOTA.
WHEREAS, the Planning Commission has considered said request on June 27, 2019, and
recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the minor
subdivision and variance for Darin Moxness, subject to the following conditions:
1. A minor subdivision is approved to allow the creation of two parcels out of one 0.63
acre lot located at 14032 Flay Avenue North.
2. A variance is approved to allow a variance in lot sizes. The property is within the
Shoreland District of Egg Lake, where a minimum lot area of 15,000 square feet is
required. Parcel A is approved to have an area of 14,875 square feet and Parcel B is
approved to have an area of 12,560 square feet.
I. The requested variance is permissible by law.
II. Because of the circumstances unique to the property the applicant is
proposing to use the property in a reasonable manner.
III. The variance in lot size would not noticeably alter the character of the
area.
IV. The granting of the variance would be keeping with the spirit and intent of
the ordinance.
V. The variance will not allow any prohibited use in the district. A minor
subdivision that creates a residential lot is allowed in the CR-3 zoning
district.
VI. The property is located within a FEMA designated floodplain. The
applicant is not proposing to impact the floodplain or wetlands.
VII. Parcel A and Parcel B will be connected to City sewer and water.

3. The applicant shall comply with the Engineer's memo dated June 21, 2019 and "red -
lined" comments provided to the applicant.
4. The property is subject to the development standards of the Central Residential
District (CR-3) zoning district.

5. The applicant shall demonstrate that the side yard building setbacks will be a
minimum of 10 feet per the CR-3 zoning district requirements.
6. The applicant shall revise the driveway design on Parcel A to comply with the
maximum width requirements of 24 feet at the property line.
7. Damage to the street and curb will be repaired to City standard at the expense of the
applicant.
8. Prior to recording the minor subdivision:
a. The park dedication shall be cash -in -lieu of dedication for a total of
$2,400.
b. All required drainage and utility easements shall be dedicated to the City
over the existing public ditch and floodplain on the property.
c. The applicant shall dedicate a 5 foot side yard drainage and utility
easements for Parcels A and B.
d. A 10 foot wide roadway, drainage and utility, and trail easement shall be
dedicated to the City and Washington County along 140a' Street North.
